Let's pretend a person visits a public place daily blindfolded. In their hand is a handgun, which they shoot one round in a random direction. Sooner or later, one of those bullets will find an unfortunate target. Convince me 17 DWI charges is somehow different. Remember, he did not drive intoxicated 17 times. He got caught 17 times.

Cars are generally confined to roadways or other passable areas. Fired bullets are constrained by gravity only. Most motor vehicles move at less than 130 mph; well below the speed of sound. If you have heard a firearm, the round is already past you or you are already struck. I am not even going to start on the doctrine of Intent, much less Transferred Intent. Your analogy is simple-minded.

His analogy was meant to show that if you do something negligent (driving drunk, or shooting a bullet in a random direction) many, many times in a row, then eventually something bad will happen. That is exactly what his analogy accomplished. Then you, pretending that you have some superior intellect, point out completely irrelevant facts about bullets being supersonic and under the influence of gravity as if that somehow disproves his point. You really typed all of that trying to look smart, but ended up making yourself look like a complete moron. Congratulations on your wonderful accomplishment.

I don’t drink alcohol nor injest drugs however, when I read 17 DWI convictions, I thought I must be in the ozone layer. How is this possible? It’s a disgusting example of a judicial system that’s not doing its job in protecting the public.

NM enacted a state law in 2016 mandating 8-12 year prison sentences for an 8th DUI offense. This guy’s last DUI offense in NM (previous to this one) was in 2015 before this law was enacted. His other DUI offenses were out of state. If convicted of this DUI, he’ll face the 8-12 prison sentence

In Wisconsin, first-time offenders usually do not face jail time unless they had a passenger under the age of 16 in the vehicle or injured someone. A second offense will carry a minimum sentence of five days and a maximum of six months. A third offense carries a minimum sentence of 45 days and a maximum sentence of one year in jail. A fourth offense is a felony with a potential for up to six years in prison and a lifetime driver’s license revocation if committed within 15 years of the third offense. Seventh and subsequent offenses carry mandatory long prison sentences.

All she's worried about is the amount of money she can keep in the state's coffers (which, by the way, is full of money because of the oil & gas industry, which she vehemently opposes yet has no issues receiving the money from), and more people in prison means that number goes down. in NM you have to accumulate 8 state DUI convictions after 2016 before you face any serious prison time. Most of his DUIs are from before 2016 and in other states

You are about 80% percent incorrect being former law enforcement or public safety I can tell you these people yes are to blame but you can't really blame an idiot that has mental incapacity or problems, this system is to blame and has failed to protect the public, because of lenient charges or liberal Democratic laws that release these people with very little supervision and allow them to commit numerous other crimes with little jail time only to offend again once released putting the public and other people in danger and even then they sometimes don't take any harsher prison sentences that's why you read 17 prior DUIs .. so you can't really blame them. If a toddler keeps getting up on the kitchen counter or oven top you know he's going to keep doing it do you blame the toddler or the parent for not taking more extensive measures to prevent him from repeating that action. Our government and judicial system is a complete joke .

I know a guy here in Kansas who was convicted as a habitual DUI offender after his 4th one. He got 4 years and a suspended license for 15 years.

In New Mexico's new law, enacted after this guy got many of his DWI's (also some came from other states), an 8th offense comes with a mandatory minimum of 10 years in prison. KS law is stronger than NM laws as 4 DWI's only has a mandatory 6 month sentence in NM along with "up to" $1,000 in fines.

Texas is lenient as well. First time is a misdemeanor with like 6 months jail unless you get probation, which usually happens everytime.

Fl statutes: Any person convicted of a third DUI within 10 years of a prior conviction or a fourth or subsequent DUI, is guilty of committing a third degree felony (not more than $5,000 fine and/or five years imprisonment).

Depends on how you find lenient. By the third you are facing 2-10 years and it’s a felony. After you get a 4th your labeled a habitual offender. A family member of mine served 5 years of a 12 year concurrent sentence for 2 back in 07-12. If he gets another one he could be looking at up to a life sentence with a min of 15 before parole which would be a life sentence at his age.

@@txtchjmb29 New Mexico will allow you to get 6-7 DUIs before it becomes a 3rd degree felony. In contrast, Texas has enhancement penal codes so a 4th or 5th DUI can be a 2nd degree felony with up to 10+ years in prison. It’s interesting because most sites measure harshness and strictness by the basic laws but it would appear to me that the enhanced charges are what carry the biggest punishments…

An 8th offense DUI in New Mexico is punishable for up to 12 years in prison with 10 years prison mandatory so why is that guy even out on the streets driving with 17 convictions?!?! He's a danger to society. He needs to be locked away because obviously there is no rehabilitating him.

Some were from out of state and states do not collaborate with other states on DWI information. Also, many of his DWI's occurred before New Mexico had enacted its new law (the one you mention).

A lot of counties do not even have a drinking law, and in most of those people do not abuse alcohol. If you are old enough to vote; you are old enough to drink. It may have been seemed like a death sentence to someone that could reason what a DUI would do to their future. I have been horrified about getting a DUI as pilots get punished twice. I have made sure I would never get one by using a secret trick that works every time.

17???? In Texas after the 6th you are facing 99 years or life. There was a guy I worked with who got a 7th DUI conviction and ended up with a life sentence. He was eventually paroled after 12.5 years and got an 8th DUI a year after his release from prison. That was in a different county and he ended up with a 40 year sentence on top of his life sentence. He won't even be eligible for parole again for another 18 years when he's 72. Crazy that someone with 17 still gets to drive around freely like this.

If you wanted to get 50 DWI's and not go to prison you only have to make sure each one occurs in a different state. As far as any one state is concerned, you only have 1 DWI.

It's not all based on the Judge's discretion. They have to abide by the laws that are in place. If that State has light penalties, the Judge can't just decide to lock up an offender simply because they think it's the right thing to do. It's a combination of things...existing laws, the local DA, and the discretion of the Court. I don't know to what extent the Judges' hands were tied when sentencing this guy. Maybe he got off easy, or maybe he had the book thrown at him...and it was just a very light book.

The judge can sentence him to the maximum allowed in the guidelines. Obviously he got off easy otherwise he wouldn't be on the road driving drunk all the time. In Malaysia a 2nd DUI is 10-15 years in prison. NM isn't bothered by crime apparently.@@jaytee2642

How many DWI he has shows the system is FU. My sister husband lost his daughter her boyfriend and their 9 mon gestation baby to a DWI 5x moron. They were on the way to the baby shower she had two weeks to give birth. She gave birth during the accident and the baby was beautiful the EMT on scene fought so hard to save it. These people make me sick!

It's from a loss of morality, all the way around. Excusing crime comes from a loss of morality and the abundance of crime comes from a loss of morality. A nation built upon the moral law of God, when it abandons God and thinks it's smarter than God, will lose the peace that follows in the nation living at peace with God and from living moral upright lives.

I had a colleague in Missouri in the late-80s that went to jail for 60 days for his third DUI (plus losing his license, court costs, etc). I can't imagine what the penalty back then would have been for the 17th DUI.

We used to have a similar problem with repeated DUI offenders. Now first DUI = suspended license for up to 2 years, second DUI 3 years. If license were revoked or suspended for DUI and person was caught driving = 2 years in prison.

I really liked the sgt helping the young Officer. Reminds me of when I started 30+ years ago. Young man has his whole a career ahead of him. He did a great job!

17 offenses spread among 4 states (NM, CO, UT, AZ) maybe he keeps moving to avoid jail time? He can’t get a license but drives anyway. At some point a prosecutor or judge should put him in jail for an extended period, some forced sobriety would probably help this guy

Forced sobriety wouldn’t have helped him. He has to be willing to get help in order to help address his problems. He’ll relapse again if he was forced into treatment he doesn’t want.

I got pulled over for speeding once. I didn’t realize the speed went down in that section of the road. I said so, apologized. The cop looked so surprised. I was like “What? I was obviously speeding. My bad.”. He also said “You’d be surprised how difficult most people are, and argue and cry and go on and on…”. It was a $50 ticket. Annoying, I noticed it in my pocketbook, but it was my fault, why fuss about it? People seem to think that laws are created by some great ‘other’, rather than being something that we’ve collectively agreed upon, to keep ourselves and others safe.

After 3 or 4 conviction you should permanently have your driving privileges revoked for the rest of your life and if you get caught driving after that you get ten years automatically just for driving a car. Otherwise you are just asking for preventable fatalities.

Well, he didn't have a drivers license, and probably has not had one for some time. That does not prevent a person with keys to a working automobile from slithering behind the wheel of the auto and cranking it up and driving down the road.

First off I want to say that I truly appreciate your channel. It is very important to see how well the majority of NM officers perform their jobs with patience and goodwill. It is sad that the leaders of our law enforcement agencies won't allow the television crews to film. What are they afraid the public will see? If the body cams aren't distracting how can an extra camera distract them? I understand that things can sometimes go sideways but for the most part our cops are just as professional as anybody's.

Evidently, the justice system either can’t or won’t do anything about this until his negligence actually kills someone. I’ve seen a few videos where repeat DUI/DWI/OVI offenders have received hefty sentences (a few even life) but it appears as if those cases are few and far between.

It makes no sense that if you are to poor to pay a ticket they suspend your license, the third time you get caught its a felony and you get 5 years in prison. But you can get 17 DUIs and still be allowed to drive.

Considering that DWI could mean Driving While Incapable of not killing other drivers, maybe every 5 or 10 convictions should result in a lengthy prison sentence. Real time in prison. By itself a DWI may not warrant prison, but when you do it 5,10, 15 times, clearly the deterrents in place don't do $hit!

DUI’s should be like felonies. 3 strikes you go away for a long time. Strike 1, heavy fines, loss of license for a year, mandatory classes. Strike 2, mandatory year in jail. Strike 3, mandatory 5 yrs in jail, loss of license for good. Something along those lines if enforced by the courts, may have an impact.

That's because we have a piece of shit horse-mouthed governor who believes in setting people free rather than holding them accountable. All she's worried about is the amount of money she can keep in the state's coffers (which, by the way, is full of money because of the oil & gas industry, which she vehemently opposes yet has no issues receiving the money from), and more people in prison means that number goes down. She's a wicked ass crook.

That's absolutely ridiculous! I remember in the 1980s a guy my father knew who had a bunch of prior drunk driving convictions got charged for the 8 or 9th time and the judge gave him a lifetime ban from obtaining a driver's license. That was in British Columbia and banned him from obtaining a driver's license anywhere in Canada (most of his prior convictions had been in Ontario, with the latter few in BC).

I had a younger brother who had 9 dui's, he spent close to 6 years in prison. He would start drinking at 7 a.m and he 3 weeks ago died at 51. I'm not missing him because he embraced the leader of Germany from 1933 to 1945.

You're usually biased AGAINST police officers, why? I'm usually biased in their favor - until and unless a police officer is shown to be corrupt, a criminal or used excessive force in their work. As far as I know, the majority of cops are good people who went into the profession to help people or because a relative was a cop, etc.

@tkenglander6226 Yes usually against officers, but at least I'm aware of it. I try not to be prejudice and judge them as a person. I appreciate a good cop even more than I dislike a bad one. It may be because negative videos get more attention than positive ones and maybe I watch things that reinforce my already held beliefs as well (I know that's common). But I guess my experiences with law enforcement has almost always been negative. Even when I had nothing to do with why they were called but was just witnessing. I have had one good experience with law enforcement that I always mention when talking about this. And people who really want to help others I think everyone appreciates but I think the majority of humans have a tendency to want to help others but unfortunately that doesn't always go well. The leader of nazi germany thought he was the savior of his homeland and ends justified the means but look at how the country that once adored him views that stain now. A long way of saying outcome doesn't always align with intent. And yeah it's definitely common to do what your parents did but that doesn't automatically make you a good fit for it or a moral person either for that matter. But I feel like in my personal experience and from videos I have watched it seems like a majority quickly loose sense with being a civilian. They act superior to anyone who is not their professional superior. When called, making an arrest benefits the department and if there is any justifiable means in the law to make one it will be made even if most people would feel a sense of injustice as a witness. If you try to stand up for your rights they will belittle you and ask you if you went to law school while at the same time holding you accountable to the law which you are supposed to know as a citizen. Many of them indulge in & abuse the power their position of authority gives them. It gives them a high and often situations are escalated unnecessarily to obtain that high. Especially when there is not a legitimate threat posed to the officer because at the end of the day everyone wants to go home safe. Anything else is just a bonus and people lives are inconsequential to them. But again I'm aware of this bias and try not to be prejudice of individuals regardless of their profession and try to give people the benefit of the doubt initially and I have had one good personal experience with a law enforcement individual and maybe I reinforce my own beliefs with what i watch but the unfortunate truth is that the majority of what I have seen and experienced has not been positive. And I could honestly probably write just as much as I just did or more on getting into problems with the justice system, which I honestly think is one of, if not the best in the world but that obviously doesn't mean there are no flaws. And while getting a dui or something isn't the end of the world and may be deserved and in the best interest of the individual and the public I do feel like are many instances in which the system is harmful to an individual that honestly shouldn't be in it in the first place.
