No he wasn't and that was the problem. As Pug pointed out, Peter faked pictures(or at least pretended to fake them in order to protect his identity), so whether he liked it or not, he was accomplice to that. If he revelead in that court that HE IS SPIDER-MAN, it would be different, but if he wanted to protect his secret, Peter had to take some blame. Not to mention that it would be hella suspicious if Spidey specifically said "leave Parker out of it". Some of his enemies are not dumb as a bag of bricks(Scorpion is) and this was public trial as far as i understood it. Someone could make connection beween spidey and Peter and go on hunt for him or his family/friends just to lure Spiderman out. And after this settlement, noone would suspect that Peter is Spiderman or somehow connected to him cause he was "punished" just like Jameson.

It's just the writers way of luring the fans by teasing exactly what everything wanted but then pulling the plug at the last second giving us blueballs because otherwise they'd have to stick with the consequences by either finish JJJ as a side charecter or make some major changes to the character but they don't wanna change his dynamic in the story. They wanna keep that Tom and Jerry dynamic between Peter and JJJ

One thing I love about the it’s because I’m black joke is that people aren’t entirely sure what Spider-Man looks like underneath the mask because anyone could be under the mask like there’s 2 other spider-men who took the mask when Peter was gone. Miles, Spider-Man #2, for instance is mixed, but people in universe think he’s Latino, and I think he keeps it that way because there’s already enough well known black super heroes in marvel. And there’s Yu Onomae the fake red Spider-Man who is Asian American, when Peter went missing Yu found the costume and became Spider-Man for a short while without any powers, and people thought he was the original, but out there in the multiverse set in modern day their was a asian Spider-Man in New York. Stan Lee didn’t realize on what he had done with Spider-Man. Making his costume fully covered Stan realized beneath the suit he could be anyone

Stan Lee actually has said in interviews that he enjoyed the idea that Spider-Man could be anyone under the mask, and he was also very open to the idea of multiple Spider-Men of different colors and genders. He saw it as an opportunity for all kids to see themselves slinging webs.

It’s the same situation pushed with how people claim the X-Men is an analogy for the civicl rights movement, not according to Stan Lee though, that’s what people who don’t know the whole facts behind the creation of characters in marvel claim, Lee said they could not come up with a unique origin of how each of the X-Men got their powers, so they came up with the idea of the X-Gene being where mutants’ powers came from. It’s been co opted by these “modern audience” people who don’t know the true story of how the characters were created and reasons why there were things in comics, many times it’s a creative decision to make the story better and not convoluted. Lee also said Peter Parker will always be straight and white and will never be truly known by any other hero identity and will always be truly known as Spider-Man in his heroics. Those same “modern audience” people hate that statement from Lee and the statement was involved when Rick Riordan casted a black actress as Annabeth when in the books she’s described in plain as day words by Percy when they first meet as looking like a stereotypical tanned California surfer girl with curly honey blonde hair like a princess and with stormy gray eyes.

I've never liked how the story ended. Felt like a bad cop out. It would have been great to see Jameson lose. Even better if somewhere in the background at the end there's a news broadcast about Scorpion taking Jameson to court. It's not like the writers would have had to worry about Spidey getting rich, MJ already convinced Spidey to donate to charity. And they could have had Jonah settle out of court for an amount that would not have broken the Bugle.
