I can see where you are coming from but I have seen drunk or intoxicated patients walk into the ER (we call it ED, emergency department) with breaks to lower extremities. To say they do not feel pain would be an exaggeration, indeed most felt plenty of pain but they ambulated well enough but every one of them were surprised that they had actually broken something. The victim in this case was not sober and may well of indicated that he was okay. I would not personally have left it at that (having said that I would not be driving drunk) He did leave him wrongly but it was bad judgment as was his decision to drive. I don’t think it was a malicious act to leave him. As for the drink driving I do not feel the penalties are strong enough it should carry the same penalties as involuntary attempt at man slaughter.

Both the driver and the victim said he stopped, so I believe that. He stopped for a moment and went "are you okay?" victim obviously wasn't, driver knew how much s**t he'd be in, left the scene and the victim in the hope he'd get away and not be identified. So still classed as a hit and run, and a massive, tower sized DI*k move! He didn't care about leaving the victim out there with a crushed ankle and foot. I'm sure he was also worried about having to pay for the mans medical care. So he stopped briefly, then took off, according to the victim and the driver.

Dump of adrenaline when you think you're going to die will keep you from feeling anything. got in a BAD motorcycle accident, got right back up, walked off the side of the road, and was more concerned about my bike than really hurting, just felt kinda bumped up. it wasn't until i tried to unbuckle my helmet and couldn't move my fingers that i realized i'd shattered my hand. Turns out i shattered my hand, shoulder, and fractured both of my heels from hitting the ground so hard.

No, the victim confirmed that the men did stop, spoke briefly, then drove off. While mustache driver feared being caught driving drunk on a “no ATVs” trail, the helpless victim may have, understandably, been *very afraid of the two men.* He’s severely hobbled and on a dark, rural trail and might’ve feared being killed and dumped in the woods by two large, intoxicated men…to never be seen again. It’s possible that he also noticed the chainsaw in the back of ATV (mentioned by the driver to officer). 😧 If injured and fearful, I may have acted similarly since there were *NO witnesses around.* I would’ve tried smiling and waving them on, to then call 911 after they were out of sight. In the days without mobile phones, this helpless victim would’ve needed to take his chances with two strangers who are already breaking laws and have the upper hand…in remote country woods. 😬

Gotta be fair, it was refreshing to hear. I get why he wouldn’t admit he was intoxicated, though. Any lawyer will tell you to say nothing and admit nothing. But given the situation, I don’t know how you could defend against hit-and-run, operating while intoxicated, and operating the UTV on a prohibited trail. Just like the victim, the driver doesn’t have a leg to stand on. Cooperating and being honest was probably a good idea.

Some vehicles are ok when your drunk, like bumper cars. They're pretty much made for drunk driving. And remote controlled cars. They're a blast when drunk, as long as you're in a reasonable place. Row boats aren't too bad when you're drunk, ether. Just wear a life preserver.

I had a neighbor who was paralyzed because he was riding an ATV while drunk. He went over a hill too hard and flipped it and landed on his neck and the ATV landed on him. Instant fracture lifetime paralysis from the waist down. You're exactly right don't drink or drive *any* potentially dangerous vehicle and ATVs are on that list.

Sitting here two weeks postoperative ankle fracture. There's NO WAY the victim said everything's ok. Extremely painful and requires metal plates and screws to put you back together. Agreed! I had a broken ankle (it wasn’t crushed like this guys) had to have plates and screws. Extremely painful and never got full recovery of range of motion in my ankle. Also expensive medical bills.

Could be shock, I've broken both legs, ribs, collar bone, it has never seemed like a big deal immediately after. Maybe that's just me, but in my experience broken bones don't really start hurting for about a half hour.

Thankfully, the victim had a phone and called 911. He also confirmed that the men did stop, spoke briefly, then drove off. While mustache driver feared being caught driving drunk on a “no ATVs” trail, the helpless victim may have, understandably, been *very afraid of the two large men.* He’s severely hobbled and on a dark, rural trail (no witnesses) and might’ve feared being killed and dumped in the woods…to never be seen again. It’s possible that he also noticed the chainsaw in the back of ATV (mentioned by the driver to officer). 😧 In a similar situation, with a phone, I may have waved them off too. But without a phone, I would’ve had to take chances on the strangers helping me…rather than dying from exposure, as you imply.

I mean, a broken ankle isn’t going to kill you most of the time. You’d die from dehydration or exposure before that. Since this seems like a fairly high traffic area (who goes for a run at night?) I’m fairly sure he would’ve been discovered before that happened. That’s not an excuse for his actions, but let’s not act like his whole body was run over. I’m just thinking like a judge who’s considering the sentence.

9:00 this is why you NEVER do the field test no matter how sober you are. if a cop wants to jam you up, its going to happen regardless of how you perform. i wouldn't even submit to a breath test, especially if you had one drink at any point, no matter how far before you drove. you could have had a sip of beer only and score outrageously high on the breathe test depending on how long ago the sip was. only ever do the blood test and only if your state requires it, no matter how inconvenient it is. one night that takes 5 or 6 hours is worth a permanent record or years in prison

About a month ago I broke my fibula, it’s above the ankle bone. Breaking anything near the foot and ankle is an *intense* pain. Enough to make you vomit. You go into shock. I could barely breathe let alone talk for the first 10 minutes. There’s absolutely no way they didn’t just ditch him. These guys are the scum of the earth. I hope he presses charges, it is *NOT* a cheap recovery.

I crushed my ankle over 20 years ago. Ruined my very active life. 3 surgeries plus 6 mons of pt. I can't ride a bike, run, surf or even squat etc. When you crush a joint there is no getting back to the way you used to be.

@@acorn-i6m Can confirm. Had an incomplete vertical fracture of my distal tibia, it no longer has full freedom of motion. Healed wonky. This was years ago, and I remember it was miserable. Not as bad as a double fractured collar bone but yeah, miserable. I wish you a speedy recovery and please, PLEASE do not test it. When it feels good again, you baby that ankle for another two months. It can feel ok and not be ok, and it doesn't take much to fuck it up and end up with excessive scar tissue or other problems.

I came across what I thought was a bag of rags laying in a busy street on the way to work at 5:00am what was the first day of school. Nope it was a teen who had been hit by a car. He was badly injured with a compound fracture of his lower leg. I blocked the scene with my vehicle and called 911. He told me the driver who hit him backed up and said "you'll be OK" and drove off. He kept trying to get up so he could find his skateboard that was precious to him . Finally others stopped to help and block the road further, I found his skateboard and shoe about 50 yards away. and gave it to him to help calm him as thee was no way he could walk on that leg. About a 2-3 minute response time from Station 77 , Paramedic Ambulance & EMS Battalion Captain, evaluated him, packaged him and transported him to a level 1 trauma center at a local Hospital. Don't know what happened to him or if any investigation ever happened. Welcome to Los Angeles

Having lived in SoCal for 22 years, I guarantee it’s worse here in Wisconsin, and was way worse when I first moved here several years ago. My insurance rates tripled because of drunk drivers, even though I drove less than 100 miles weekly here (I obviously drove way more than that in SoCal 😂). When I finally stopped driving due to disability (progressive terminal neurological disorder), my premiums on a 20 yo Suburban driven less than 6,000 miles per year were $3,600 just for state minimums. This despite being a former driving instructor (semis) with over 1.6 million safe miles (no tickets or preventable wrecks).

Shame on this driver not only for his actions that night, but then having the temerity to plead not guilty when all this is on camera AND they had to get a warrant to test his blood. Now all this time and effort has to be put into a trial. I hope the injured cyclist has filed the appropriate lawsuits against this drunk driver either in criminal or civil court, because he needs to be made as close to whole as possible. Ankle injuries and breaks can be brutal with long-lasting limitations on mobility.

Right now (or a few months ago, given that the trial date has passed), the defense attorney and the prosecutor are working out a plea deal. I doubt this went to trial. That’s the game: hit the defendant with maximal charges so you can knock off some charges for a guilty plea. The defense is thinking about the penalties and how to minimize them. The number of charges is not as important because the penalties (jail time) usually run concurrently. This case is going to be tough on the defense, because everything seems pretty clew cut.

I'd love to have a few cops try the drunk tests on sober people and see how they do. It would need to be a cop, because their presence can make one unsteady.

It's basically a scam to get a blood test or a blow as it is a subjective test. Many sober people would fail that test for many reasons.

You are not required to do field sobriety tests. In fact many lawyers have advised against doing them because cops will use them to try and prove you were impaired, even if you weren't. If you are sure you are sober you should immediately request to do a breath, urine or blood test and skip field sobrietys as to not implicate yourself by any perceived missteps by the officers.

@@petrichorsdreamin Tn if you refuse field sobriety test the next step is being taken to a hospital/EMS to get blood test. If you refuse either you’re charged with DUI or whatever it is automatically. I had a dui and I refused field test but when instructed by my lawyer on phone at jail he said you either do the blood test or you’re viewed as guilty, I did. I still beat it. Bc blood test can take months to process so if your lawyer is good they will do whatever they can for a fast process to settle/get it thrown out BEFORE the blood results get back. Mine was august and court was October and the blood wasn’t back yet from the state. It’s not a CSI type shit where it’s here tomorrow. You’re in a long line of mofo’s lol

I suspect the bike rider was sitting on the ground with his feet out into the pathway. No lights on his bike, I bet he stopped because he couldn't see and planned to stay the night. May even have been asleep.

I really appreciate the professionalism these officers displayed throughout the entire encounter. It's hard when you know the person hurt someone and then left the scene.

They are not known for intelligence or self awareness. Even the ones we othewise seeing do n ok job. What ws any one of these officers up to last week I wonder. Kinda how it works. We see the cool video, we don't see the previous 714 complaints, assault allegations, etc,

No one can. All the tests are designed for you to fail so they can get blood. That is where their cases fall apart is the blood draw. But until the results come in you are guilty as far as the law is concerned

And that’s why you should refuse if legally allowed to. I doubt I could do it and in this case it was on a rough dirt trail and I doubt a sober teenage athlete could pass.

thats why you don't do them. especially if operating a boat. field sobriety tests are purposely made for the person doing them to fail or have a difficult time performing which in the end leads the officer to believing you are drunk or impaired in some way. NEVER agree to a boat field sobriety test.

@@Double_Deez Interesting. I also heard that during sobriety field tests, asking the subject to recite the alphabet backwards is a specific prompt. An attempt to get subject to say, "I can't do that even when I'm sober."
