🫵Section 14 of the specific relief act states that :

🔆If the employee quits the notice period the employer can only recover the notice pay no employer can force an employee to complete the notice period.

⚡️Section 27 of the Indian contract act states that :

🔆In your work contract, in the separation clause if the word “in lieu of” is mentioned. in simple words in lieu of means (by out)
if it is being mentioned in relation to the payment against notice period and if the employee is ready to pay against the notice period in such cases the employer is bound to issue the relieving letter.

⚡️Article 19 of the Indian Constitution provides the fundamental right to every person to choose the profession of his choice and any agreement contrary to this is invalid!!!

if there is a pressing business need
or the employee refuses to compensate for the notice period
or if there is any monetary advance paid to the employee pre-hand then the organisation can force the employee to serve the notice period.
