If I had just moved into a place and this happened, it would absolutely be up to the landlord to pay for my hotel stay until everything was fixed! Not to mention this guy has a wife and two children!

Not an assumption of thought but civil court (like small claims or arbitration like this) is a court of "more likely than not" with a verdict of less than 50% yes. As such, it is actually her job to assume if facts are consequencial or not. And her assumption is an upgrade people do... However there is another reason that judges might do this and that is to gauge reactions... Arrogance in the face of such things tends to show guilt where clustering shows honesty.

I don't think the renters are in the wrong here, I am a landlord. I had this problem and my tenants as they called me twice a year for plumbing problems. This was tree roots that were blocking the pipes. After twice I had the trees taken down, and have not had the problem since. My tenants are happy and so am I. While the trees were removed they also found a big knot of limbs in the sewer, a gap under the driveway that had to be filled with cement, the entire thing cost me over $5,000.00, it was well worth it to be able to keep renting the property and have great tenants.

There is also a reasonable expectation of habitability which was not provided in this case (cite Judge Judy cases). Roto Rooter was out FIVE times, and the tenant does not have to endure a residence that is uninhabitable. That being said, I do also feel that the defendants had buyer's remorse.

Nice landlord tenant case. They didn’t have to stay as long as they did. The lease IS a legally binding agreement but by not providing an appropriate living facility she violated that lease (she tried to correct it but failed) .

Some landlords see renters as suckers, once they know you have some money they demand that you live in their place forever, so they don't have to bother with taking someone with fewer finances. She couldn't find people as rich as them so she sued them. Like the wife said it's the sin of too much greed. Some landlords will sue even if someone moves in.

Our house did this less than a week after we moved in and it rained and it flooded the street and everyone's poo came up through the drain in our basement and they immediately remedied it AND offered to pay for all the laundry to be cleaned, took all the garbage, and had the basement professionally sanitized and dried with commercial dryers!

I was a landlord for awhile before selling my properties in 2020. We had a property that was a very nice one but the sewer backed up (trees the city hadn't maintained grew into the drains) I heard it about and within in an hour had offered them 1. 3 days in a hotel to figure out what it would take to the do job, (takes the immediate pressure off of everyone) and 2. scheduled with roto-rooter to come in and inspect the next morning. the next morning they told me I would need a whole new main drain to the tune of $9,500. The lead time on service would be two weeks from then. I offered an additional 2 weeks in the hotel at my cost or they could break the lease and I would give them $1,500 to move immediately. they took the 2 weeks in the hotel but would only let me pay for one week because they didn't feel it was "fair" for both of us. They were the best tenants ever! the re-signed the lease, I took less by $50 to have them re-sign the following year the neighbors house was shot up by some disgruntled neighbor and several bullets hit their car/my living room. the police were there all night and I spoke with the officers on scene about 3am. I asked the tenants if they were wanting a hotel that night or what? they said the police are still in our living room so there will be no sleeping tonight. I gave them another week in hotel and gave them the entire last month rent that they had paid (this was on the 26th of the month) plus they had already paid the following month and their security deposit. I gave them that back immediately. I offered to allow them to "break" the lease, or rather I told them I would not enforce the lease and do not care the condition of the house as long as they were safe. they took me up on the week in a hotel and they officially moved at the end of the month to a new one. I gave them a letter of recommendation and explained the prior incidents and suggested ANY potential landlord should call me personally and gave them my cell phone number and private facebook account so that they could get whatever house they wanted. All that to say this... This landlord is a complete scum who didn't have the money to pay for roto-rooter re-piping her entire drainline and that's what it needed. This landlord would've known that previously because they just don't all of a sudden get backed up and she tried to re-rent the house to someone else knowing the condition of it. there is no way to get the stink out of the house and I am sure that she did not have water back up for the house. the whole basement would need to be remediated and cleaned thoroughly.

(the tenants I mentioned felt so bad for my wife and I (we didn't own very many units) and we lost so much money on that particular house that it was not worth taking the chance on the covid rules where they didn't have to pay rent forever, and you could be stuck with paying their utility bills and have no recourse to have them removed. so we sold them.

I myself am asthmatic. My home had a leak, flood..1st floor, opened walls, found mold from previous occupant. Did mold remediation..got an all clear report, came home after a month, still got sick, from what I don't know as I was running HEPA filtered fan. Went to Urgent care, then ER 5 days later was kept overnight, having 6 breathing treatments, then on steroids for 3 weeks. Insurance had to pay for me to live at a hotel for 3 weeks while they fixed my home. I couldnt live in it while they were working on it. It was imperative they leave. I'm surprised they stayed 19 days! I don't agree with the judges perception that they were saying Yahoo..were buying a house..like they were being 2 faced. Think they had to act quickly, and yes, I think they deserve their deposit back plus extra for lost property and for the hassle, so pain and suffering..

What a greedy woman. I've experienced sewage water in the basement and the smell is horrendous. It's a nightmare to live in. And she mentioned the lease being a legal contract but as a landlord, the law states she must provide livable conditions and while the smell may not be considered unlivable (it should because it's unbearable) mold is extremely dangerous. And the mere fact mold was present tells me this was a long standing issue. It takes time for mold to form to the degree of causing breathing issues.

I did mold remediation for a few years. It is not joke. I was in one house where roof leaks had caused mold in PLASTER walls. The elderly lady asked if I wanted to sit down and I declined. The house was so clammy and moist that I couldn't bring myself to sit on her furniture.

No1 has 2 live with mold! Quick story! My wife is allergic 2 mold. She was sent on a vacation by an allergist b/c he felt she may be stressed alongside of being allergic 2 mold and cat and dog in which we’ve had 4 6 yrs. Needless 2 say, he was a COOK and had EVERYTHING wrong! But my wife went 2 Miami Fl. And stayed in a 5 ⭐️ luxury resort that had black mold on a vent in bathroom. They moved her room a couple days later, but I told her 2 get a refund! They’re dead wrong. They didn’t wanna refund her n we’re trying 2 get her 2 sign something. She signed NOTHING, and was able 2 get a refund through whatever travel ap or agency she used. I was encouraging her 2 sue b/c according 2 the cook allergist, she was allergic 2 mold and she did break out in hives while there. However, after visiting with a different allergist, we figured out what her problem REALLY WAS! And it had nothing 2 do with mold or pets! Judge Millian got this 1 💯% right!!!

Wow, the losing Plaintiff after the verdict: "I think what they did wasn't right 😓😡" Lady, your tenants were living with black mold and sewage that backed up more than once; the dad and a kid had asthma on top of it.... And this was all within 19 days. Got to keep $8,000 in rent for 19 days of stay, but wanted payment for the full lease because the Defendants "just left". 🙄 Just like someone else: I don't think she learned a thing.

She praises when wives talk over their husbands all the time. She’s so annoyingly hypocritical when gender is involved. He just didn’t want his wife interrupting the judge speaking.

The defendants should have the right to leave. This is not a problem that could be fix within a few days, and given that they have allergies, it's either they go live somewhere else and not pay rent until the problem is fix or they can back out of their contract.

Yes, I lived in a basement apartment that had the same problem. One day I had 2 inches of backed up sewer water. Ruined all the carpets and the smell never left.

I don't understand why the Judge didn't reward for pain and suffering because "it all worked out in the end." Should they be punished for getting out of a dangerous situation and moving on with their lives? Would she have preferred thay they live in a worse place in order to grant it? She doesn't have to grant it to them, but at least provide a better reason .

It wouldn't have mattered. She is bound by the law and statutory maximum (the most they can receive in small claims court per their jurisdiction is $5000), they aren't allowed by law to receive more. That's small claims vs paying an attorney to get to a bigger court. You cut your losses and be done or lose more hiring an attorney.

Because they left and *bought* a house, which means they were able to leave at any point in time. Still, they got 5k. It covers everything else and it's what they asked for.

Remediation? The fact that there was mold, sewage and water? This is a HUGE problem and takes time to remediate. The defendants had every right to leave!!!! I have dealt with water flooding, it’s awful and takes weeks to fix. The plaintiff is so ignorant of her rights as a landlord when you are renting a home that wasn’t liveable.
