What is the guarantee that you do not buy from walk-ins and claim to be orphaned by customer. What the city is doing is correct. What gives you the right to own an 'alleged' abandoned product? Imagine a shop just like yours but actually doing the bad stuff as mentioned above. This is where the law shows its teeth and is good. You have to change the way you do business, that is, give the estimate, do not repair the laptop until the service fee is paid.

We do give estimates before doing repairs. But we do not take payments until the repair is done. Why would someone pay for a repair before we complete it? Would you trust someone that demands full payment upfront, before they do the work? That's insane.. You state how do they know that I'm not doing this. How do you know that I'm not murdering people and tossing them in the river at night? Just because you have no proof I'm doing it, doesn't mean that I'm not doing it! Maybe I am! This is career grifting by enforcers who would otherwise have no activity to justify their jobs. The problem is that they are incentivized to “find” (invent?) code violations rather than incentivized to enact careful, investigative enforcement. Their colleague who finds double the violations in the same period gets promoted with higher performance marks, whereas they do not. The incentive structure of many American enforcement jobs is broken.

To cover the loss of all the dorm business, they cranked the costs on all the surrounding customers. I was living off-campus at the time. Never had this problem when I used to work in consumer electronics. The stuff for sale was clearly listed as unclaimed repairs, and a sign clearly showing unclaimed merchandise will be sold for repairs. To counter the summons, arrive with the job tickets for the items including the customer information for when they were brought in for repair. We refused to repair any items with missing serial numbers. This is not NYC, so their laws may differ.

My understanding of this situation was that he was being charged with 15k for each violation. They have proof of the 2 laptops, but I am sure they have summoned him because they will try to find evidence of hundreds of other laptops he sold prior to them visiting his store. I bet they plan on making this a multi million dollar fine, which they will probably threaten him with in an attempt to scare him into accepting like a 50k-250k voluntary fine or something. That is how this always works. Threaten the person with a fine big enough to bankrupt anyone, but say that if they just admit their guilt today and not involve the court or waste any more time that they will wave 90% of the fine and only charge you X. Wasnt California trying to draft some kind of legislation that says they can tax your income even after you leave the state. Yep found it on googs Assembly Bill 2088 (AB 2088), which was introduced in Sacramento in August of 2020, would impose the state's first wealth tax. When you mentioned that you're getting a car delivered... keep in mind that is one of the few things NYC has to offer, that you can live well and never own a car, most of the rest of the US does not have that option. I am not a lawyer, but if you have not got one already, you need to do a written rebuttal to each of the charges and take it to a lawyer and get him to swear an afadavid. Send a copy of this to the court judge before the hearing date. You need to type this written rebuttal so you have what you want to say before hand. It will give you control over what is said.

Louis, as a fellow New Yorker who left 25 years ago, I've never looked back. NYC and cities like it are ridiculous. Fortunately I too can make the same income and pay half the housing costs, 40% less insurance costs, 20% less food costs. The first step is the hardest, but once you're through the door you won't regret it.

@@McVaio Here if you want to set a business, you have to get license. For some things you can just go to special office and get it, but for some you must show that you have background for it. If you want a restaurant, you must have education or experience and you must show that you know laws related to restaurant business (like hygiene and fire inspection). If you want to start a business building houses, you must have an engineering degree. If you want to fix computers, right now you need no education.

I'd rather live in a lawful society. Doing whatever you want doesn't work when you run a business people trust. What if someone stole your PC and went to this shop for a repair and left it? Then they sell your stolen PC to an innocent person looking for a deal. Two victims now... I don't want to purchase anything stolen, besides the moral implications the legal troubles would be insane. Unscrupulous people infiltrate every aspect of our lives. This law is in place to protect people. So what...that its a bit more paperwork for abandoned property. They are making money ..right? Expensive electronics should have a paper trail and part of running a legitimate business is making sure you're NOT aiding criminals, maintaining proper documentation of the origins of the products you sell should be a priority.

I’m a chef. Same thing happens with health inspectors. There’s those that help businesses correct small violations and those that throw the book at them for small violations. I was told by an industry inspector guy that most of these inspectors failed out of cop training so they do this to still have some power over people. Pretty sad.

Decades ago, I was a day manager at a theater that served food and spirits. The health inspector usually showed up during prep day while the only part running was the prep kitchen. The day he decided to show up was summer camp day. I had 400 kids, 10 adults, and none of the other employees showed up because 'It was beautiful beach weather.' The camp counselors were very understanding and helped funnel the kid-packs out to everyone and didn't complain about the late start in the three theaters. Meanwhile, this guy shows up trying to look intimidating and demanding I open the other stations for his inspection. I didn't know what to do, so I gave him the keys to the doors and told him to have at it but I couldn't follow him as I had to run things. After I got everyone set and the movies going, he came back up to me to give me the report. Seems the owner had left a sangria container open in the storeroom after night shift ended and knew they would properly sanitize during set up the next afternoon. Ovens, not in use, were left with the doors open because night shift had burnt pizza in them, brushed them out, and were hoping the smell would be gone by the next night. The last item was my hair. It was acceptable to wear your hair back in a clip. During the rush, my clip had slipped off. He'd noticed and noted it. If we'd had one more thing wrong, he would of closed the place. He tried to give me a stern lecture about the serious nature of all of this. I told him if I could find work at ANYPLACE else in the area I wouldn't work here. So, I really didn't care if he closed the place down but be ready for a legal fight. I knew restaurants that passed where roaches walked all over the dinning area and there were animal droppings on the plates. Places in his jurisdiction. "Us lowly paid restaurant workers are connected to each other. We gather and tell each other what's really going on at the places we work. Did you find anything disgusting here? No, of course you didn't. WE keep it clean. WE have a scheduled deep clean company come by every 4 months." I listed off a few places I knew he had given stellar ratings to that didn't deserve them. Then I gave him the owners number and told him to call the owner to discuss anything else. He said he was going to catch us in a serious violation and we'd be shut down. He didn't, but the owner smoothed things over with him.

These inspectors are incentivized to do this too because their pay and promotion structure is based entirely on number of violations issued rather than eliminating actual poor or illegal business practices.

I know you may want to try to handle this legal matter yourself during the court hearing, but I strongly recommend you contact a lawyer that specializes in this area of business law and see how much it will cost to have them represent you. It then becomes a business decision on if their costs are equal/greater than the possible financial & personal time lost to fight the case are worth it. Keep in mind that many times "losing" one of these cases not only results in fines but also suspension/lost of the business license for a certain time period - so the final costs can quickly multiply.

Yes but this is not true: at the point the decision is made to sell the abandoned item to recover costs then it has been bought, for $0. And the compliance paperwork ought be completed before it’s displayed for sale. It's your responsibility to save for your retirement. It's your responsibility to provide health insurance to your family. Before government got involved the family took care of the elderly. Churches and communities took care of families that landed on hard times through charity. Now everyone has their hands out for tax payer funded entitlements. It's disgusting. This is why voting should be restricted to those who actually pay into the system. All the net takers shouldn't be allowed to vote for productive peoples money. I hate entitlements, and I hate the idea that govt should provide for people. It's a disgusting collective mind set and it's as moral as theft.

Technically there has to be a transfer of ownership. As a business owner we scrap items we receive for repair and are assumed forfeited due to non communication or unwilling to pick up the item. These items are not owned by my company and so I have to prove that I now have ownership before I can sell it. It's cheaper and less hassle to scrap it. Legally proving that you own the item you sell is a business responsibility. Now of you can prove that you have communication for these laptops that the owners are effectively forfeiting their property, you can prove it in court.

I learned a lot and know many who did as well. I'm SURE there are some out there. Who can finance a fight back against the "city". A "Keep Rossman Repair Group" fixing campaign. Without them "Right to Repair" ends. Losing much of it's influence. All hedged w Luis's channel. His "geographic peculiarities". The underdog fighting to do business at all. Nonetheless in one of the most difficult to do business cities in America. Is a popular story for a reason. This is the perfect opportunity. For Luis to DIG IN. And, rally a charge against the city. I for one think he'll win. Not just for himself. For those sent to collect the fines. AND those businesses being fined.

You can tell that Louis actually does give all of the shit about his business, but even more about the PEOPLE THAT MAKE IT WORK! He spoke to how specialised their skillsets are and their accomplishments, and how hard replacing them elsewhere would be if he left alone... So he tells us that he plans on finding somewhere else to set up shop and is WILLING to help his entire staff MOVE WITH HIM, including things like covering moving expenses and potentially aiding in rent on arrival. This man is a fantastic person. I appreciate that.

Its strangely comforting to know we in WA State are not the only ones subject to governance that makes sense (joking). WA State passed a law that outlaws auto insurance companies from using client credit rating in determining premiums. Evidently, WA thinks it knows more about risk assessment by reviewing a bill for 23 minutes than insurance companies who have been studying risk for hundreds of years. My insurance agent informed me that my premiums went up because of a good credit rating and went down for those with bad credit, penalizing good behavior and rewarding bad.

@@srjwari Raising taxes has a political cost and must be processed through ruling. Sending inspectors to fine business is easier. Just like the police doing once in while operations to give a lot of speeding tickets on the highway. Inspectors and police have quotas to fill. Towns and governments include fine revenu in their budget which is a scam. It should be treated as a bonus and not a part of the budget.

I don't do Apple ANYTHING!!! But, yes it's nice to know that you don't have to bring Vasoline with you when you get your Mac fixed,,, I do PC's, parts to machine done, but I do not do MB repair/Component repair, more like find problem replace with new part there you go. So many peeps, do not listen to me when I say I can build a powerhouse but,,, it's going to be more than a $400 laptop, my personal system 4 years ago was $3500 to build but I still do whatever I want including running 2 games at once(oops) and noticed nothing in degrade of game play quality. 5 things you can't save money on for a good pc.. MB,RAM,VidCard,CPU, and last kind of the cherry SSD. get cheap here and you will always know it and regret it!
