I am fighting one case for 11 years and after having a decree from Delhi High court I been told it could take 4-5 years to execute degree. Delhi courts are worst then even African countries. Shanti Bhushan complied to Raj Narain's eccentricity which precipitated the abysmal crisis. It was a v.difficult time when India was reeling under economic crisis, threat from Pakistan, refugee crisis, global financial & oil crisis. At that time these fellows wanted to dethrone Indira Gandhi through unconstitutional & undemocratic means. Emergency proved clearly that a Prime Minister's position in such a critical condition cannot be overthrown or debarred. This is to be understood very clearly without any doubt.

In India "The Emergency of 1975" refers to a 21 month period in 1975 - 1977 when Prime Minister Indira Gandhi unilaterally had a State of emergency declared across the country officially issued by President Fakhruddin Ali Ahmed under Article 352(1) of the constitution for 'Internal disturbance', the emergency was in effect from 25 June 1975 until its withdrawal on 21 March 1977. The order bestowed upon the Prime Minister the authority to rule by decree, allowing elections to be suspended and civil liberties to be curbed for much of the emergency, most of Gandhi's political opponents were imprisoned and the press was censored. Several other atrocities were reported from the time , including a forced mass-sterilization campaign spearheaded by Sanjay Gandhi, the Prime Ministers' son. The Emergency is one of the most controversial periods of independent India's history.

I was a kid in 1975 & remember the heard about the terror of Emergency from seniors. After 43 years when I see this video, it seems to me- (1) What was the role of Election Commission of India in the whole episode? An 'electoral malpractice' is primarily a prerogative of the ECI. Was it a party in the Allahabad HC? What was their say ? Why these Rajnarain & others did not draw the attention of the ECI during the occurrence of the said malpractices immediately and waited till the results were out? Doesn't it expose their 'crooked intentions' of 'Entering the Parliament thru the back-door'? (2)The ground on which the election of Indira Gandhi was declared invalid were mere 'Flimsy legal technicalities' and the actual 'Peoples mandate' of Raibereli was subverted. It is 'most improbable' that the insignificant 'electoral malpractices' committed by IG had earned her a margin of more than a hundred thousands! Even without those, she would have won it hands down. (3) I agree with the Bhushans that it would have been much more magnanimous for IG to stay away from the parliament till the SCI has pronounced its verdict and then, act accordingly. Even If she was ousted as an MP, she could have continued as PM up to 6 months before getting herself elected in a bye-election, as she did later in Chikmagalur or in the Rajya Sabha, and come back with enhanced glory. Emergency was indeed, a bad and suicidal decision putting a black-spot forever in her brilliant career as a PM with so many feathers in her crown e.g. Bangladesh war, Nationalization of banks, Nuclear Power and so many. The State Terrorism unleashed during the Emergency was deplorable. But, I think, Indira G could have spared it, had there not been her blind ego & the malevolent persuasions of her son & her coterie.

Shanti Bhushan admitted to an unethical conduct on his part! During cross-examination, using a tone that would lead the witness to give evidence in favour of the prosecution/applicant, thereby taking the facts out of the issue being argued upon. Facts that are material and necessary to ensuring justice is rendered. Indira Gandhi might have lied to the court. But Shanti Bhushan also didn't want the truth be told.

Yes, but why should Shanthi Bhushan emphasise that he intoned the question in a way that suggested the amendment was illegal, and so corner her into denying she gave consent. That tactic clearly did not seem to register with her, because she admitted she HAD given consent. She scored an own goal due to her own assumptions / ignorance (actually that's on her counsels). Having said that, whether she had said yes or no, the result would be the same: invalidation of her election. Of course 'yes' proved she was guilty of using state machinery for her political ends and that attracted its own penalties ...
