Peter - I kept thinking of a different “Aha” moment that I think we’ve all been waiting for. He has repeatedly asked the judge “is that a judicial determination?” when she has shut down some of his subject matter jurisdiction questions. Yesterday, she finally had enough and she sort of chuckled while saying “it IS a judicial determination.” I loved it.

There aren't any filibuster type rules in that regard, but attorneys are ethically obligated to follow the rules of evidence and the rules of procedure, so if they continuously made baseless objections like he is, any judge would have admonished them in front of the jury and then loudly taken them to task outside the jury's presence. If they kept it up after that, a judge could actually hold an attorney in contempt, and would likely turn them into the Bar Association for intentionally attempting to sabotage a trial by creating a circus in the courtroom.

New member! I’m glued to this trial, and completely frustrated I feel like I need therapy!! He drives me nuts! This Judge is so generous and patient. My father and Uncle are Lawyers then Judges. I can’t imagine him being in their courtroom! I’ve never sat on a jury, but how the she says “ The jury will disregard all his comments “ yeah ok, it’s not possible. He is frustrated that he can’t punch the Judge - like he has Erika Patterson - when the Judge disagrees/argues with him. He thinks they are having a “conversation” instead of a sitting judge making a ruling. He reverts to his being a “man” (arguably) who she must respect. He can spend his remaining days in prison rationalizing his superiority once the Judge gets this to a verdict, presumably, of GUILTY of all charges.

The tune "Wheels on the bus go round-n-round" rings through my head as I watch this ridiculousness..... And I cannot help but feel that the Judge can be an enabler of this some of the time. Most of the time, I agree that she's a "Saint"-- patient in her handling of him. BUT I do think she needs to come down a bit harder on him when he plays games and perform his (Narcissistic) Power Trips-- She needs to take control of HER Courtroom! As far as the mechanic testimony-- I wish the witness would have used term "Emergency Brake" instead of "Parking Brake" to identify an option available to the driver.

I’ve had to pray so many times over this case because it has brought me out of my character….I’m not a woman with hate but I have found myself having to look inside myself to figure out where this hatred is coming from, and learning how to let it go. It’s brutal to watch him belittle and demean everyone around him as if he didn’t MURDER 6 people and injure many more. When he mocks the female witness who mentioned she suffers from injuries from the incident (not physical), clearly eluding to having possible PTSD or other mental health stuff from it, I lost it. He is a horrible human being and cares about no one. His mom can say it’s bi-polar, mental illness, or whatever else, the truth is, he’s never had to be accountable and is a narcissist!

IMO Brooks flipped out because his girlfriend disrespected him and wouldn’t do what he wanted so he drove off. He didn’t know downtown Waukesha and got even more irritated and angry when he saw barricades. The barricades were another metaphor of something blocking him from going where he wanted to go when he wanted to go. In his anger he didn’t care about anything or anyone else. His motive is ‘I don’t give an eff about you.’

That fits with what I'm seeing in the courtroom. Whenever he gets throttled, his objections are denied or his questions are shut down, he gets really angry and aggressive. The death stares at the judge and the jury, the disruptions, the muttering under his breath... it seems to fit his profile.

I live near the massacre. The night it happened I saw his Facebook and KZbin account before they took both down. He was very anti white and posted about it. He wants hates white people and wanted them dead. He should be charged with hate crimes and domestic terrorism. He also ran over his baby momma with the same car, and was out on bail for it.

I cannot IMAGINE how good it is going to feel for this judge to be able to look down on him and pronounce his sentence of six consecutive life sentences plus whatever is given for the other 60 charges and with no possibility of parole with him having no right to speak his mind or defend himself because trial is done. I HOPE she chooses to have him remain and bound and gagged for the sentencing because there is 0 chance he is going to sit there and take the sentencing like a civilized human being and I don’t think that he should have the option of the dignity and privacy of afford to him by sitting in a court room on his own…even if he is on camera for the world. I think his victims should be able to look right at him while he is sentenced and know that he is hearing every world. I understand why she is chose to use the method she has during the trial so that it can’t be argued that he couldn’t meaningfully participated. But participation isn’t required as the sentence in pronounced.

She is one of the most generous judges that I’ve ever been in front of. I find her professionalism phenomenal and with the understanding that there’s going to be a retrial, her desire to make sure that every, every opportunity and decision falls in the defendants court… and he will still fail…. She’s doing a great job.

@@LD86 The OP may have meant appeal instead of retrial. Otherwise, I agree with everything the OP stated. This judge is dotting every "i" and crossing every "t" to make damn sure his appeal(s) fail.

My local police department requires a writing class as part of the police academy due to all the errors usually found in police reports. (I was told this by the chief of police when I participated in the Citizens Police Academy a few years ago.)

Watching this the morning after. Work in Texas as a paralegal. Nothing like trial prep frenzy and then the case gets continued. We prep just as much as the attorneys I work with. They focus on pleadings, Q's outlines and etc. I get the fun stuff of making exhibits, coordinating witnesses, running electronics and etc. We don't have unlimited resources (Govt) like you said. We do have bureaucracy and pretty much have to do everything 'old school'. One attorney & one paralegal is a trial team. The attorney MIGHT get a 2nd chair only for trial to make sure s/he doesn't forget something procedurally. If Im lucky, I get access to a legal secretary. Not always. Really enjoy your work, commitment and explanations.

!GROUNDS! There’s nothing funny about any of this situation but I listen to this trial while I’m delivering mail all day and it never fails when you hear the prosecution barely starts and said ‘Obj…’ … ‘GROUNDS!’ It had me laughing out loud at his stupidity

If the judge really wanted to make him mad. Turn off all the cameras..except one camera... for the record. Let him know he will no longer be televised.

Yes, he seems really aware that he's being televised and is, at certain points, putting on an act for the camera.

When DB starts in about who the plaintiff is and why they aren’t in the courtroom, could the judge or DA inform him the plaintiffs aren’t in court because they are deceased??

So many years ago in a personal injury case in VA I survived on the jury. While we found for the plaintiff our award was one third of the settlement offered by the defense (at the time we didn’t know a settlement was offered). The plaintiff and her lawyer where so shocked and upset. Goes to show go to trial roll the dice.

The state should show a computer animation of the path DB drove through the parade. An overhead view of an SUV hitting/running over 70 unsuspecting people would be powerful. Also, I think I’m in love with the judge.

@@jacksonFluffy He has seen what he did. Did you see his face when they were playing the video of him driving over people? They didn't show it to us, but his eyes were lit up like a kid on Christmas morning. Did you notice how he lit up when torturing his victims all over again on the stand? I wouldn't ever let him watch it again, he got too big a kick out of it.

He also mentioned that to another witness but didn't go on and on about it. Don't remember what day or who it was.

@@BjBeam I had to go to court before and was told to direct my answers at the jury. It's difficult to do when you're not used to it. Your instinct is to respond to the person answering the questions. I can see how that probably looked odd to him, but it is what you're supposed to do. I noticed it's officers or people who are in court regularly who are more likely to do this with ease.

This Judge is keeping him in the Courtroom for a reason. Brooks is full of crap and appears to be a very dangerous individual. I pray there is full security and protection for the Judge, and for everyone else attending the trial.
