We had a homeowner that put wire in the water around the outside perimeter of a dock so trolling motor props or bug motor props would hit it. The homeowner found out in Tennessee that you only own the dock none of the water around it. End result once caught the home owner lost his privilege to have a dock in the lake and had to remove the dock. Now he doesn't have to worry about people fishing around his dock any longer though.

Note: you don't even need a address, if the owner of the property your near won't give you the address you can send them your location via latitude/longitude. Long as you have a smart phone, They send you a link and you just click on it, gives them your location.

It’s not the fishing that bothers them you dink. Try owning a boat that costs the same as his bass boat as upkeep expenses for 3 months of the year... Bass fisherman by practice will always be close to docks, houses, boats etc to the point they’re in peoples business. I’m a fisherman. I live on a lake and always respect boundaries with peoples docks to give them some level of privacy. Bass fisherman on the lake will be practically at your bulkhead. They’re the aids of the fishing community.

I love when fishermen come near my dock at my lake house. Seriously it's great talking to them. Sometime they offer me a beer or two. I also wish that people were more grateful for what they have. The house I have was a gift to me, I am blessed to have it, with that kind of mind set of appreciation, it changes the way you view this kinda thing.

I think the concern is that while many fisherman such as the ones you encountered are great, there are many jackasses out there that would still everything on your dock and boat that isn't nailed down. Hard to tell the difference between a nice fisherman and a scumbag from a few hundred feet away.

Disturbing the personal property of a person engaged in lawful hunting, fishing or trapping. 5. Disturbing a lawfully placed hunting blind or stand. 6. Disturbing lawfully placed bait or other material used to feed or attract a wild animal. 7. Engaging in a series of 2 or more acts carried out over time, however short or long, that show a continuity of purpose and that are intended to impede or obstruct a person who is engaged in lawful hunting, fishing, or trapping, or an activity associated with lawful hunting, fishing, or trapping, including any of the following: a. Maintaining a visual or physical proximity to the person. b. Approaching or confronting the person. c. Photographing, videotaping, audiotaping, or through other electronic means, monitoring or recording the activities of the person. This subd. 7. c. applies regardless of where the act occurs. d. Causing a person to engage in any of the acts described in subd. 7. a. to c. 8. Using a drone, as defined in s. 941.292(1), to conduct any activity prohibited under subds. 1. to 7. (b) No person may knowingly fail to obey the order of a warden or other law enforcement officer to desist from conduct in violation of par. (a) if the order is based on any of the following: 1. The warden or other law enforcement officer personally observed such conduct by the person. 2. The warden or other law enforcement officer has reasonable grounds to believe that the person has engaged in such conduct that day or that the person intends to engage in such conduct that day. (3) Exemptions. This section does not apply to actions under sub. (2)(a)1. to 8. performed by wardens and other law enforcement officers if the actions are authorized by law . (3m) Affirmative defense. It is an affirmative defense to the prosecution for violation of this section if the defendant's conduct is protected by his or her right to freedom of speech under the constitution of this state or of the United States. (4) Civil actions. (a) A person who is adversely affected by, or who reasonably may be expected to be adversely affected by, conduct that is in violation of sub. (2)(a) may bring an action in circuit court for an injunction or damages or both. (b) The circuit court may enter an injunction under ch. 813 against conduct in violation of sub. (2)(a) if the court determines any of the following: 1. The defendant is threatening the conduct. 2. The defendant has engaged in the conduct in the past and that it is reasonable to expect that the defendant will engage in the conduct that will adversely affect the plaintiff in the future. (c) The circuit court may award damages to the plaintiff if the defendant's conduct in violation of sub. (2)(a) has adversely affected the plaintiff. The damages awarded may include punitive damages and any special damages. Special damages may include approval fees, travel costs, camping fees, costs for guides, and costs for equipment or supplies to the extent that the plaintiff did not receive the full value of any of these expenditures due to the unlawful conduct of the defendant.

I fish that same exact spot and was also harassed. Regretfully I left after a killer day of fishing and called the wdnr. They called me back and said I could fish it and they would have a word with the marina. I went out the next day and no issues. Hopefully it stays this way.

If the marina has such hazards they had best fix them, or buy plenty of liability insurance. There are many underwater hazards alongside most docks; just watch the magnet fishing videos, there's everything from shopping carts to full sets of nice golf clubs, and miles of wrapped up monofilament line.

As a Dock Master and marina owner I feel I need to say my piece. We have many tournaments in our area and there is some big money on the line. If I see these fishermen around our marina, I will walk out and chat with them a bit. Usually I will warn them of any underwater hazards they might not know about and I can usually point them in the direction where others have caught fish. I am in WI and have had to educate more than 1 person on the legality of fishing in and around the docks. Yes I have even gone as far as retrieving lures that got somewhere they shouldn't. Not all fishermen are bad and not all Dock Masters and property owners are against fishing.

I did acknowledge he can fish in the marina. I did tell him where the fish were in the marina. This video was edited creatively and he did not stick around to talk to the DNR with me.

I am always surprised by how many of these videos I see. I fish constantly, on many local lakes. Most of them have nice homes around the shore line. My normal encounter with folks who live there goes more along the lines of..."Good morning, having any luck?" Or Hey, it's a beautiful day on the water today, isn't it?" I try to respect others property, just as I expect people to respect mine. Never ceases to amaze me how belligerent people get over petty issues. Let's all just enjoy nature and coexist!

So as an avid bass angler, I know the feeling man. I myself do the same thing quite often and get the same type of pushback. I had a long conversation about this with the owner of a marina in my area who is also an avid angler, he has had several pipes and lines torn apart by careless anglers. I know you are very careful when back behind docks as I am, but not everyone is 🤷🏼♂️. Yea it’s legal, but the harbor master didn’t sound too unreasonable... it’s all about respect like you said. Tight lines!

Some damage is the chance they take for floating all their crap on public waters. Mother nature does far more damage to their equipment than anglers. I am always amazed at how clean and clear local waters look when fall comes and the marinas take all their junk and their customers boats (most which barely get used) out of the water.

I had an issue in that same marina this spring. I stood my ground like you did and told them to call the police if they thought I was doing something illegal. They walked away and the police never showed up. Sad to see this happens to so many other fisherman as well.

At that point when he says he doesn't want you there it's not safe, just say thank you for your concern have a good day! After that you don't have to socialize with them. I just ignore them and if they want to call cops, so be it.

Our lake in Texas states that as long as you on the water you can fish around the docks and piers you can't touch or get on the docks or piers or on ground.The game warden said as long as your floating you can fish. I've had a few problems.

Had a somewhat similar incident happen to me as well in September last year. Fishing public waters, minding our own business, when a woman tried to get us to leave. Lied to us claiming it was private property, threatened to call the police on me, etc. Did my best to handle it as civil as possible. Can't give these people an inch or they'll take a foot. 100% support you for standing your ground and not giving in to this guy. I got a LOT of heat for that video though, but thankfully, I got more support than I did negative feedback. Hopefully your video doesn't get shared on a large local forum full of pleasure boaters for that body of water, or the dislike explosion will hit you too, lol.

I own lake property and am an avid bass fishermen. The only time that I've ever said anything is when someone bounces a weight off my boat. Spent too much money for someone to abuse my stuff. Make sure you're proficient at casting and operating your boat before dock fishing.

Same happened to me here on the West coast, had a security guard tell me the water was "private property" around their docks in the Marina, around the marina del rey hotel. . When I explained to him what navigable water ways were, he told me to get the fuck out. I laughed at him and simply turned my back to him in my kayak . I invited him to call the sheriff , he did. Guard kept talking mess, I invited him to jump in the water... LOL. sheriff came and told me I could keep fishing, only after I told them I was well within my rights. Guard looked stupid, I wish I had recorded it like you did. Some people feel entitled, sheriff has been called on me 3 times this year fishing MDR. Not once have I been told to stop fishing. Your right to stand your ground. Keep fishing my friend.

I love the arrogance to just come up and tell someone to leave because in his opinion that the water wasn't navigable. The gall! You handled it perfectly, polite but firm. Shouting and expletives won't help. In Indiana what he was doing is a crime, at least after the point where you told him you intended to keep fishing. The guy is a classic bully... he probably hogged the best swing on the playground as a kid. " I'm gonna stay here though." lol FISH ON MY BROTHER!

In my state (Minnesota) "Navigable" water is any water able to float a canoe, further if your feet are wet from that water you are considered to be on that water.

@Ek Hatch Maybe it does but it is idiotic to pull a boat in there and fish. You could do the same fishing there with a cane pole. The Harbor Master, although maybe technically within the bounds of the law, has a legit concern and any normal person would run off some moron pulling between the dock and rock shore in a boat.

Not sure what authority the harbor master has but why would someone drive 14 hours to fish someplace where they are knowingly going to be harassed? You cant make a rule saying only people who know they can control their boat and act responsibly or are just as cool as me can bring their boat in here. No logic to that argument. Just has to be a blanket rule regarding the safety of everyone and the surrounding infrastructure. The entire situation just seems a ridiculous waste of time and energy.

It's hard to argue a waterway is not navigable when you're in a marina. Some states have different definitions for navigable though. There's a myriad of different rules from state to state.

Some states have different rules for inland vs. tidal waters, natural streams vs. manmade. Knowing your rights is important, but also knowing that it's a jackass move to get arrested over a fish is something else.

ALL navigable waters of the USA are fishable IF not prohibited by specific regulation. Federal navigable waters are traditionally and legally considered to be any water that a person can drag an empty canoe through it in any season of the year.. It does not matter what some harbor master says or thinks.

Nicely done!!! It seems like there's ALWAYS one in the crowd!!! I had to deal with a guy like that on the shore of lake Erie. We were on the public fishing area. The private beaches were 50 yrds to our right. He called the police bc he JUST knew that we'd eventually be on his beach, trespassing. The police showed up and advised the homeowner that THEY were NOT the"thought police". Nor, do THEY arrest people at the advisement of a psychic!!! We fished for a couple hours and eventually relocated. 1.) The fishing wasn't great & 2.) The homeowners sat in lawn chairs throwing rocks into the lake where we were fishing. *Which explains why the fishing wasn't great. A total waste of a beautiful day.
