To be clear, he doesnt NEED a new firm of solicitors at the moment. Complain, then raise it through the Legal Ombudsman.

If you have a car accident and the party at fault is insured by the same insurer as you then could there be a conflict of interests if the solicitors appointed to represent you are being paid by the insurer who may be looking to minimise how much you receive or, to avoid it altogether by dragging it on until the deadline has passed. Not saying that's what's happened here, Sounds like it's incompetence rather than intent.... but also, I assume the lawyers fee is not dependent on getting a result because if it was I suspect they would have settled this case for the caller within a year.

They wait for the absolute last day of their 3years to raise court action. I experienced this by relatives in accidents and working in a PI firm. They generally do a deal to avoid action but both sides run down the clock to eventually settle on common ground.
