It’s a 100% fact you should never drive an overheating car. The fact their car overheated so badly, they were stranded TWICE means they damaged additional parts multiple times. Driving a car “slowly” doesn’t make the issues any less severe, I have no idea where she got that information from

She admitted that they continued to drive a car that was overheating. They either fully or partially contributed to the damage done. The judge tried to get him to understand that he was speaking too fast and using too much jargon for her to understand. If he would have slowed down and helped her to understand that they more than likely caused the damage by continuing to drive a car that was overheating, he probably would have won. They just got a free get out of jail card.

It’s basic comprehension to not drive an overheating car, the only justification is to drive it somewhere to fill it with coolant, but she stated they kept driving it because they had no other transportation and were stranded twice. Those two times the car stopped working could cause CATASTROPHIC issues.

The only thing the defendant was wrong about was charging more for a new starter. The car was over heating. The first issue that needs fixed is the bad head gasket. Once that is done and it still overheats then there is another problem. They should not have driven at all if it overheated. The head will certainly have the same issues if you drive it while overheating. I believe the judge was wrong in this case.

They paid 1600 the first time to have it fix. But he scam them by using junkyard parts. Honda redid his work and it was fine after they worked on it.

No, Honda also did the heater core. Brand new head gasket can fail in one drive with bad heater core. If the mechanic wasn’t a dummy he could have explained that.

He may or may not have fixed the head gasket properly. All we know is it still overheated shortly after leaving his shop. He should have done a long test drive at various speeds to cornfirm that the engine temp wasn't still climbing. Sometimes with overheating you can run the car at idle all day and it will never overheat but as soon as you take it for a drive the temp starts to rise. If he had done the test drive, he would have discovered the other issue. It's incredibly important for him to be 100% certain that vehicle isn't still overheating when it leaves his shop. Without that confirmation there is no way to prove that the car owner caused further damage and that his repair was done right.

Had this same issue with a Jeep Grand Cherokee... I drove carefully, shutting it off and letting it cool down before continuing, but still managed to overheat the head and cracked it. Confirmed by dealer. Stop driving the dang car. Continuing to drive causes more issues. I believe the defendant when he says they authorized the dealer to do what they needed and didn't for him [because the whole reason why they chose the defendant to work on the car was to save money, as he was a cheaper option].

I’m a mechanic and The plaintiffs drove the car because they spent money but they caused more damage in between time. When the car is overheating you check for leaks, thermostat and water pump. Both the defendant and Honda wasted a lot of unnecessary time trying to milk the couple for whatever they could

I’ve had the dealership destroy my car, diagnose it completely wrong, “fix” it, still happened again and then claimed the actual issues were “outside of warranty.” Dealerships to ever be trusted, I had to fight it and received confirmation it was within warranty… and then fixed that part and it STILL didn’t work.

I believe the defendant failed here. At the beginning they charged her an unauthorised extra charge for a repair to the starter. He later states that the problem was due to there needing to be repair to the starter core. He said they did not replace it as they were unauthorised. Why would they not tell her and ask for authorisation?

It needed a repair to the heater core, which was only backed up by there complaints of coolant leaking in the cabin. I’d be willing to believe that he told them it had a cracked heater core, not engine block. Driving the vehicle while overheating will cause the prior work that he preformed to fail. The Honda dealer wouldn’t go out and give that statement without the plaintiff requesting a statement for a lawsuit. Changing the starter without prior authorization was wrong but in the end the plaintiff was wrong for continuing to drive the car while overheating.

The car sounded like a scrap pile. He had to replace the starter to even get the car to run for a diagnostic on the overheating problem. He should’ve authorized the starter repair but it sounds like he was just trying to do his job.

They originally blew a headgasket. Guarantee when they did that it overheated and blew the heater core. This mechanic fixed the headgasket. But didnt realize the heater core blew as well. He should've caught that when they brought it back in, but didnt. The bad heater core caused the car to keep overheating and eventually led to another blown headgasket.

The problem is (apparently, because I am not a mechanic) he could not diagnose a bad heater core after the head gasket was blown, and when they "brought it back in," the head gasket was already blown (due to driving the over-heating car), so that's what he fixed again. If the plainiffs had stopped driving the car AS SOON AS it over heated (and BEFORE blowing the head gasket again), then the mechanic would have known that the head gasket was NOT the real problem and would search for another issue (he even said as much, but the judge missed it).

No the first thing u check is the technical service bulletin, second they never actually fixed the car, second they did in fact have the heads off and would have noticed and stated or should have stated it would be bad, and an incorrect torque on the heads can crack the block and also make the new gasket useless. This was 100% the wrong verdict. I understood every word he was saying. The dealership redid the head gasket because, just like with him, they had trouble finding the heater core issue before doing unnecessary work. Then, add in the fact that they kept driving the car, knowing it had an overheating issue. The only question I have is whether or not the first mechanic should have located the heater core problem more effectively, even though the Honda dealership couldn't, either. The defendant was wronged, because he wasn't able to explain himself properly, and the plaintiff prevailed even though she shouldn't have.

I do agree the additional damage was cause by them driving the car while it continue to heat up, the judge miss the part that she mentioned she took it to honda to diagnose the car to get a second opinion and was charge 1500 vs the local mechanic 1200 for the "SAME REPAIR".. if they let honda repair the car for the same repair, they would been in the same shoe as well.

The mechanic got shafted . He couldn't diagnose the heater core without fixing the head gasket and getting it running. They drove it with no coolant so they killed the new gasket. The dealership lied because once the second gasket failed it would be impossible to determine how much torque was on the bolts.

The starter did him in. Only people that work in cars know that sometimes the symptom gets fix because the cause is masked by the symptom. It happens to the best of them. Customers think they are getting scammed when the cause is discovered after the repaired symptom fails.

Yes, one big problem can hide another smaller problem. Going to the doctor is the same. All the parts are connected and so if one of the em is malfunctioning long enough, it causes other problems and only if you pick away at each symptom can you fix the underlying cause of the problem.

Overheating requires a lot of trouble shooting. I have a Honda and I went through a lot to address overheating over several occasions and multiple mechanics. I changed the top radiator tank, changed the motor for the fan, changed the radiator cap, changes the clips for all the hoses, changed the thermostat, repaired the goose neck, rodded out the radiator, changed Coolant.... You know what I never had to do? Change the head gasket or repair the engine block... Everybody and their mother know that once the overheating sign comes on.... You stop! I don't think the judgement was fair.

the judge is wrong, the heater core caused all the problems. he said the engine was replaced with a used engine before all the repairs were done. the heater core causes an air packet which will causes it to overheat. if the engine was overheating it should not be driving.

I'm going to be the odd man out here I disagree with the judge's ruling on this case I think the defendant is absolutely correct in saying that them continuing to drive the car by their own admission could cause an array of problems and a cracked head gasket of course Honda is going to tell them that all the previous work was done incorrectly and that it needs this and it needs that, larger car lots are notorious for doing that, this is coming from somebody who has a fiance who is a mechanic at a larger car lot some of the stories he's told me about the last car lot he used to work at were disgusting, another thing that annoys me about Judge Milian is that she will ask a litigant a question they will go to answer her question and while they are in mid-sentence she rudely interrupts them they try to finish what they were saying and then she tells them not to interrupt her she also told the defendant that just because he talks loud and Fast doesn't mean he's right.... if that's not the pot calling the kettle black! she is notorious for talking fast and loud 🤦♀️🤦♀️🤦♀️ I don't even completely trust that their car is 100% fixed and then it doesn't still have issues Honda may have fixed one problem but that doesn't mean that all the other problems don't still exist.

I tend to agree. And additionally, overheating problems can be very complicated to solve because so many parts involve is a cooling system. The blown head gasket is a result of a overheating problem and not the cause

30 seconds in, you know it’s verdict for the defendant. If there was a warranty, bring it back to the original mechanic. Don’t bring it to another store. That voids your warranty. Also, never take a vehicle that is not under warranty to a franchise dealer. You were just asking for trouble. I gave a friend an old Acura I had with 240,000 miles, so they could have it as the first car for their daughter. They made the mistake of bringing it to an Acura dealer, who quoted them almost $5000 in repairs. It was literally a first car to learn on. They were so freaked out, they donated it to purple heart. I did great, a ton of money. It was really disheartening.

Judge Millian got this one very wrong. The defendant was 100% right and honest. They kept driving a car that was overheating further damaging it. It is so annoying when the judge doesn’t listen or understand certain things like auto mechanics. Dealerships always want your money. Plaintiffs knew they were wrong. So annoying.

I'm with the defendant on this one, except for the fact that he charged them for a starter that they didn't authorize. That was his only mistake. He fixed the first problem, and they refused to authorize anything more, so he wasn't able to fix what caused it. They kept driving the car, it continued to overheat, and the thing he fixed broke again. The Honda dealership fixed it again, then ALSO fixed the thing that had caused it to break, which he had never been authorized to do. JM obviously didn't understand a word he was saying, but he was right. They screwed up by continuing to drive an overheating car. Defendant was robbed. He should've had to reimburse them for the starter and that's it.

They didn't want to fix it all at once because they didn't have the funds. But I do think the mechanic should had been more clear or even wrote out on paperwork that not fixing the problem all at once and replacing parts one at a time can cause repeat damage or worse.

Whoa… I’m shocked… Judge M missed this 1 by a mile. IMO, she made an emotional rush to judgement without wanting to understand the diagnostic protocols of the technician. Also failed to recognize Honda Motorcars technical service bulletin pin-pointing the root cause of the overheating problem. Head gasket has been compromised. Shop replaced it. I’d say 8 out of 10 techs would have done the same. PS: Never ever ever continue driving your car if it overheats. Ever. Turn it off & spend a hundy on a tow truck and take it to a local, we’ll-reviewed independent repair facility.

I'm a professional mechanic with a lot of experience. The defendant was mostly right. If the heater core was leaking and the car was overheated to the point of blowing the head gasket then the gasket would be the far more serious and obvious problem and would be fixed first. And it would be easy to miss a heater core in that situation. If the plaintiff continued to drive the car and it continued to overheat she should have immediately taken it back the shop. Now the defendant was way out of line with the starter repair. If the plaintiff was a good customer as she appears to be then he should have gotten authorization before doing the repair just eaten it. Starters aren't expensive for a 2004 Civic. Once it was known that the car was still running hot after the initial repair and there was coolant in the interior any average mechanic can diagnose that as a heater core. A lot of what the defendant is saying makes sense, to me. But I have almost 40 years of mechanical experience so it's easy for me to understand. The defendant didn't explain things very well so it made it sound confusing but at the same time he should have warrantied his work even if the heater core was leaking and then sold the heater core job. It honestly sounds as if he has mechanics working in his shop that are less experienced and might have misdiagnosed a cracked block or something. And cracked blocks are very rare, especially on a car like a Honda Civic.

also the only reason the problem got fixed by the dealer is because the plaintiff gave the dealer permission to fix anything necessary to solve the problem and she did not give her mechanic that same opportunity , so the judge completely was in over her head and did not understand the situation because her lack of knowledge regarding auto repairs.

My dad has been an extremely trustworthy mechanic my entire life and I don't think the guy was trying to screw her over like she let on and based on what she was saying about her going to him for years, why would he suddenly rip her off? It just doesn't add up. I wish the guy had explained his case better because to me it really seems that because she was only willing to fix 1 little thing at a time rather than getting to the source because she didn't have the money all while driving it with the issues, she shouldn't have continued overheating it. Which would mean things have to get redone & the root of the problem be fixed. It was a breakdown of communication between the customer and the mechanic. And the Honda dealer just got lucky and got the biggest job of all of them. Yes, this is all speculation, but I'm sure they were willing to put it down on paper it was some other guy's fault so she could have a case and get the money to pay the Honda dealer off instead of having a payment plan.

Sorry, Harvey but no, a dealership is not the end all be all of “knowing their cars”. They can actually be super shady places. I bought a Chevy from a Chevy dealership and my check engine light kept coming on. It was under warranty and so they had to “fix it for free”, they never fixed it, the check engine light kept coming on every couple of months. I finally took it to a my boss’s mechanic and they found out that my O2 sensor was bad, they replaced it and I never had that problem again. I doubt the dealership ever even popped the hood of my car, they just turned off the check engine light and called to tell me my car was ready.
You cannot keep driving a car that's overheating, doesn't matter if you have no other transportation. You're going to ruin the engine... Just like I did LMAO

So they paid Honda for the diagnostics to be done and a quote. Then they found someone cheaper to do what Honda said was the problem. But turns out, that wasn’t the whole problem. These people are just cheap, this isn’t the mechanics fault at all. He even did a hydrocarbon test to see if his repair was sound. On top of that, they didn’t stop driving an overheating car. They even said they didn’t want to put more money into the car.

I took my car to a reputable mechanic to check my brake pads as I was due to drive a long distance, he said I could easily go for another 6 months before changing them, but the next week it was making horrible noises every time I braked, he checked the brake pads and brake disks and told me there was nothing wrong with them. A month later I couldn't stand the screeching noise any more so took it to another mechanic and they told me my brake pads had completely worn down and that in having no brake pads I had ruined my brake disks, so everything needed replacing, it cost me an absolute fortune. Not all reputable mechanics are reputable...

Brake discs are the same thing as brake pads. You also could've picked up a rock in the calipers and was making the noise. You could've bent your heat shield into rotors. So many things to list.

She was in the wrong because why would you continue to drive the car and knowing that it's overheating and bring to the mechanic and the mechanic says stop driving it cause it's overheating and I can't find the issue because you keep blowing head gaskets and stuff like that so no she shouldn't have won this case I understood everything that mechanic was saying and the only reason why he lost is because he didn't explain it better to the judge who isnt knowledgeable in car mechanics

Why didn't Honda pick up in their fantastic diagnosis that the heater core was damaged? Especially when they apparently had a history of heater core problems. Sounds like maybe the dealer was acting a little dodgy.

Tires plus has always been a rip off. Took a vehicle in for oil change they didn't plug it. On the way home the car stops and engine light come.

Problem with this judge is she tries to act like she is knowledgeable on every field. What the defendant said was 100, the coil caused the over heating that blew the head gasket. After they fixed the head gasket it was only a matter of time for it to be blown again from over heating. The dealership should have caught the coil issue in the first diagnostic. They missed it and the mechanic/defendant just fixed what he was told to fix and tried to save them $300 at that.

she should not have won this case. she withheld information that was important to the mechanic 's credibility because after the case was ruled and she was in the hallway she admitted that she had been his customer for years and never had a problem but she cleverly did not mention that to the judge so i think she misrepresented her mechanic in court to help her case.

also the only reason the problem got fixed by the dealer is because the plaintiff gave the dealer permission to fix anything necessary to solve the problem and she did not give her mechanic that same opportunity , so the judge completely was in over her head and did not understand the situation because her lack of knowledge regarding auto repairs.

No. I think there was some miscommunication between them. I think the defendant was right all along, but didn’t communicate everything properly/effectively. The plaintiff continued to drive the car while overheating and then act like its a mystery it blew the head again.

You don't just replace a head gasket without identifying the cause for the overheating in the first place. It's like changing the inner tube of your bicycle tire, but leaving a nail in the tire.

driving slowly does not help with the heat it would have been better if you drove fast. otherwise stop and go with a 30 minute break to cool the engine down. mostlikely caused more problem doing this. Did the defendent not find any leaks on coolant that coolant has to go somewhere.

I’m confused why people disagree with the verdict. They came in and paid money to have the car fixed and the issue continued. So they should get their money back. If they can’t fix the issue and it continues to persist, then they shouldn’t charge for the work. Tell me if I’m wrong.

a friend of mine had a HOnda......the car was in a garage at least once a month, for days at a time. The Honda dealership to which she was taking the car was just terrible. (she bought a Hyundai which was good for 15 yrs.)

My Honda is 20 years old. Just now I've had to do repairs on it other than regular maintenance and tires. It's still going strong after work on front end and brake pads. Both my Honda Accord and Honda Pilot have been work horses.

Well ya he is right, if the heater core is bad don't drive it there are steps to fix it,And all mechanics are in completion with other mechanics so he's not lying but I didn't hear anything about the warrenty on the car he has 3 chances to fix the car even after the warrenty expires cuz it's an on going issue, the same issue not a new one but issue they originally were working on

I had expires Plus Tell me something was wrong with my vehicle when it was overheating, They charged me like 60 bucks to run a diagnostic. They wanted to charge me some outrageous price. I got a free diagnostic at another mechanic and the problem was only some $30 part. I spent less than 100 bucks to fix the problem. Tires Plus is a rip off. And they give their mechanics commission. So of course they're going to tell you extra stuff's wrong with your car that you don't really need.

Don't trust your dealership. Ask for reports, see the numbers and the parts yourself before agreeing to pay a penny. Mercedes dealership tried to screw me over and they couldn't. Toyota dealership tried to screw me and actually succeeded but I got back at them. They don't care about you, they care about their money and want to get away with as much as they can. And they do get away with a lot.

Nope she had a piece of paper that any Honda tech could've wrote up and you can tell them what to say so that they will get your business. She was also in front of a judge who doesn't know a lick about cars. They don't call them "stealerships" for nothing.

No way to know that the heater core caused the original overheat. Head gasket failed and needed replacement before you can even begin to diagnose additional issues. You are correct.

Dealer ships most of the time are full of crap they knew the head had been done and they knew about the over heating problems of that model in the past i've been to court many times because of dealers lying or twisting the truth i've been to court and taken full diagrams of engines etc so the judge understands and before i show everything to the customer so they get a understanding of whats going on i even get them to come in and see the job when its half way though i even take picutres and send them to the customer i will even do a video if they ask what i do is try and cover everything so the customer sees all and they get all the used damaged parts in the boot wraped in plastic .

its not easy working on car especially old ones. theres no exact pinpointed cause for every situation. sometimes u have to use ur intuition to figure issues out and that may not even be correct.. the dealership hides information from independent shops or charges astronomical prices for technical repair data.. then people want u to do hours of work on their car for $50 .. lol

You should not continue to drive a car that lost its fluid. That will damage the heater core and Crack the engine block. Dealerships are known to upsell work that needs to be done. I don't think the mechanic was really sleazy. He explained it in a way a mechanic would understand. The Judge is a savvy person. But I think she should have put some of the blame on the car owners who continued to push their car until it got even worse. And then baby stepped it to a mechanic. There has to be culpability on the car owners part as well.
