First the plaintiff said the stains were there before he moved in. Then he claimed to have proof that the stains were not there when he moved out. Which is it? I was surprised the judge didn't catch that. Of course his proof was nonexistent anyway.

The plaintiff seems to really have no idea what renting a house month to month means. He really believed he doesn't have to give a notice and he can just leave without having any obligation. That's the scary part for me, a man of his age who has no idea about basic stuff like this.

the 30 day notice rule is biased against tenants and always favors the landlords . there is no equity or fairness to that rule and it should be changed to maybe 2 weeks or even one week of notice .

@marleonetti7 Actually, that's not true. It's really a matter of consideration & prep time on both sides. The tenant so they can look for a place & the landlord so they can list & schedule to prepare the place for the next tenant. Normally, if it's an amicable situation, the tenant can extend their time if they're having difficulties finding a place. What you're referring to, as the tenant not being as financially solvent as the landlord isn't always & it's not relevant.

When the plaintiff INTERRUPTED to say there were no stains when he moved out. Judge should've said oh well you have to pay for carpet cleaning then. Because he first acted like the carpet had 14 year old stains that couldn't be cleaned. But if they just so happened to disappear when he left he lied and he stained the carpet.

JM didn't respond to his comments because it really didn't matter. Carpet stains are normally considered wear & tear, unless you can prove it's brand new. Especially, when carpet is in a place where it shouldn't be. I mean who has carpet in the bathroom, up along the tub? That trailer must be from like the 50's or something, when they thought wall to wall carpeting was luxurious.

She always says that the landlord has to have pictures of how the place looked before the tenant moved in. She also tells the renter to take pictures of any damage that is there upon move-in. Sometimes a landlord has pictures that the tenant disputes are even of the unit that they were renting. Sometimes she has to decide who is more believable. It’s always best if both the landlord AND the tenant each have their own set of before and after pictures.

He wasn’t repairing something that was necessary to live there. He moved the gas regulator from beneath the home to the outside, which he may have thought was essential for his safety, but he didn’t have any proof that that was true. If I was the home owner I would not want my tenant to do such an important repair. I would only want it done by a person who is licensed to do that work. He also did something with the dryer vent. Again, I’d only want a qualified person to do that because if done incorrectly there’s a risk of a house fire. He might have done an excellent job, but the owner has to worry about liability for the rest of the time she owns the home. He drained the water heater but that doesn’t sound like a necessity. He also moved some pipes connected to a pellet stove. That could also be a repair that should only be done by a professional. All of those repairs were due to his preferences, not requirements in order to live there. I haven’t heard JM tell tenants to repair things and then deduct the cost from the rent very often, but I don’t remember her ever asking them to do it on their own, or without asking the landlord first. The only things that a tenant can have repaired (and then deduct the bill from the rent) are essentials, like no water or heat, or no functional toilet or bath, or a hole in the roof or window or a electrical hazard. And when she says “get it repaired and then deduct the cost from the rent” she means call the plumber or electrician. And even then they can only do that if the landlord refuses to get the repair done. Or they can break the lease without penalty instead. He moved in accepting things as they were. She had not promised to change those things as a condition for him to move in. So unless he can prove that those things were required by law to be repaired then he has no right to demand any changes or to be allowed to make the changes himself.

My wife is starting into menopause. It is hard and I feel sorry for her. Her emotions change drastically and I know she doesn't like it. She doesn't get upset when I talk about it. I wish people in the world weren't so thin skinned. Everyone has to walk on egg shells anymore. I miss the days when we could be a little more open and not take comments from others so seriously.

It's dismissive to blame a woman's actions/attitude on her hormones. Yes, women can be affected by things like menstruation and menopause. But it's rude to use it as a way to automatically explain how they're acting. It's realist and not sexist to refer to menopause, mood swings are a recognised fact. The Judge is there as a Judge, not particularly a woman, and she needs to remain neutral and not jump on the feminist bandwagon, she has done this before.

Sorry, but everyone has emotions, and things that effect them. The issue is implying the person is emotionally out of control, unable to regulate them such that they overwhelm reason. That's the case for children, and to imply it is the case for grown women at that time of life is indeed sexist feeding into the trope that women are "more emotion, less reason".

My wife is in her 50s. She’s going through menopause. There are times when her hormones are bouncing around and I’m walking on eggshells. It is NOT being sexes in stating facts. I Love my wife deeply and I realize that at this time in our lives there are times when she’s very loving and other times she’s a bitch on wheels. When she’s bitchy, I give her a wide birth and try my best to love her through it. We have had a wonderful marriage and this is part of our vows of it’s not better, but worse. We will get through this and eventually get back to our wonderful marriage again.
