Why did the rest of the family not warn the OP about the aunt being known to rip people off? They obviously knew that OP was in school to be an artist, and the aunt would eventually try to scam her. Was she just supposed to magically know these things that nobody talks about? At least OP now knows that she must work out the payment, art piece details, deadline, etc, in writing with the client before starting work. Sadly, even good friends and family can rip you off. And the aunt deserves all of the shit coming her way.

Well, her aunt did say she was giving her invaluable experience. This isn't the way any of us artists want to learn the "make a contract and get a down payment" lesson. But she did get you a sit down appointment with a lawyer for free to learn what recourse you have! That's a lot more than most artists get in these awful situations. Still awful how you had to learn the lesson

Commission work should have a clause in the paperwork, that being "Any suggestion of compensating my work with 'exposure' instead of my stated fees will result in said fees being doubled and required upfront"

STORY 1: *NTA* Aunt J was treating OP like trash! First of all, exposure/experience is not a form of currency. Friend/Relative/Stranger, it does not matter the degree of relation between the commissioner and the artist, if you commission an artist to do work for you especially when it’s taking up time from paid work or other higher priorities, you need to pay them CASH. Aunt J was totally acting like an entitled karen that doesn’t get how much work goes into art. How she was acting when OP was giving idea sketches before moving on to the final project was disgusting. SCREW AUNT J! Op needs to expose her. I agree with all of the comments saying that you should never do work for family. I am a craft artist and I’ve lost count how many times I’ve had family members ask me to make some decorations for them for free and expect ME to pay for all of the materials. *Never work for friends and family* ATU: At least Aunt J got valuable experience on why paying for your artist’s time is better than ruining your reputation by being entitled scammer. ^^

I’m always amazed that people who don’t want to court trouble because they are doing shady stuff, constantly try to bring attention to themselves. Imagine you are a drug dealer. Wouldn’t you make sure your car was taxed, tested and insured so the cops didn’t have any excuse to pull you and search your car.

Yes! Exactly! But you would be surprised how many of them don't. My Father in Law is a retired police officer and he said almost all drug busts and arrests come from normal traffic stops. So if there's anything to be learned from this it's only do one illegal thing at a time and always make sure your car is legal to drive.

That's why I always ask for nonrefundable 50% of the price up front before I start any work. If they're serious they'll pay it. If they don't, then your time isn't wasted. If they pay but then decide nah, then your get 50% of the price for them using your time. And if they ask for multiple sketches because they can't decide what they want, after a certain amount of sketches then charge them for each sketch.

As an artist, I have dealt with this kind of attitude for years. People think it's a hobby. No it's my lifes work. I have to pay ahead for materials, equipment, misc supplies. Where I live it is mostly people who are having auctions. Can you imagine donating a $30 piece to find out the minimum bid is set for $5? This is just an example. Atvthe same time they tell you that you will get so much business from the people bidding on the pieces. No you don't. Because they end up being bargain basement sales, so why should they pay full price? Most of my artist friends no longer donate to any auctions.

I hate people like like that aunt in story one. Artists are workers too! And talented workers at that. Art is NOT cheap, it's not easy and it is not something you can pay in "exposure". Let me just say this. Artists that you are commissioning do NOT need experience, they do not need practice, they do not need exposure. None of that pays our bills. I stopped taking commissions because of people like that (I paint miniatures and sculptures) and my brother, who still does commissions (digital artist) still occasionally complains about people like these. Treat your artists with respect!

People that think they don't need anything in writing when dealing with family miss the point: Get it in writing to AVOID misunderstandings, ESPECIALLY when dealing with family! If you squabble with a regular customer, the fallout isn't anything more than financial and legal. But with FAMILY, you have the emotional and relationship issues, which can be more involved than money. Don't ever sell yourself short: get it in writing, get a deposit, do everything by email and check careful track of all requests. Write a detailed scope of work, and seek responses at several steps along the way.

Real estate reguires a license like anything else to do business with a company. The fact that the head of the national chain for that real estate company knew she wasn't working for him could go after the aunt for defamation of character, fraud, misrepresentation as well as report her for working unlincensed/ unauthorized/ without authorized consent. Yeah I'm glad that Uncle is seeing the destruction heading his way, is getting his life boat set and is getting away from the aunts turd ship as it sinks. There also will be hefty fines along those lines that could also equal to a prison term as well as a fee for the damage and fraud she caused.

I didn't have to go far in Story 1. The aunt is specifically asking for a commercial product (logo). And while arguably not commercial, the paintings, murals, etc. are all important for her workplace's interior and may be featured in advertising. These are not meant to be paid in experience. Here education should have included never work without a clear contract with every step and payment outlined. She stated out wrong the second she did free art for another family member under the guise of a paid job. OP admitted she didn't get a real offer to pay, and the one made would be experience, not money. This is the obvious scam that artists get, and it only works if the artist refuses to insist on the contract. She's sending threats to a woman she isn't close enough to enforce. Girl was too busy trying to call it family drama to avoid telling her mom "I screwed up." And instead she ended up having to add trying to hide the mistake until it blew up in her face to her mistakes. The discovery of identity theft didn't come out due to her not getting paid. It was something he has been aware of being a big risk, so he likely checked his credit randomly anyway. This not paying is part of a long term, consistent pattern. Aunt wasn't completely stupid. She was very careful to make sure the company's logo wasn't anywhere near similar. It dodges looking like she is tied to them, and can't be considered as part of them.
