Ok, sorry, apologies for the length of this: There is that, but then again, there's inconclusive evidence to say that they were in a rocky relationship with regards to actual abuse. There were texts she sent to him, where she says she was "scared" of him, but maybe it's just me, and maybe it's because I can only look at this from a male perspective so I guess maybe in some ways I'm biased.....but the texts, whilst they DO read to a relationship that isn't totally love and joy and happiness, to me, they DON'T read DIRECTLY to abuse. Although it does make sense if viewed in hindsight with her death, they sound definitely like a couple that's had an argument and that at the least, the man has raised his voice (I'd assume it's him, coz it'd be weird for it to be her, but she's telling him she's scared.... Also, I'd be worried if she was scared and he hadn't at the LEAST, raised his voice). But that's all we have to go on, pretty much, which is why it doesn't suggest an abusive relationship that has existed for a long period as opposed to one that's just going through a particularly bad patch. Pistorius But my point is, that, considering there's no concrete evidence their relationship was what you could perceive as murderous levels of 'rocky', her behind the door doesn't suggest she was hiding. unperceivable So, whilst the context of the texts, the killing and the plausible reason of her hiding from him, suggests you're right, I doubt it would pass the 'reasonable doubt' test. And as someone has pointed out, he likely wouldn't have known she was directly behind the door, if the door wasn't see through and was locked, even if he WAS doing it purposefully. So, the fact that he pointed the gun towards the lower part of the body with his first shots, not towards where the upper body would be, which if you had trained with guns, from my general knowledge on this subject, you know is THE place they tell you to fire if you're shooting to kill or severely wound but you can't do a military style double tap to the head coz, y'know, you're just a normal person.....that doesn't suggest he was aiming to kill, especially as he trained with guns, he'd know, if he knew she was directly behind the door, that he was aiming roughly for her lower torso, not her heart, which if he was deliberately trying to kill her, is probably where he'd be aiming. Just my opinion, but I think what you said, is a bit of a leap too far, if you're looking objectively at the case.

It's the infamous 'dingo stole my baby' story that's actually a very dark part of Australian history, involving weak circumstantial evidence, a wrongful conviction, appeals to Australia's highest courts, and loooooong ongoing inquests. There's a famous case of a Korean celebrity named Kim Sung-jae (a kpop idol) that was murdered in the 1990s. At first the police stated that his death was caused by a heart attack, however 28 needle marks was found in his body. After an autopsy was performed it was found that his body had an animal anaesthetic in his body (the type used to put animals down). Eventually his girlfriend was convicted of his murder however, she was acquitted on a retrial due to lack of evidence . To this day, His parents believed that it was her and there is actually a lot of evidence to suggest she killed him (she was a med student, her dog strangely disappeared that year and she replaced it with a look alike, she was jealous girlfriend etc.) it'll be interesting to hear exactly how she got acquitted of the murder cause its pretty obvious it was her. (KZbin grazygrace does a video on it in more detail if anyone is interested.)

There is a way to argue with it because anxiety is essantially unproportional or unnecessary amounts of adrenaline in our bodies. That state of panic is known to make our brain prioritize sight over hearing. He could have literaly be deaf when he shot the door. In Spain there was a big case surrounding the disapearance of a girl named Asunta Basterra in 2013, that was found dead the day after. She was adopted by her parents at the age of 1 and it was proven that they sedated her for months before commiting the murder. The mother was a lawyer and the father a reporter, both sentenced to 18 years.

a azeem I'm assuming you mean like our types of degrees / law degrees. We have 3 types of law degrees. BA (3 years), LLB(4 years), and BCom (3years). But you can't qualify as a lawyer without a LLB degree, so it's an additional 2 years of postgraduate LLB if you study BA or BCom. You should come visit Cape Town. 16:37 Engineer here. Not sure if I understand the situation fully, but sound energy is concentrated (louder) within enclosed spaces, such as in hallways or alleys. Funnels, like horns or open windows, improve the interface between a source and the air at the cost of some of that energy. You know, you might like to look at the Pell case in Australia, where the High Court overturned a jury verdict, which at least in Australia, is really rare. Not only that, but the Supreme Court (trial and appeal divisons) found Pell guilty. Yet, the High Court decided unanimously that there was reasonable doubt.

The David Bain case from New Zealand is incredibly interesting from a legal perspective as he was originally convicted on all 5 counts of murder and spent 13 years in prison before winning his appeal and being found not guilty on all charges. There's a really good 10 part podcast on the murders called Black Hands and the case is very famous here and very polarising. Loads of problems with case including possible police tampering, sexual abuse allegations within the family, and weird timelines. Yes the Bain case is very interesting indeed...everyone here in nz knows the facs lol bc it was the most expensive trial in Nz history costing the taxpayer a total of 11 million dollars. Can you believe he did not even receive any compensation for wrongful imprisonment after he had spent 13 yrs in prison !! Their family story before they all got shot and died is so fascinating - being teachers in Pupa New Guinea then moving to Nz and living the farm life...sounds so exciting!!

I totally felt the adrenaline rush when you were explaining this and the fact you actually tested out the expert evidence really blew my mind - great job! I totally understood the context as I am doing my Bar Exams now and my gosh, this is just such an experience. I guessed if you wanted to look at some interesting cases, perhaps some cases from the Innoncence Files (it's on Netflix) would be a great start. The show illustrates the cases took up by a pro bono department set by a University who takes cases to liberate prisoners who were wrongly incarcerated solely based on expert evidence which may not be accurate. I recommend the case of James Bulger. It was one of the most heartbreaking cases I've ever read about, and I think it's really important for everyone to know about it as the murderers of the case are still controversially living in society with signs of relapse. I just wondered, couldn't have (or did?) the defence use this line of reasoning to refute/explain the forensic evidence. Oscar Pistorius and Reeva went to bed at 7 pm. Oscar claims, when he woke up, Reeva was awake. Couldn't have Reeva woken up earlier and eaten while Oscar was sleeping. An alternative explanation to the food contents found in her stomach. If I was defending I would try to argue this. I'm not saying that this is what happened, or that I believe he is innocent. I'm not. I'm just wondering if this was or could have been used.

I suppose it's because who was behind the door was irrelevant because it was still have been premeditated murder. The forensics evidence was mostly likely used to discredit Pistorius' statement.

@@BassikMusic because he still shot four shots, therefore intending to kill whoever was inside, therefore murder was committed which he was charged for...whether it had been a burgler or his girlfriend, he still murdered them

Abe Bennett i get your point, I guess there would be a difference had he wrongfully - but reasonably - assumed that he was acting in self defence. Perhaps they couldn’t make this argument because shooting someone four times is excessive, even in self defence. Plus, it was not reasonable of him to assume that it wasn’t his girlfriend
