When that didn't work he thought firing a round off would scare him away. When that didn't work he panicked. At that point he KNEW dude really would take his gun away from him and he panicked. It's note worthy to mention that anyone who knows how to use a firearm will not let the target get within arms reach of the weapon. That's how you get your weapon taken away from you. That's also why dude immediately closed the distance between him and the gunman. So he WAS close enough to take it away. If guy had been planning to shoot dude he wouldn't have put his own life so close to being taken in the process

I don't really think she meant for that to be the result, but I certainly think she was being coy about the denial of her being at fault in the breakdown of the upholding of custody according to their family court situation, and per her attorney's advice and years of taking his crap - wasn't going to try and help the situation with an apology or anything. TBH though 100% Robin, I just think that Mr Read should have never lost his cool like that. It's never worth it. Being upset over your kid's custody that wasn't exactly on time how you wanted it is the hallmark of a crappy parent and spouse. I’ve never been more frightened than when going through custody disputes. It’s so heated, everyone involved is over-emotional, and everyone believes they are 100% right - all to the detriment of the children involved. Thankfully my former husband and I have gotten past it and he, his wife, my partner, and myself get along great now and our daughter is free to go between our homes as she chooses and we even celebrate holidays together. I’d give anything to take back the “bad times,” because the damage done is slow to be undone. That said, we are all reasonable people that could absolutely have been in similar circumstances should a firearm ever have entered the picture and that terrifies me.

Nice to hear this worked out ok for you. I myself saw a custody dispute up close and personal with my own sibling. I looked at one of the legal papers for the reason for the divorce and couldn't believe what I read typed in there. On the front, the ex was referred to as Satan.

@@teskejon She didn´t let Chad, the man shot dead, see his children (his son). She provoked the whole situation by not letting him see his son and coming up with all kinds of ideas to not let him see his son. The shooter was suspected of treating the children badly before, so it´s no wonder chad wanted to see if his children were alright. To me it seems like Christina was setting up a trap for chad, so they could get rid of him "legaly". Its very sad Chad gave in to his emotions/ego and gave Kyle a reason and excuse to kill him.

This reminds me of a case we had in Winnipeg one or two years ago. An older guy was moving a trailer into or out of his yard and he was blocking the street while doing so. A young guy who was driving down that street became impatient with the older guy and got out of his vehicle to confront him. The two got into an argument and the young guy punched the older guy and ended up killing him.

She knew he'd be picking him up at school and let him go thru that Then she said she wants to see (the son) more than she does. This tells me she did all of it on purpose. The mother apparently didn't communicate the absence to Chad and didn't seem interested in sending a text to explain the absence and gi e an alternate pick up plan for the child. I've been in many altercations and every time I am very, very afraid, but I try not show it and dont back down, and such determination and willingness to fight alone settles most disputes But some tactics which I use from childhood: I tell myself "if I die I will go to heaven so there is nothing to worry about". or I tell myself something like "What kind of a person am I if I do nothing". etc At the same time, I also have fear of certain insects. I remember a family gathering, was probably Thanksgiving or Christmas at one of their homes. They got into an argument after one of their kids spilled koolaid on a carpet. I saw an interview with the daughter and one thing where people keep commenting on how weirdly calm the wife sounds after watching her husband get murdered was addressed; she didn’t know he was dead or that it was a real gun. She thought he had had a stun gun because it was so quiet and that he had just knocked him out for a minute. She didn’t immediately respond because she wasn’t going to escalate the situation further, but was letting him know that she had it on film and would be calling the police. Why didn't Christina call Chad and tell him their son was at her mother's house and to go there to pick him up? It's not like she didn't know Chad was coming to get their son when he wasn't at school. Christina damn well knew Chad would be mad and upset that his son wasn't at school upon arrival to the school. Christina deliberately is breaking the law to aggravate and escalate Chad and the situation. As Chad said, he legally gets his son at 3:15pm. I don't have children but my male friends and others I know have this ongoing issue with the mother of their children. The mother's break the legal custody agreement constantly believing they have more of a right than the father to the children and then attempt to get full custody by saying the man acted irrational when she wouldn't release the children to the father. the mother did fail to notified the father of his son's whereabout and violated the agreement. She did admit she wanted to have her son longer . Kyle didn't escalate it, the father did. In no uncertain terms he was told to leave. He clearly refused Kyle's orders. We live in a "stand your ground" state. Play stupid games, win stupid prizes. The mother can be a stupid hoe. That's not illegal either. Trespassing, however, is 100% illegal. I'm 100% prepared to protect my homestead as well. Hopefully it never comes to that, but I won't think twice if an aggressor comes on my property to stir up trouble.

The review from ASP, a self defense oriented page, noted that the rifle in the case was a suppressed 9mm carbine. In the original videos it sounds more like a BB gun than a rifle. Jennifer might have thought Chad was simply overreacting for getting shot with a BB gun without recognizing that Kyle had actually shot Chad in the heart with two fatal shots. Finished "Harm Reduction", Dr. Grande. Here is my review, and left it at Goodreads too. Thanks for such an entertaining book! Harm Reduction, by Todd Grande, is a compelling psychological drama that will have you zipping through the pages to find out what happens next. Being a former social worker, I love the psychological aspects of the story, and Jenny is an intriguing character. I've read hundreds of books over the years, but I don't think I've ever been this deep inside the psychology of a character. This is what I love most about this book. Some authors would have written this in first-person POV--from Jenny's perspective--but I'm glad Grande didn't. His way gives the story more objectivity, and insight, which Jenny just didn't have about herself anyway. She had some, but not enough--like a flashlight's dim glow because of low batteries. Grande delivers a gripping story without giving too much away at any one time. In fact, he builds mystery and suspense, mostly in the mind of Jenny and her observations, thought processes, and interactions with the world around her. This author knows how to craft a multi-faceted character with layers, issues, and magnetism--meaning that you just have to keep reading to find out about Jenny and what makes her tick, or break. The story itself is a puzzle that you the reader are invited to help solve. Grande knows his way around a plot, the suspense builds at a maddening pace--even and steady, teasing it out a little at a time, which is super effective. He cleverly builds characters and scenarios that rival anything Hitchcock has to offer. The story mounts with tension, and you aren't sure what the ending will be, but it will definitely jolt you. This would make a terrific movie. If you like crime dramas that keep you guessing until the end, you will love this one, and will become an instant fan of Grande and his OCEAN of talents.

It was a Ruger PC9 carbine. The reason why it was not as loud as the woman would expect a gun to be is because it is chambered and fires 9mm which is a handgun cartridge. When firing a pistol round out of a much longer barrel it will completely (or near completely) burn all the powder in the case which in turn will not make it quite as loud as would have been fired out of a 3-5 inch barrel like that of a handgun. To be clear it would still not be considered hearing safe.

Not really. Like doc said Kyle introduced a gun into a situation that was not violent to begin with. He didn't NEED to do that. With a death we have to look at what was necessary and what wasn't in the moment. Kyle's life was not in clear danger when he grabbed his gun. Well you can train to handle certain situations. For instance, as soon as the gun came out you leave. Knowing that it's not worth potentially losing your life for missing a few hours or days with the kid. You could also absolutely use the recording of someone pulling a gun on you when you went to pick up your kid as evidence that the household may not be fit for a kid or, at the very least, the mother is actively trying to stop you from seeing your kid at the court appointed time. Most of it comes down to anger management and knowing when it's not worth it to keep arguing or fighting. Get the police involved and let them sort things.

It's possible that a finding of self-defense hinges on the use of the "warning shot" made by Kyle. Typically it becomes very easy for the prosecution to dismantle the "imminence" of the deadly threat when you chose to use deadly force simply to spook someone off. Warning shots are well understood in US law to be dangerous and unnecessary; if you truly feared for your life, why didn't you shoot to kill? If you fired when you didn't fear for your life, you could have injured or killed a third party. A warning shot could manifest a deadly threat to the OTHER party, enabling a defensive deadly force response on their own part. I'd be willing to argue that the act of leaving the area to retrieve a rifle and return, combined with the warning shot both indicate that Kyle did not have a reasonable fear of imminent bodily harm, and instead chose to remain in the area and escalate the situation into deadly force.

The video of this incident is utterly disturbing. After Chad was shot, Jennifer said something on the lines of “Kyle, I recorded you…” What?! 🥺I think most people would run to their loved one in panic and disbelief. Everything seemed casual while Chad was lying on the porch floor, dead. It was painful to watch, the reaction of everyone right after Chad was shot was so cold. I watched the actual video several times and found it disturbing to say the least. I find your analysis of this situation to be measured, systematic and accurate. What's really upsetting about the video is how they are all so wrapped up in fighting that they continue to argue over who's at fault after the shot goes off as the guy is laying there dying or dead. Repeated violations of court ordered custody always end badly. Christina Read knew perfectly well her ex would attempt to pick up their son from school at 3:15, chose not to inform him that she already picked him up from school and doesn't have him ready to hand off when Chad Read understandably comes to take him from her residence. She tells him she intends to keep him longer in violation of their custody order. Under these facts, Kyle Carruth's claims of trespass and protecting his home with deadly force should fall flat.

Going inside and grabbing the firearm to threaten deadly force may not have been legal in this instance. There were absolutely no reasonable threat before he went inside to get the weapon. Another example is that you can't invite someone into your house get into an argument with them, threaten them with a gun if they don't leave and shoot them when you're "feeling threatened". Texas is a little crazy, but not this crazy. The laws are the way they are to let people defend themselves against home intruders and not to allow this type unnecessary of escalation of force. I'm not saying he definitely won't get off on self defense grounds, but it's far from given due to the circumstances.
