Hi atty. Sana makagawa kayo ng video tungkol sa problema ko. Bumuli po ako ng lupa para sa anak. Minor po Yung anak ko at ako Yung administrator. May titulo po. Ngayong may kasundoan kami ng parent ko na sila Yung magsaka ng palayan ko (agricultural land po ito). At mag babayad lng sila every harvest. Nagsasaka po sila ng palayan for two years then Yung kapatid nakiusap na gusto niyang rentahan Yung farm ko. So pina rentahan ko sa kanya. Every harvest siya nag babayad sa akin. Ngayon po. May kinuha siyang farm worker. After two years yata. Ayaw na niyang mag rent. So parent ko ulit ang nagsasaka at Yung farm worker siya pa rin ang kinuha ng mama ko. Hindi kasi Yung renter nakakabayad ng rent sa akin every harvest. Kayat kinuha ko ulit at pina rentahan ko sa kapatid ko na babae. Same farm worker pa rin ang kinuha niya. Ayaw na ng kapatid Kung babae na mag rent. Ngayon Yung kapatid ko na lalaki na man ang nag re rent uli. May time na nakabayad siya may din na wala. Ngayon gusto ko na ako na man ang magsasaka sa lupa ko. Ito na po Yung problema. Walang problema sa kapatid ko. Ang problema is Yung farm working. Ang Sabi niya matatawag na daw siyang tenant matagal na daw siya na nagsasaka sa lupa. 15% po binibingay ng mga renter sa kanya. Ayaw po daw umalis ng farm worker at gusto po daw akong ipa DAR. Pwede ba yun. Wala po kaming verbal agreement. Hindi ko po siya kilala ang never ko pa siyang nakita or nakausap. Ano po ba ang pwede kong gawin. Thanks. Kung fully na paid kayo sa installment, ay dapat require ninyo ang developer o may-ari na mag execute ng Deed of Absolute Sale, at maibigay sa inyo ang subdivision and plan with approved technical description. Kung hindi pa naiwalay mula sa kabuuan ang inyong nabiling lupa, ay dapat mag pa survey either ang developer or kayo bilang buyer(depende sa nakasulat sa inyong kontrata kung sino ang gagastos) upang maisagawa ang nasubing pag survey at malagyan ng mujon ang boundaries at corners ng inyong nabiling lote. Kung pina ikoikot pa rin kayo ng developer or seller ay mag file kayo ng complaint sa pinakalamapit na office ng Human Settlement Adjudication Commission(HSAC) upang mapanagot ang hindi pag tupad ng developer sa kanilang obligation.

Dahil hindi naman maituturing na compulsory heir ang step children ng step-mother ay wala silang karapatan na mag mana kayo walan asawa at anak ng step-mother. Ang tagapagmana ng step-mother ay ay kanyang mga kapatid o pamangkin. Maari lang mag mana ang step-children from step-mother kung gagawa ng last will and testament ang step-mother making thestep-children as her beneficiiaries and voluntary heirs.

Atty.may tanong po ako,binintahan po ako ng lupa ng kamag anak ko,kaso deed of sale lang po hawak ko,yung lupa kasi habang naka file pa yung titulo sa kamag anak ko bininta na nya sa akin,ngayun gusto nya bayaran ko yung titulo na pina file nya.kaso nakapangalan sa kanya.ano pong gagawin ko,kasi kung bayaran ko sya pag nalabas na ang title,gagasto na nanaman ako para isalin yung pangalan.

Hello Atty! Yung license to sell po ba hihingin sa developer? Or naccheck po ba to online? Sa contract to sell po kasi nakalagay lang yung name nung real estate marketing company na authorized daw sila to sell with special power of attorney. Tapos naka indicate po dun OCT # at address. Farm lot po ang description nila tapos sila daw mag subdivide at magbayad ng amilyar while installment. May nabanggit po kasi kayo about agricultural land, paano po malalaman yun? Pwde po ba ko magpunta sa RD at kumuha ng copy nung title na nakalagay sa contract to sell? Pasensya na po sa daming tanong. Wala po tlaga ako idea sa mga terms at process. First lot purchase ko din po, installment lang po kaya ng budget.

Gusto ko lang po kasi malaman kung legit yung ganun na naka SPA sila then yung title nasa name pa nung original owner. Sabi meron daw sila deed of sale kaya lang hndi ni-transfer sa company name nila coz sa buyer na daw ililipat pagtapos ng installment
