Recap of the bistory between this store and my business earlier this year: • New Dollar Store Wreak...
This week at the RollingOps Dumpster shop, we're dealing with a leakier situation than a truck with a blown head gasket! The new Dollar General next door decided their building plan apparently didn't include proper drainage. Now, every time it rains, their runoff floods right into my shop doors! Muddy, dirty runoff that doors right under my garage doors.
Clogged drains, overworked sump pumps - it's a nightmare causing major problems for my equipment. Look, I appreciate the business from some of the contractors using my dumpsters, but whoever's in charge at the big wigs level needs a serious reality check.
This isn't the first rodeo with these folks. They've already pulled stunts like removing gas lines from my property, turning on the water meter in freezing weather (burst pipes, anyone? This is actually the second incident that flooded my shop), and treating my parking lot like their own personal equipment storage.
Enough is enough! This flooding situation is the icing on this overflowing dumpster fire. Time to hold someone accountable!

I would not talk to ANYONE else about this, I’d be quietly talking to my lawyer. Get estimates from restoration companies to clean up, add up drain cleaning, sewer jetting, painting, flooring, your time, all of it…thats the cost to them EACH time it floods unless they fix it.

Call city and ask for code enforcement. Rain water and soil erosion are hot topics at multiple levels. Take picture before you fix anything! Ask why an elevated building (to existing) was allowed without a 208 between their building and yours??

i agree city should be called they cant dump their water onto your property. also they allowed them to build close to property and raise the lot higher than yours with no run off for drainage

A lot of cities just sign off on the plans if they were done by a professional engineer. The city engineer, private engineer, and planning dept all messed up and didn't do hydraulic calculations or check to see where the drainage was going.

At minimum there should have been silt fence or cfs at the bottom of that grade until grass or other native plants are well established to prevent that erosion

Drainage is a "civil matter" if you ask most jurisdictions. I'd get a good lawyer and go after them for dumping water on your property. Most codes require you to keep water runoff on your own property.

Time to put a big ass berm with silt fence between the properties and tell the project manager to get some proper drainage installed along with the bill for the damages to your property.

I'd call insurance and lawyers. I'd file suit against the property owner, building owner, the municipality, and the builder. In my county we are required to maintain ALL water run off on site. I had to install a dry well and run all down spouts to it.

The property and building are just going to be owned by a worthless shell company that is going to lease it to DG. The deepest pockets here might be the insurance of the engineer that signed off on the building plans.

I seriously doubt the storm water runoff plan they submitted included all water draining onto your property. Unless your zoning laws are different, they should be responsible for all damage's and to fix the problem.

You have a backhoe to make your own defilade, irrigate the run off back into there lot. Use the excess dirt to make a shore up on your side or just use some quick creat to poor a make shift gutter. No money spent.

Multiple drain-points pointed straight toward your building where there is no runoff trench in-between leading to the main storm water ditch, and you were totally left to be victim of their building? That's insane bro, I'm so sorry to hear that. And not only did the engineers for the contractor for Dollar General obviously not consult with you, the state/county/city inspectors or whatever that is supposed to oversee this type of issue TOTALLY failed you. In KY, I've worked specifically with water runoff and permitting and there is zero chance I could have gave this a pass. But did I know plenty of others who would have? Absolutely, and it's a shame.

The comment made about a Vac truck would probably be the best route to get those drains cleared out if you have any businesses in your area that use them. A plumber is going to take forever to get those cleaned out and a vac truck can do that pretty quickly. But an attorney, Builder and the City building inspector should all have a sit down and get this crap straightend out. Their building plot grade should have been the same but if not at least required a retaining wall/retention area around it for such reasons because of the level of where your building/lot sits. If none of that is possible, DG's insurance should pony up some dough to make you whole again for the inconvenience and potential damages to your building and those building supplies.

A vac truck is not going to be able to clear out the fence post and concrete that were put into the drain. Also, the only involvement DG has is they are going to lease the property. They do not own these places directly. A worthless shell company owns the building and land. The deepest pockets may be the insurance the engineer who signed off on the plans carries.

I'm sure you don't want to hear the expense behind this, but call a local independent (non-franchise) restoration company to come out and take a look at the damage for you. With the business you're in, I'm sure you could find one that would love to trade out some dumpster time with you...I know I would be all over that. This is called water intrusion, so it's not a covered loss under your standard building-owner's insurance. Possibly if you had a flood policy, but most people don't have a reason to carry flood insurance. Even when you get all the standing water out, you've still got a lot of residual moisture and humidity that needs to be extracted from the building. Everything that our industry can do for you today will prevent you from having a mold issue six months from now. You can do most of the labor yourself, just hire them to bring in the drying equipment for a few days. We do this everyday. The key is getting it dried out quickly and treated with antimicrobials. It looks overwhelming at first, but you'll be back to normal in no time. Good luck.

Dollar General has a storm drainage issue. It is not permissible for Dollar General’s stormwater to flow on your property. The management of their stormwater should’ve been considered in the design of their building and property. The flooding of your building is merely an inconvenience in comparison to your building developing black mold. Black mold will render your building uninhabitable. You should have a discussion with the building department and Dollar General but more importantly you need to hire a lawyer right away at minimum to document your effort to resolve this problem.

I'd build a 3 foot tall retaining wall along the my side of the property from sidewalk to alleyway, post private property signs - towed to owners expense, and contract a tow company to do ride bys and tow unauthorized vehicles.

Most plumbing code books will state specific code about run-off or storm drains. And most of the time, you are not allowed to have run-off go towards a neighbors property, they are responsible for proper management, ie a ditch between property lines, or a dry well. Get your attorney involved, and go after city and DG, they shouldn't of passed final inspection.

I agree with a previous poster that a professional clean up crew can document your loses and provide yoy with the evidence you may need to square up with Dollar General. In Georgia you can contact your county storm water department and they can help make the company fix the problem they created. Unfortunately, I'd guess the only way you'll be able to get damages is with a lawyer.

The weld may not be pretty, but if it holds it is golden. I used to love karting here before it was all turned into condos. You might have to put up a silt fence between you and the dollar store. Someone need to get a trash pump and empty the catch basins then try to rod out the culvert. If it was me i would also dig a temporary pit to stick the trash pimp in and discharge into an open area as far away as possible.

There’s several issues going on here one city didn’t do the job to the contractor knowing it was an issue didn’t take steps to implement a resolution before it happened number three dollar stores incorporated is 100% liable for any damages done to your property whether it’s a building products, soil, erosion, or even the clogging in the pipes They’re 100% liable for that Texas tried the same thing when they tried to put in a road they got sued and lost and the state said they were immune from being sued if the state can be sued and lose dollar stores, which is a much smaller company than the state of Texas will lose Keep in mind will never fix anything until you file and to sue against them which preserves your rights to take to court. There are time delays, but you have to keep in mind if you don’t before a certain time frame you’re exempt from taking them to court a intent to sue takes away that time limit. I’ll give them an option to fix the problem and settle, and still allows you to take it to court if you need to

As far as your welding good. Grind all the old weld out. Then when you weld it hit it with a wire wheel on your grinder to get the slag off. If you put weld in there and then grind some of it out you weaken it. Do those two things and they should last a bit longer

You'll want to have a chat with your lawyer. They are negligent by building up their property level and directing the run off directly into your property without putting in a stormwater management system.

Get miss dig out there to mark any underground utilities.... then dig you a "moat" the whole length of your property line from the back right to the ditch.. Or go to Harbor Frieght and Buy ya 5 "caps" to put on their black pipes. LOL

I don't know what state you're in, however most states adopt an "as is, or modified" version of the ICC. Both the Construction Code and the Maintenance Code in most states prescribe drainage minimums and address pooling water very specifically. While it looks like the "New Construction" may have met some of the Slope Requirements away from the foundation of the new building, it would not meet the full requirements in most states. New Construction would not be allowed to flood your your property or building and would require the use of Swales or BMPs for example to control runoff. You would be responsible in most cases only for pooling water created by the impervious surface of your own property i.e.. your drains. I would start with the Plans Reviewer for your jurisdiction, they are responsible for approving engineered plans and the Field Inspectors are responsible for ensuring buildings are built according to the plans. While sometimes the same, both of these departments are task with making sure the minimum code requirements are met. There's likely some state codes that will protect your property.

@@rollingops WTH really. That is a load of crap dude. Go to your county planning property and get a copy of the site plans, engineering plans and storm water run off plans. Then find someone WELL educated in commercial architectural engineering pay them to study plans vs what was done. Then get an attorney, have him meet with you and the engineer and develop a plan to sue. If it goes to court you now have a SME (subject matter expert) that is very familiar with the case and can be declared an expert witness. Winner winner chicken dinner. They will settle before the end of court and the sky is the limit sir. I speak from experience.

that drainage should of ran to a rainwater runoff system at the main road or a drainage ditch to the nearest low point. (most modern constructions now even have a water reclamation res to allow the ground to soak it up over time)

Take this to the building inspector for your municipal government, their building impact absolutely effected you and the codes enforcement, building inspector and the like are going to be on them like white on rice. IT is illegal for them to dump their water run off on you, they had to sell a building plan to the local government that worked, it obviously did NOT work of they told the inspector one thing and did another, either way you have to hire a lawyer, and sue them for damages, losses and repairs, keep all your receipts, record of all your time, this is a multi million dollar company and they damn well knew this was a issue, and didn't care they are big and you are small. YOUR LAWYER needs to LEVERAGE your complaint to the Municipal government. A government that should have protected you for this, one that you pay for in taxes for. YOU NEED a lawyer to handle this interest objectively. You have to do this because I would have ditched a tank trap ditch across their parking lot for THEIR water, but I can be irrational, this situation needs to be handled objectively.

Yeah, you are right, DG is a multi million dollar company. Unfortunately, DG is only the intended tenant of this building. They plan to rent the property from a worthless shell company that has no assets other than the land and the building.

I'd add a drainage swale, ditch or some type of culvert pipe on your side of the property between your new neighbor. I'd try to do it before they install the fence. Unfortunately it doesn't appear that you have sufficient slope to run the water into the ditch by the street.

Why did you not get the building inspector involved while the flooding was at it's worst? The building under construction had runnoff onto your property that included silt that plugged your drains. Then theres the whole issue of why is their design allowed to send water into someone else's parking lot?

Yes, there are a lot of problems here. But we don't have typical zoning laws in parts of this area. That doesn't make the issue ok though. So at that point we have to involve an engineer and attorney, and that obviously doesn't happen overnight sadly.

As far as fixing it, I see a couple of posibilities. 1. They could adjust the slope so their yard acts as a storm water retention area. 2. They could trench it and put in a drain line to the culvert at the front. If the city allows them to move water off site of course. 3. They could install a bunch of dry wells, perhaps even one per downspout, to allow their water to leach in on their property. Now, you could also threaten a few things. 1. Come in with a dozer and trench right next to their building to build the drain culvert that they need. 2. Poke holes in their back wall and redirect the drains into their building to allow the water to ge back to where it used to go.... This is probably NOT a good idea, but the threat might make them take this seriously.

Dollar General is a horrible neighbor and community member. They have all the real estate owned by holding companies and leased back to them so they aren't directly liable for anything. Good luck but don't expect much from them. I'd be tempted to put expanding foam in their downspouts...wouldn't stop the runoff, but would make it more of an issue for them.

Yea I would totally blame them and the city for it. I’m assuming that Typically Engineers on the DG side would survey the site during design and take existing elevations of surrounding roads, property, etc.. allowing them to design to match existing grades. If not to match, then to install storm sewer infrastructure that would prevent exactly what happened to you. What I’m assuming happened here is DG stores are cookie cutters meaning they probably use same plans to build all around the U.S and probably didn’t take into consideration the existing elevations. Since they build those things so quick, no one probably thought about rain and what the consequences would be. Typically I see DG built next to empty lots and high like this as well so no one says anything but in your case, it’s a problem. 1. I would try talking to city officials and see why and how they approved those plans. Did anyone look at them? How did they get a permit? City May be at fault too. City Inspector needs to check those plans and go out there to verify they did this right. It could be that the contractor just built it like they always do everywhere else do build. Maybe builder missed drawing or detail and there was supposed to be something there. 2. Keep sending emails, pictures and keep bugging the shit out of DG. They need to come up with a solution to this. 3. I feel that it is your right to get legal help and place a claim for damage to property. Maybe your insurance can do something about it because now your “food zoning” may have changed? 4. This fix is easy, it’s the inconvenience, damaged caused and all the cost to build new storm sewer infrastructure to prevent this from happening again that will cost and who is going to pay for this?? The municipality shoukd be able to provide relief, though they obviously didn't do their job during the planning process. Call the codes office and show them the video/aftermath.

You file a lawsuit against Dollar General you also file a lawsuit against the builder and you file against the city and county because all those people have to approve what happened on their lot and they are responsible for the damages to your lot since they caused the issues. Ps they should have put a drainage pond in place to prevent this like they did at my local shitty dollar store

Time for a big dirt berm. ALL of your expenses can be passed on to them. Hourly rate for clean up, costs etc. Ask them nicely and hand em an invoice. Then file a suit if needed. It's plainly obvious. Too bad you didn't have that conversation with the contractor recorded. Proving they KNEW it was gonna be an issue.

IF they dont figure it out SOON, I would go take those gutters and bend them UPWARDS blocking the water from coming out AT ALL! forget that... They arent gonna continue to ruin my building ! Im sure its doing structural damage under your pad as well the way the water is rushing in like that!

I don't know who designed the storm water management for the site. They must have bought their degree online, and your twp approved it is a disgrace allowing all the roof water drain on your property. If it was me, I would dig a trench along the property line until they come up with a permanent solution to divert the water away from your property

After they pay for damages they should be required to install a drainage gutter or ditch on their own property and pay for any easements through other properties...

Get some drainage rods and clear your drains. They need to put a drain to the ditch by the road. Or you may just have to dig a ditch so the water runs towards the road but that's just expense that you shouldn't have to fork out for, just a shame your building is the lowest point. Keep your drains as clear as you can

there's so many ways u can fix this yes it will cost u . but u can also cost them if u plan it right ... gravel berm 2 foot high and a drain pipe on ur side to catch what water does get tru . also call code enforcement if u have any in that area . concrete wall of 2 foot high will stop that water and make it go back to there side . then they will have to fix there side also .
