Ahh, a subject which apart from the usual interesting topic is one about which I have actual experience! I do not know the full details of this bill, nor of what it's overall intent is supposed to be, but I have concerns. ICT, like any craft/occupation requires a form of control and oversight, with quality control and suitable qualifications available. However, just how far down the chain does this bill propose to go? What if I (if I lived in Kenya) built you a web-site, would I be doing that illegaly if I did not have the right permits? If I ran a company that supplied ICT solutions I would ensure I had the relevant licences to trade, and apply for the local equivalent of ISO Quality standards, etc., etc. If the work provided was sub-standard the I am sure my company would not get paid in full, could get sued for breach of contract and so on. Would I, as a business owner have to ensure that all staff I employed had the requisite degrees to be able to work? Of course *I* would not be able to work within the field of ICT in Kenya as I do not have a degree (of any kind, let alone ICT-based). And yet I have/had a bit over 25 years experience in the field of programming and later Technical Support and Systems Administration. If I wanted someone to fix a water leak I would go in search of a qualified plumber. If I wanted someone to write me a computer program/application I would go in search of someone qualified to do so. Regulate ICT by all means; define what qualifications are pertinent, specify what knowledge regarding security is needed for certain things. But do not come out with a blanket 'you need THIS' to work in the field. And I missed the puns! ;)

I own an ICT firm and I don't support this bill at all. I am glad the president has not signed it and has sent it back. We need to be more vocal so our leaders feel uncomfortable going against our wants and needs.

I think when they were coming up with this bill it was based on the fact that they think they can catch illegal hackers. They should instead work on that and not control how we share information in the IT space. Controlling the freedom of ICT will add another load that keeps Africa back when it comes to ensuring sustainable innovation in Africa where tech is the solution for a country with limited resources. Kenya keeps stifling development.
