i do like this, but I feel like the ad placement was completeeeeeeely off tbh. it felt too light hearted a segue in a tragic case - literally mentioned fatal offences just before, maybe beginning or end next time!

Just an early note to say, I'm incredibly aware of how serious this case is and the sensitivity of the topic - as with any situation that enacts criminal law. I'm hoping this series highlights & educates about how the legal system and courts of law look at case facts to establish causation and sentencing. There are also several relevant outcomes of this case for gun reform and safety protocol, which are important reflections. However, please do give me feedback if you think content surrounding serious criminal prosecution does not have a place on this channel. As a former law student, I'm aware that I'm largely desensitised to topics such as this (after spending at least 1 year undergrad looking at 100s of murder cases) - and so want to appreciate if this does not have space. Thank you!

I would say (as somebody who has also studied and worked in criminal justice) that monetising content like this that concerns real people's lives and suffering and especially making a video on something so recent around which the pain is still so fresh for those intimately affected is ethically iffy. I'm personally not comfortable with it and have opted not to watch and to unsub for this reason. I'm sure you have interesting insight to share and that this video skews more educational than entertaining, but from the few minutes I did which, the light-hearted tone also didn't really sit right with me. In the end, it's entirely your decision whether you'd rather move forwards with this series or share your expertise in other ways. I hope this comment comes across as constructive and respectful.

As long as there is some educational value to the video and the people involved are treated respectfully and fairly - like it felt for me in this case - I have to say I enjoy watching them. It gives me insight into cases that are being discussed by media outlets (most of the time sensationalised and without proper legal knowledge). It also teaches me about different legal systems, which I find increasingly important the older I get because it does inform so many of our political and social debates. It is horrible that this happened. But it did happen. And i prefer them being reported on from a legal pov and a focus on the influence big cases like these can or will likely have on all of us. However, I have to agree that putting a sponsored segment into this video feels off eventhough I do understand that it is probably not possible to spend so much time on a project without some compensation.

I’m also from a field which deals with sensitive situations so it’s not the subject matter itself that I find off-putting as I don’t see it as a question of desensitisation. I came over to the video after being quite struck by Eve’s comment of “It will keep you entertained” on her IG story but I wanted to withhold my judgement until I watched the video. I do think that the tone of how true crime is handled nowadays often feels off but I can see how that may be subjective while the point of monetisation is very valid. There’s something dystopian about segueing from an ongoing case by linking it to defence against criminality in the form of Surfshark. While it’s more comforting to tell ourselves this content is simply educational, in all honesty it feels closer to morbid curiosity. All that being said, I’m glad to see that constructive criticism is being welcomed here. I recognise that not everyone will find this unethical but it’s good to have these discussions nonetheless.

Here are a few suggestions, either include ads at the beginning or at the end and/or maybe don't do segway related to the video, doesn't feel good. Apart from that a great well researched video, I'm sure you'll find more stronger stand and voice navigating such videos

Why chose this music😭 At first it‘s like a movie scene, creating tension before someone in a movie gets shot. And then in the explaining part it’s super cheerful?!So inappropriate for such a tragic death! And also way too distracting.

found the lighthearted editing and music to be a bit out of place here, not to mention the uncomfortable segue into the sponsor read. understand why you wanted to make this video with a legal perspective but with the case being so serious and so recent, it didn’t really feel appropriate for what is usually a pretty personal and light youtube channel. just one opinion because i know a lot of people enjoy true crime. it just feels ethically questionable to me, especially monetised :/

Editing and music, perhaps yes. But the sponsor and monetisation, no. Eve has produced an in depth video about the case and is using her legal knowledge to educate people. To expect her to do this free of charge is ridiculous. She’s delivering a service and is entitled to be paid for that. Having said that, the placement itself of the ad and how upbeat it was did seem inappropriate.

I totally agree with other comments about the tone and editing of this video. I’m glad I’m not the only one; felt so surreal and not what I would expect from this channel. As a fan I enjoy hearing about Eve’s new eras and life updates, but seeing her walk in cheerfully immediately after seeing someone’s year of birth and year of death flash across the screen was jarring to say the least. Others have already commented on the strange ad intro and upbeat background music, so I won’t rehash that. Someone said it could be due to a new video editor? Hoping that’s the case! Regardless, I don’t think it’s an issue with the content itself; just the execution. I’d love to see more of this type of content as the analysis itself was very interesting!

Agree with this. I felt iffy after the smiling intro after seeing someone’s death date on screen. Then after seeing an animation of how someone with killed there's then an Ad? And the upbeat music + smiling for a discussion around how someone died, it just all felt very icky

I think we've got to take into account (she's already released a statement about this) that she was a law student. I understand your point, but we hear cases like these or even much worse on a daily basis for a year that our module runs throughout. So it is expected that we get desensitized about these topics. The focus and purpose of this video (as I see it) it's not so much for entertainment as per most of her previous videos, but rather educational, and I think the tone was correct; it was straightforward, clear and precise. However, I do understand your point and I can empathise with all the comments. Also, I presume the editor is more or less in the same position, he is given a task to make such heavy content based video into something more gullible, so the music I think it reflects that, It's merely background music and I don't think its because of a lack of professionalism or anything of the sort. Having said that, I'm sure Eve and her team will take into account all the feedback and make sure the next video of this series will reflect all of the feedback!

Hi Eve, I have been a subscriber for a while now and have seen you do some amazing research. This video felt kind of off for some reason. One of the viewers commented as well on the way you introduced the sponsor of the video. I understand that this KZbin channel is what a part of your income comes from, but that viewer gave a great suggestion to either put it at the very beginning or end of the material. Overall, I am curious about this series, it is a bit in the grey zone regarding moral and if content like this should be sponsored/monetized but I think, this being the first one, the feedback on this particular video can be a great foundation for all that is to come. It is good to see you back, making legal content again, we really missed it!

really appreciate the research and explanations that you're giving, but i think the music isn't the best choice here (esp. during the murder v manslaughter section). and as others have said, the ad inclusion was very jarring.

Hi Eve! I’m a big fan of yours and I see what you were doing with this series and I think it has so much potential. I love creators like Kendall Rae, Bella Fiori, Eleanor Neale to name a few who cover true crime. I think with your legal background you’ve definitely got the potential to mirror these creators with a new perspective. However the editing, your tone, the music and the advert in the middle felt quite out of place and slightly disrespectful to Halyna. Potentially the tone was a little too jolly and humorous at times too? Please don’t take this the wrong way and maybe it’s not my place to say but just constructive feedback to this new era of your KZbin. I have admired you speak so candidly and respectfully about other topics so I’m sure it’s just teething issues but I felt I wanted to comment and I hope it’s as respectful as possible.

I agree with the other ones. This kind of editing and style fits with talking about let's say drama in the royal family or very stupid court cases where no one was brutally murdered or a tragedy that traumatised many people. It's totally fine to do a video essay and discuss public topics like this but please adapt the style in a respectful way du to the fact, that many families and individuals have experienced severe trauma which they have to live with now

Little correction: a civil case is not only decided by a judge. Based on the 7th amendment, civil cases "at law" have a right to a jury trial. However, civil cases "in equity" do not.

Yes, a defendant can choose judge alone or by jury for a civil case. Also it is the burden that separates civil from criminal cases. Civil cases are based on the preponderance of the evidence; whereas, criminal cases are based on beyond a reasonable doubt.

I think I was more put off by the ‘this is gonna be fun’ preface. Maybe because cinematographer is my dream job but Halyna’s death just seems so tragic to me. Even without that, true crime cases where the victim literally never saw it coming/ couldn’t really prevent it always makes me more sorrowful. I feel bad for her family especially her son. Everyone has chosen to make this case about Alec but Halyna deserves a solemn and considerate introspection. It’s just absolutely horrific what happened to her.

Hi Eve, I never comment and am sort of an invisible subscriber on this channel, but have been following for a few years from when I briefly flirted with the idea of doing law. I just felt the need to voice my opinion on this, which is that this video sort of feels off. Immediately from the intro everything just felt a bit ‘doing tiktok dance while captions pop up describing Ugandan genocide’ if you know what I mean lol. Even in cases which are decades old, I still feel a bit weird to see people making chipper videos in an almost marketable tone about people who died, and who died tragic deaths. I could just be misreading the tone in your voice etc but what I’m absolutely convinced of is the placement of your ad. It really should’ve been left to the end of the video. I think that the turning of this tragic incident into a punny segue into a VPN ad is just quite...disturbing honestly and is not what I expected to see from you. Still an informative and well-communicated video, but I just think it’s a bit insensitive in places. Just my two cents. Which you didn’t ask for. But here we are.

Something that consistently gets lost in discussions of this case is that Alec Baldwin was a producer on Rust. As a producer - especially a producer with as high of a profile as Baldwin - he was responsible for EVERYTHING on that set. He would have signed off on the hiring of all personnel. He would have signed off on budgets and where money was allocated (I.e., whether there was more money for safety personnel or more money for the actors’ salaries). He would have been informed of the unsafe working conditions AND was responsible to see them corrected. When something goes wrong on a set, the buck stops at the producers’ offices. So while it’s not Baldwin’s fault that he was the one holding the faulty gun when it went off, it absolutely is his fault that there was a faulty gun on set at all, and it’s his fault that safety protocols were so ignored that that faulty gun could be loaded… and yet declared to be cold.

As a complete side note, this is also the reason that Steven Spielberg should have been held liable for the deaths of Vic Morrow and two kids during the filming of the 1982 Twilight Zone movie.

Do we know what kind of producer he was though. Producers are different. Some are in name only. Some only handle creative stuff and others deal with every aspect of the film. If he was the latter than he would have more responsibility

I will echo what others have already said: I enjoyed the information in and the format of this video and would definitely be interested in seeing more like it. I also think an ad shouldn't be put right in the middle of such a heavy topic - as others have said, it didn't fit the tone and didn't sit right with me, given that these cases came about due to someone's death. Another channel I watch regularly says, "this video is sponsored by XYZ, but we'll talk more about them at the end" which would be a much more fitting segue if you need the monetary support. I would have really enjoyed more background around the other people involved. Lots of people were introduced but really only half of them were mentioned with the civil cases, and it felt like some information was missing or unclear. Again, I find the idea interesting and would watch more videos like this*, but I think a few things need to be tweaked to make it even better. *edited a letter

Great video! Didn't know about this case. I'm curious about why is everybody trying to blame Alec and not other crew-members such as the Armourer, Props Master, Director... Like, even if Alec pulled the trigger and killed the woman, he is "just" the actor of the scene. He was not really responsible for the what the gun contained, because someone else has the job to check that. You can argue he was not careful enough, but it's not his job to check the guns or props. His job is to act with the props he is given haha.

I could imagine this situation happening in other cases. For example, many movies use swords. If the actors are told these don't have cutting edges by the Armourer and Props Master, but then there is an accident on set because the swords actually did have cutting edges, I don't think I would blame the actors. They were just doing their job (acting) while others (Armourer/Props Master) weren't.

@@CataSaini1 Alec Baldwin is not "just the actor" of the scene. He is also one of the movie's Producers, which makes him one of the people who is responsible for the actions of all the crew members, including the Armourer and Prop Master.

He has responsibilities as a producer and as someone handling the gun. But it seems like the heaviest responsibility would fall on the armorer. And she seems to have been quite inexperienced and a bit arrogant.

obviously I agree that the armourer and props master also bear responsibility here. but he was the one who pulled the trigger, and I think this would fall under involuntary manslaughter. no he didn't mean to kill her, he was just doing his job as an actor, but that did result in her death. so no it's not first degree murder, but someone did lose their life. I don't think Alec should be the only one held responsible for this, but he should be held responsible nonetheless.

I really liked the video. Thought it was succinct and got the legal points across. There was the small inaccuracy on civil cases being heard by only a judge. That is the case in England and Wales but in America there is the possibility of a jury trial in a civil case (though I don’t know how this is decided).

As this is such a serious topic I would try to keep a clear distinction between the case and an add. The font and editing was a bit too light hearted and felt a bit like you were introducing a sitcom, rather then breaking down the case. The content itself was very clear and easy to listen too which is one of the reasons I love your channel

it is an educational video not a tribute to the woman who died so there is no need to be solemn. If the editing was really 'dark' then the video would be less educational and just a bit bad. She was outlining the case - if i was the family of the victim this would be fine - she was showing why what happened was wrong, not encouratgain it

Viewers should definitely read her comment before watching the video. Her discussion of the case was brought forth with the most respect I personally believe was necessary for a legal analysis. As a prelaw student, I know it was shocking to sit through my first lecture talking about harsh topics with what seemed to me as insensitivity. However, law requires legal analyses to be conducted from a detached viewpoint. This generally gives way for people to note the facts as they apply to the law. This does not mean that she or any other legal professional does not care or realize that events transpired with serious psychologically damaging issues, it just means that’s not what they’re observing at the moment, aka not their job. She, as well as many other legal professionals, are entirely capable of giving the case the emotional attention it is ALSO required, just…in a different setting, ie therapy, or just not a legal analysis:) just my two cents

Hi Eve! Just going to reiterate some of the other commentators’ concerns regarding this video’s tone as well as the choice to use and the placement of the ad. I understand the need for monetization, but I agree that the transition was a bit iffy and if you are going to include an advertisement, placing it at the end of your video would be the most appropriate option. I also wanted to add a few of my own thoughts regarding the current choice (and potential future choices) in subject material. Via this channel and through your social media, you are a content creator and influencer - the content included here ultimately serves to promote your overall brand, which is understandable. However, the “influencer”ifcation of true crime is a significant issue, even for cases that are decades old. This tragic accident happened, what, less than a year ago? It’s so fresh, that there’s even more need for the topics to be handled with extreme care. Which goes back to the issue with this video’s tone, even the thumbnail for this video rubbed me the wrong way in this capacity (and I’ve already discussed the ad). If you continue down this path of videos, I’d recommend you be EXTREMELY critical in the editing process and make sure you aren’t sensationalizing and/or acting flippant about topics for the purposes of creating content. As such, I would recommend steering away from topics dealing with death, abuse, etc. You work within tech, maybe you can find a way to focus on cases within that sector? That way it’s relevant on multiple fronts. Finally (and I promise this is it, I know I wrote a bit of an essay here), I need to explicitly speak out against a topic I’ve seen suggested in the comments. Please do not try and tackle the Depp v Heard defamation case. The memeification and “trial by TikTok” has been truly nauseating. I did my best to avoid and/or block literally as much as I could from that case, but still, the memes and the jokes and the fan cams permeated my social media constantly, and has been incredibly triggering. Your decision whether to include the case in your series is obviously yours alone, but if you do decide to do so, I will have to unsubscribe. A drop in the bucket, I know, but I needed to voice my concerns. If you see this comment, thank your for your time. I’m encouraged by your responses to other commentators, and hope you are able to find a way to incorporate/address our concerns into future videos if you continue with this project.

I totally feel the same about the idea of a Depp vs Heard video. That case has already been everywhere for so long and even if there is a new, interesting legal perspective/exploration Eve can share on it, I wouldn’t be interested. I would like to see more of this series though, but definitely with your feedback in mind!!

Although I believe Alec has very little responsibility for her killing (I believe the blood is on the safety and firearms peoples hands), he should be charged with involuntary manslaughter. In the same way someone would be charged with the same if they killed someone in a car acciden

To add, I hope it is found out who surveyed the gun, finding the information that it was a “cold gun”. That person is mostly responsible for this. As well as firearms and safety people who should have been the ones to check, double check, triple check, quadruple check.

Hi Eve, thank you for researching into this incident and legal context in New Mexico. This consolidation of facts and law really help us to understand the case more fully. As there are many civil actions still ongoing, is there any reason why has been there is no joinder of parties (i.e. multiple plaintiffs join in an action if each of their claims arise from the same event) in this case where the issues or parties involved overlap sufficiently?

I actually really enjoyed the content of the video; being walked through the legal jargon and implications of such a high profile case in a non-patronizing "explain it like I'm five" way was really helpful. However, I agree with many other commenters that the editing choices (upbeat music, sponsorship in the middle of a serious discussion) made me feel a bit off while watching. I completely understand that you're just getting started with a dedicated research and editing team and there will be growing pains, just keep these comments in mind for your next installment in this series. Love your work, can't wait for your next uploads!!

I personally really enjoyed this video. I hear the concerns about the topic being sensitive but I don't see the issue with monetizing videos that educate people about the law and break down the facts about cases (and especially cases like this that are highly publicised and sensationalised). There is a place for this type of content on your channel in my opinion. Maybe keep the ads at the beginning or end of the video and change the tone slightly but other than that I think it's great work as always!

Loved this style of video and find your thoughts really interesting and the herd v depp case has highlighted even more a need to learn more about law. However, I do agree with other viewers that the ad break seemed off and insensitive. I understand monetisation and want to support that but an ad at the beginning or end would be better suited. Hey Eve, I thought you handled this video quite well. It felt educational, you didn't add any personal opinions about potential rulings or faults without being directly within your wheelhouse (e.g. it's not murder because it wasn't premeditated). You laid the facts out to see and I did learn something about US law! I do understand others' concerns though. Do you think you'd be willing to donate a portion of the proceeds of each video to some form of legal aid charity? This way, although you're profiting off making an entertaining video, some of it is going to assist people dealing with the judicial system. It might make this series a bit less controversial. Regardless, I enjoyed this video and will continue watching :)

Working within the UK television and film industry, I was taught that if you brake the rules (in the legal sense): Yes, you can be held accountable, but it also falls on the production company (and director of the production) and its something I've not really heard discussed much in this case. Yes Baldwin fired the gun, but a couple of people within the crew failed to their jobs and keep things safe. The buck stops with the director (and in this case, in safety terms, the Assistant Director) and they were negligent. From a personal standpoint, I believe Baldwin should face some charges, because accident or not, someone has died as a result of his actions; I also believe the director/Assistant Director and the Production Company should face consequences.

the only reason you were able to make this video and monetize it is because somebody died in an extremely tragic accident. someone lost their life so the ad in the middle is extremely off-putting. i understand the need to make money from the content you produce, but when the only reason you were even able to make this video is somebody’s death, it feels in poor taste.

With the civil cases, Alec will obviously be held at fault, but IMO it should be under his production company rather than as an individual, because his fault more so seems to fall under production errors. The props/armor staff would logically be brought as individuals under civil cases, and they seem to be more responsible for this specific incident. The fact that this incident wasn't the first firearm incident of the shoot, and the fact production did not seem to intervene, appears to be the issue
