Is there currently a retro based system to assist creators with retrieving unpaid historical royalties. Is there a statute of limitations on royalty payouts? Is there a 3rd party company who audits the PRO’s, digital distributors, and publishing admins.

In one of your videos you stated that a bmi member should also have a publishing company even if that member has a publishing administrator. Long story short, I'm a songwriter registered with bmi and I'm signed up with Tunecore publishing administration. Tunecore says that I shouldn't register my compositions with bmi once I register them with tunecore. According to Tunecore they will register my compositions with bmi for me. 1. Do I still need a publisher account or publishing company with bmi though I have Tunecore publishing administration and, 2. Should I still register my compositions with bmi after registering them with Tunecore publishing administration?

Enjoy your day and to help with your sleep a few drops of lavender oil near your bed or on the pillow will help or fresh lavender ( if you like the smell) , also eat some lettuce b4 you sleep or blend some and drink. Also look into Diatomaceous ( spelling may be incorrect ) Earth , which you take in water, juice or a smoothie is meant to aid good sleep and has MANY other health benefits . Would imagine you probably already know about all these things . Take good care : )

Another fire video! And yes I shared. Now for my questions. Could you talk about price points for tracks and stems? What would be a good range for an up and coming producer that is asked about his or hers rates? Should it be a per hour type thing or a lump some? I’ve heard some producers say they will treat the creation of a track like a job. Example: They work 10 - 14 hours per week on a track at $50 an hour and then charge the buyer $500 or more for the track. Or, I have heard some producers will just put a flat rate on the track and charge anywhere from $500 to $10,000 or more. It just seems that someone just starting out should start with a feasible rate. Thoughts? No rush at all because I know you are ridiculously busy. We all appreciate your guidance. Peace!

Tynia, Thank you for the video. I am new to the music industry, and I need to speak to some one who can set me straight on all the royalties and copyright issues. I am a cover musician, I play classical guitar. Most of the music I play, and record, is in the public domain, having been written before 1922, as I learned from a website Distrokid sent me to. Some of the music I play is "anonymous' the composer is unknown; also called 'traditional'. This music is in the public domain, but are there any copyright issues I should watch out for? And what about the book that I got the sheet music from? Do I owe royalties to the book publisher or author for any of these pieces in the public domain? Some of my material is copyrighted, and I understand I have to pay royalties to use that. Do I owe anything to the book publisher and author in that case? If I make an arrangement of a copyrighted work, do I need to write it down on paper? I understand my arrangement can be protected by copyright, so if I perform it on a sound recording, I can get some royalties for that, while still having to pay royalties to the copyright owner of the original work. Should I clear my playlist with a lawyer before recording ? Thank you so much for taking the time to read this.

Hi Tynia I was wondering if you could do explain how to split the. Song because I notice that BMI does a share of 200 as opposed to the flat 100 figure. Also what happens if only one songwriter registers their share in the song but not the other songwriters does that person get paid regardless of whether the other songwriters registered the song with their own PRO's or does one only get paid after everyone registers their splits? I would really appreciate your feedback on these two questions when you're able to respond I completely understand your hectic schedule 🙏Thanks a mill

Master Recording royalties and, owning the Master Recording......... that answer is not clear in my head........You are the singer only, do you get Master Recording Royalties or, do you own the Master Recording, equally with the composer/producer or, both, only as the recording artiste ????? there seems to be a difference, 1. getting master recording royalties and, 2. owning the master recording.

Your answer for question 1 should be the performer gets mechanical royalties period ..secondly a person that doesn’t write the song and just perform the song cannot get writers credit ..you perform it same as a actor a actor does not get credit for the scrip of of a movie ..next thing the you if your the performer and it’s your voice on the record and you didn’t write the song you can’t own any part of the mastering of that song ..this is why a producer or record company can easily get someone to cover the song and when it’s cover by another artist the original perform doesn’t get anything ..all of what your talking about is under the copyright law i am not taking away from your knowledge of the publishing area of the business but this what your talking about is all under the copyright law two different things in a sense ..if you go to court as a perform and demand all this extra money for credit for writing and son on and having a % of the masters and you did not contribute to the melody or written content or the any part of the beat to the song you perform your claim will not stand...that’s just facts..love your channel as always and this is what it is all about learning from each other I hope you have learn this much from me as I have learn something about publishing from you and if is one thing I know is the copyright law when it comes to music music business.
@tyniacoats
@tyniacoats 5 жыл бұрын
I appreciate your info too, but that is actually not correct. Mechanical Royalties get paid to PUBLISHERS and publishers then pay out to writers because that is who publishers sign. In regard to your statements about master recordings, I was answering a question for a performing artist who will be performing songs from HER OWN album/EP, not a cover of someone else's songs. This is not the same situation as what you're talking about. & just FYI, many big name artists who do not technically write their songs, give themselves writers credit even though they did not technically write the song. As long as the writers/producers are ok with this, it is fine. I worked for the biggest performing rights organization in the world and dealt directly with royalties and copyright in the US and all over the world internationally. I've seen the contracts of many of the biggest names in music and am well aware of what can and cannot be done. You don't have to take my word as gospel if you believe otherwise, you are definitely entitled to run your music business as you see fit! I'm just educating people with the knowledge that I have.
@damonsta80
@damonsta80 5 жыл бұрын
Tynia Coats yes I wish you had made that clear (only if the writer or producer is ok with them getting credit )..you made it sound as if the perform can just automatically do it on their own in the video and it’s not so ..you have to make it more clear next time but see how you took the time and think when you wrote back your thoughts here are more clear and understandable ..but in any case I agree with you ..a performer can get extra benefits only if the writers or producer agree to let them have some shared rights..also mechanical right does pay out to the to whom it is listed to ..publishers ,writers ,producers and the perform ..whom ever is filling out the sheet when doing it for a song must put the perform name included this is so that on paper you BMI /ASCAP know who is the performer on it ..and every time that record is played the perform gets something from the mechanical that’s comes in ..the label should make sure of that once money is paid out ..for example a well known international artist which I won’t name ..I have seen where she has nothing to do with the song that she sung but only to perform it and still collect a check from mechanical rights pay out period ..so radio plays ..streaming and downloads a % of those goes to the performer(who didn’t write or produce the song) ...now some label don’t do that and that’s cheating the performer but when exposed in court will be force to pay a % of that back to the perform because as long as the paper work is done correctly everyone involve in the song will be covered.But love your channel once again and you and I know this is music business and it’s ever changing and from laws to music it is all ever changing so keep up the good work I see and feel ya ..much love sister I support you bless.

As a songwriter I have to say there is no way in hell i will let an artist take any writer royalties or put their name down as a writer. I get writer credit, the publisher gets the publishing and the artist get's their share . I pitch songs to the Nashville scene writers don't share writing credits with anyone who did not co-write the song. Nor will they let the artist make any changes to the work. Otherwise every singer out there would be making changes to lyrics when they go into the studio and then try to claim writer's credits.
@agentcalm
@agentcalm 4 жыл бұрын
@Anne Day That's true Anne..but you only get a third if the writer gives permission. No one regardless of how famous can simply change a lyric, call the writer and say they want a share of the writer's royalties. It is true that a lot of writers allow the artist do this just to get the cut. They feel getting a cut is worth surrendering some of their royalties. Me? I wouldn't agree to it personally.
@agentcalm
@agentcalm 4 жыл бұрын
@Anne Day Im not actually from Nashville but regardless of location...go to about 3:25 to 4:30 of the vid. She's answering the first questions and says "a lot of artists dont write but end up getting a share of the writer's royalties". Not without the writer's consent they wont. She then advises the person who asked the question to always get you name on the writer's share. She even advises to make a change when recording the song so you claim you were part of the creation. Again, I'm simply making the point that if you were an artist recording a song I wrote and you came to me having listened to this girl and said "I'd like to change a couple of lines and get a share of thew writer's cut". My answer would be no. You can have your artists normal share i.e. mechanicles but you are not a co writer. Anyway. I'm done here Anne. We probably wont see eye to eye on this and these forum arguments and can go on. Have a great weekend.

@@agentcalm @Xave, do you know how arrangers get paid? since I understand arrangements are entitled to copyright.
@agentcalm
@agentcalm 4 жыл бұрын
@@brianhiggins4614 Hi Brian. I'm not actually familiar with that term. Do you mean arranger in the same way as production? By default no one is entitled to copyright except the writers. I have heard that some of the top producers manage to get deals whereby they do actually get royalties. Perhaps their argument is that their production skills are part of the creation of the work. But I'd say it's only the very top guys manage to pull that off. Mind you, there are a lot of producers who do actually co write with the artist. Taylor Swifts producer has co written some of her hits to the best of my knowledge.
@brianhiggins4614
@brianhiggins4614 4 жыл бұрын
@@agentcalm I think I need to speak with a lawyer. I play and wish to record music which is in the public domain, but the sheet music I am using is a specific arrangement that some one published in recent decades. In some cases the music was transcribed from violin to guitar ( my instrument). From my brief study of copyright law, I have seen that arrangements can be copyright protected. From : www.copyright.gov/title17/92chap1.html 103. Subject matter of copyright: Compilations and derivative works (a) The subject matter of copyright as specified by section 102 includes compilations and derivative works, but protection for a work employing preexisting material in which copyright subsists does not extend to any part of the work in which such material has been used unlawfully. (b) The copyright in a compilation or derivative work extends only to the material contributed by the author of such work, as distinguished from the preexisting material employed in the work, and does not imply any exclusive right in the preexisting material. The copyright in such work is independent of, and does not affect or enlarge the scope, duration, ownership, or subsistence of, any copyright protection in the preexisting material. Arrangements are derivative works, and the only copyright the arranger can claim is their contribution. How such an arranger ever gets royalty for their contribution is not at all clear to me.

I giving people crappy advice. You didn’t write the song you get nothing. Switching it up a few things don’t make you a writer. I can tell you don’t write. Do you know what coming up with a concept, a melody and finding the right words are like. Especially when you craft meaning into what you do. You have to be huge to ask me for that cause your brand would sell the song by itself.

I am actually a songwriter, so your assumption is wrong. Whether you want to believe it or not, many big name artists give themselves some of the writers credit even though they did not truly write the song. & they do this for the very reason you just stated in your own comment, b/c it is their brand that is selling the song! I also mentioned that if a writer/producer takes issue with this, then they can just negotiate publishing credit instead. It's a business and all open for negotiation, which is how there are so many cautionary tales in the music industry where many musicians/writers/producers end up getting NOTHING. But hey, I'm just a girl giving "crappy advice" with years of experience working on the inside. Who am I to tell a commenter who provided no credentials, who came on my video, that they are incorrect? :)

You are right. They can ask. They are not changing anything on my song. They are not owning anything on my song. That’s why I don’t even bother approaching recording artist anymore. It’s easy to take something that’s already created. The melody, personality, the emotion the concept. Easy to come along and say you want to change something just to say you write something. Easy. But never understand the cost of writing that song the emotional time and sacrifices that go into some songs. If the song has value to the singer it has value to any singer who can sing that song. If you do have a brand like Beyoncé we can talk about it a little. But since I don’t write simply for money it’s not a long conversation. Yes your advice is good for majority of people but I guess not for someone like me. So calling ur advice crappy is harsh. Cause am the walk away from the cash type. And since I don’t even write for artist that’s not working for me directly I should have kept my fingers still.
