Police Caught Him Speeding In Manatee Zone BodyCam Footage - Florida Fish and Wildlife officers were conducting water patrol duties south of Peanut Island when they noticed a vessel disregarding a manatee slow speed zone. Upon approaching the vessel operator, the officer explained the reason for the stop, citing the violation of the manatee speed zone. Observations revealed that the operator spoke with slight slurring, and officers detected the smell of an unidentified alcoholic beverage emanating from both the vessel and the individual as he moved around. The man exhibited glassy, bloodshot eyes with droopy eyelids and unstable movements, necessitating him to brace himself while standing and eventually prompting him to sit down midway through the encounter.
Considering the culmination of factors, including the officer's observations of the individual's speech, bloodshot and droopy eyes, the odor of alcohol on his breath, his unsteady movements, and his performance during the NASBLA seated field sobriety tasks, the individual was placed under arrest for boating under the influence.

I refuse the field sobriety test and opt for a chemical(blood, urine, breath) test. Implied consent in Florida only applies to chemical tests and not field sobriety, the field sobriety test has a high false positive rate which means they can charge you for DUI if you fail it even if you blow below .08. It's sad that they can overstep the way they do.

Never answer any of their questions, outside of the required boater safety and identification questions. That's it. Nothing else. And never do the sobriety tests. The officers are not your friends and they are trying to establish probable cause for your arrest.

@@MrLayneKent They must establish on their own whether probable cause for arrest or citation exists. By answering questions and agreeing to field sobriety tests, you're only providing evidence against yourself. Now, if you believe that you're not drunk and can do testing, then that also means they would have a hard time establishing probable cause for an arrest. Most officers don't want to risk an arrest w/o probable cause (since it is illegal and can get them sued).

That cop didn’t say they are optional. You should never do them! Never!! You will only hurt yourself. Sober or drunk. When you do them YOU are providing evidence AGAINST yourself. Constitutionally you are not required to do that.

@@floridagirl386 Refusing a breath test means they take your license for a year. That's different than the field sobriety tests. If you refuse those, then they have to go off the information they already have to make a decision on whether to arrest or not. The safety inspection is basically a field sobriety test, and by watching that, they usually already have enough signs of impairment to make an arrest, whether the captain refuses the field sobriety tests or not.

Signs of Impairment: Look for glassy or bloodshot eyes. A person’s eyes can tell you a lot about them and their mental state in a particular moment. If their eyes are glassy and bloodshot, it could be a sign that they've been drinking too much. Additionally, if a person has DROOPY EYELIDS and is clearly having trouble keeping their eyes open, this could also be a sign of intoxication

@@firstsgt279 The problem is that it's all subjective and, if this channel has proven anything, it's that there are plenty of FWC officers out there with a giant chip on their shoulder just looking to put people in the jail. There are plenty of videos on here where the person passes the stupid tests AND blows under 0.08 but the fish cop still locks them up and says they suspect them to be under the influence of something other than alcohol.

I was a gov contractor on a navy base. I was an electrician at a nuclear training facility on a river. We were putting in conduit under a pier and there ended up being 2 manatee getn it on right next to our boat. We had to stop all work until they were done. We sat and watched 2 manatee's getn down for over 3 hrs, lol.

Its a pretty dumb system america uses. In Australia the police just breath test you. Sure you can refuses and its the same process of being suspended for a 1yr or whatever it is per state but they don't mess around with tests. A traffic stop for DUI is literally over in like 5 minutes.

@@terryk711 It's dubious at best. The "captain" is allowed to delegate tasks to crew or passengers however he sees fit. If it was truly about a safety inspection, it should be encouraged that other people on the boat know the location and operation of the safety equipment. Furthermore, if it's only FWC policy that only the captain can present this stuff, that policy doesn't trump the actual law. It would certainly be an interesting court challenge. This isn't about safety equipment though. These pre-contextual stops are all about catching "drunks". It's the same thing with claiming to "smell alcohol" on the breath of someone standing 10 feet downwind in the vicinity of multiple other people. It's all lies meant to get people to self-incriminate.

@@Nwmariner Agreed and trust me ...I know exactly why they only want the captain/boat driver to move around the boat. But, I would think their unsteadiness on their feet while a boat is rocking could get overruled in court with a good Lawyer and the refusal to do stupid human tricks when they stop you. In many of the cases they don't use the portable breathalyzer on the captain but they will on the passengers to see who is sober enough to drive. They could start with that but it doesn't give them that video they like to show in court.Never do Field sobriety tests. And...try to get them to tell you its mandatory.

The other big one is, "I need you to do some tests to make sure you're OK to drive/boat." If you hear that, your ass is going in. The burden-of-proof is on them, it's pretty slick how they shift that to YOU. So now I have to prove my innocence? I've actually seen a guy pass all the tests with flying colors and the cops are in a huddle going, "Well, I still think he's drunk. He's getting away with something." Yeah. Cops get better formal evaluations, more points toward promotion, and better year-end bonuses for DUI arrests. Literally, they are financially motivated to arrest you for DUI, that's why so many of them railroad people. A cop will move heaven and earth to bust you for DUI, we've all heard the stories of people on horses and 5 MPH lawnmowers getting busted for DUI. The corrupt courts dutifully declare that horses, lawnmowers, and anything that are not your feet are "motor vehicles".

wow, I’m honestly more enthralled with the absolutely gargantuan ‘super yachts’ lining the background of this video. It wouldn’t be a stretch to say some of those vessels are in the tens of millions of dollars, if not MORE, which will never cease to amaze me. As the level of wealth required to maintain those boats alone is astonishing. There are a TON of financially independent people in the world that couldn’t afford something like that in their wildest dreams.

I’ve never heard of that either. I’m not a boater, so all this is new to me. I also got a little bit into that trial where the guy was riding a river on inner tubes, got into a fight with some teenagers, stabbed a couple with a pocket knife, and one died. Interesting stuff.

Manatees are very slow swimmers who typically stay close to the surface because they are mammals that breath oxygen. They also love mangroves, warmer slow moving water, and sea grass. Which are abundant in the intercostal waterway where most of these interactions occur. They were almost driven to extinction until efforts were made to protect them. Now you know, and knowing is half the battle!

As an Australian, where we have breath analysis machines (breathalysers) to blow into providing a quantifiable reading, I think the Field Sobriety Tests waaaaaaaaaay to subjective. And by subjective, I mean, if you have a cop determined to fail you (or a corrupt one), you're going to fail you anyway. Any variation in the way the driver/boat captain does any of the exercises and you're cooked. I'm Autistic, with balance, co-ordination, and motor-functioning issues. I look normal, I can drive a car or boat, but I drop my knife or fork randomly. Some cop doesn't believe my diagnosis, I'm 8 hours in a cell and court date that should never have happened. Probably even lose my license. I mean, the technology has been available far too long, it's now an excuse to say "oh we dont have them in the car/on the boat" and you can't say it's harder to train someone to operate a breathalyser..... it's literally holding a button and reading a number off a screen. If a cop can't do that, should they be a cop. Mind you, I am staggered that you guys have 0.08. We run with 0.05 here in all Australian States and Territories. \

Nobody can pass that test unless they practiced for an entire day completely sober… he was obviously drunk, but those tests are complete nonsense.

All FWC officers are now equipped with AVA (Alcohol Visual Augmentation) that allows them to visually detect alcohol fumes. This technology was rolled out at the same time manatees were equipped with distress signals after they began demanding increased protection from drunk/reckless boaters.

after watching so many of these boating safety inspection videos I finally got stopped for one yesterday. I was so ready to show them everything and I was stone cold sober only for them to ask for lifejackets only lol. Texas water cops seem real laid back from my experience

I’ve witnessed hundreds of hours of police bodycam footage, and I can definitively say I’ve never seen one of those tests prior to this incident. Even being familiar with the other test, I was a tad confused what was going on if I’m being honest

Heres an idea.All captains should BUY THEIR OWN Alco-sensor from a police supply store. Before the police begin their tests, give yourself the test (they cant stop you) and video it. This applies only to those not drinking.

I think a good defense lawyer would capitalize on the officers verbiage when saying he needs him to board his vessel and needs to dispel his suspicions that he may be impaired. The SFSTs are VOLUNTARY. The officer’s verbiage phrased it in such a way that it sounded as if he was required to submit to the tests. Which the suspect was not. As someone who does boating LE, I’d advise him to revisit his verbiage in order to avoid any unnecessary heartache in court.

“Like this one?”….“Uhm, no that’s a fender.” Holy smokes, has this guy ever even been on a boat before? How can you possibly confuse a fender with anything else? A fender is literally something you use every time you enter or leave any dock. At least he behaved like a civilized human being with his arrest, although he seemingly knows nothing about boats.

They threaten you with losing your license and shit. But if they want to take you in. Let them, fighting will make it worse. They usually made their decision already. Get a lawyer. A lot of cases like this get thrown out.

Just tell them that you do not have to assist them with their investigation against you. Sit there quiet, and do not admit to anything at all. Don’t tell them where you’ve been or are going. Don’t tell them anything about what you’ve done or are planning to do. Their questions are designed to be vague and misinterpreted. If you do answer any of their questions, be more vague than them. Answering questions with questions is the best way to do that. Stand your ground until they give up. At that time, they will either just go away or arrest you on bogus charges that you will get thrown out. Then you can file a retaliatory lawsuit. You likely won’t even have to do the whole court thing. They’ll most likely settle out of court. They never want their evil ways put out there for everyone to see.

Never do the tests. The tests are intended to establish probably cause for your arrest. That's mean that they are potentially self-incriminating, which is why they can't be legally required (it would be a violation of your 5th amendment rights). Never answer questions (they also can be self-incriminating) and never do the tests. Ever. Even sober people can show signs of impairment for any number of reasons. It is always baffling to me that people try so hard to cooperate with law enforcement to get themselves arrested.

FYI. The Road side & seated in boat Gymnastics are more than a points test, it is also video evidence of the DUI, also remember that everyone impaired or not looks bad in these videos even a totally sober person. That is why I always say to just say no to the gymnastics tests and tell them you want only the blood test. The clean blood test is the one that will prove you're not impaired. But if you have been drinking and impaired, you're caught.
