Olivia Young but he was aiming towards the lower portion of the body, so why not the possibility that he just wished to - oh no I forgot that word. As in he wanted to make the intruder fall, immobile and unable to Attack him if he were to open the door? He would predict the person to be, as he said, “attempting to escape”, and thus aimed towards the legs, “knowing exactly where to aim”

Ok, sorry, apologies for the length of this: There is that, but then again, there's inconclusive evidence to say that they were in a rocky relationship with regards to actual abuse. There were texts she sent to him, where she says she was "scared" of him, but maybe it's just me, and maybe it's because I can only look at this from a male perspective so I guess maybe in some ways I'm biased.....but the texts, whilst they DO read to a relationship that isn't totally love and joy and happiness, to me, they DON'T read DIRECTLY to abuse. Although it does make sense if viewed in hindsight with her death, they sound definitely like a couple that's had an argument and that at the least, the man has raised his voice (I'd assume it's him, coz it'd be weird for it to be her, but she's telling him she's scared.... Also, I'd be worried if she was scared and he hadn't at the LEAST, raised his voice). But that's all we have to go on, pretty much, which is why it doesn't suggest an abusive relationship that has existed for a long period as opposed to one that's just going through a particularly bad patch. Pistorius But my point is, that, considering there's no concrete evidence their relationship was what you could perceive as murderous levels of 'rocky', her behind the door doesn't suggest she was hiding. unperceivable So, whilst the context of the texts, the killing and the plausible reason of her hiding from him, suggests you're right, I doubt it would pass the 'reasonable doubt' test. And as someone has pointed out, he likely wouldn't have known she was directly behind the door, if the door wasn't see through and was locked, even if he WAS doing it purposefully. So, the fact that he pointed the gun towards the lower part of the body with his first shots, not towards where the upper body would be, which if you had trained with guns, from my general knowledge on this subject, you know is THE place they tell you to fire if you're shooting to kill or severely wound but you can't do a military style double tap to the head coz, y'know, you're just a normal person.....that doesn't suggest he was aiming to kill, especially as he trained with guns, he'd know, if he knew she was directly behind the door, that he was aiming roughly for her lower torso, not her heart, which if he was deliberately trying to kill her, is probably where he'd be aiming. Just my opinion, but I think what you said, is a bit of a leap too far, if you're looking objectively at the case.

You should look into the Lindy Chamberlain case from Australia! It's the infamous 'dingo stole my baby' story that's actually a very dark part of Australian history, involving weak circumstantial evidence, a wrongful conviction, appeals to Australia's highest courts, and loooooong ongoing inquests. Super interesting from legal, media bias and women's rights angles (oooh boy the expectations of Lindy as a 1980s grieving mother are something else) and also the cultural impact it has had

There's a famous case of a Korean celebrity named Kim Sung-jae (a kpop idol) that was murdered in the 1990s. At first the police stated that his death was caused by a heart attack, however 28 needle marks was found in his body. After an autopsy was performed it was found that his body had an animal anaesthetic in his body (the type used to put animals down). Eventually his girlfriend was convicted of his murder however, she was acquitted on a retrial due to lack of evidence . To this day, His parents believed that it was her and there is actually a lot of evidence to suggest she killed him (she was a med student, her dog strangely disappeared that year and she replaced it with a look alike, she was jealous girlfriend etc.) it'll be interesting to hear exactly how she got acquitted of the murder cause its pretty obvious it was her. (KZbin grazygrace does a video on it in more detail if anyone is interested.)

a azeem I'm assuming you mean like our types of degrees / law degrees. We have 3 types of law degrees. BA (3 years), LLB(4 years), and BCom (3years). But you can't qualify as a lawyer without a LLB degree, so it's an additional 2 years of postgraduate LLB if you study BA or BCom. You should come visit Cape Town. We have a beautiful country 🦓🐘🦒 and our currency is worth very little compared to first world countries so you'll probably get a lot for very little 💰 lol

Im sure I vaguely remember there being evidenvd that the gun had been shot from a height that imply he had his prosthetic legs on, which he said he wasn't wearing and wouldn't have had time to put on in this situation. This would mean he wasn't doing this in a panic, but had time to prepare before hand

Hi Eve- loved the video! Just a quick thing- sometimes the background music in this video is really loud compared to your voice, and as someone with a hearing immpediment, I really struggled to hear what you were actually saying because of that. If it could be a little quieter in future videos that would be really helpful!

She could add in subtitles to her videos since this one isn't open for community contribution, and her other videos could have the same setting on. It would take a while to put all the subtitles in, especially since this is a 30 minute video, but that would definetly help with understanding what she's saying.

my thoughts. one - she wasn’t on the toilet. she was protecting herself. her mother said that she thinks that Reeva was planning to leave Oscar. Perhaps she had told him this that night, which would explain the screams of an argument and Oscar’s crying. Also, if Oscar had spoken to Reeva, he would have surely noticed she wasn’t in bed as he walked between the balcony and the bathroom...

In Spain there was a big case surrounding the disapearance of a girl named Asunta Basterra in 2013, that was found dead the day after. She was adopted by her parents at the age of 1 and it was proven that they sedated her for months before commiting the murder. The mother was a lawyer and the father a reporter, both sentenced to 18 years.

16:37 Engineer here. Not sure if I understand the situation fully, but sound energy is concentrated (louder) within enclosed spaces, such as in hallways or alleys. Funnels, like horns or open windows, improve the interface between a source and the air at the cost of some of that energy. A field would be one of the worst cases, as much of the sound is going to travel away from listeners. Hope that helps!

There is a way to argue with it because anxiety is essantially unproportional or unnecessary amounts of adrenaline in our bodies. That state of panic is known to make our brain prioritize sight over hearing. He could have literaly be deaf when he shot the door. Of course it wouldn't make sense in his case since he could hear the "invasor" trying to escape

i'm south african but was never interested in following the news of this case while it was happening despite it being broadcasted and talked about literally everywhere, but you made it so so interesting eve i was hooked through the entire video it would be so cool if you did do the OJ case because it is another thing that's been talked about a ton that i haven't been invested enough to actually find out much about, and it would be cool to have those gaps in my knowledge filled in an interesting way

A good case would be the sewol ferry incident in korea that took the lives of hundreds of high school students. I was in grade 5 and wow did we discuss this. I remember a friend of mine telling us that her parents knew Oscar and that they weren't surprised. I was so upset that he got such a lenient sentence even though I was like 12/13 at the time.

The David Bain case from New Zealand is incredibly interesting from a legal perspective as he was originally convicted on all 5 counts of murder and spent 13 years in prison before winning his appeal and being found not guilty on all charges. There's a really good 10 part podcast on the murders called Black Hands and the case is very famous here and very polarising. Loads of problems with case including possible police tampering, sexual abuse allegations within the family, and weird timelines. People still don't agree on whether it was David or his father who committed the murders, it's really interesting to look at!

Yes the Bain case is very interesting indeed...everyone here in nz knows the facs lol bc it was the most expensive trial in Nz history costing the taxpayer a total of 11 million dollars. Can you believe he did not even receive any compensation for wrongful imprisonment after he had spent 13 yrs in prison !! Their family story before they all got shot and died is so fascinating - being teachers in Pupa New Guinea then moving to Nz and living the farm life...sounds so exciting!!

2:30 There's already a red flag right there. If you're in his shoes and you whisper to Reeva to get down and call the police, wouldn't you want to make sure she heard you, and will do what you asked her to do, before venturing into the bathroom area? The fact that any sort of acknowledgment from Reeva regarding his request to her, is missing from his story, is highly suspect.

There's show called 'The Innocence Files' on Netflix that examines cases taken on by the Innocence Project in America, and shows how much pseudoscience is involved in crime investigations and how unreliable witness statements can be (and also talks about prosecutorial misconduct). I feel like everyone should watch this show before jury duty. Your points about ballistics and food digestion reminded me of the pseudoscience they talked about. It all sounds really credible when you hear it as a non-scientist, but these methods are not exact (they can be pretty dodgy). bostonreview.net/books-ideas/nathan-robinson-forensic-pseudoscience-criminal-justice Additionally, I would question how exact witness statements can be when it was 3am, they probably weren't properly awake, and they had solid walls between them that would have muffled the sound. Not sure they'd be able to differentiate between male and female voices in those circumstances. This is probably why a lot of the circumstantial evidence was dismissed, and they just focused on whether he had reasonable intent to kill when sentencing.

Couldn't the gunshots wake them up at 3am and his loud crying be audible at such an hour I think they told the truth , and the forensic scientists would have been able to tell how long the food had been in her body.

@@josephedwardsarena9487 the issue with forensic science is that it's not a scientific discipline in the way that biology/chemistry/physics are, it's literally a huge range techniques across different disciplines to try and find evidence to convict someone in court. It's science invented to try and put people in jail, so it lacks a lot of objectivity and has a history of bad practice. This is explained in the first three episodes of the documentary series. Also the point wasn't that it was impossible for his neighbours to hear, it was that the circumstances of the crime and the conflicting accounts make their testimony unreliable. Human memory is seriously fallible, as shown in episodes 4-6 of the series (in the context of eyewitnesses). I imagine this is why the court made the decision to not focus on the circumstantial evidence, and the prosecution focused on the legal principle of 'dolus eventualis' for the appeal (yes, I looked it up on Wikepedia). Probably wasn't exciting or dramatic enough for a video though.

@@smk1460 well for now forensic science is good enough, unless better methods are developed we still need the discipline to ensure we're not incarcerating the wrong people, the defense is free to call upon specialists they deem important to the case so cross discipline aspect is rendered moot if the defense has reason to believe that there is something wrong with the forensic information and whatever the ratio decidendi was in deciding the case doesn't mean that the witness testimonies were worthless, they just said what they heard and that was invaluable information in my opinion going forward. Forensic science can only be improved upon not thrown out that's utterly unrealistic, we need to use science to know what happened at the crime scrne and bring the details for interpretation in court.

@@josephedwardsarena9487 How can it be good enough if it's not real science? The point of the documentary is that it's literally been used so many times to incarcerate the wrong people. Around half of the cases the Innocence Project takes on are related to issues with forensic evidence. We absolutely can throw out forensic science if it doesn't work, e.g. bite mark analysis, and we have to be really careful about drawing conclusions from techniques that aren't exact, e.g. stomach contents analysis (as this paper says pubmed.ncbi.nlm.nih.gov/2929541/). Anyway, I don't really want to debate about it, I just wanted to draw attention to the documentary series and the issues it talks about.

I just wondered, couldn't have (or did?) the defence use this line of reasoning to refute/explain the forensic evidence. Oscar Pistorius and Reeva went to bed at 7 pm. Oscar claims, when he woke up, Reeva was awake. Couldn't have Reeva woken up earlier and eaten while Oscar was sleeping. An alternative explanation to the food contents found in her stomach. If I was defending I would try to argue this. I'm not saying that this is what happened, or that I believe he is innocent. I'm not. I'm just wondering if this was or could have been used.

I suppose it's because who was behind the door was irrelevant because it was still have been premeditated murder. The forensics evidence was mostly likely used to discredit Pistorius' statement.

Abe Bennett i get your point, I guess there would be a difference had he wrongfully - but reasonably - assumed that he was acting in self defence. Perhaps they couldn’t make this argument because shooting someone four times is excessive, even in self defence. Plus, it was not reasonable of him to assume that it wasn’t his girlfriend

Love this! Please do this for other notable cases, it was awesome! You know, you might like to look at the Pell case in Australia, where the High Court overturned a jury verdict, which at least in Australia, is really rare. Not only that, but the Supreme Court (trial and appeal divisons) found Pell guilty. Yet, the High Court decided unanimously that there was reasonable doubt.

I recommend the case of James Bulger. It was one of the most heartbreaking cases I've ever read about, and I think it's really important for everyone to know about it as the murderers of the case are still controversially living in society with signs of relapse. I totally felt the adrenaline rush when you were explaining this and the fact you actually tested out the expert evidence really blew my mind - great job! I totally understood the context as I am doing my Bar Exams now and my gosh, this is just such an experience. I guessed if you wanted to look at some interesting cases, perhaps some cases from the Innoncence Files (it's on Netflix) would be a great start. The show illustrates the cases took up by a pro bono department set by a University who takes cases to liberate prisoners who were wrongly incarcerated solely based on expert evidence which may not be accurate. For the food argument, isn't it possible that she got some more food while Oscar was asleep? Oscar did say that she was awake so maybe she got hungry and had a snack? I don't belive this, he's obviously guilty but it's a possible argument I think.

I remember this case vividly, as it was absolutely huge in South Africa when it happened, and I followed case updates daily on the news and on Twitter. I remember that on the morning after it happened, radio stations started reporting that Reeva had tried to surprise Oscar for Valentine's Day by sneaking into his place and that he mistook her for an intruder, and I remember so clearly feeling so sorry for him, that what was supposed to be a Valentine's surprise turned into something so awful. Also, as crime is such a huge problem in South Africa, we could all immediately relate to being afraid of someone breaking in and causing harm so of course initially I felt very sorry and sympathetic towards Oscar. That is, until the facts of the case starting coming out... This video really took me back to that time, and how consumed I was with this case! You did a great job! Would love to see more of this type of content in future!
