The plaintiff says he was parked at a diner and saw a truck parked there. He saw the truck’s driver near his own car and discovered it had expletives written on it in magic marker, and his bumper and panel were bashed in. The defendant admitted to police he caused the damage, so the plaintiff is suing him to pay for the repairs. The defendant says he damaged the plaintiff’s car because where it was parked made it difficult for him to leave.

16:13 "Who takes pictures of the other cars in a parking lot?" The guy who knows he parked like an ass. I wouldn't damage someone's car, but if someone parks ridiculously and I can park in the space next to them blocking them from being able to open the driver's door I often do it. I had one person yell at me when I was parked perfectly between the lines, she couldn't open her door because she had parked over the line with lots of room on the other side. I pointed out that she was the one that parked like an idiot and told her she should have been nicer, then went back into the restaurant and ordered a desert that I took my time with. She was still there fuming, but kept her trap shut so I drove off.

The plaintiff even said he could see that the defendant's truck was sticking out, so he knew that in parking his car where he did AND in the wrong direction, that he would be blocking him in. And the plaintiff lied about having taken photos beforehand, saying he deleted those photos, but strangely had the 'after' photo of the scuff on the side. And there is nothing more irritating than a car deliberately blocking you in, so I can understand the defendant's frustration, but he should have phoned the police and have him towed away...

He took the photo of the scruff on the side a few days after the incident. I think the plaintiff deleted the photos he took that night because it would have proven he parked illegally. The snow bank made it impossible to park in those spaces correctly. The defendant should have done what the judge suggested....spoken to the restaurant manager and had the defendant come out during his dinner to move his car.

As odd as it sounds, I sometimes take pictures of the license plates of cars parked around me because of past issues. As this case proves, many people have no integrity. But I really think the plaintiff is a huge jerk. The way he spoke to the judge shows what hot stuff he believes himself to be. I believe he parked where he felt was convenient for himself and said screw everyone else. That's why it was "irrelevant". The defendant is also a jerk, because doing something so dumb (and illegal) in front of his child is just setting his son up to find trouble in the future. I can understand his frustration because I've experienced many stupid drivers and bad parkers ( in Massachusetts) but to blatantly vandalize his property was just highly immature. Another immature but legal option was leaving a colorful note expressing what an a**hole he was🤷‍♀️The defendant's actions may have given him instant gratification but what it cost him in the end wasn't worth it. They are both hotheads and contribute to the sh*ttiness of the world.

This plaintiff isn't just "presenting his case." He's trying to tell the judge how she should think. He seems to be used to bullying his way through a discussion. Does he bully his way through other things as well? Also, he claims he took pictures, but didn't think they were necessary to keep, so should the judge just take his word about what they showed? Because he had had damage before. But, he "straddles" wrong. In EVOC, we used to be taught to try and find four empty spaces in a 2x2 grid on parking lots, when driving an ambulance or brush truck or similar sized emergency vehicle. This leaves clearance all the way around, and also avoids "block ins".....

The defendant fails to realize that the ruling wasn’t only for damages, but for punitive damages (malaise). He’s obviously not remorseful at all. The plaintiff parked in an unauthorized way, knew it may cause problems, and took a picture of the other vehicle’s plate in case anything came of his actions.
