That's exactly the flaw in his appeal. If he was completely authentic, Rockstar wouldn't have been able to get away with it due to image rights. But because he's a product of another intellectual property that hasn't been claimed by the rights holder.. he's not got a leg to stand on.

The reason he won't go away is because everyone keeps giving him attention. He has NO case, because even though the character is clearly inspired by him, it doesn't even have the same tattoos. They can easily claim he is just an inspiration for the character, which they don't even have to do. He isn't the only person to ever sport tattoos like this on his face. I'm pretty sure lawyers have already explained this to him, or he would have already filed a lawsuit. He is just milking his noteriety for all it's worth right now. Now if only people with a platform would stop paying attention to him.

If you have ever played a GTA game, you'll know the amount of brands that Rockstar get away with replicating. This is because they have mastered the art of changing things just enough that they slide beneath copyright infringement. With Florida Joker, they changed his face and tattoos just enough that it's passable. That's why they also changed the looks of the people in the other viral videos 😭

rockstar even made the main characters which are modelled after real persons a bit different. michael franklin and trevor look similar but by far not identical to their digital counterparts. even if they all agreed to be shown like this, rockstar let the backdoor still open if something goes wrong. even if you do all the mocap and voice things, you are still not owned anything by rockstar. the only thing they need to give you is the sallary they accepted in the contract. no contract no money.

DC owns the Joker character, not that tattooed person from Florida. A criminal having face tattoos in a police hearing is a realistic scenario for a rendition of the comic book character. Nothing the real person has done can be attributed to or wholly transformative to make their case. The only thing that they have is their REAL name which is not used. I'm reminded of the Ms. Cleo lawsuit filed 15 years after Vice City was released. Even if PRN filed within the three year statute of limitation, they'd have a hard time proving that a random Haitian woman with an accent using magic or voodoo to make the main character do certain crimes ... is the same as a television fortune teller.
