Thanks for your good job. I am a US Citizen and the I-130 (for my wife) has been approved and she just get birth to our first child. 1-Should I fill out a separate I-864 or just include the baby in the same I-864 with my wife by selecting Part-3, item-1 and item-2 and filling out the info of the baby in "Family member 1"? Because I am going to file for my child passport and CRBA. So total family size is 3. 2- In case I need to fill out a separate I-864 for my child. what option should I choose on part-3? They don't claim me and I don't claim them. We just live under one roof. I make more than enough of the 125% poverty guideline for my wife and I. My question is living with my parents a problem? I became US citizen when my petition for I-130 got approved (I was able to let USCIS know about my status change). I-130 approval took more than 2 years due to COVID. First question: I am now double minded whether my 2 kids are approved or not with I-130 petition for my spouse alien relatives (I have 3 years of daughter and 1 year old son) I did provide all the birth certification documentations as supporting document with I-130 petition. My second question is do I have to file I-864 and include my children in one affidavit of support as I was green card holder when I filed the petition or I have to file separate I-864 for both child including spouse (total 3 I-864 forms?) because I am now US citizen. If the USCIS Center is processing the paperwork in 10.5 Months (Vermont) You have submitted the 130 Form On June 8, 2022, and you have a case number when will they ask to submit the Affidavit of Support? I got a message from USCIS on July 25, 2022, that they are now processing my paperwork and said they have not asked for any other paperwork so far. Will they ask in 4, 5, or 6 months? Or more? How months in advance will they set the interview date to give the person time to get the Heath Check? 2 months?

Hi there! I have a question. I live outside the USA. My husband make a petition for to to get the green card. NVC had approved the I- 130 form. But he passed away June 2019. I tried to send online mesages to NVC to notify my husbad passed away but they never received the death certificate I attached. Now in july 2021 I tried to attached it again and a month later they finally said they are gonna let me know soon what's gonna happened but I have an online mesages I received in may 2021 saying that they can't continue with the process until I submit the Affidavit of support, DS-260 form and civil documents. The form is so confusing. Especially part 5 & 6. I'm petitioning for my mom. But I thought in Part 6, Person 1 where I put my husband's income, no? Then you mention he would have to fill out I-864A. Looks like that's why everyone gets this part wrong. Completely makes no sense how misleading it is. And in Part 5 it says to put 1 if you are married. But you said to put 0 there.

Yes, you do in this situation. Unfortunately , divorce does not cancel out the I-864 so you would still need to add him into the household size. The only exception is if is now a USC or has had 40 working quarters in the US.

Hi Ahmed, no, neither one of you would be counted in the other's family household size since the case hasn't been approved yet. Yes, he can use his expired passport as proof and attach an explanation for why he doesn't have a renewed one

Thank you for the informative video. In short: Filed I130 for stepdaughter, it was approved. I am a graduate student (3rd MA) and have been in Grad school UC Berkeley, SF State etc. I was injured years back and was awarded SSDI benefits $12,700 in my name and $6000 in my name in care of my minor daughters here in US. While studying and doing research in the Philippines years ago a met my wife who had a daughter. Currently, we have two daughters here in the USA. I have been getting grant awards and scholarships and GradPlusI working towards a doctorate. My wife works and goes to school. Our combined income on our taxes put us over Trump's public charge (barely)! However, my mother is willing to use her income $30,000 a year on retirement to make sure we clear the public charge. She still uses an old mailing address but lives with me. Does this matter, or should she just be a joint sponsor? I have a lot of questions and I am willing to pay for your services. I have looked at a lot of these videos on youtube and I am a former law student (not lawyer) and I know I need to get this right the first time. Thank you in advance

HI Conrad, your mom can be included as a household member and use form I-864A but she should have some proof of address to show that she lives in the same house. If she's not able to, I would recommend using I-864 and adding her as a joint sponsor

Hey dear i have a question NVC approved my documents 3 April but they didn't schedule my interview yet my cause status is At NVC, i want to upload more evidence like WhatsApp chat history call history wedding pictures etc so my question is that can we upload the documents after the review or not and if i upload now more documents to nvc did it's going to delay or effect me or not
