@@sarthakbansal7929 that's the whole point brother. He is asking that how is he accused. On what basis? To be present in the court as an accused there needs to be either an FIR or a documented statement of any witness/accuser or documented evidence (which in this case has to be the paper about the crime). If none of the document is presented to the court, then no has been accused of anything. It's just an empty petition. Based on the memorandum 27 no one be considered an accused. So, IF HE IS NOT AN ACCUSED, HE CAN WEAR HIS UNIFORM.

And go to SC against the order of HC also, but if in any court you say I will complain against the HC judges.. for passing a wrong order.. , like seriously? Lower court is not stupid. He is a judge because of a reson. You cannot behave like you know everything and judge is fool. If he would have have behaved in Delhi HC, judge would have thrown his file on his face.

I belong to a military background. He is not wearing uniform but his medals. He has earned it and they are allowed to wear it. Any personal retired or not, proudly wears it whenever they feel like and it’s commonly observed. He did him homework, and defended himself well. no doubt he is well read officer no matter who is right. I also truly believe, no one is god and even a judge is human being. Truth is above all and anyone should be challenged be it judge himself if need arise.

Can a Doctor go there wearing a stethoscope and apron then? He also earned it with his hard work and dedication..he also served people, some of them serve in the Army too. Athletes should also be allowed to wear their medals in court they won medals for their country. Everyone should be treated equally! Cricketers should come wearing pads and with trophies they won for their country. It's a court..people go there for justice and that's why there is a dress code so everyone can be treated equally not with uniform to get some privileges.

And whatcif the Supreme Court kicks the file back in technical grounds saying that prayer to recuse was not made on the apprehension that justice will not be served in the lower court given the contradictory remarks of the HC regarding the 4 docs. Here the accused has correctly articulated his reason for prayer to recuse . How that amounted to contempt only the judge can say

@@Ureakmazino1998 Notwithstanding what the merits of the officiers argument, from whatever little I understood, the judge was pointing to the fact that the officer cannot dictate the judge what to do ( which I agree ), and the fact that he was wearing his uniform was to influence the judgement ( which is debatable ). Personally, i feel that the judge provided the Officer with a lot of liberties, anyone other than him, would have been booked for contempt.

It is everything for him and he wears it proudly , with head held high no matter on duty or off duty. @@hiheloByby6902 yes he mentioned it in the end , he was paid a sum of 18 lakhs by a person whom he had lent money in the past , later on it was found out the money was stolen & a case was filed against him that he had stolen the money as well as he was an accomplice to the crime . And that is what he has been fighting.

The judge adjudicates over this case only to hear him and decide whether the district judge has passed the wrong order. Officer's commitment could amount to a contempt. But judge didn't take any action which itself is a very great respect. Why always humiliate judiciary over the grounds which you aren't even clear of.

@@ranjitsumati27 Accused doesn't mean Guilty. He has the right to wear his uniform. In many other cases Judges can be seen scolding officers not present in Uniform. This shows sheer biasedness of the Judges. That's why good faith over Judiciary is declining day by day due to arrogant Judges like this who think they are above law and can dictate anything. If you're following this particular case then you'll know it's been months they knowingly not providing him the required documents. They are simply harassing this man. Common people like us would have gone crazy till now.

The judge knew he was wrong, so he didn't recuse from the case and harassed the officer by threating contempt of court. This is the condition of HC/SC judges in our country. No accountability of judges. Judges can change their decision without any consequences. That's why judiciary needs to be brought under the purview of legislature.

Do you even realise what you're saying. If this happens India isn't a democratic country anymore. There is a procedure to pursue a case before court and this officer here has no respect for the law. In my opinion the Hon'ble justice is very lenient otherwise he would go directly to jail for such behaviour.

@@anipindivedam1857 threatening a high court judge that he will file a case against them if they don't order as per his wishes. Challenging an order of the court is different than threatening to drag a judge in the supreme court. Although nothing of this sort can ever happen, and it's his right to appeal before the appellate authority but this is clear contempt. See there exists a procedure through which a trial proceeds and the court is bound by that procedure.

@@Sharp318This is typical slave mentality. Earlier, we were forced to bow down to Englishmen and now the so called guardian of constitution wants everyone to bow down in front of them. And don't even talk about procedure, we have seen many times SC disregarding the procedure and taking up cases which has no relevance and giving bail to people like Teesta Setalvad just because she is daughter of former AG. Whereas, they don't even listen to other matters which don't involve common people. Many retired judges have said that contempt should not be used as a common practice, it is there for exceptional circumstances. But these judges who don't have any competency other than being relatives of former judges, lawyers etc, are constantly using this tool to establish thier dominance over common man and other pillars of democracy.

If an officer of a lower rank does not perform his duty, the court punishes the officer of a higher rank. In the current situation, if the lower court does not act properly, the higher court will be punished.

Last year we visited Ramappa temple. While enjoying the beautiful temple and its premises, suddenly everybody was asked to leave because a district court Judge was coming. So the Judge came and spent around 1 hour in the temple with her security. We do have to agree the judges misuse their powers and it should be stopped.

@Vivek99118 of course they do. Only their sword is taken away and put on the table before the Court on a direction at right angles to the accused. If he is found guilty then the tip of the sword is placed pointing at the accused. If not guilty then it is placed with the tip pointing away from him. On announcement of the not guilty verdict he is allowed to put the sword back in its sheath.

This Naval Officer is the epitome of Confidence... he was respectful, held his ground with PRECISE FACTS BYHEART. I could picture the scene of Mahabharata - where Abhimanyu bravely on the basis TRUTH fought single handedly inside the chakravyuh.... clearly we were not happy to see how the State's lawyer(government lawyer) and the judge were treating him. I personally found it disappointing. Officer was Rock solid.

@@AstroAnalytics Yes ,I agree even some people in defence are alleged to be corrupt .For a moment considering this naval officer too is corrupt but it should be lawfully proved ...but the question how far our legal fraternity follows due procedures ,the judge in this case is threatening with contempt of Court - what does it mean ??? and from the conversation it seems that due procedures are not followed in lower courts before the case is dismissed . Thousands of cases in India face the same faith .....all don't have the means or guts to stand up .And remember it is not economy but the standard of law in practice defines the quality of a country .
