I totally feel what Judge M is saying here. I had my ring cleaned a few years back and found out that somehow, my diamond has a huge chip in it. They asked if I wanted to replace it. No. It's the diamond my husband proposed with and placed on my finger again the day of our wedding. PLUS, I am not physically what I was the day I got married either, after having four beautiful children. I accept my flawed diamond completely, because I am accepted and loved with all my flaws. Chokes me up too, Judge. 💞

I agree. We could only afford the cheapest plain (thin low grade) gold bands.... but I Just can't change / upgrade... we could afford way more expencive rings now then we could back then... but the meaning behind them and the memories is way more important than having a New more expencive ring ❤

That's the difference between money rich and love rich. We don't fall in love with someone for the money they have or the property they own. We fall in love with what love the person has to offer. Such they might love each other but property will always rule over their marriage.

It doesn’t matter in regards to your love/marriage but when you spend money on something so expensive (that I’m sure you get insured) you should absolutely protect that investment. If you bought a car and the dealer damaged it of course you would take legal action.

The seller may have wanted to resolve this, but he needed a “judgment” to go after the “setter”. So he had the court “document” the facts, for his claim against the setter.

Plaintiffs actually brought evidence Defendant seems decent ( just stuck in a hard place ) No one seems like they are lying Litigants aren't yelling at the judge or each other JM isn't yelling No one sassed at the end Is this the most reasonable PC case ever?

Lol I know this case is old and I've seen it a few times but I was thinking the exact same thing when I watched today. They both seem to be good people, very well spoken. Until the fiance said she wanted a new ring. I know its her choice but I don't think she really understood what JM was saying.

Fun episode. I didn't know the judge was such a romantic. Buying a diamond is kind of like buying a car, you gotta make sure it gets appraised to see if it's what you were told, just like bringing a car to the mechanic to make sure everything is in working order. Perhaps buy insurance for it too.

She shouldn't bring anything personal to the table. If she's happy and sentimental with her ring good for her. But that's nothing to do with the case at hand. Same when she tells families how important it is.to have as many children love your kids, etc.. It's not her business to play therapist.

I am all for sentiments, and I LOVE judge’s story behind her ring 💍 but I’m also a little admittedly superstitious and feel a little bit “off” having my wedding ring be chipped and the source of a lawsuit. I’d be scared it’d be a bad omen lol so I get why the fiancée would want to just start fresh

@@raquelh8791 He didn't actually spend $7,000 on the ring - that's just the value of the diamond. My engagement ring diamond was appraised by the GIC (Canada) at $9,000, but my husband "only" spent somewhere around $3k

Very sad. I only bring my diamond to one jeweler, this way if there's anything wrong with it, there's no doubt who did it. Judge is same as me, married 28 years and I still have and love my first ring, but hubby surprised me on our tenth anniversary with a beautiful, larger diamond ring. Also, get your diamond insured!!! I lost the very valuable diamond out of the setting and I didn't have it insured. Thank goodness I found it 5 months later in my pots n pans cabinet. We both were thrilled!!

they'd have to do something massive to the stone to "chip" a diamond. it's one of the hardest materials on earth, it doesn't "just happen" when setting it!

Actually, it is very easy to chip a diamond. A diamond is hard and resistant to scratching. That is what the hard means. But, diamonds are extremely brittle, they can be chipped very easily along the correct angles and if you smash your hand against a wall then a diamond will most likely chip.

Diamonds are so overrated. Ruby, emerald, sapphire, jadeite, and turquoise are much much rarer than diamonds. Only marketing and public demand make it expensive.

@@Shawnacl09 Actually, rubies and sapphires have a Mohs hardness of 9. Very scratch resistant. Steel cannot scratch them. Jadeite cannot be scratched by a metal instrument either. Although jadeite is softer than diamond, it is much “tougher”, meaning it resists breakage and chipping. This is due to its tight granular structure. Many people don’t know this, but diamonds can chip if bumped hard against a hard surface. Diamonds are hard and “scratch resistant”, but not chip resistant.

I love JM’s advice about accepting the flawed ring her fiancé proposed with but I also understand why the plaintiff decided to find something else. Going to court and having to sue to get the ring fixed before you got married in it puts a bad vibes around the ring that I wouldn’t want to spill over to my actual wedding g or marriage. Starting over with a fresh ring in this case is justified

I am currently a jeweler, and was a diamond wholesaler for 25 years. Diamonds can be damaged by striking something, or by being dropped. they form in layers. Think of the pages of a book. If the stone is stuck in the right place where the layers meet, they very easily chip. they are not the hardest substance in the world. As is often misquoted. They are the hardest gemstone.

I bought my Wife's ring online after a lot of research. When I had it appraised, it was valued at more than 5 times what I paid for it, and it was expensive!

Appraisals are often so artificially inflated that they have become pretty much useless. I think you got a good deal w/ 5 times but, in my experience, appraisals are usually inflated by twice or three times the retail value, at a minimum.

7 months to engagement is exceedingly fast and may be what you reference around your first two statements. That's all I'll say about that. I respond here primarily to your "a chip no one can see" sentence. Sometimes, yes. Accept life happens and go with it. But this specific example was about ~$5k. It's likely a sizable investment for these people. The ring is a material item that the groom to-be purchased at a price based on the quality. He learned it wasn't the quality it was supposed to be and returned it. Why do either the groom to-be or the bride to-be have to be responsible for that financial loss in the quality they paid for versus the quality they received? They shouldn't. That's on the setter. So it matters more than a hill of beans. Setter didn't want to take responsibility, but now they'll have to. It's their workmanship that caused this and they'd hoped to hide behind the 10 days, never mind it was fraud because the workmanship was contracted at a higher quality than the product delivered.

7 months in, and she's dropping marriage hints. She's obviously already hit the wall, so since she's found a dude with money, she's gotta clamp him down. Imagine rejecting the ring that the man you profess to love, gave you as engagement, simply for a fault that nobody will ever see. That tells me she doesn't care about the sentimental aspect of the ring. She just wants something expensive to show off. God forbid this dude ever lose his health and can't provide the shiny toys, cause she'll be gone in a heartbeat.

My grandparents got married after 2 weeks and were married 35 years until he died. It’s none of your business when people decide to get married, and empirical study shows no correlation. @@DD-d6d3 they chose to make it a lawsuit by delaying the appraisal and thus not finding the issue sooner, and they won it so big deal. If this is too much to be reminded of this relationship is doomed (as if 7 months hinting for marriage isn’t red flag enough).

personally, i would ask for a discount on the ring but would keep the ring because thats the one i was given on the initial proposal and that means more to me than whatever flaw the ring has. I'm one of those sentimental kinds of people where a second ring would just not be the same

The issue of "he didn't get it appraised fast enough" is kind of shitty since you're not expecting a new, multi-thousand dollars purchase to have hidden issues; a buyer shouldn't be obligated to appraise it/take it to a professional ASAP in order to make sure it's up to snuff before the return policy voids, especially when the issue(s) are hidden and can only be figured out by a professional. How is a reasonable defense: "you didn't go to X professional(s) to make sure nothing was wrong with your new item in a timely fashion, so it's not my problem anymore." That'd be like buying, say, a new computer, and shortly after the return policy you take it in for some upgrades and the professional finds a defect (like a broken/improperly installed RAM slot) that had to of happened during manufacturing so you can't get the full upgrade you want, and the defense is "not our fault, you should've taken it to a computer expert right after buying it to make sure nothing was wrong with it before the return policy voided."

US attorneys only make about $75k a year and the average attorney has nearly $200k in student loans. The debt to income ratio makes finances pretty tight for US attorneys.

The fact is that most lawyers who go into public interest positions like prosecution at the federal or state level struggle financially as in they live pay check to pay check. You know exactly what the judge was saying. It’s not that deep.

What I find funny is my step father spent 28k for a diamond ring for my mother years ago....My husband bought me a replacement ring that we both fell in love with because I didn't have a wedding ring set because we lost it in the flooding of Hurricane Irene 2011( we lost everything......our home of 18yrs, both pets, our belongings and our only vehicle and still dealing the emotional side affects of what happened).....I'm not a female that likes to spend lots of money on rings etc its the thought behind that counts....The new ring was like under 50.00 and everyone loved my ring over my mother's 28k ring...They couldnt believe my 50.00 ring wasnt real and boy did my mother get mad over that idea....Now they are divorced and my husband and I are still happily together...and she didnt return the ring either...She thought she deserved that ring....just mind blowing....so I guess what i am saying is spending 5k-28k on a ring isnt the best thing...its the thought of having a piece of jewelry significant to show the love that your husband has for you....or no ring at all...I went months without a ring...but my hubby did open a prize from a gumball machine thing and it was an expandable ring for me to wear...lol again the thought over price is PRICELSS in my book....29 yrs later 2 beautiful kids...and i love my husband as i did when i first met him in 1992 married in 1993...He asked me to marry him on our first date....

Usually these cases the people are materialistic and unreasonable but here the lawsuit was certainly in order. The put their case together really well also.

I find this interesting…. It’s considered fraud because you sold someone something you unknowingly wasn’t something. But if you do the same for a car. It’s oh well?

actually, People's Court deals with used auto fraud cases from time to time. If there are clearly documented misrepresentations, plaintiffs win cases

@@mdgamble this was a sale with two conditions: 1) 10 day return; 2) gem certification. Buyer missed relying on 1), Seller failed on 2) diamond provided was not as described

The lady just seems like it's more about the ring than anything else. This poor guy went through so much effort to get this ring and then she's like naw I'm good. That's a huge red flag and I wouldn't be shocked at to learn they have gotten divorced.

Fellas, small word of advise, get the ring appraised as soon as you get it. Chile if that diamond would have fell out before it was appraised, he would have had a hard time with her and the jeweler.

I completely disagree with the judge here. There is a clearly stated warranty. And the groom waited too long to bring it back, and the warranty is null and void. I will be proposing on Monday. I made sure that the proposal happens two weeks before the warranty expires. This gives me plenty of time, if something is wrong, to take the ring back.

I'm a little confused, why did he have to have it appraised after purchasing it when surely the diamond had already been appraised before he bought it, otherwise how could he know what he was buying? A diamond that is only an SI2 clarity, is the worst quality of a diamond, and a cushion cut isn't worth as much as a round cut diamond, so he wasn't buying the best diamond, he was buying it for the size, whereas if he had bought a better clarity, round cut and smaller in size, it would have been worth more...

I could be wrong, but I think it was more of a double check appraisal. He (the defendant) had it appraised by his people, now the buyer wants to have it appraised by a guy of his choice to double check. That is why if the appraisal had come back accurate the plaintiff would of eaten the costs of said appraisals, and couldn't have successfully sued for them.

@@joshdavis3743 If that was the case, you have it appraised BEFORE having it put in a ring setting. And today you shouldn't buy a diamond without a real GIA appraisal where the diamond is micro-laser engraved on the edge so you can't swap it for another diamond. This plaintiff bought from a middle man with his own meaningless appraisal, which tells you it's not legitimate and the diamond could very well have been damaged BEFORE being put in the setting. And what jeweler doesn't know how to put a diamond in a setting, but instead chips the diamond, only an amateur, that's who...

She is right. i paid $500 for each of our rings, 25 years later we are in a better financial state than we was then. We will NOT grade our rings. I did down grade a my ring due to my work. Anyone that willing to spend the price of a down payment on a home, for a piece of glass, my power to you. it’s about the status in the image for the woman it’s not about practicality in reality

I know this episode was uploaded to YT two years ago but I feel sorry for the dude - parents have a house in Breckenridge Colorado (implied it was a vacation home), she wants a whole new ring (and probably a more expensive one) rather than the one that has meaning with it - like how is his next proposal going to beat what she felt the first time around? Going to guess this guy has signed himself up for a lifetime of big expenditures to keep her happy. If I was a betting man I'd wager she was a bit disappointed it was 'only' a $5k ring that he got her.

I have a question. Wouldn't the diamond dealer have looked at the ring afterward to make sure the diamond was the same one before passing it on to the customer? And if he did would he have seen the flaw? Makes me wonder about my own rings after having my largest one sized...I just assumed the diamonds were not damaged.... are they still the original diamonds? Guess my sons will find out after I'm gone and they get my jewelry appraised. No daughters to hand all my jewelry down to.😞😞😞 I wanted a daughter so much! Sorry...my brain just went in a whole different direction now.

Stupid appraisals. I understand people want to get their money's worth. It's about value. But at the end of the day a knick on a diamond does not take away from the marriage. It's not even visible with the naked eye. People put so much emphasis on the material. It's a pretty, shiny thing on a finger. If it's not perfect, well neither is life, and neither will your marriage be. Let it go . . .

Milian ignores the UCC(UNIFORM COMMERCIAL CODE) which gives you 1 to 4 years to put in a damage claim. NOT JUST A 10 DAY RETUEN. Milian and judy constantly ignore the UCC CODE. WHIC GIVES YOU UP TO 4 YEARS TO MAKE DAMAGE CLAIMS!!!!!

I've been married 22 yrs, I still have 1st ring he gave me, we have upgraded but I've had same upgrade for 20 yrs. I DO NOT care about the ring, my original is 1 means TME MOST.
