The plaintiff went to the defendnant's club, but they lost her expensive coat, so she's suing for its value. The defendant argues the plaintiff didn't come back until a week later. They don't keep items overnight.

Most places have a 24 or 48 hour time period for picking things up and then it is gone. Why anyone would expect their coat to still be there almost a week later simply because they didn't want to wait in line...Do you know the problems that would cause? Many people would just leave their stuff there and pick it up later on the way home or something days or weeks later when it fits their schedule.

Had she gone back Monday I might be more sympathetic, but she waited a week. If I was an employee of a busy place, by Tuesday that coat would be in the corner, Wednesday in a box, and by the end of Thursday out the door. At least call on Monday and try to explain your work schedule or something to let them know you can’t come back right away.

So at what point is she responsible for the club allowing someone to claim her coat? The coat was claimed that night by someone else. They were responsible for making sure her coat was only given to the person with the ticket. They didn't do that. Her coat is not missing b/c she left it over night. I used to go out dancing quite often and would take my well-worn coat on the nights it was necessary. My mother bought me a very nice wool coat one year, and was slightly upset that I wouldn't wear it until I explained that there was no way I would take that to a packed, chaotic club, coat check or not.

In the black community there's a huge stigma about only paying in cash and many black folks don't have cards to charge to. My aunt was that way. This does happen at a coat check. A friend of mine, about 35-40 years ago was getting her coat out of check and she ended up with a real fur coat. She was only 16 at the time so she left with it. I'm not saying it's right, all I'm saying is this happens.

The ticket said they weren't responsible for items left overnight. She left her coat there Saturday night......because she didn't want to wait in line for it. Sunday night, Monday night, Tuesday night, Wednesday night, Thursday night....then she came to get it Friday. Without the ticket. After listening to her ramble and posture with all kinds of made-up excuses over a ridiculous lawsuit, and a cloth coat miraculously morphing into a designer coat that (surprise!) had no receipt or even a picture of her wearing it, I wouldn't be surprised if she picked that ticket up off the floor and made up the whole story for some free money. Either that or she's a Karen who seems nice at first but thinks the whole world revolves around her.

I lived in CT and even in the middle of January, when it was below 0°F, I wouldn't wear a coat to the club or bar because I didn't want to worry about checking it or carrying it around all night. If there was a fight that night involving law enforcement, it’s understandable why she might have left her coat behind in the chaos. The nightclub should have reviewed their surveillance footage. Clearly, she didn’t get her coat back since she still has the claim ticket, which suggests either she never received it or the staff didn’t follow proper protocol. I believe she should have been compensated for the coat’s depreciated value, despite what was written on the ticket, given the chaotic circumstances. It’s disheartening to see her mocked for using ebonics and speaking in her usual manner. She seems like a kind person who just wanted what was rightfully hers.

But, usually the workers in the cleaners take your clothes wear them and then get them clean, pressed, and prepared for you to pick up.
