1. The basic mission for which the police exist is to prevent crime and disorder.
2. The ability of the police to perform their duties is dependent upon public approval of police actions.
3. Police must secure the willing co-operation of the public in voluntary observance of the law to be able to secure and maintain the respect of the public.
4. The degree of co-operation of the public that can be secured diminishes proportionately to the necessity of the use of physical force.
5. Police seek and preserve public favour not by catering to public opinion but by constantly demonstrating absolute impartial service to the law.
6. Police use physical force to the extent necessary to secure observance of the law or to restore order only when the exercise of persuasion, advice and warning is found to be insufficient.
7. Police, at all times, should maintain a relationship with the public that gives reality to the historic tradition that the police are the public and the public are the police; the police being only members of the public who are paid to give full-time attention to duties which are incumbent on every citizen in the interests of community welfare and existence.
8. Police should always direct their action strictly towards their functions and never appear to usurp the powers of the judiciary.
9. The test of police efficiency is the absence of crime and disorder, not the visible evidence of police action in dealing with it.

Hey 401, here's something to think about: we're told repeatedly that ignorance of the law is no excuse. However not even police or judges have the laws memorized and need to look up statutes. How is it a civilian is supposed to understand and follow the laws when they're convoluted and the amount of laws has grown to the extent not even police and lawyers know them all off the top of their heads.

@Samuel Sweetmann Pardon the pun, but that's a backwards law imo. I always back into parking spots and into my driveway, given the option, because it's much safer to go forward when leaving than try to back out.

The reason ignorance of the law is no excuse: sociopaths are slippery rule breakers. You need to stomp ion them or they will wiggle away... Officers can issue warnings, or tickets. A friend, who had been speeding, undid some buttons on her shirt, heaved her chest when talking to the officer, and accentuated her French accent. She got a warning. I'm pretty sure the officer was quite pleased with his traffic stop. She plead ignorance, with a huge dash of sexy cluelessness. Likely he knew what she was doing, but, well, the results speak for themselves.

It's almost like there needs to be a legal precedent made..." If a law can not be understood by an average intelligent adult (18+... High school grad)... then it's not legally considered a law at all. Something like that would (at least) greatly diminish the convoluted manner in which legislation is presented to the general public... no more of this crap about "Well this is basically what it's supposed to do" one day... and once passed, "Now you owe twice as much taxes and get half as much service from the government... because YOU voted for it! Yays!!" If there was a lower denominator in humanity, that would be the politician. ;o)

Well first there is a SHIT ton of state laws. Ordinances and federal laws. As well as sub sections to those 3 mentioned. I dont think ANYONE could possibly remember every law ordinance federal law and all of their subsections. I believe officer 401 or free field training did a video of it

I absolutely loved this video. I feel this is the kind of thing cops and civilians need to see. I also think inspiring cops to be introspective and truly think on what it is they do, how they do it and what it truly means to them is a good thing. Only by contemplating the self fo we gain insight.

Thank God you posted a new video, I was going through withdrawals... Lol. I 100% agree with you Bruh. Our PD practiced the SARA Model in Community Policing and it was outstanding!! Many LEOs forget Ethics of the badge and only focus on Authority of of the badge. Keep educating and stay safe. Bruh.

I would love to hear more on the subject. Also, how departments struggle or deal with the media bias and lies. How does a department preserve or rebuild trust after an event or the media destroy it?

I had an interview today for a promotion (not LEO). I talked about hiring people with values. I didn't specifically mention ethics, but i damn well should have. Strong values and ethics are cornerstones of good government. Police work or just us regular civil servants.

This is all well and good, but I have had not only the misfortune of running into a couple bad cops in my time, but also a nasty prosecutor who "kept the party going". You fight them (even within the confines of the law) and they know where you live. Think you could repay the favor? Tack another charge and threaten 30 years of prison time if you don't plead guilty. The entities that police the police as well as the court systems appear to be in bed with each other. Thoughts? All I can think of is that if the rule of law goes out the window, people convicted under dirty circumstances will thirst for blood.

And I think we are seeing the results of the police losing the trust of the general citizens in several countries around the world right now.

Unfortunately you need a private lawyer. Never, ever speak without one present. Do not answer any question you are not legally required to. Private lawyers will go above the local court system if you really are innocent. Ideally try not to break any laws, but if you do remember anything you say can and WILL be used against you.

When I was 23 I was handcuffed and then beat up by a highway patrolman.For years after that I had a grudge against the cops,but officer 401 is helping me come back around to the truth,guy was just a world class asshole,and he does not represent but a small percentage of good and decent officers who protect us from harm everyday .Thanks 401 for making cops more human to us all.

God, we need many more officers like 401, provided their actions match their ethical principles. Having lived from coast to coast, I’ve witnessed many over-the-top reactions by LEOs, perhaps the most egregious was a 74-year-old grandma who was body-slammed by a cop who didn’t like her slow reaction to his barked commands; she had been diagnosed with dementia two years prior. Despite officials complaints and her MD’s letter confirming the diagnosis, the offending sergeant was promoted a couple of months later to lieutenant. I became an agnostic regarding the good faith of many-most?-in law enforcement. Keep up the good work 401.

When Rob Davis was the chief he would personally teach the ethics class for San Jose Police Academy. He did so because he felt that it was so important that he wanted it to come straight from the top.

Based on my personal interactions with various police agencies and a few "officers" who visibly demonstrate their "true intentions," I contend the following: 1. *THERE IS A HUGE SEPARATION BETWEEN WHAT IS SAID & WHAT IS DONE!!!* As a direct target of deliberate racial profiling, I can unequivocally state that the majority *DO NOT WALK YOUR TALK.* Despite not having a record of ANY KIND, I am STILL assumed to be "a drunken injun" *EVEN THOUGH I DO NOT DRINK, HAVE NEVER HAD A DWI OR DUI IN 47 YEARS OF HAVING MY LICENSE & DRIVEN IN 26 STATES & CANADA!!!* 2. *ROADSIDE MANNERS!!!* The ONLY police agency that targets ROADSIDE MANNERS in required training via a 3-week concentrated session, followed by a 12-hr refresher course REQUIRED ANNUALLY TO KEEP A SQUAD VEHICLE ASSIGNMENT IS *THE NEW YORK STATE POLICE.* They treat you like a human being with respect!!! *I strongly advise every cop to take this training....* 3. Militarized presentation that is clearly visible to the public *SCARES THE SHIT OUT OF US!!!* Decades ago, I would not hesitate to seek out police if I had an issue.... *NO MORE... NOW I AVOID YOU LIKE CANCER!!!* I DO NOT TRUST YOU. YOU LIE. YOU MANUFACTURE GARBAGE. YOU CONFISCATE MY PROPERTY & MONEY WITH NO REAL LEGAL REASON TO DO SO.* I know I am not alone in this fear....and NEW officers *ARE A MILLION TIMES WORSE* than more mature, older officers that have years of "seasoning" based on my personal experiences. This issue IS THE ROOT CAUSE of why I AVOID YOU and will continue to do so... broken trust.

The Amazing Lucas recently posted a video involving an officer who pulled over (detained?) a solid, young black man for having an air freshener on his rearview mirror (even had the nerve to give him a warning). The officer fished and fished for something to pin on that upstanding young man to no avail. I was deeply offended for the young man. It was deeply insulting. I have no idea how he kept his cool. I'd have probably been hauled off in cuffs. To me that was an injustice. What should we, the public do in/after such a situation?

You're not kidding. It's super easy to get salty and forget why we do what we do. As far as gifts and gratuities... yeah, that's a grey area. It's not unheard of for people to pick up the tab of police/fire/EMS/military in uniform just as a way of saying "thanks". It's when that kind of thing could possibly be construed as garnering favor or soliciting special treatment (especially in the case of police) that it becomes an issue.

The only thing I would say is that your initial assertion that an officers duty is to protect the public is "technically" not true. Per the supreme court and many lower courts law enforcement has no obligation to protect the public specifically, just to enforce the laws generally.

Love your video and completely agree. What is your thoughts on the fact that SCOTUS ruled that officers "no not have a duty to act"? Rick Gore has the ruling on his website "think like a cop" or youtube. Everything you say is absolutely true and I agree that an officer SHOULD have the same mentality. Unfortunately, they seem to get drunk on government power these days. Limited immunity, is what officers have, and they take advantage of it. Love your videos, just want your opinion buddy.

You hit this subject right on the head but now we need to address the general culture of cop hating as an identifiable minority that has become a major epidemic to the point perspective recruits do not want to choose policing as a profession. I do not know of any single US or Canadian city that does no have a police staffing crisis. Every city and town is affected by the staffing crisis.

"Absolute impartial service to the law" is dubious at best. The role of a police officer is historically rooted in "keeping the peace," and the law was originally used as a tool for them to do so. Nowadays, police officers are often tools for the law to exercise itself. Police discretion is an important counterweight to this. Police officers need the power to question the necessity or applicability of a law or whether they should use that law to charge someone. If you as a police officer, knowing that marijuana is entirely fine and safe to use, encounter a person with four ounces of marijuana, how can you justify arresting that person and turning their life upside down? You can't, because the law is inherently wrong in that regard and it doesn't take a rocket scientist to figure it out. The idea that police officers "should enforce the law without exception" is counterintuitive to the idea that police officers are supposed to police with the consent of the community and keep their interests at heart. You either show compassion and care for your community or you slam the book down on it. I don't think it does the community any good if you arrest Barbara for shoplifting a can of ravioli because her kids were starving and she didn't have the money to buy it. There's a difference between her and Adam, the guy who snorted two lines of coke and robbed a 7/11. At the Nuremberg trials, the idea that Nazi officers and soldiers were innocent of wrongdoing because they were "just following orders" was rejected, because those personnel could've refused to carry out those orders even if it resulted in execution. "It's the law" or "that's my job" doesn't absolve a person of their responsibility as a human being to follow a moral code. Police discretion is based on the idea that some people deserve second chances, because everyone makes mistakes. It's not based on "I like this person" or "I don't have time for this," nor should it be. Police discretion is based on morality, as well as the understanding that the law isn't a substitute for morality and isn't always right. It's the difference between ruining a life for almost nothing or helping someone get on the right path. Not all problems can be solved with a pair of handcuffs and a jail stay.

Thing about being old and salty is simple: People are wired to detect patterns and over time, those patterns become so evident that no amount of 'feel good' training can offset it. Ironically, the new 'feel good types' lack the experience or awareness to understand that: 1) They too will get there if they stay long enough 2) Stay long enough to forget only to institute these policies...

you may notice patterns. that is fine. however the mistake is in assuming those patterns apply to every INDIVIDUAL. human beings are INDIVIDUALS. no matter how common a pattern you may notice, you must approach every person as an individual. if you start assuming qualities about people as part of a collective, then you fall into a trap of profiling them. profiling people will always be ASSUMPTION. without approaching each person based on the objective circumstances and their observed actions, you cannot act in good faith or ethically.

​@@ensom 7% of the population commits 52% of all homicides; is it wrong for me to PROFILE the INDIVIDUAL? Perhaps. Yet then, is it an ASSUMPTION, that when approached by that individual, who represents a PATTERN, I should just ignore that flag and just... ASSUME the best? You live in a small world, my friend, so I understand that your feelings are of love an acceptance. Hopefully it won't get you killed some day...
