As a former court employee who has participated in over 300 jury selections, I’ve never heard it referred to as jury deselection, but that’s exactly what it is. This man is a genius.

deselection? so this would be AFTER you have a sitting jury? normally the two parties would agree on a selection that best fits their case, each side would try and remove anyone who they think would be detrimental to their argument.

Especially selective prosecutions now with the political motivations. While selective prosecution might skirt the idea of prosecutorial misconduct as legally defined, I think it' can be very immoral imho. Fabricating and/or hiding evidence I understand IS illegal. I wonder how much prosecutors and police get away with that? After all, that kind of misconduct is kind of distributed don't ask, don't tell, which probably makes enforcement of those rules and laws a lot more difficult.

You are so right in saying that it is jury "deselection". I was called for jury duty for an officer involved shooting. The first thing they did was tell everyone who had a concealed carry permit that they were excused. Since this was in Texas, about 1/3 of the jurors were automatically ejected. The good news is that the officer ended up not being convicted, but it was so obvious that they didn't want anyone who knew anything about firearms to be on the jury.

To be fair, it might of been a case specifically involving a concealed carry permit(since they just kicked people out with a concealed carry permit but not necessarily anyone who owned a gun in general). They do absolutely try to pick the best jury for their case, but both sides do it, and so they sort of meet in the middle. If one sides kick people out for owning a gun, the other side could kick people out for not owning a gun. They both have a limited number of people they can kick out and don't have to give any reason so it could potentially be for any ridiculous thing they want.

Dear Mas, thank you for these videos. I could’ve used them in 2010 when I went through this kind of situation. As a firefighter (and someone who had never been arrested before), I was horrified to find myself charged with aggravated assault, while the two assailants-who accosted/threatened me at my home were not. The experience cost me a year of trepidation, $15,000 unreimbursed legal fees, and probably one heart attack. Luckily, the loaded .357 I had in my house was not involved, because when the one assailant reached into his back pocket after threatening to kill me, I probably would’ve shot him. Instead, I punched him as hard as I could. Bad enough. The local news media showed up at my house (because a firefighter “viciously attacked two innocent men in a jealous rage”). I told the guy what happened [off camera], and that I didn’t know what I was going to do. The reporter, a guy named Ari Haight (WTAE in Pittsburgh), actually told me what the procedure was, and to get a lawyer! Apparently, both the prosecution and defense are each allowed 7 juror strikes. The prosecution used all seven, we used none. Despite their attempts, the jury still included a police officer, a nurse, and a paramedic. I did testify. I was terrified of the experience, but I was confident that telling the truth was solidly in my favor. I was cross-examined, and asked ‘why did I leave my house,’ and more importantly, ‘why did I not immediately call the police.’ At the time, it just so happened that I was on the phone with my mother, who heard the whole incident, even after I dropped the phone when the first assailant threw a wayward punch at me. The prosecution had her testimony thrown out. The prosecution-and particularly, Democrat District Attorney Stephen Zappalla-had me charged with aggravated assault because my assailant, AKA the “victim” suffered a ‘cracked orbital bone,’ which we commoners typically call a “black eye.” I showed up to court in a suit, while my accusers appeared in ragged jeans and graphic t-shirts. The victim was both under the influence of alcohol and narcotics in the courtroom (by his own admission). Despite the obvious absurdity of this whole charade, the DA tried to paint me as a jilted lover, who was capable of inflicting more damage than any MMA fighter his “expert” witness had ever seen done in a single blow. The fact that I was a public servant apparently served to enhance Mr. Zappalla’s political career, and he would spare no effort to convict me. Unfortunately for him, it took the jury 45 minutes to both recess for lunch, and find me “not guilty” of any charges. My assailants were never charged with either criminal trespass, criminal mischief, disorderly conduct, terroristic threats, or even found liable for property damage to my fence (the reason I stepped out of my house in the first place). They were actually engaged in a drug deal around the corner that had gone bad, and were seeking their confederate who ran off with their drug money. I was the hapless citizen, oblivious to those facts, who had the misfortune of answering his door at 9:30 on a July night. I told my lawyer, “I should’ve shot the S.O.B.!” He told me (in 2010), “be glad you didn’t. A manslaughter rap costs at minimum $100,000!” Everything you’ve said is so true, Mr. Ayoob. I live in a crime-ridden city, and even though my neighborhood is decidedly nicer than most, now I know that crime can occur here as well. I am never without my Shield Plus, but I am acutely aware that if I should ever-God forbid- have to use it, the state and local governments will do their best to destroy my life; the media will vilify me; and the legal fees will invariably bankrupt me. Everybody-from first-time gun owners, to the people who don’t even have guns-should watch these videos. My story is only one tale in God knows how many. I got through it, but wish to God I never had to. It helped that I rendered first aid to the guy after I knocked him out, but it could’ve easily went the other way for me. As a firefighter, we are trained to react instinctively. People have asked me, “what did he have in his back pocket?” To this day I do not know. I was a firefighter, not a police officer, I wasn’t trained to check people’s pockets, so I didn’t. But like I said to the cross-examining DA, “I was sure he wasn’t reaching back there to give me his card!” Another second and I probably would’ve found out the hard way… 15 feet in front of my house, in my stocking feet, on a warm July night, and my mother would’ve heard the whole thing over the phone: Pittsburgh Fire Lieutenant Tommy Pouch, aged 42, US Army veteran, Paramedic, 3 Bachelors Degrees and a Masters. Sadly, these things happen daily.

WOW first off I'm so sorry to hear you had to go through that when YOU were the victim. This gets me so angry just hearing the story, it's absurd. Thank you for your story, this can help many people. As soon as I can get insurance for my gun and get a lawyer, I am because even tho in this life you may be such a good person and never do anything bad, this world finds a way to fuck people in the ass even though they didn't do anything wrong!

Politically-minded DAs are a huge problem. Politics has no place in the DA's office. DAs should be appointed, not elected, and those appointed should not be allowed to seek elective office while serving as a DA.

The crap you went through 😂Bloody as hell when the cops showed up, I realized he wasn't bleeding anymore, started working on him, when they showed I could not recover the fucker shooting at others then me, para had to tap me out, I was gonna make that fucker live 🤣yea point and laugh Nightmares suck balls. That is awful! Sorry you had to go through that but so glad you came out it being found not guilty. It's so ridiculous that you had to go through that mess with no recourse against the actual aggressors. They should have at least had to pay your attorney fees.

A friend of mine who is now deceased was on night shift with me in a NC sheriff's dept. We were road deputies. He was a few years older than I and was a Vietnam Vet having served in the 101st. One night I stopped a vehicle with three young black males in it that a city PD had put an BOLO out on for destroying a convenience store and terrorizing the clerk. As the driver quickly exited the vehicle the pistol grip of a shotgun was visible on the floorboard. It turned into an interesting stop rather quickly. After it was all said and done, the three were transported to the jail with charges applied. My friend said that if I had had to shoot one or more of those young men, the NAACP and the family's lawyers would use my prior service as a US Army Ranger, my high scores in our bi-annual qualification and anything else against me. My friend was a black man and one of the finest men I have ever had the opportunity to know. This was back in the late 80's mid 90's.

As long as the client can pay them. That's the great trap in the American legal defense system. The prosecution has money to afford any witnesses they want. You as a defendant have to come up with cash to hire them to testify for you. Always keep that in mind if you wind up as a jurist, to view expert witnesses through that lens.

The best training I have taken was one you and Ray Chapman taught in Utah, at the VA, in the 1980's. With that training you guys taught me to continue education not just one or two classes. Thank you. The class was all classroom but it taught a lot. I have taken training combining both classroom and range time.

Short answer is yes. Because *anything* can be used against you in court. Recent jurisprudence shows that facts, respect for the law, and reason play a minor supporting role (at best) in most cases involving the use of violence. Especially if you have the currently bad luck of being a normal white male.

Absolutely get "In the Gravest Extreme " and read it three times through! Then pick up whatever articles you can find which Ayoob wrote. He's not perfect, and yes he sometimes comes across as a know-it-all, but he's one of the half-dozen best experts i've come across in the defensive use of firearms field.

I think you should be able to request a trial by 12 people with Concealed Carry Licenses or Permits. I know that would never happen but that would be a "jury of my peers".

When I was going through the ACADEMY I was setting a blistering pace on the range. Infact I finished with a Nearly perfect record (I was scored on one round which failed to fire.) Consequently I won the Lt. Mike Galvin Award. Towards the end of training it was suggested to me by an Instructor to throw a few rounds in the dirt. He told me "It's Better Not to be Perfect" I am glad I wasn't a Lawyer....It's hard enough living with myself as a Cop. God Bless! You you were my Mentor as a young Peacekeeper back in 1976! 🇺🇸 True Blue💙

"Immediate and otherwise unavoidable danger of death or grave bodily injury to the innocent." Words that earned my instant respect for this man. No "tacticool" frat-house "Bruh, I'm an AMURRICAN, that gives me the right to do as I please with a gun because I'm a patriot!". But an educated approach that appropriately balances the need to protect oneself from harm while taking the legal system and public perceptions into consideration so you don't get blindsided. As Mr. Ayoob mentions in his L.F.I. instructional video from way back when, "The moment you draw that weapon, you're walking on ice. We're here to teach you how to walk where the ice is thick."

I agree 💯 i try to take at least one class a year and will be working to get my instructor cert this year. My reasoning for wanting to teach is i moved from a metropolitan city to the country once i got out here i noticed there was zero handgun training available in my area and a saw a need for for the predominant long range crowd in my area to be able to get additional training. I am having issues with the men in the area wanting to take classes however my wife has already been doing non paid training with allot of women who carry but very seldom shoot to give them confidence as well as skills to be able to better protect themselves. Long and short no matter the skill go take a class from a reputable and competent instructor no matter your skill level there is always something to learn. Thank you Mass for your wealth of knowledge and years of practical.shooting and training you are an inspiration to the next generation

Great video, Mr. Ayoob. Here's a topic I'd like to hear discussed: carry rotations. I often hear people talk about their "carry rotation", and it often consists of various guns with various manual of arms. Maybe I'm missing something, but I carry the same gun day in and day out, as I feel that it allows me to master my carry gun.

Maas, as usual -- is right on point. What you learn in training is critical, and it can be used to defend you in any type of case. Of course, I once had an "expert" with tons of experience - who turned out to be the worst witness in the world. He let the prosecution lead him during cross examination in trying to be too "fair" to both sides, and it was one hell of a job in trying to rehabilitate him - which luckily I was able to do. That was a lesson in needing to train even your expert. Some of them who do it as a business -- think they know more than the attorney -- and then have their own "theory of the case" -- which if different than the attorney can be a death wish. But, I would take one exception with what Maas says -- having your instructor as a witness and then adding another expert -- allows the prosecution a chance to draw a wedge between their testimonies. I preferred using the cops on cross examination almost like my witnesses -- you can do it if you know the cop side of life -- and only a single defense "expert", if and only if, I thought that was still needed. And one more point for the attorneys out there -- it's not what a reasonable person "would have done' -- it's what another reasonable person "might" have done under the same circumstances, with the same knowledge, that is also reasonable. There are often several "reasonable" responses to criminal attack -- and all of these are protected under lawful self defense. Jurors need to understand that.

Sir, your knowledge is priceless. Thank you for all you've ever done for firearms owners and the 2nd. amendment. Entertaining and educational ...how do you beat that? I've had CCW training twice. Once in Arizona, and then in Massdoeschewit. I just like to come here occasionally to brush up on the latest. Had firearms since the age of 16 and I'm about to turn 73. Long live the NRA! Life Endowment.

The answer is YES but you should train anyway. If you are ever in a self defense situation EVERYTHING will be used against you so just train

I was recently called for jury duty and after two days, we all were excused because the cases were all resolved by either a plea or they were dismissed. On my way out, I asked the court clerk if in her opinion I would have been picked to serve. I am a 25 year LEO with 90% of my time serving as either a working detective, supervisor and finally manager. She looked at me, grinned and said there was NO WAY that I would been selected. She told me that after my jury questioner was evaluated, I would been one the first to be struck. Pure jury "deselection".

I just listened to Tom Grives. He is now a defense attorney, and he says there is a federal law that could put you in prison for 10 to 30 years if you used an NFA to defend your life, I have heard of people using a SRB and CAN as their home defence weapon. But in this federal law, it also includes the ASSAULT Weapon, if you have time could you address this.

I was trained for the base auxiliary security force by the Marines to shoot 'double tap center of mass' the closest threat. Then re-evaluate the field. I have never been in combat as I got in and out between wars. I still go to the range monthly, I sincerely hope I never need my training.

Great Video and the article that Mas referenced "Defending the Self Defense Case" by Ms. Steele is a must read. It's a very easy read for legal advice and her perspective is refreshingly candid. I wish that I'd read this article years ago when attending use of force training as a LEO.

The point Mas makes about choosing instructors carefully is vital. There are some instructors that need to be avoided.

Most the online instructors focus on skill-at-arms tactics, but go no further into the importance of avoiding armed confrontations wherever possible, and they are mostly devoid of communicating the essential things to do when the shooting stops…stuff like carrying & using prepped tourniquets, immediately calling 911 & quickly hanging up to call your self-defense lawyer, preserving physical evidence, not yapping with the police, etc.
