The People's Court

The plaintiff says the defendants are her parents, who she claims gave her ATV to her sister and she can’t get it back. She’s suing for the value of the vehicle. The defendants say the ATV was stored at their home for two years and they ran out of room. They say if the plaintiff wants the ATV back, she can ask her sister for it.

Sometimes the kids have to know the truth about what's going on. Now they see that their grandparents and aunt are not for them. Especially a gift from their dad. That's selfish of the family.

@@hangingwithkelz3376 That was my take here. The parents call the ATV just a toy and that's all it is. It's a toy that the Father bought the kids that they can remember their father. Yes its the kids that are paying the price.

I just have this gut feeling that her sister and husband was having an affair , her parents probably found out but didn’t want any part of the drama 🤦🏻‍♀️

I feel the same way. That rage the plantiff has didn't come from nowhere. The parents knew, said they didn't want to be involved, so it registered as a double slap in the face, because the parents didn't at least validate her feelings that being cheated on (and with her sister!) was wrong. The defendants wanted their cake and to eat it too, by choosing not to pick sides. They're just facing the consequences of that. Not that I think the plantiff is behaving very well either. And if we're wrong, then she's way out of line. But if we're right, at least that would explain her behaviour. (It's also telling that the sister is lording her executor status over on the plantiff as well.)

@@pseudobean3827 Ummm. I didn't see 'rage' from the plaintiff. I saw someone who's frustrated her sister and parents; someone who can't make progress because the parents have a hand in disrupting the harmony. If my parents wouldn't allow my child to have a phone for me to contact them when away from me, I'd also limit the visits.

The parents very clearly favored the sister. And it shows that they cared more about the sister and status quo than the plaintiff.

@@pseudobean3827 They not only refused to acknowledge the harm the cheaters caused....they took the grandchildren's atv to the home wrecking sister, who promptly locked it up & now refuses to give it to the children. So they really did "take a side"--they took the home wrecker's side. It's no wonder the children's mother is frustrated, hurt, & angry. But she needs to spare the children further anxiety & just move on. Sometimes you have to put your own feelings aside to do what's best for your children. If that includes disowning the home wrecking sister & the parents in order to have a peaceful & happy future, so be it. An atv is just stuff. Stuff can be replaced. Causing the children stress & anxiety over replaceable stuff is just wrong.

Mother bought the kids to gain sympathy. She's a manipulator. Blamed her sister for her divorce stating her sister chose his side. If her sister had to choose his side, that means there was already friction between her and her husband. Then 6 months after Jim died, she cuts off all communication from her family.. probably because she married the "other guy" at that time and didn't want her family to know. I'm not finished watching this case so I hope she loses this case. She just doesn't want her sister to have anything that belonged to her.

This is one of the saddest things I’ve seen on The People’s Court in a long, long time. Those three kids are sitting there trying not to cry while the grownups in their lives behave like absolute morons. Those kids need a family, not an ATV.

They're mother did the right thing by showing their kids to not let people push you around and take advantage of you. I believe she did awesome in that aspect. That's what you need to teach your children. She taught them to not let people regardless to take advantage of you.

Judge Judy would’ve sent those poor kids outside the courtroom to protect them from all this. This was so sad. My heart goes out to every last one of them ♥️

Bad judgment for MM to ask about the aunt and father, and for the mother to answer plainly, in front of those kids. And their father isn't even alive to defend himself against such allegations if he were so inclined.

This family is clearly seriously messed up so you'll forgive me if I don't just blindly believe one side when the other Is deceased and therefore can't give their side of the story. Either way, that's something the kids should get dragged through.

As a kid that’s been in a toxic family like this, it’s insulting to pretend that the kids aren’t mature enough to interpret what’s going on. I’m sure they’ve seen all the fighting first hand and they’ve heard everyone in the family talk bad about family members that they love. In my opinion, trying to shield those children from stuff they already know and have heard would be a distraction from the help they really need which is therapy for everyone. To finally see an honorable adult put their loved ones in a place that holds them accountable without demonizing them is something that could very well inspire hope for them. And it certainly helps that they were able to hear out loud how deserving they are of healthy relationships and love, who knows if they’ll ever hear it again.

Exactly! When they kept saying they didn't want to "take sides" or "get involved", it always seemed in a way that benefited the other sister. Oh we're not taking sides but we gave your sister the ATV. We don't want to get involved but you shouldn't divorce your husband despite us having nothing to say about your sisters involvement in it. There is a reason why the plaintiff was *obsessed* with sides. She talked about it constantly. Her parents were on her husband's side, her husband wasn't on her side, etc. While this is a toxic trait, it is very often born out of feeling unsupported or neglected. The whole family is dysfunctional at this point. When asked at the end of court their thoughts, the adults were STILL going on about the stupid ATV while *again* not saying one word about the kids or what they want to happen with the relationships, despite the note JM finished on. I feel terrible for the kids; they are now also unsupported by the adults in their life, and clearly are filling that gap by supporting each other. Hopefully their dynamic and love doesn't get tainted by what they're seeing and hearing.

What was the purpose of the plaintiff even bringing her kids into court to witness this drama? They look sad and confused. She's just using the ATV and her kids as a pawn for deeper issues she has with her sister. Her children's mental health is way more important than an ATV.

I think they got drag in it so they had to come for the ride. Sadly rumours and gossips in the family travel so far and children are usually chess pieces between adults. They would hear something and it is a disaster if they got manipulated. It is not ideal but they are not born in ideal life nor to ideal parents. If this is what they need to go through to pass whatever mess the sister / ex husband did .. and is haunting them .. there be it.

I believe the plaintiff’s sister had an affair with her ex brother -in-law; leaving her the executor of his estate added insult to injury! The plaintiff needs to let her anger and bitterness go so that she can heal and focus on her new life and husband. There’s no way her kids should’ve been on court today. It’s not about the atv. She’s blaming her parents for the actions of her sister and dead ex! She needs to let go and give it to God!

Kids being present....absolutely a screwed up decision by the judge and the family. Makes me sick. I don't know if I can ever watch this program again.

yup Judge Judy has it right.....she sends children out of the court before the case starts. That sister needs to go before a judge....there's NO way that an executor should be taking that long to do her job. All the best to you!

Noooo, the husband knew that she would spend and sell everything so this was the only way to make sure the kids had something when they get older , otherwise why wouldn't he just straight up leave it to the sister

There was definately an inappropriate relationship with the sister. It's obvious. Did he not have a will? Where is his family? The kids wanted the ATV which is what kicked this off, and why they were there. They should have been dismissed from the courtroom. Also, it appears that the kids had been riding the ATV up until the point their father died. which there would be no reason for the plaintiff to ask for it because they had access to it. The parents don't want to get involved, but they should have just gone and got the ATV for the kids, instead of taking a step back. The sister has the leverage since she's the executer. Also, I wouldn't allow my parents to see my kids either if they knew my sister was sleeping with my husband, and they refused to draw a line, or at the very least advocate for me. I wish the plaintiff would have just said that, but I feel like she didn't because the kids were there- which is why they should have been dismissed. But that sister was definately having a relationship with the plaintiff's ex husband, and the parents knew.

@Annie497 Listening to the grandparents state they didn't want the kids to contact mom when they were with the grandparents, and the fact they sued the daughter to try to get grandparents rights and visitation? The kids were placed in the middle of the grownups when the grandparents acted like that. The grandparents put them in the middle fighting for custody that they had no rights to.

Wow! Her husband slept with her sister, and the parents minded their business. WHY WOULD THEY TAKE THOSE KIDS THINGS TO HER HOUSE?! Her parents are toxic… and she was right to cut everybody off. The kids didn’t need to be in the courtroom.

i don’t think the mom is an angel either, bringing the children into court and involving them at least somewhat in her familial issues like keeping them from grandparents (who the kids likely want to see if the mom agreed to it after their court case) is terrible. using your kids as pawns in family drama is heartbreaking. everyone in that family needs to focus on putting those kids first and keeping them out of the drama, it’s sad to see so many grown adults do this to children they say they love. i truly hope those kids are in a good place now!

We don't know what he had put in his final will or who he had listed on his life insurance. Besides, why does she have to be careful, someone going to take away her birthday.

The parents are toxic? WTF? They aren't the ones that used the kids as pawns in the courtroom. Also, you have know clue if they slept together, just like the wife. His wife doesn't exactly seem like a pleasant woman to be around so maybe he brought her along all the time as a buffer. The parents did mind their business. All they did was move the shit out their garage to make room. Plus she was the executor so it makes total sense to move everything there. You make no sense.

I know the mom needs help with anger and hurt BUT can you imagine her sister withholding from her kids after ( most likely) screwing her husband behind her back after allowing her to move in to help and having your parents just not doing anything to keep the peace. The “sister” being the executor of the estate was sheer evil . The sister is pure and utter evil for getting in the middle . My brother did the same thing, God has a special place in hell for a sibling who steals from another one ..

@@chrisshaffer2672 WOW, you just don't get it ..... You must have a streak of evil in you... It was clear that the life insurance policy of 250,000 was to be FOR THE KIDS .... The ATV was FOR THE KIDS ..... THERE IS ZERO REASON for the sister to sit on the estate while the money from the policy and the ATV depreciates in value due to inflation .. If you can't see that you are really something .. The moms attitude is NOT relevant ... This was an estate that BELONGS to his children ...

@@chrisshaffer2672 If the sister was a good person, she would have declined to be executor. Being named executor doesn't mean you are obligated to do it. You can refuse and have the court appoint someone else. A normal person would know the trouble accepting that executoriship would cause.

The sister should have distributed the estate already; it's been 4 years. The estate should be distributed to the kids but the sister doesn't want to do it because of the mom. Likely, in the sister's eyes, the wife was preventing her from being with the husband and despises the wife because of it.

and it's disgusting that so many people are blaming the mom for being the victim of it all alongside the kids. She didn't ask her parents to gaslight her and 'not pick sides' by picking sides. She didn't ask for the husband and sister to pull these massive cunty moves; cheating on her, screwing her out of the estate and insurance, etc. Everyone IS against her, it's not her just feeling it. The grandparents are against her simply because they CAN'T be against the sister and that's what this whole thing boils down to. Everyone doing everything for the sister.

Sometimes i don't like how judge Judy acts but i do agree with dreamingfool2 that judge Judy would have sent the kids out cause kids don't need to be exposed to adult issues like that. I know cause growing up watching my parents crap affected me alot. Let kids just be kids and not have to worry about adult things.

TIOTALLY AGREE! No reason for them to be in court. I almost feel that when things started to get really bad, the Judge should have had the children wait outside- but I think she didn’t because she wanted the kids to see the Judge talking to their grandparents and mother and setting them straight...

I disagree. I think the sister was screwing her husband and her parents took the sister's side. The sister has no right keeping those kids inheritance from them, and the grandparents had no right giving the stuff to her sister.

@@mrmc9278 As much as I might agree they had no choice. If she is the executor of the estate and she demands the brothers property they have to give it to her. That being said she's expected to distribute the property not keep it. However unless theres a time limit clause she can take literally forever to do it. She needs to sue the sister. Still dont care for her attitude.

The plaintiff was absolutely not making that up. The defendants only said they weren't taking sides because being against the ex would be the same as being against the sister. So by that logic, they were taking the sister's side.

The parents are weak and their decision to stay neutral speaks to their complicity in this situation. They should be ashamed of themselves for choosing to do nothing. It is obvious that the sister kept the money and provided the parents with financial support from the insurance payout. The estate should have been settled years ago. With Covid, the sister is going to stretch out settling the estate even longer.

They also knew that their golden child was sleeping with their daughters husband.. that’s why they didn’t want anything to do with it but they will gladly take the financial support that comes from it and then they try and sue the mother so they can get legal time to spend with their grandchildren that they’re really not trying to help.. to be honest everybody in this case is selfish. (Not the kids obviously)

Yeah at the same time they knew it was a Christmas gift that belong to the kids. The only reason it was in the fathers name is because it can’t be in the children’s name because they were minors when it was purchased. The grandparents were just storing it. If the sister called for it and asked for it I would have told her the children already picked it up with their mother. Called the children’s immediately after I got off the phone with her and said come get this atv, before your sister finds out it’s still here.

She deserves all of it after being put through what she has. You don't get to always get away with being a trash box person and get away with it. Mom and Dad sound like their inches away from defending it. Child or not you don't support your child in being a trash box! You can love your children and still not agree with the trashy things they do, and if they don't want anything to do with you bc you won't placate to their trash behavior well then you got to love them from a distance.

@Keith Sergent no I don't find it odd. I find it odd that ppl have become so desensitized in this world that we blame the victim and we judge how someone else handles trauma. She should have left her kids at home and she is suing the wrong ppl but she definitely should fight for that estate and everything in it, bc it belongs to her kids, and they're minors, and can't fight it for themselves. It's our jobs as parents to fight for our children's rights when they cannot.

I felt the judge handled this carefully and wisely. Claims are dismissed. This is something that small claims can't get involved in. My father taught me years ago, "sometimes you have to lose in order to win" What are you winning? Peace of mind and peace between each other. I've applied this to many areas of my life. It just goes a long way. Best to this family.

I'm a relationship counsellor in the UK and nothing shocks me anymore. We have an organisation called Relate that used to be for marriage counselling, its more up to date now. But some of the things I've seen and heard 🤦‍♀️ people will do anything to justify cheating, lying, etc.

Sounds like the sister did the plaintiff dirty after the plaintiff allowed her to come live with her while she was down on her luck and then played victim to their parents. I am a CNA working with the elderly and I have seen and heard quite a bit of family drama, and it’s just so sad. The grandchildren, wether they are still young or grown adults, were the ones affected the most by it and continue to have issues in their life, stemming from this type of thing. The saddest part for me, is even when they are in the end stages of life...the family drama continues and can even escalate. They just don’t get it. Life is short and shouldn’t be wasted on petty drama. Money, property, etc can all be replaced but once a loved one is gone...they are GONE. After that, all you have left is the could have should have would have and guilt that will eat you alive. My heart goes out to those 3 children ❤️

I see this comment so much so I'll respond to it.. It's not the mom who asks if the kids want to be in the room, it's either a judge, barrister, or security before they go into the court room that asks the kids if they want to be there. This is why in a lot of other ones the kids are OUTSIDE the court room unless their testimony is necessary. The kids asked to be there. They may have said they wanted to to be there for their mother, but their mother didn't say "Yes, they're coming in with me" Even then, the mother TRIED to not be specific about a lot of things and you can tell it WAS to shield the kids. But you can still tell especially with the details that were given, and the defendants putting the rest of the pieces together. Sister and ex had an affair, defendants knew, but didn't want to piss off the sister because she's volatile and threatens them (as they admitted to her doing twice) so they took her side while telling the plaintiff "we're not taking sides". this occuring after however long the ex and sister were gaslighting the plaintiff during their affair. The way the Judge asked "are these your feelings or do you know" after kind of doing the dick thing (usually not something she does) and asking if she believed they had an affair, that head nod that was reluctant definitely showed she knew, but again was hesitant of saying it in front of the kids. But kids often know. They probably knew. Hell they may have even caught them having an affair. Lots of people assume that their kids don't know their drama, but... they're never so clever to hide it that well.

My grandparents never had problems with it and they're the same age range. Their mom just wanted to keep in touch with her child which any good parent does no matter who they're with. What happens if they gets lost while with them how are they supposed to get help with no phone? C.) They definitely something was going on between sis and ex-husband and I wouldn't doubt parents knew. No reason she should be executor. Should have been someone from his family. She's holding 250k hostage from his children. So sad.

This case is so sad, but I understand why the plaintiff sued her parents. It's pretty obvious that the sister had an affair with her husband. They were still together after the divorce hence why she doesn't talk to her. It becomes even more revealing that the sister is the executor of his estate, and withholds the tv (that she doesn't even use).... because if she really didn't have a thing with her ex husband why is SHE the executioner and not his siblings or a family member. Not only that- these grandparents are a joke. Because they enable this behavior instead of calling their grown adult kids out on the bs they do. WHAT MAKES THIS WORSE. Is that these kids lost their father... I can't imagine that being an easy topic to talk about. They probably thought they were being punished by their family withholding something thats theirs. The emotional distress she's endured is probably way more than what was shared. I bet she was too embarrassed to share that they DID have an affair, especially in front of the kids. It seems her family is against her and I would just cut them all off. Therapy can't undo that level of betrayal. If it was ME, I'd never speak to any of them again, wouldn't want any of that behavior around my kids.

@@4everThoughtful That was mostly just a compromise to end a lengthy and pointless court battle the grandparents were waging despite them having no legal basis. Grandparents visitation rights aren't a thing like the judge said except in states that have made rules for it. Federally supreme court says they have no visitation rights. Also I went back and looked they took her to court 6 months after she laid the father of her children to rest. She was probably still dealing with the loss herself(even if he did cheat and they divorced. She still loved him and some point) and consoling her children and now she has to fight a legal battle against her own parents They were upset she cut them off after they undermined her authority as a parent and tired to keep her from being able to contact her child while with them. Parents are worry warts and just a check in text can be very reassuring. If it's excessive ask politely to tone it down. I also assume there's a lot more they did to piss her off they didn't get into for time and relevance. Something tells me they also had an idea about the potential affair between sis and ex-hubby. That's why they "didn't want to take sides".

As the judge said the only reason it's registed to dad is he paid for it and the kids aren't old enough to be on the registration themselves but all parties agreed it was a gift for the benefit and use of the children

The thing is the grandparents are part to blame for it too. While the mother was being a bit over protective by constantly texting her kids, it is not the grandparent's right to take the phone away. They should have called their daughter and tell her to not worry and everything is fine and she doesn't need to text. And if the texting continues - so what. Also the plaintiff has been through a lot as well, having a husband divorce her and end up with her sister is just nasty. Both the husband and sister should have known better to stay away, even if it is "what the heart wants". That is just something that should not have happened. And the plaintiff showed great restraint in not explicitly stating what happened. I do agree that she is putting her children in the middle of this and that is not right, but if people were a little more sympathetic to realize what she went through as well, they might understand where she is coming from.

The sister and husband were having an affair! I bet he had no idea that the kids’ aunt would block them out like this but a woman who’s sleep with her sister’s husband should never be trusted! Poor kids😔 they’re the one’s losing!

These children didn’t need to be in the courtroom. It’s not right that minors are still in courtroom and it makes the mother and grandparents look horrible. But the judge sees what is going on I’m glad she called them ALL out on their ignorance! Like Doug, I feel sorry for them all!

Watching those kids made me cry every time I saw them trying to comfort each other. Sounds like her husband was cheating on her with her sister and now the kids aren't getting what their father intended for them because the sister thinks it belongs to her.

Another sad case where the kids suffer because of the supposedly adults, because the adults are acting like children and the daughter who has the atv's is being very malacious, vindictive and spiteful...just give the kids their atv

Those grandparents are awful. And the sister? Release the estate. Clearly she doesn’t give a crap about her niece and nephews. That is their estate and benefits. Why is she holding it hostage from them? Awful.

Been there, done that. It's SO true that when he died and the title was in his name, it's ABSOLUTELY part of the estate, even if it's not referred to in the will. It has to be sold. His sister can't just give it to her. Courts won't let her, even being the executor..people don't understand how estates work, not even close family, not till you go thru it as an executor. Doesn't matter if you agree with it or not. Law is law..unfortunately the sister is right in the eyes of law and clerk of court estate division. It's an asset in courts eyes

I feel that saving money and buying a new one is a hell lot easier than going through all that messy situation... hell, sell a kidney and buy a bloddy ATV it's easier than going through that.. Or simply get the kids to go to their auntie and ask for it personally

Sister is also holding a 250k life insurance payout from the kids and won't tell mom anything. It's not about the ATV in itself it's that the parents are siding with the sister and the sister is actively harming her family by abusing her executor powers and withholding the estate

They still have to go to court for the life insurance that the AUNT should not have. It is for the CHILDREN, not for the skank

@@nickcollins1052 IF there's life insurance, which I doubt, it'll have to go through probate. With covid, probate can take longer than usual, and it can be years even in good times.

I feel so bad for those kids. I hate seeing grown adults acting so immature and selfishly that they don't even think of what their kids are going through. And bringing them to court...she only did that to make the grandparents feel bad. Those kids didn't need to be there and see how selfish ALL the adults were.

6:50 when the big sister takes the little brother's hand is such a sweet gesture. Those poor kids. That mom is weird for letting them be in on this. Just let them see their grandparents. Like this isn't painful enough for them.

The mom has a lot more ish to worry about then a damn ATV... get your priorites straight....if the ATV WAS SO IMPORTANT SHE SHOULD OF GOT IT A LONG TIME AGO

Says who? They see them x1 monthly. With divorces, the absent parent usually has visitation every other week. The grandparents seem messy; doesn't want the only living parent to text or call her own children. What kind of behavior is that? It sounds controlling to me.

Not only are the children affected, it is heartbreaking 💔..I kept my eyes on the children the entire time. After the verdict, when mom says she doubts this will be resolved, I saw the girl child's bottom lip quiver and it broke my heart. PEOPLE!!! STOP BEING SELFISH AND PUT YOUR CHILDS BEST INTEREST 1ST. Darn that was hard to watch.

Id like to see the sister cause there was definitely something going on for her to be left as the executor of the estate over the mother of his children. More so why withhold it from them.
