no sir...the answer isn't clear for most folks. Here's the real answer: If a healthy tree that's strong and growing appropriately on your property blows over onto your neighbor's place...then it's an act of god. If it's dead, potentially falling or leaning out over the property and is clearly going to fall...then it's the land owner's responsibility to take care of the potential damaging tree that's about to fall or leaning over on the neighboring property. That's how the law reads and how the insurance companies handle it. This was a case of an impending fall as the tree had been leaned out over my fence for 2 years. I handled it....no biggie..but my neighbor could be held liable if I pushed the issue. I just took care of it and he'll never know that I did it...but it is his responsibility by law.

Everything you say maybe true but we are not talking about a structure... when it comes to fence in my neighborhood we all try to work with one another.. granted I am on of 4 property owners in approximately 1 Sq mile.. have a blessed day

@@StoneyRidgeFarmer Yep! That explanation comes to us from common law but states may codify it. If a tree is a ‘nuisance’ it is the land owners responsibility but if not then it’s the other parties responsibility. Nuisance has a legal definition here not the common meaning. Look it up. Property line issues should be communicated by and to each property owner as they arise and in some states (Kansas) there is an arbitration board for just such issues when property owners don’t agree. If the falling of trees onto another’s property by acts of God is a common occurrence, then the tree line distance to the fence or the tree’s conditions could be a nuisance, which would shift the burden to the property owner. An arbitration board could make that call. It’s always best to come to a meeting of the minds with your neighbors over such issues and possibly work together to mitigate the situation.

I always just fix my problems myself, regardless of who or what caused it. Trees fall on fences. It's just part of country life.

Unless it is negligence on your neighbors part, it is your problem legally speaking. In this case it's in the country, so I'm pretty sure it's stoney ridge farmer's problem.

Had this issue in the past. Neighbors land was cleared leaving a treeline a long my new fence and eventually the tall pines left behind started falling during storms because the buffer trees were gone. Crushed my fence but acts of god are no one's fault. Cleanup, fix and move on. Welcome to country life.

To keep peace if you have the means and health, just do it. It’s these kinds of things that causes neighbor issues and can sometimes escalate. Should the neighbor encounter an issue caused by something from your property let’s hope he’ll take care of it and move on as you have. Neighbor helping neighbor is what we need more of especially these days.

Those Honda Pioneers are awesome! My buddy is a Honda dirt bike fan. He bought a Pioneer 700 and loved it. He ended up trading it in for the 1000 because of power steering. We are middle 50s and shoulders hurt. He uses his for hunting. Where we hunt here in the central valley of California gets really hot. In the heat, under load his 1000 was over heating. My friend also knows farmers that use them for farm work like spraying fields. They also have over heating problems. My friend took his back to the dealer but they were unable to fix the problem. But apparently Honda was aware of the issue. Another friend changed the fan and shroud assembly with one from a Honda car that sealed better. This was a big help.

I don't know about in the Carolinas, but in Louisiana, it is your problem with the trees falling on Your fence. During hurricane Ida couple of trees fell on fence and one on a shed. It is an act of God and neighbor nor responsible

if a tree, in any state, is dead or dying or unhealthy and or hanging out over someone elses property endangering life, limb or property then it's the responsibility of the tree owner. If it's a healthy standing tree then it's an act of god. An act of god isn't preventable or foreseeable....this was negligence

Despite four pro saws (Stihl 261, 400, 500i and a Husky 565), I use my battery saw as much as possible. No gas, excessive noise, fumes etc.

I am a huge sthil fan and I love running a sthil chainsaw. I recently bought a small dewalt electric chainsaw and i could not speak more highly of it. For small tasks around the farm it is great. The electric saw is easy to get out and use if you need to do something quick and also very lightweight. and when your not using the saw you can use the battery on other power tools which is super convenient as well not having to keep up with different chargers and batteries.

It's an act of nature. My neighbors tree went through my roof. His insurance would not cover the damage mine did. Because it's an act of nature. But if he knew that the tree went down being neighborly he should be out there helping you to clear it.

Pines grow in a grove, once one wind storm knocks some down, the rest will follow. Pines grow close and use the tree next to them to sway, and rebound, once the trees can't help each other take the storms, they fall. The roots go far but not deep.

The fence is a act of nature. Yes it is his tree but no major damage so cut it up keep the wood say thank you lord for no one got hurt. The fix is simple. Looking for other trees that may fall and drop them for safety purposes. I have a little craftsmen 10” battery saw it is great for down trees in the road it’s in my truck most of the time just for that reason. Not expensive at all and very useful. Love it.❤ Like video’s you make most of the time. Sometimes people over explain or rambling conversation not so fun. God blessing to you and family. Thank you for sharing

It's great to see a professional using the saw as there are many 'homesteader' on KZbin with all the gear, but are clueless on how to use it correctly. I have been using one since I was about 15 & L am now 75. and live in Australia. The first saw was a Jonserad from Sweeden & it was very heavy. Keep up these great videos.

Yep I used to keep the fence line clean but now I'm 60 plus years old my back's all out of whack got up I could get back into it again thanks for the video brother my neighbor's been doing a good job and keeping the fence line clean Young whippersnappers

I got an Ego 56V 18" chainsaw for Christmas. I dropped 40 trees, up to about 6" diameter, with no problem and used less than half the battery. I haven't had a chance to use it on anything bigger, but I have no doubt it would work. I love this thing. Easier, and safer, than a gas saw.

My tree fell on the neighbors side and when I called the insurance they informed me that it was their responsibility to remove debris from their property. It fell on electric lines so the electric company came out and cut it down and removed it. My grandsons removed the cut down trees as a favor to the neighbors. The little dent to their gutters? Had to call their insurance not mine.

I absolutely love my battery powered chain saw and pole saw. I throw one in the back of the gator when we are running the fences and it is about as handy as a pocket on a shirt. For the bigger jobs I break out the gas powered saws but for 80% of our needs the electric works great.

Every saw has a purpose. Electric won't due the heavy work but my wife has started trimming the lower branches of our 40 acres which she couldn't due with gas. They are also good to pack in a side by side.

I was wood chipping a couple of days ago. Good therapy! I purchased an electric chainsaw by WEN last year. I have found it extremely useful while chipping to trim the snaggled water oak we have her in Florida. It is a lot easier to push a button and pull the trigger then fire up the Stihl just to cut a branch or two.

Since I live in a southern city with a next door neighbor who does NOT maintain trees in her yard with roots pushing over my fence, and the property is a rental property, I have long been interested in any hope that might be offered. BUT the problem with HIS trees and YOUR property .... well, HE MUST BE MADE AWARE OF THE PROBLEM. Then you might take him to court when damages occur. Good luck! Not a straight forward solution even under the best circumstances! Did not expect to be watching your KZbin stuff, but I like your attitude! 😊

"Surrendering" that strip along the edge is a good idea, even though it may "cost" you an acre or two of pasture. Keeping the livestock within is the most important. Being able to mow on both side also keeps the saplings from getting ahead. Furthermore if a tree does fall across, you can work on both sides of the fence to get things straightened out. It is how I would do mine, if I had it.👍👍 I only have a small(10") battery powered saw, but it never smells of gasoline and I don't have to let it cool before I set it in the truck bed. A charge on the battery doesn't last as long as a tank full of gas, but no mixing, no cooling before refilling, no spilling or overflowing, just pop another "tank" in the socket and away it goes. I still have doubts about electric vehicles, but many battery powered tools work quite well in the boonies.

It has happened to us with three trees on a new $$$ fence we built. We clean it up and move on....neighbors don't care about our fence. Bad thing is you can never straighten the wire or get it tight again in that area.

When a large oak tree that was growing on the state's property fell on my trail, I confiscated the log for the sawmill and called it a day. I forgive them. :)

Good morning! Re fencing and trees, I empathize with your plight. We have somewhere near 9-10 miles of perimeter fence on our farm over in the western Ozarks, and only about 1.5 miles of that is not within reach of a tree. So cutting downed trees and patching wire is a large part of our maintenance. The responsible party is whoever has cattle on one side or the other. If both do, most of the time the one who finds it fixes it. I suppose there might be times when both meet at the problem and tackle it together, but that’s probably the exception unless the job was really big or somehow more dangerous to do solo. Those electric chainsaws are pretty handy for light to medium work, especially intermittent work. Instant on-off and quiet are definite advantages. My sister has a Milwaukee she uses on the farm for limbing trees when we clean out fences. She leaves the felling to me with the Stihl gas saw. Quite a useful tool.

Trees were there long before you built the fence. Trees are subject to falling. You chose to build said fence within falling distance of trees.

nope...not the law and not correct. It's the land owner's responsibility if an unhealthy tree poses a threat to life, limb or property. I cleaned it up....but it was not my responsibility to maintain my neighbor's property. My property is mine...his is his....and if there were a tree on my land leaning towards his house and about to fall...it would be my responsibility by law as well as my duty as a good neighbor. I cleaned it up no problem...but he would be held liable if I pressed the issue. It wasnt a big deal...but could be a huge deal if cattle get out and get hit by a car and harm people because of negligence

this is one of the reasons for my excavator, dozer, skid steer, dump truck, and telehandler on the farm. You would be surprised how many neighbors take advantage of my "help a neighbor plan to take trees waaaay back from fences, clean ditches that flood, and get firewood. The wood chipper is a nice touch, where is my Vermeer catalog?

I have one of the battery powered chainsaws. I love it. So much easier and lighter. I use to use a small stihl chainsaw. I trim all the smaller limbs off the tree and hubby uses his Husqvarna. We cut wood for our outdoor furnace and use it for brush clearing. Have a great day!

I’ve only tried light/medium duty electric chainsaws so far but there are a few good things about them: - They are only “on” when you are cutting. You’re not wasting fuel between cuts - they are instantly at full power if they are on. - They are light weight. - No fuel to get old if not used frequently I like using a trailer type lift bucket for trimming trees and an electric saw is much safer and lighter in that situation.

Trees fall. Good fences make good neighbors. Both are still true. If the fence is on your side of the line it is your responsibility. Ultimately, good relations are more important than who puts in the work. That said I have an understanding with all my neighbors that we can go on each others place to fix fence and tree issues. We also clear dead and dying before they fall. Looking at that tree line, you need to have a chat with your neighbor about some preventative cleanup.

You are responsible. You put the fence next to his trees. As far as legally goes, I have no idea lol. Also, have you looked at the Kawasaki Mule Pro FX? It's a perfect farm UTV, huge bed, quick, nice suspension.

I agree - don’t put your fence so close to the trees (property line). We use 4 plank oak to hold high dollar horses. There’s a property line fence then 20’ in is the livestock fence. We keep the buffer clean at our schedule. Very few emergencies.

nope...you are wrong....his tree was leaning out over my fence...it's not my responsibility to maintain his dead, leaning or dying trees. I took care of it...but it was his duty to maintain his property my friend. The fence has nothing to do with him maintaining the property. Just a little back story...he hired a timber crew to cut all the pines because they were dangerous....and actually falling on his house! I've yet to see the timber crew..but we both are aware of the issue. He was responsible.....but I took care of it ...just another day on the farm.

you do understand that there is a buffer right there...if you watch the video you'll see it. We are farming for livestock and beef my friend...and using the available pasture is important. We aren't farming pets...and if you have a dead or dying tree leaning over my fence, and I notify you...it is your responsibility. The same goes if this tree were hanging out over my house or barn. That tree was about 50 feet tall...should I build my livestock fence 60 feet from the property line? I took care of it...but it was negligence on his part....a person shouldn't have to worry about dead and dying trees falling from a neighboring property...the property owner has a duty to remove hazardous trees that pose a threat to life, limb and property....not the farmer build the fence to accommodate for negligent forest management

@@StoneyRidgeFarmer I also run a cattle farm. Might be old timer logic, but if a tree falls on your fence then it's your problem. Nature is gonna do nature. It's kinda rude to put up a fence next to someone's property then financial burden them by telling them they need to cut down old trees. The state doesn't make you trim your trees that are next to the road, they do it because the road is their responsibility. If one of your trees fall in the road it's the states/county who clean it up and the responsibility isn't the property owners.

so...you think it's rude for me to maintain my property and my neighbor to let his grow up and fall over? I'm not telling them anything, however when you buy land, house, property....then you have the obligation to keep it up. The state maintains the right of way my friend...it's their property...I get what you are saying...but what I'm saying is if a tree is on your neighbor's place...and he sees it's about to fall on your fence, it's unhealthy and leaning...whether it's a fence or a hay barn it's on his conscious to take care of it. Cost money to own land...if ya can't afford to maintain it then it's time to consider selling out and moving into a condo in my opinion. Now...the simple country reality of it all is that it would be unrealistic for me to expect him to pay for something like this...I just cleaned it up and sucked it up. I wouldn't expect him to pick up the tab...but if my tree fell on his fence..you'd bet your bottom dollar I'd be out there pitching in to help and letting him know I was sorry about it. Just being neigborly. A little side note...I've had to stop mowing in that pasture because they were target practicing shooting 100% toward me...right in the line of fire! If you've got money for Ammo...you've got money to drop a hazardous tree...and if you don't have the common sense to not shoot towards a man mowing in his pasture.....you shouldn't have a firearm. This fella makes it a point to put up no trespassing signs facing my land...for no reason other than to "poke the bear"...only reason I'd ever go over there is to get one of his trees off my fence. It's handled...but it's interesting to get folks take on the situation. It's up to a landowner to maintain his property...but I'm not gonna waste my land and put my fence 100 feet off the property line because his trees were there first. When we cut timber I asked if he'd like those leaning pines removed...he declined...6 months later he tried to hire the very same guy to cut his timber...just a strange neighbor my friend...I don't think he even knew the tree fell down lol

It really is the land owner responsibility (his tree) !!! But, stuff happens and if you can clean the tree up your self, do so (Be a good neighbor) Let the neighbor know you took care of it, it's all good no real damage to your fence !!!

Your neighbor is obviously responsible, but you're the one with the immediate need\care. Not everything is about blaming someone else. Sometimes we just need to get stuff done, because it's important. Also, trees just fall on fences, unfortunately.

Broom straw grass (broom sage) is a sign your soil is poor and acidic. You need to get a soil test and fertilize and add limestone accordingly.

yep....conventional thought process for modern farming....we do need to lime for sure...but we don't use conventional fertilizer on the property. This is the worst pasture on the farm....but....it's getting better every year with rotational grazing. Keep on watching and see how we're feeding the land without spreading $25k in fertilizer every year

My insurance company told me to send letter to neighbor warning them of huge tree hanging over my house and if it ever damages my house it would be their responsibility for costs of repairs. Documentation warning.Didn’t do it just discussed it politely and they had tree cut down.

Along with my Stihl MS251, I've been using an EGO battery chainsaw for a few years now. I use the EGO more often than I do the Stihl because I do a lot more limbing and brush cleanup than I do felling trees on our farm. The battery chainsaw has plenty of power for those kinds of jobs and performs like a champ.

For the average homeowner, the electric is ideal. I use one for my property and NEVER had a problem cutting through any tree up to 24inch. As far as who is responsible? If the tree was downed by the weather the owner is generally not responsible. If it went down because it was rotted and the owner was aware of it, the property owner the tree is on, IS responsible. However, if it's done little damage to your property, in the interest of neighbor relations, it's probably a good idea to just take care of it yourself.

lol...man so funny how folks don't see what I do here as work...got 4 cameras rolling ($3,000) a skid loader ($40k) a wood chipper ($10k) and paying my editing staff ($500) .....so I'm not "picking up extra cash" lol...I'm working and wearing out equipment my brotha lol....you saw the work...but behind the scenes there's so much more!

Having large acreage, its a part of country life . I have small acreage and it happens, Pretty much knowing what it is, just deal with it. Free firewood. It would be a different story if it was more of an urban area or city area where people traffic occur at a regular and could be hazardous then I can see getting the tighty whites in a bunch because of the hazard to structures or people. Im surrounded by large farms on three sides and I have never seen the owners but a couple times in over a decade police their fence lines. One neighbor to my front had cows come over onto my property . Woke up to cows all in my front yard. He rustled the cows back over and fixed the fencing where old trees fell over breaching the fence. Some trees on his side some the other.

Where I live the owner of the tree is responsible for clean up, and the fence/building owner is responsible for repairs. Unless the tree has been flagged by insurance company or either property owner as a potential hazard, due to it being dead.

Nice tight woven wire is a great perimeter fence. It's a pain in the rear to put up and stretch, but it'll turn dang near any livestock.

I've got a Dewalt electric saw. I use it all the time for limbing and small jobs. It's convenient as can be and more than adequate for the things I use it for. It's great for minor trimming with my chipper.

The falling tree is nature. It's your responsibility to fence in your cattle, unless you live on free range territory. If you want to maintain your fence then you do the work.

Growing up in a farming area, I feel that the person's property that is being impacted needs to take care of the removal of the tree. I spent many hours clearing fence rolls for farmers. They will call and tell me that they could use a fence cleared. I would get any wood that I could cut into fire wood and the rest would be piled so the farmer can burn the waste. That was back in the 1950's.

A big grey gum eucalyptus tree on my neigbour’s property fell onto our place. It was huge, around 30 meters tall and wide at the base. It was so big that when it fell a branch from the falling tree snapped a 10 meter tall iron bark tree in two around three meters above the base. It took us a long time to cut it up, we got a huge amount of firewood from it. When we looked into who is responsible, according to the law in New South Wales Australia, the land owner the tree falls on is responsible for damages, unless the owner of land the tree is on is advised the tree is dangerous and needs removal and they do nothing about the tree. If the tree then falls and causes damage it is then the responsibility of the owner of the land the tree was on. So we were responsible for cleaning up the fallen tree and damage it caused. Bummer.

I think that for what you are using it for, the electric chainsaw is fine. I agree with you that the electric tool technology has improved a lot, and is largely being used commercially. Maybe not the chainsaw so much, but eventually.

Yep, I bought a battery electric Stihl chainsaw because it’s handy to have and use. The only reason I bought Stihl was because I already have other equipment that uses the same battery. It came with a 30 amp battery but I use 20 amp batteries because the life between charges is about the same as the need to refill the bar oil. I can check the battery strength and at the same time I know how full the bar oil is.

He (the neighbor) is responsible for his tree. But, it’s your fence so it’s your tree now. The mulch and lumber are yours to do with what you will.

As a kid I used to do fencing on my father's farm. We didn't complain when a fence got broke we just fixed it. When you have properties as large as that it's mother nature's fault. I've had trees get blown over on my property that took out power for half the town. My property is too large for me, or anyone else, to trudge through the woods looking to problem trees.

nobody is complaining at all buddy, I think you're missing the point...it's food for thought. I don't care if it's a fence, barn, house or classic car in the driveway...it's property...and when your neighbor has a dead, dying or dangerous tree hanging over your property potentially endangering life, limb or property...then it's their responsibility to maintain. This isn't about trees blowing on the power line..it's about asking a question...Who is really responsible? I fixed it...no biggie...but in the end he should have removed the tree. Cost money to own land....but nobody should have to worry about a neighbor appropriately maintaining his trees. Act of god if it were healthy...negligence if it was leaning, dead or dying. What if that tree fell on a cow or even a child? This is food for thought buddy

@@StoneyRidgeFarmer I agree when you're not dealing with lots of trees. All I was saying was the larger the property the more gray things become. Also I don't know how forested your area is. Where I am is heavily forested, but the set-backs in my town are 100' which helps avoid issues as well. Fences are still fair game though.

I love my milwaukee chainsaw. I bought it do branch cut up like you were doing but find now I use it for most of the job. If I'm heading up to the camp for the weekend the gas saw rarely makes the trip anymore. Now I have a bunch of other Milwaukee tools so I carry 2 large batteries and 3 smaller batteries. I hope to in the future get a cap for my truck and actually have a charger built into one of the side doors. The odd thing with electric chainsaws is I find its not that uncommon for me to forget to bring the bar oil.

I carry a Makita 18v 10" bar chainsaw in my side by side on my farm. It works great for downfalls. I also use it when climbing trees to trim them. I haven't used any other brands but I'm sure if you stick with name brands you'll be fine. I had started with Makita set years ago and just kept building. I have seven batteries, three different impacts, numerous types of saws and a grinder. I hope the Toro holds up as well as the Makita, I'm thinking it will.

I’ve been told if a neighbors tree falls on your property, it’s yours and the neighbor bears no responsibility. You can also cut any part of his trees that extend over the property line. Trimming his trees for him can safeguard your property.

When that tree falls on your Prop. it now becomes your tree. You can call your insurance company, but it will cost you money.

Have u ever tried Vinegar salt water and dawn dishwashing For a Is grass and weed killer along your fence ? I look for the Natural stuff to use myself instead of harsh chemicals

I don't spray my fence lines...wanna make your farm a total mess...spray your fence lines and watch the wire deteriorate...the soil erode and create a gully under your fences. The fence has been up for about 4 years now and I've only sprayed one fence line to demonstrate a weed killer for a video.....never again after that! Remember...vinegar is acid...acid eats off the galvanization on the wire...even glyphosate is a salt...all of it eats wire...better to trim the fence lines if needed and cut any saplings that grow up in it

Insurance would say that you are / your insurance is responsible if they were involved. So I'd say it's your responsibility.

A few years back, several large hickory/oak trees from my neighbor's property fell onto my property during a storm. When they blew over they took out 3 smaller (12"diameter) oaks on my property. The cleanup of the mess fell onto me. Neighbors? Best wishes.

If you want the correct answer per the law, here it is: If the tree is alive with no sign of disease or dead limbs / trunk and it falls on your property (Real or Personal ) it’s an act of God and your neighbor is not responsible. It the tree is dead, dying or has dead limbs and you notify your neighbor of the potential danger to your property or possibly bodily injury and he / she doesn’t remove the danger within a time frame of a reasonable person, then they are legally liable. When you discover the danger(s) document the exact location and notify your neighbor in writing through certified mail. If their trees damage your property in the future, you have done your due diligence and they can be held responsible. If you let them know about damages after a reasonable time of their inaction, file suit against them. They will notify their insurance carrier and the insurance carrier has a duty to provide them legal protection and settle all legitimate claims against them within their liability limits. That’s the legal way, but the best way is for your neighbor to jump in and help clean up and repairs. That’s what I’d recommend.

Talk to your neighbor and see if you can clear 50-100’ on his side. If he is a deer Hunter plant it in clover and other good forages. Let him know that during the summer you will mow the fence line. Cut it bail it and spread it out on your land. Win win for everyone. Or just ask if you can clear the trees so far back and leave it at that. They will either say yes or no.

lol...never happen. You are talking about him spending $50k to do that....heck he knew about this tree leaning and didn't spend $1k to hire a tree company to cut it before it fell on the fence. I knew it was gonna fall...just a matter of time so I just fixed it. I don't think he even knew it fell...I don't mind but imagine if it was a house or shed

Cut the baby tree off the fence, shove it over to the neighbor's property, straighten up the fence wire and go do something productive.

Responsibility ends at the property line. The only possible way around this is if you notice a damaged/dying tree, and notify the neighbor that it might hit your house, garage, barn, fence, etc. or out your kids in danger or something of the sort. Then they may have the responsibility to take care of the hazard, and liability if they don’t. This may not be true in all states/locals.

exactly! This was a known hazard and hanging over the fence dying for a long time...we both knew about it...it becomes negligence at that point...I took care of it...but if the shoe were on the other foot I'd do what it takes to be a good neighbor and prevent damages...what if it fell on a person or a cow? Hmmmm...no harm no foul but what if?

​@@StoneyRidgeFarmer I'm not a lawyer, but I've seen lots of TV! haha Knowing something, and being able to prove that something was known are two very different things! If you could make a video of yourself informing your neighbor of a hazard tree and the neighbor saying they wont do anything about it...or informing them via a registered letter that required signature, etc. All had to be done in advance of any damage. Otherwise, the neighbor will just deny knowing how bad the tree was, and then its just an act of nature. Unfortunately, accountability is lacking across the world. I dont care about your political persuasion, religions beliefs, etc. If it costs someone money or in an inconvenience to them, so many people wont do the right thing.

If you have made him aware of the problem it's his issue. If it is hanging over your property you can cut off at the property line.

We had a similar situation for several frustrating and expensive years. Neighbor's Loblolly pines were intentionally planted in a row right on the fence line. Many years later and new property owner, and the things started to blow down. They were towering, swaying beauties. The damage was an act of God, is what Virginia law says. The first tree took out my lamp post and smashed the trunk of my wife's car and landed very close to my house. Insurance claim. Next one smashed the windshield of my truck. Insurance claim. I pleaded with them to take the ones down that were threatening my house and cars and garage. I started parking way down my driveway when a storm was imminent. Next storm came out of nowhere, with wind shear, and landed across both of our cars, smashing both windshields and causing major body damage. I asked him to drive me to the body shop to pick one of them up. Nope. Finally, my insurance company told him they would be "subrogating" the next claim, meaning they would be going after him and his insurance company. That convinced him to take action by examining the trees most likely to fall and paying to have them taken down. The bottom line is he seemed to enjoy my suffering and did not take action until the pain would be his. By the way, every claim I made counted against a number of claims, and although I had never filed before, all the claims with my insurance company were not without consequence, as you likely understand. Stoney Ridge, your case is a bit different, but similarly, I would not expect any action by the neighbor until and unless the pain is his. He'll tell you, you should have considered that when placing your fence. BTW, Good luck!

if the tree is clearly dead or about to fall on your property it is your neighbor's responsibility by law...if it's standing, live and healthy then it's an act of god...this one had been hanging over the fence for about 2 years

If I had been the neighbor, I would have met you and your insurance company in court and I would have won - at least in Texas - plus countersuing for legal fees as well as the emotional toll caused by your insurance company attempting to intimidate me. A live, healthy tree that falls - no matter what it's close to - is the problem (or benefit) of the person whose property it falls onto. Your neighbor was either as ignorant as you are to this reality or was actually a nicer guy than your post gave him credit for and decided to help you out. Or, perhaps, he learned he could make money off of large Loblolly's by selling them to a lumber yard. Now, on the contrary, if the tree is diseased or dead and you document having asked your neighbor to have it taken down pre-emptively, then it is his fault.

I agree with your final statement...but I don't agree with you on the loblolly pine being planted as a decorative tree or a privacy tree or making money on them. A full load of loblolly pine trees on a logging truck only brings about $1200 bucks at the lumber yard and is hardly worth the trouble to harvest a small amount. I don't think that calling someone ignorant in the comments and or treating them harshly with insults is the right move here either. There's a way to articulate your message without being insulting my friend. I think this would be an interesting scenario if it went to court... I just cleaned up the mess and moved on but if it was a chronic issue then a good neighbor would empathize and help correct the situation to prevent further damage. Standing on a soapbox when bad things are happening because of poor choices from other's is not very neigborly. We "Love thy neighbor" around here and therefore I didn't ask for anything...this very same neighbor has no trespassing signs all over the woods facing my property....as if I'd come over there for some reason....very same neighbor also didn't have enough common sense to not shoot in my direction as I was mowing the pasture one day....I did have to go over and ask them to stop until I am not in the pasture...seems like common sense..but I didn't throw a fit or mistreat him...just politely asked. Love thy neighbor my brotha! Being nieghborly sometimes means preventing problems before they occur despite the cost to the land owner my friend...when we start talking lawyers and issues like that then we open up a horrible bag of worms

Southern yellow pine is not a type of pine tree. It was made up by the timber industry as a catch all for the crappier species of pine in the south east.

If you're fortunate to own a good amount of acreage, absolutely agree - install your fence well within your property line. (Or tree height.) So you can trim & cut outside the fence line without having to get your neighbor's approval. (Or stir bad feelings - some people are nutty!) Expecting neighbors to be responsible, as they should be, esp this case, to conscientiously maintain their property lines is probably not very realistic. (Although some neighbors obviously do, certainly. 👍😉)

Take an old pair of chaps and run the electric saw through them. You will see they are dangerous as they can keep cutting right through the kevlar in them due to the torque produced by the saw. I like battery saws and use them myself but just know if you catch your chaps it will go into your leg of the trigger sticks

All electric chainsaws have "overload" protection that will stop the saw if it's overloaded like that my brotha....if you hit the chaps it should pull out fibers and bind up the saw to overload it. The saw will cut out unless you are aggressively mashing it into your leg...however....great idea for a future vid!!! I'll use it!

I'de say if the tree was a known problem, like a leaner over type then yea mention it to him but a random tree falls in the country, I'de just chop it and move on. If its a continued problem and its an old neighbor, maybe cutt any questionable trees that might get your fence. I know your time is valuable, I just don't know.
