@1 36, only a licensed attorney bahaha. Thats the problem, once you get a BAR license. And join that private club you are no longer working for a citizen. You are working under the license and protecting the intrest of the state n the club. Sovern citizen is such a lose term, everything from terrorist to mentally ill. It is funny people want to represent them selves or a corporation yet don't know how to establish or unestablish jurisdiction.

I didn't care for the judge letting this guy run his courtroom. I imagine this only reinforces the stupid behavior, and makes it harder for everyone else who has to deal with him in the future.

@@LawTalkWithMike One thing I've learned from watching tons of these videos - some judges can control their courtrooms, some can't. This guy can't. Wouldn't have happened in the courtrooms of Middleton, Simpson, Bryant, Washington, etc.

I love when they say “so, you are just going to enter a plea for me?” Well, yeah. You are presumed to be innocent and if you aren’t going to plead guilty then I have no other option than to continue to remain presumed innocent....thus not denying you any of your rights.

Mike I will disagree with you when you say "overall the Judge handled it well". That was a 'straight up' victory for the sovcit. That Judge let a sovcit and a public defender take control of the courtroom from him from the 'get go' and they didn't relinquish that control until the Judge entered a plea for him and set a new court date. All that did was empower the sovcit for the next round.

My issue with this whole situation is how they let it go on so long, didn't take him into custody when the judge ordered it, and the woman basically saying they should give him his way in order to get on with it. This guy probably sees this as a solid win.

And if he sees it as a big win, then you just know hes gonna post it and talk about it, totally incorrectly, to add. All of the other ignorant ass sovereign cits will be encouraged, bc we all know that videos of them absolutely, without a doubt FAILING, encourages them, so of course an assumed "win" would encourage them to no end. It just keeps them coming. Better to just nip it in the bud, dont give them ANY leeway. They will be given an inch and take 10 miles, so it's best to just confront it at the first sign of silliness, and tell them that their made-up "legal jargon mumbo jumbo" wont fly and they can proceed and participate with the real rules and laws of the court, or be in contempt. Show them real quick how much that defense will NOT WORK.

I think judges grant far too much slack to these wack jobs. I think my favorite is an audio-only of a woman judge with a southern accent, who tells a sovereign citizen that she'll hold him in contempt if he kept peppering her with questions instead of answering hers. He didn't adjust well on the fly, and got 5 days in jail for contempt.

A lot of time the sovcits are trying to get the judge riled up so he/she says something unprofessional and has to recuse him/herself. A smart judge lets the sovcit talk enough to hang themselves by their own words. The sovcit then gets the book thrown at them at sentencing and the judge can smile in private.

I have never had to appear in court in front of a judge, but it seems to me the very last thing you want to bring to court with you is an attitude. Leave it out in the car when you pull in.

If it doesn't matter where he sits (in some ways it does) then it shouldn't matter to the sovcit either. He was clearly being intentionally disrespectful and disruptive on purpose. Its kind of their thing. That's why he was threatened with contempt. The judge has a right to maintain a certain order and standard in a court and not have it turn into a soap box for whatever crackpot theory someone wants to express. I reckon this guy got off lucky, I've seen others put in contempt for much less.

The courts here (Erie Co, OH) you have to walk thru metal detectors or you don't get into the court. If you have any type of electronic device you have to take back to your car or you an give it to someone outside of the court. They used to have lockers that you could lock stuff in but they no longer even allow that. They're pretty strict on that!

Had I been on the bench, I would have stepped on the PD. She actually bought into the jurisdiction thing, knowing perfectly well -- I must assume she has a real law education -- that there are specific forms by which jurisdiction may be challenged, and that it is something dealt with at trial, not at what she calls a "more informal" pre-trial hearing. I don't know if it is within the discretion of the court to hear a challenge to jurisdiction immediately. That would be my preference, to accept the statement by defendant as a motion to dismiss for lack of jurisdiction and hear it on the spot. Assuming the state has made a written allegation -- likely an affidavit of probable cause -- I would say that the state has presented a prima facie case for jurisdiction, now is the defendant's opportunity to present evidence rebutting that case. Of course he wouldn't be able to do anything but splutter that the state has to prove jurisdiction to him. And that's when I would tell the sovcit that he has things upside down, that a question of jurisdiction is decided by the court, not by the state, not by the defendant. If he disagrees, his remedy -- if he is convicted -- is to appeal his conviction, citing lack of jurisdiction as grounds for reversal. Period. End of report. Move on.

If that PD keeps doing that sort of thing, it’s not going to end well for her. I can’t imagine the judge continuing to put up with it. The way I look at it, having been dismissed by her client, her coming back into the dialogue is in a way her being a referee between the judge and the defendant, acting something like an appeals judge handling an interlocutory appeal. That’s got to get under the judge’s skin, and he’ll eventually scratch that itch kinda brutally.

Who ever the voice was that asked that this man be allowed to stand should have asked earlier. The judge has instructed this man to sit. It is now a contest as to who is in charge. By allowing this an to stand is the same as saying to the judge "F#%k you " ! Iwould not stand for it!

These seemingly pointless stands that the slobbering citizens always take, over insignificant things such as where to sit, is a battle of wills; a power play to show the Judge that he’s not in control. They want to prove that they are powerful and that neither the Police nor the Judge can force them to do anything. It rubs me the wrong way to see them get away with controlling things in court, even minor things such as where they are to sit and when they are allowed to speak. I’ve noticed that not one of them has risen when the Judge enters the court. This is not an accident, this is blatant disrespect.

As soon as the judge backed off on the contempt order, he guaranteed further disruption. People like this defendant interpret any judgement call not as a form of consideration, but rather as a validation of their crazy views.

Of all the things that you have ever said, your story about your close call resonated with me. The basic understanding of protocol, respect and common sense that used to be commonplace in our society, has apparently just disappeared. Am I an anachronism? Jeezus. It was awfully nice the Judge to appear 11:15 in _the defendants courtroom_ because the judge 👨🏼‍⚖️ had NO CONTROL over the outbursts in this room. Even the bailiffs were as intimidating as a puppy and backed down when someone politely (though foolishly) said no thanks.

I watched a talk by a,long serving judge who said that she once heard counsel mutter “bullshit” while opposing counsel was making a verbal argument. She wasnt pleased. She also said that judges tell other judges who is easy to work with and who is a pain, and of course in most places there arent that many lawyers and judges that work in each court. If youre a jackass word gets around… quickly.
