The plaintiff gave the defendant, a realtor, $2,000 to hold an apartment. However, the plaintiff couldn't afford the entire deposit for the lease and wants her $2,000 back. The defendant won't return the money, so the plaintiff is suing. The defendant argues the fee is nonrefundable.

@@tiBoomer It is. Some agencies offer to pay the brokers fee as a sort of enticement. Most of the time the renter/buyer pays it and it’s only refunded if the broker doesn’t find a property. He did, and she actually signed a lease- then changed her mind. I feel super bad for her, especially because he seems a little sleazy!

We don't have these broker fees here in AZ, I don't get how NY and NJ allow realtors to charge a huge fee for simply finding an apt for someone. The defendant was slimy and irresponsible, and does not even have the contract yet won??? I feel the plaintiff should have gotten back at least half of her money to punish the defendant for not having this important document and because he was able to rent the apt. I totally disagree with JM verdict on this.

The broker should have never taken the “deposit” as his broker fee. That money goes straight to the landlord and then the broker can sue for his fees if he has to. He stole that money from the plaintiff and it’s not counted under the “non refundable” as he didn’t use it for a deposit. It’s also interesting how in some videos the judge is “bound by the law” but in other videos she will literally add extra “just because she feels like it”. Having watched nearly every episode on this channel since Covid, the judge is extremely unpredictable in many cases on how she’ll rule based on what she currently feels like.

Some people don't believe in wearing a ring. In my case, the ring was purely symbolic, a $10 silver band. JM needs to cut it out with - No ring? Not your fiance! Just a bf..... there's a huge difference - bf is noncommittal, could be nonmonogamous, etc. Fiance means marriage mindset, planning on spending the rest of their lives in union.

The ring is symbolic, $10 ring is just fine. The rings price doesn't show how much someone loves you. The ring and marriage means commitment emotionally and financially. Women falling for the pump fake, because all they have is a boyfriend who's not going to commit legally. He can walk away at anytime with no legal ramifications. Fiancée sounds more grown-up than boyfriend, but they are just lying to themselves, everyone else can see the truth. The judge is trying to guide these women into the light, and embarrass the so called "man". I would never let a woman call me her fiancée if I didn't propose and put a ring on it.

IMHO, she comes off as a total jerk mist of the time. If people want to say fiance because their relationship is beyond gf/bf status, why is it any of her business? I like that the litigant continued to say fiance, and I think she even said husband.....the $10 ring was my second marriage, my first legal marriage. My first marriage was common law. We had kids and bought a house. We were together from age 19-28. We called each other husband/wife and introduced ourselves to others that way. We believed that we didn't need a legal contract to prove anything to anyone. And after legal marriage at age 34, divorced at age 44, I don't think I will do that again. Life is long though, and never say never. It depends on my partner, what we think we need to do to feel comfortable with our relationship. Some people don't care about legal status or rings, and that's their prerogative. And JM can be a jerk. That's also her prerogative.

As someone who worked retail for over 20 years, people like the plaintiff was the bane of our existence! Comes in, wastes everyone's time, does paperwork, wastes the time of the business or entity that has to approve the paperwork, impacts the earning potential of the business since they've now taken the product off the market, wastes the salespersons/representatives time and income potential because they are now not spending it with revenue generating customers, and then all of a sudden they change their mind and want their deposit back. Then the customer plays victim. So glad they plaintiff lost, hopefully it's a lesson learned that there are consequences. And that defendant? Total sleeze. He should have lost something based on how untrustworthy/sketchy/slimy/icky he came across. Feel like I have to bathe after watching this one.

It seems like he got paid from the plaintiff once and then he stated the office got paid from the other renter also but I think he left out the part stating that the office then paid him. I would have ordered the money returned. The guy showed up to court missing the paperwork which validated the money was non-refundable. If he can't prove that was the agreement, I don't see why anybody should be held to a contract he, himself, admits that they cannot find. The defendant admitted she signed SOMETHING but there's now a question regarding what that document was because neither party can present it for review. If you can't show me the contract you are trying to enforce, how can you expect me to enforce it?
