She would be stripped of her QI because he actively and knowingly committed a crime, not an error: Criminal excess speed and eluding a peace officer (which he did not cite her for, but another prosecutor can still charge her for that, among several other violations of the law. Prolonging trials generally favor the defense. For instance in the last case where the prosecutor said it was a refusal the officer's report and any video will be excluded leaving the officer only his memory to call on. Memories fade, witnesses die, etc, etc.

@@TheRsbas That's usually not true. What do you think these three people had happen after they got arrested for DUI? Did they lose their licenses? Maybe so. Are they out on pretrial conditions? Maybe so. And then there are these court dates, some of which they have to attend, so they gotta take time off work and can't travel, and for all court dates they gotta pay their attorney. Even if they win the case, those legal fees will never be refunded.

I advise waiving no time and asking for a speedy trial and demanding discovery in most no cases I think that’s the way to go. It puts the prosecutor on the defensive. The ruling is that it must be submitted that day, or it would not be allowed. That is why he denies the motion to dismiss, but allows the motion to suppress.(~1:50) In this video the same ruling carries forward and all evidence that had not been gathered and submitted to the defense in discovery would not be allowed. That was the ruling. The judge didn't toss the cases against his clients, but he suppressed any evidence that had not been submitted for discovery. So in total there are 3 cases where discovery was not given to the defense, as ordered by the court in December, so that evidence is suppressed. (If not submitted that day, which the prosecutor said he could not do.)

Why does the prosecutor not understand that appearing in court is not just a duty, but also a right? People have a right to be present at their trial to be informed and to communicate or object when necessary. The prosecution making more appearances necessary is a burden even if the defendant is excused and even if the defendant doesn't appear because he's unduly being made to forgo the right to appear by the prosecutor's incompetence.

A defendant can not choose whether they want to attend their Court hearing. Failing to attend is a criminal offense. In reality the defense isn’t sitting any better than it was, if not worse. They had asked for discovery, even asking the Court to compel discovery. None was provided and now by Court order no more will be provided. So the defense knows no more than it did and the case is going forward.

This exact same thing happend to me. Twice! Except mine was thrown out on the first charge, then the county appealed the case and they missed or went over the time they had to file discovery again, and it was thrown out again. St Lawrence County Court New York state. The district attorneys office was in shambles at this time, and a lot of cases were getting tossed.

There is one thing that I would've said if asked if I had any witnesses and it may have been out of line but I would've said to you honor the defendant and a witness for the defense would be the police officer who issued the citation. That would give them something to think about. Do you understand how sloppy the district attorney's office is being run in that area. They don't want these cases to go to trial it's going to take a lot of work on their part. They probably haven't done anything thinking they would get some kind of an offer from the defense to at least suppress some of the charges or dismiss them. Don't think for one second that the police officer may not even be in that department any longer and that would be a revelation as well.

Just as you assume the prosecution has no evidence to rely upon. It’s a false assumption. To be this far along in the Court proceedings there is already evidence that has been presented. Whether or not it’s enough to get a guilty verdict is up to the Jury. The arresting officer had to provide evidence at the preliminary hearing either by direct testimony or sworn affidavit. This is already part of the Court record. It can not be suppressed just as it can not be unheard. You have allowed yourself to be fooled. We can not say with any amount of certainty that the defense improved its situation any at all.

I wonder how quickly I would be the victim of a "botched robbery" or some such, because if I was a judge I would be holding DAs, prosecutors, cops, etc. in contempt and write arrest warrants for no shows, perjury, etc. 0 tolerance. Like recently there was a case where a citizen flipped off a cop, the cop illegally pulled him over, lied about his speed, and him and the prosecutor lied in court about 1) his speed, 2) the speed limit. The citizen had dash cams proving his speed was around 25mph, not the 49mph the cop wrote and testified. Judge took 8 months and 6 appearances to come up with a ruling and he bended over backwards to protect his buddies who committed perjury.

The way the prosecutor addressed the court complaining that some of the defendants weren't in court, and paint the defense as underhanded, should have been unprofessional enough for the judge to admonish the prosecutor, at least, or even sanction the prosecutor for violating the rights of all these people. What’s absolutely DISGUSTING is the prosecutor seeing holding charges over the defendant and NOT providing evidence is not in any way inconvenient. EVERY SINGLE MINUTE charges are held over a criminal defendant are more than inconvenient, they’re life altering, in regards to stress as well as financially, and in many cases such as this, the defendant was already punished by the process, not the sentence. He lost his job due to the ARREST, not just a conviction. We are supposed to be treated as innocent UNTIL proven guilty. This prosecutor is a POS and has NO business being in his position. Well argued Larry as always. At minimum, the prosecutor should be held in CONTEMPT for violating the court order.
