When the DA threw out the case against the husband, that's a clear sign that his lawsuit against the cops is going to be a slam dunk, but expect the police dept. to put the taxpayers on the hook for a hefty legal bill defending the indefensible until someone with sense agrees to offer enough to get a settlement, also at taxpayers' expense. Arresting the husband for telling his wife that the cops need to come back with a warrant was clearly retaliation. The wife's case is more problematic because she should've covered her bases during the 2 week interval, but her husband should collect enough money to make up for whatever they throw at her.

Texas is a no fault state. People involved in a minor fender bender can handle the accident themselves without involving the police. All they have to do is exchange information: proof of driver’s license and proof of insurance. Both parties can then be on their way and contact the insurance companies on their own. They can also go to the nearest police station or go online to file an accident report. As long as there are no injuries and property damage is under a certain amount the police do not have to be involved. If the police come because one of the parties lacks proper documentation or refuses to make an exchange then the person at fault will most likely get a ticket and will have some points on their driving record.

Years ago, I was in a fender-bender with a van that received much more damage than my SUV. We were disputing who's at fault. I wanted to call police but she was on her way to an important appointment and had kids in the car. Everyone was calm and civilized. We agreed to fix our own damage (exactly what we did) and went on our way. If she had called the police on me after I left, would that have made me "privileged," and should I have been expecting cops to be knocking on my door?

Officer told him to get it off the police report cause they were clearing traffic. A week later, no police report. Two weeks later, no police report. Turns out police report went "missing" and internal investigation found that "it must have fallen behind something. Sorry." No info on the other driver, at all. Being in our 20s, we only had liability. Had to take a total loss, while being students. Life experience has taught me that things aren't black and white, and rarely fair. And it's good to know a lawyer. Better, if you're married to one.
