The prosecution fell for this, hook, line, and sinker. The defense was never going to make such an unreliable witness central to their case. This was simply a way for them to completely disrupt the prosecution’s case and they delayed it by at least a week. That also gave them more time to find the Fuhrman tapes and as an added bonus, because of the prosecution’s request for the examinations to be on tape, it essentially gave the defense a trial run of Lopez’s testimony, to see if it would actually hold up after cross examination. Because of that they were able to throw the whole thing out, and the sanctions were irrelevant as well because they never called Lopez. The only outcome achieved was the delay.

@lukedaniell8 ай бұрын
One aspect of the OJ Simpson case that's fascinating is how whenever a motion went the prosecution's way, it still worked in the defense's favor. The Lopez testimony is just one example of this. The prosecution wanted Lopez's testimony to be treated as a conditional statement, pursuant to Penal Code section 1335. (17:17) Judge Ito granted the request. Because of this grant, the defense got the opportunity to see how Lopez's testimony will play out before presenting it to the jury. Realizing that it would be damaging to Simpson's defense, they chose not to present Lopez as a witness. If the prosecution hadn't made the motion that it did, the defense wouldn't have been able to prevent Lopez's damaging testimony from being heard by the jury. The most significant instance of this backfiring phenomenon was with the bloody glove found on Simpson's property. The defense thought from the beginning that the glove was planted by Mark Fuhrman. They tried to have it thrown out of evidence as the product of an unlawful search. The prosecution opposed this motion. Ultimately, the prosecution got its way and glove stayed in evidence. If the prosecution hadn't opposed the motion and the glove was thrown out, there would have been no occasion to question Mark Fuhrman. As a result, the race issues, which became the focus of the case after the tapes of Mark Fuhrman came to light, wouldn't have been aired at all. Also, there wouldn't have been that infamous moment when OJ tried on the glove and pretended it didn't fit. Johnnie Cochran wouldn't have had the opportunity to say, "if the glove doesn't fit, you must acquit." The prosecution won so many battles in this case. Because they did, they lost the war...

@kennethcharles13862 жыл бұрын
Ms Lopez was the perfect witness to get the prosecution stuck on her, because of their timeline of 10:15pm this was brilliant by the defense attorneys; and the prosecution fell for it. Ms Lopez was a critical witness as to meeting Mark Fuhrman and then a tape recording of her giving a statement that the defense attorneys didn't disclosed on purpose, that had no absolute purpose other then to buy time for the defense team to find those Fuhrman tapes. The prosecution team wasted all that time on a witness who never testified in front of the jury. Ms Lopez was totally irrelevant to this case other then to slow down their fast forward approach by the prosecution, the defense team bought plenty of time and changed the entire trial with just one witness. This witness should have been done in two hours not a week. Unbelievable that the prosecution team didn't see this decoy. Darden was definitely the wrong person to cross examine Ms Lopez and the defense team knew it and this would prove to be his downfall in this case, he's become like a little child now complaining about everything that the defense team was doing. Ms Clark from the start fell into the trap and now they got Darden. Case over.......
