@@liezelbickle9430 but she isn't. she is neither the biological nor legal mother of either fetus. vee is right, contractually it is not her body and not her babies, therefore not her choice. if she wasn't capable of adhering to the parents' wishes, she shouldn't have agreed to lease out her body. besides she was clearly getting way too attached to the babies already, what is going to happen come delivery? is she going to fight to keep them because she gestated them and she thinks of them as hers?

Louisiana and Michigan are currently the only states that still ban surrogacy contracts, however Michigan has a statute going into effect in 2025 to allow surrogacy. If there was no contract, then the baby belongs to the birth mother, regardless of the biological parents, however most individuals have a contract and either a pre-birth or post-birth order to transfer custody to the biological parents

It's called a hernia of Morgagni. In most cases the baby cannot develop properly. Babies born with this diaphragmatic hernia might require immediate surgery. A very few number of babies born with this live their lives, no problems. Others, like me at 55 years of age, have a sudden dire situation when the abdominal organs move through the hole and enter the chest, affecting the function of the heart and/or lungs

Yeah great. And what if it hadn't ended up this way. This is a fictional TV show. Which means that in real life most likely this wouldn't have turned out this way. He could've killed all 3 of them if he hadn't been so lucky. And she shouldn't have had the right to make that decision. It's not her kids. She isn't the one who has to live with the consequences. Those parents are most likely going to have to pay for a lot of medical procedures later because when you have that kind of hernia, it's not just one surgery and everything is cured. Now those parents are going to have to suffer the consequences of her decision to do that. But sure. Let's call her a hero like she didn't just hold those parents hostage like she did.

here’s the thing though they weren’t stressed out about the boy having the condition, they were upset bc the healthy fetus was at risk of dying as well and they were the last two eggs. if it’s between one or none most ppl would choose one.

A lot of it depends on how far along the fetuses are and how strong they are. All of that is assessed when giving a chance of probability. Yes, maybe your relative was lucky enough to survive it. But there's a whole slew of babies that never do. You can't make a decision hoping that you're part of the 1% when other lives are at stake. By allowing the male fetus to grow, it most likely would've killed both him and the other fetus. I'm going to guess that your relative wasn't a twin. The decision might've been different if they were.

Why didnt this get brought up along side the selective abortion ? Parents thought there was only only on choice. Either lose one baby or both. They were clearly on board with the new option where both babies could survive and surrogate was willing to take the extra risk to herself. They all wanted both babies to live. I am pregnant rn. 21 weeks and i could not imagine hearing my baby's abdominal organs have gone into his chest etc.

As awful as it sounds, unless the surrogates life is at risk she has absolutely no say in what happens to the children. She is not the parent legally or biologically, she was told this at the beginning most likely. That is what being a surrogate means as harsh and inhumane as it sounds; when you sign up to be a surrogate you are signing up to be a living incubator for someone's child. your opinion on how that child is medically taken care of is null and void.

I find it kind of strange that they didn't bring up how general anesthesia was a risk to her until they were talking about the second surgery, because it would have been a factor in the first surgery too. And it would complicate the matter a lot. In this it's framed as an issue of the surrogate wanting something different for the babies from the parents. The contract in that scenario means everything, letting the surrogate make the choice would the same as letting someone override the parents wishes for their child once the child was out of the womb. Dr. Halstead's arguments that she's not just "a living incubator" are stupid in that scenario, because they're not talking about her, they're talking about the babies. But when the general anesthesia problem comes into play, it completely changes it. Then the living incubator question comes into play, she signed a contract saying they could make choices about the babies but didn't sign it saying they could make choices that put her life in danger. Dr. Halstead's point seems a lot more valid that way. In this I was just frustrated with him, you can't change your mind with a contract like that. If you could change your mind then what would be the point of the contract?
