Being a Messy Mover

The plaintiff says she hired the defendant’s moving company, and she claims he overcharged her and damaged some items. She’s not going to be pushed around, so she’s suing. The defendant says he has no idea what the issue is, and he claims the plaintiff wasn’t even home when they arrived with her belongings.

They were supposed to get there early in the morning. 10 AM, which is the time they would have gotten there with no traffic is not early in the morning. The mover is completely wrong. They had agreed to be there early in the morning and they broke that agreement. The defendant also had no evidence that they tried to call her before they arrived.

@@nBasedAce the defendant had his phone records showing him calling her repeatedly the rest of that day and the following morning. They were expected at 10am but hit traffic. Two hours is not breach of contract. If that were the case, every delay in delivery would bankrupt companies like ups and FedEx. Regardless, knowing she wasnt gonna pay the actual amount owed, the defendant agreed to a settlement amount of a lower rate. The plaintiff then wanted the original agreement amount paid to her, so she expected the company to pay her for moving her stuff. The plaintiff should have either been there or designated an agent on her behalf to be there for them to unload. Or answer her phone.

I had to go back to listen to the announcer to see what she was suing for. This lady is crazy and entitled. The final bill was $2,000 but they gave her the opportunity to only pay $1,300. Someone need to tell the plaintiff the $700 she didn't pay covers her damages. Also, they were waiting for her, with HER stuff but she didn't show up instead she went to work. Also, he could've charged her for storage.

I have moved too many times in my life to count. However, I have used a moving company only three times. I was very fortunate to have top notch service all three times. Very minimal scratches or dents. Then I was reimbursed for those. However, I took off from work the day before, the day of and the day after each major move. Took pictures of everything before it was packed. I know you have to work, however, moving is a big deal. Time starts ticking once that truck starts up. I am too much of a control freak to trust anybody with the move. Because I am so methodical and organized, the movers wanted to hire me to teach people how to pack, label and organize a move. I bought food for each of the teams and tipped each member. Prices, time expectations and insurance were discussed before hand. It pays to be organized and available.

I've moved many times due to military service. The moving companies that moved me NEVER insured what was already boxed up because they didn't know what the contents were, not the condition prior to them moving it. I had very minimal things broken when my stuff came from Japan to GA. I can't imagine a 4 hour move causing much damage, if any.
