The reason the rides were reimbursed is because the rental car was in his name therefore she essentially stole his car which it’s a crime. I’m not saying that it was a bad decision on her part to remove herself from the altercation the only way she could but that is the legal reasoning behind the ruling.

She's not going to get out of the car again, where he is still acting out violently and after he just hit her, especially on the side of the highway, at night and in the rain. She really didn't have another option, she did what she had to because her immediate safety was threatened. And giving him back the keys and control of the vehicle after 1. He was already driving recklessly and 2. Is now also enraged in anger and acting erratically, would be completely irresponsible and pose a danger to everyone on the road, including himself. He's lucky the cops weren't called on him because it was definitely warranted and they certainly wouldn't have let him drive in his condition. Not to mention, he probably would have been arrested and the car most likely would have been towed. So if anything, him having to get a Lyft ride probably saved him a lot of money and legal trouble. The way I look at it, her leaving him and taking the car was a direct consequence to his actions and poor behavior.

But what people sometimes don’t understand is that the correct choice does not always mean it is the legally correct choice. Morally, absolutely but the law doesn’t care about that unfortunately and a judge is bound by the law even if they feel different morally. In this situation, she has other options available to her. She could have called the police and gotten their help. She couldn’t driven the car to a safe location and called a ride share and texted him to tell him where the car was. Instead, she chose to take the car that was legally rented in his name and leave him on the side of road while she left the area and returned home with the rental. It probably would’ve been a little more understandable if she would’ve just used the car to get out of the situation and then left it in a safe location. Then she could’ve rented her own car or arranged other transportation to get back home. She did not have to take his rental to return home in, leaving him stranded in the area with no other option but to use ride share services because he couldn’t rent another car since he already had an active rental. Once again, i do not disagree with her choice that night but legally she was in the wrong by taking the car to return home and leaving him stranded.

It's just like Judge Milian always says, "It could be the best choice you ever made for yourself and you did what you felt you needed to do for you. But sometimes our good choices, don't cost someone else." I'm 100% with you on that. I also didn't realize that she took the rental all the way home with her and that that caused extra and unnecessary complications because of how far she was. I must have missed that point. So I actually agree that she took it too far in doing that and that the reasonable thing would have been to remove herself from the situation, park the car safely, and then find her own way home from there.

Everyone here acted stupidly and they're lucky to only be in court and not splattered along I-95. Don't let someone drive drunk, no matter who the car is registered to.

Yes, everyone in the comments mad she didn't get on the defendant more about her getting hit in the face. There is no proof aside from her saying he hit her, that he caused it. If all of them were throwing punches, pulling wigs off, etc. she could have been hit anytime, by any of them during that. She also said he threw her phone down and stomped on it, and then it came out the phone was knocked out of his hand by her boyfriend. The only things the judge could rule on were facts. And the only things that were clear were that he dropped the phone, and she took the car that wasn't in her name.

I go out with my friends alllllll the time and drink. In town and out...they are clearly not friends. He needs some help. Drinking should not make you treat ppl like that.
