I am not laywer but common sense tells me it tends support my statement. I believe in priciple and in spirit that most people what I mean. The supreme court ruling was very simple. A law can not be implemented by a government agency. The individual agency of the government are in place to enforce laws made by congress. So the question is simple was DEF, and other clean air acts rules and regulations implemented by congress. in my research the answer is no. The clean air act was put in place by the EPA. So in my opinion none of the clean air act was ligament legislation therefore the laws are not legal. That said many won't disagree so if your prepared to fight for your rights and the rights of others against the will of the manufactures delete away. However if your not prepared to take it to the supreme court your stuck being an obedient citizen and not a free patriot. Make no mistake your freedoms are not free. The facts are simple politicians let the depts do the dirty work because then they are not responsible and won't be held accountable in the voting booth. Then the lobbyist get involved and push for the rules they want to benefits their business. Make no mistake Diesel engine manufactures want emissions and all the car manufactures want laws that make them install safety equipment because it makes them more money. The manufactures were not happy and showed their hand when Trump said CA couldn't have a higher standard of clean air than the rest of the country. GM was not happy because it was going to cut into their bottom line. In Trucking DEF breakdown have added Billions of fees in breakdown occurrences. Their are to many people making money off these regulations. None of these laws are about clean air. All of these laws are about the money it cost to install, regulate, and maintain. Good luck Folks.

Alot of the engine manufacturers were pissed about the emmisions laws, like for example the red top n14 cummins, they were forced to stop manufacturing them cause epa said they emitted too much emmisions and the n14 red top cummins was their best engine they ever made, same with catapillar. Now lolets get to the def fluid, they say the def fluid being injected in the exhaust lowers NOX, how does it lower? Well when the def pluid is injected in the exhaust system above 400°f there's a chemical reaction that happens, they say during the chemical reaction of the def fluid it creates ammonia and it takes the place of NOX thus lowering the "carbon imprint" isn't ammonia toxic aswell and causes other environmental issues, and don't forget that plastic bottle that you have to throw away to save the planet!

When The government said that CA couldn't have a stricter level of emissions than the rest of the country at the federal level GM jumped to the front of the line to complain, because the extra mandates give them an excuse to charge more money for their products. As competitive as corp business is they are all operating on the same models. Maybe some manufactures are not on board but they all profit from this. Any heavy duty road truck with 350K Generates about 2 to 3 thousand permonth on dealer and towing services. If the EPA said no DEF anymore you would not see the manufactures stop. There is simple to many people making to much money on the junk science. DEF cuts the over all life of the engine by about half. Prior to DEF we used to go about !,000,000 miles on an engine (ISX) with DEF the engine goes to about 500,000 with sensor issues starting at 350,000. It's all a scam pumped by greed.

Just to be clear, I do understand that the EPA was granted certain things by Congress to regulate mobile energized devices. What they did not do is Grant to the EPA, the ability to tell somebody who buys a mobile device, such as an automobile or a diesel pickup truck or whatever, that they cannot delete these things on their own. And that legal mechanism occurred in 1976 when the state of Washington tried to get after a man who had removed the catalytic converter from his 1975 or 76 Chrysler Cordoba. As it turned out, as memory serves me correctly, it came to a point that they insisted that the car polluted more with the converter off of it then with the converter on it. So they tested the vehicle in both conditions. And it was actually cleaner without the converter. But at the end of the day because he had done it himself he was not subject to the law in the first place because he is not a licensed mechanic or a licensed repair facility. And the EPA can only exercise authority over repair facilities and certified mechanics who are working in Commerce!

With all due respect, I don't care about racers. The real problem is with the tens of Millions of people using diesel trucks to make a living. This is put a major cost on small businesses and big businesses because these systems simply do not work. I hope someone comes up a way to file a successful lawsuit against the EPA because they are mandating something that simply does not work as advertised. The technology is not there. All this DEF exhaust garbage is destroying small businesses like mine because it is unreliable and keeps breaking down.

The new Humvee replacement uses a 6.6L duramax with no emissions equipment. I think its the JLTV. The military wont have the emissions equipment on their rigs because they know it absolutely doesn't work and cannot be relied upon

Pretty simple….I’m guessing it’d be bad to have your combat vehicle go into limp mode in the middle of war. Pretty safe to say there’s a lot less potential danger to a civilian running out of def in there dozer vs military in a combat situation. FYI, the huge chunk of non-combat government vehicles out there are no different than anything sold on dealer lots.

I understand rolling coal is not clean(thats not me)but there’s so much bs added on cars and trucks that you cant get good mpg unless you modify them.

I’ve had my diesel for 7 years I only have 77500 miles on it and the heater in the def tank threw a code because it was below freezing for 7 days. At this time I either fork over $1000 to get the heater changed out or for a little bit more I take care of the issue myself. I’m taking care of the issue as I want my truck to keep going for a very long time

Back in the 2009-2011 time frame they did fight, however even with 1000s of hours of research, and many papers detailing the problems with the technology, the EPA would not consider any changes to the timeliness for rollout. The EPA was completely deaf and dumb.

DPF/DEF EGRs on Diesel engines are nothing more than money pits and cause those type of engines to constantly break down. Creating those emissions type products cause more emissions than the vehicles themselves. The biggest copper mine is in Escondida, copper is what is used to make the insides of a DEF exhaust. Container ships are used to transport that copper. There are roughly 10,000 container ships in service. Those ships run on diesel motors that have NO emissions on them. 1 of those container ships produce as much pollution as about 50 Million cars. There are roughly 1.4 billion vehicles as of 2022 according to automotive market research. So if all those container ships are running they are producing enough emissions as 500 billion vehicles. So even if only half of those container ships are running that’s still enough emissions as 250 billion vehicles.

I bought a new 2022 Colorado zr2 bison diesel with one mile on the clock and has been in the shop 4 times with def/dpf issues. Shop said if it weren’t for the warranty it would’ve cost $8000 each time . The truck now has a lil over 4K miles on it. Once that warranty is up you know what time it is….. Thankfully I live in a state where there is no emissions testing.

Side note for everyone to think about is that military/government/fire department/ambulance/ well should have left it government are not required to have this because of failure issues and cost of maintaining. Texas Constitution Article 8 sec2(d) says there is property that is not commercial and the government has the car dealers converting your “goods” into “ Motor Vehicles”( 18USC31(?6). The they convert you into a “ Commercial Driver” and tell you that you must license. BS …not unless you work as a driver and make money on the road and cause unusual wear to the road. Texas Transportation code 521.021 meaning of license: Learners Occupational: defined in law as A trade, profession, job, career, or calling. Congress can't give law making authority to the Executive branch of government. There is nothing in the Constitution that allows this. So, whether congress clearly states this transfer of authority or not, matters not. Furthermore, the so called "interstate commerce clause" does not give the federal government the authority to regulate individuals, not involved in commerce. They are not going after racers, because they can't do so legally. A state can, the feds can't.

My brother in law used to work high up in the BP oil company during the Obama administration. When that bad oil spill happened, BP immediately called in the Japanese tanker ship to help contain the spill until they could stop it so that it wouldn’t spread, but…. As we know it spread for days until it reached land. Reason is, Obama stoped the Japanese ship and wouldn’t allow it into US waterways, and stoped BP engineers from trying to plug the spill, just so he could use his government engineers who knew absolutely nothing about oil, drilling, or oil rigs. Osama even put out a competition to engineers students to come up with their own solution, just so he could trick the public into thinking he was encouraging the youth, and make people think his administration was going to save the ocean from the big bad oil company. BP, their engineers, and my brother in law tried everything to get the government to back off and allow their own engineers fix the problem before it got worse, Osama said no. My brother in law interrupted one of Osamas officials in mid sentence and told him, “With all do respect, your administration is making things worse, your engineers know nothing about the oil industry, and that these BP engineers live, sleep, and breath oil, and their administration needs to back off”! It was until the oil made landfall the public started to demand more action, and Osama finally allowed the Japanese ship to cross international boarders and help contain the oil, and finally allowed the BP engineers to do what they know was best, and stoped the leak, and Osama took all the credit for something BP had been begging Osama to allow them to do from the start. And BP took all the blame. BP deserved the blame for the initial spill, but Obama was to blame for the wide spread pollution. All so he could say he saved everyone. Wake up people, this whole climate change, and green deal is a billion dollar scam. If you look at the worlds history of climate changes, we are over due for a massive, natural change, and that the air pollutants were way higher during the ice age, and hundreds of years after due to the burning of woods for heat, more natural volcanic activity, and other things happening. Scientists have already proven this by taking core samples from deep beneath the polar ice, and other areas around the earth.

@@argusfleibeit1165 , the oil spill was all over the news, Obamas administration sent out a notification on the news wanting to allow MIT students to try and come up with a robotic drone to try and reach the bottom and plug the hole, this delayed the containment of the blown hole, and the clean up, that was all on the news. The private meetings between BP, and the Osama administration was not televised. After the oil reached land, which was televised all over the world, and the EPA, and people of the world started to complain, then Osama allowed the tanker to cross our international borders and help contain the oil, so the blown hole could be plugged, which was also televised as the tanker showed up to contain the oil, which was BP’s plan from the moment oil started to spread from the blown hole.

The biggest issue that is not a legal issue with the EPA is they are making a lot enemies. You stop one company it has ripple effect to their employees and area that company serves. Now they have created millions of enemies that can vote. It is an issue the EPA cannot ignore for too much longer. Many in the motorsports want to work with them so they educate each other about each other about these industries. If they EPA fines them that makes this idea nearly impossible to entertain. In the south motorsports and diesel industry is a multi billion industry.

What emissions did the old Diesel engines actually emit? Carbon Dioxide ( what the trees need to be able to grow) and soot but after 1986 with the introduction of ECMs and EUI’s diesels cleaned up the soot . DEF introduces acid rain and the heat shields on the knew Diesels get really hot and causes way less fuel mileage which then creates more Diesel fuel production and more oil drilling.. so EPA needs to roll back emissions to pre Montreal protocol emission regs and let us be

Regarding the EPA vs Borla case, what happens when a vehicle was never intended for operations on public streets and highways, can a state ban them from operating? Case in point: many states allow surplus military HMMWVs to be registered on the street and highways for operations. However, Kalifornia now no longer allows for registrations of these HMMWVs!

Not from the US so not 100% on all the laws but my argument would be “The Right to Repair.” The emissions systems on the diesel trucks is defective and it was removed to retain a useful life of the vehicle that you purchased. After the 8year /80,000 mile emissions warranty has expired it’s free game on emissions in Canada.

Based on this video, I have a question regarding what is an approved vehicle. Chevrolet had Banks Engineering set up something like a thousand 1500, 3.0 liter Duramax Diesel pick up trucks for the military. It is my belief that these were deleted (amongst other updates) legally by Banks for Chevrolet. Based on this, wouldn't all 3.0 Duramax units be legal (based on the approved mods done for the Chevrolet 3.0 Duramax units, or only the specific units built for Chevrolet.

Just read yesterday that Carb is planning for increased smog checks, plan is to annual, then semi annual, to quarterly, also set up "roving" smog check stations, looking at testing vehicles when they enter the state, even for vacationers.... I am so glad that we left that liberal looney bin

Sneaky workarounds like Friendly lawsuits during the Obama Admin with the EPA and conspiring corporation to set court precedent as law hundreds and hundreds of them. Attempting to circumvent law by making false laws tying decisions to another state. Is separated entirely from your state representation. Not legal, yet done more and more because they don't get the laws they want so circumventing is best. Simply because they are superior to the people. This lawyer made the most ignorant statement that I hear from so many people. “I’m not a constitutional lawyer or a Supreme Court expert” inferring that he does not have the authority to interpret the constitution. Conveniently for us the constitution was written in plain English and its meaning is not inclusive to constitutional lawyers and supreme court judges! The constitution means exactly what it says by the terms and definitions of that time period! There is no room for interpretation there is only confetti about the application of the constitution which any American citizen is entitled to read and understand the constitution. After all laws that apply to us Cannot be vague and ambiguous and if they are so complex that a normal person cannot understand them then they are void for vagueness

The EPA has insisted this junk be put on my little John Deere Tractor, talk about a waste of time and money. It only runs about 30 hours a year and when it does I have to keep it at higher RPM needlessly in an attempt to keep the DPF happy which burns more fuel.

For those of you saying why doesn't it apply to gas vehicles... in March of 2022 Cobb Accessport took away the ability to tune engines without emission devices and took away ability to ignore DTC codes that those engines throw. Luckily I got my 700awhp Subaru wrx Sti tuned before they took it away. But yes its on gas and Ethanol cars as well. Parts like catless downpipes, high flow cats, EGR deletes, Air pump deletes, TGV deletes, Flex fuel sensors that hook up and draw power from emmision sensors are illegal now. But they went after the manufacturers of these tuning devices. Standalone systems are the only way to fully tune now.

Maybe I have missed this somewhere (not exactly this video but related).... Why do gasoline emission systems not lock down the car to 5,10,15mph when they fail, but diesels do? seems like a very biased rule since people can drive around their 30 year old civic with a dead catalytic converter with no issues since they have not "removed or modified emissions equipment" but if our 2 year old diesel emissions system fails, it cripples the entire vehicle in 150 miles?

So, basically, the only way you can have a race vehicle is that is is based on a pre-1974 or something vehicle or be built from the ground up as an off road vehicle with no emission controls. That REALLY sucks for racing classes based on road vehicles and those are the classes beginners get into and are the lowest cost to get into.

Unfortunately, other countries ARE more crazy about emissions..European countries, for example, like Germany and many others...even countries like India have crazy emission laws in some of their cities, like you can't have a car that is over a certain number of years old, taxi's, etc. also, because of emissions. Japan also has crazy emissions laws, that's why Australia is able to get a lot of good used cars from Japan, because they can't be driven in Japan any more.

DEF does not produce less carbs because your Diesel gets half the fuel economy. Therefore you burn twice the fuel which is counter productive to its claims. Not to mention the amount of carbs it takes to build these emission products.

Maybe true for combat vehicles, but a huge chunk of government vehicles are no different than what the public buys off the dealer lots. Also, just because a gov vehicle doesn’t get emissions inspection, doesn’t mean they’re exempt.

So I understand that the EPA has clearly expressed legal consent to enforce emissions regulations on mobile vehicles, that's clear. What is not in that expressed consent is the ability to make changes to those rules or make more rules without the approval of said rules by congress. That is what we need to use for leverage on this. As them making the rules and enforcing them is a complete and utter disregard of our checks and balances system we have in place. The ATF is doing the exact same thing and why they are currently in court cases vs Texas and 17 other states as well as multiple firearms manufacturers.

I wonder what all this has cost people who's diesel truck with a egr/def system in their trucks that does cause ALOT of failures and complete loss of the vehicle. The Government and the EPA should be paying that out to people who did loss their vehicle and wasn't covered by warranty or like most warranties are a scam because there's actually nothing covered by them.

EPA almost put my shop out of business as they fined my automotive shop for doing automotive repairs normally saying that because we had catalytic converters Gf a vehicle while changing a clutch in two cars at the time they walked in fined us for 15k dollars and if we didn’t pay then they would pull are epa license so we couldn’t service any cars fluids we felt it was the mob show up to just money grab and force us from conducting business as Normal being in California and the cost of trying to fight this I lost my house to save my shop they need to be regulated and no Lawer at the time would touch my case for under 50k to fight them so I just paid it and lost my home and I still haven’t recorded years later

I remember the fuel shortage and they wanted to ban the Indy 500 because race cars use to much gas. Well they were suprised when it was pointed out that Indy race cars didn't run on gas but pleasure boats consume more gas than racers. So when are they going after the industry's that are polluting more than race cars and streetcars like private planes and helicopters.

"Kinetic" is a term used in the military to denote active combat situations like fire fights, ambushes, etc. I don't see how that applies to individuals voting or donating to an organization that supports a cause. If anything it can be interpreted that you want people to do more than simply vote or leverage monetary support. I hope that isn't the case.

Listening to this there is still an open question A chassis that was not equipped with an emissions package that had a blown up engine say a 2006 model no dpf or scr system. Was rebuild and put back on road with a non modified stock pre egr engine Say a 1999 model engine The engine meets all epa requirements for that power plant but is installed in the 2006 chassis This is not taking a 2022 model with a full emissions system removed and pre emissions components added Is this one of the Grey areas in the ruling This would compare to pulling a chassis out of junkyard or weeds and build a truck With mixed parts

If this was already brought up, I apologize. When I had my truck deleted I did so because the DPF went out and the repairs at a dealership were going to be $5K plus. I had the truck deleted at half the price. When I picked it up, I was asked to sign a document stating the work was performed so the truck could be used off-road only. I understand this was a protection for the shop who did the work. Does this somehow make it legal?

I’m far more concerned with not heating up the planet needlessly. Sometimes all the options suck. I’ll definitely side with trying to avoid a worse outcome for the warming of the planet than an optional, and avoidable, inconvenience of dealing with a truck issue. The less bad choice is the one the EPA is doing. It takes personal responsibility to do the right stuff instead of wasting whatever you want so you can have a big truck.

@@FirstnameLastname-bp5cm Although just to be annoying, the emissions control systems being discussed here are designed to address air quality and health related emissions, not greenhouse gases. To be doubly annoying, SCR that works to reduce NOx emissions (which contribute to acid rain and respiratory problems) actually INCREASES the greenhouse emissions as the NH3 is broken into N2 and CO2 during the catalytic reaction when combined with NOx and CO in the exhaust... DPF is a simple filter that pulls out particulate matter that is also a serious human health concern - again not a greenhouse gas mitigation technology. So like in all things in life, compromises are made and balance struck between competing needs for emission control. The best thing to do for reducing CO2 emissions is to use less fuel - and yes that is sometimes a result of removing these things. But the cost is increasing the rate of cancer and respiratory problems in your fellow road users, and thats not cool. But having said all that, the relative increase in CO2 from these systems is very minor, and arguably massively offset by the air quality and health outcomes achieved. The internal combustion engine technology is simply at a dead end. Its tapped out for any meaningful improvements in either greenhouse or air quality emissions - the F150 Lightning neatly deals with both sorts of emissions completely ;)

I don't why or how any diesel truck owner can come to the conclusion that after the Supreme Court ruling that every news article covered the lawsuit it mentioned it on my involved Virgins coal power plants and nothing to do with Diesel aftermarket parts sellers. You the private owner of a diesel can do what you want but it's when you do it sell it and or are selling diesel delete aftermarket devises are going to get fined when the EPA comes after your documents or fined for not keeping documents on every part sold and who you sold it to.

Only by the lefty’s because of their ruling on abortion and guns one if someone can’t see abortion is murder there’s something wrong with that person for the simple fact if you murder a pregnant woman on her way to a abortion clinic it’s double homicide and well gun we have the second amendment for a reason personally I don’t like either side I’m a libertarian I believe in freedom and small government

This lawer is over complicating this with his explanation. It's very simple: the federal legislator (government) must grant these agencies the authority to create laws, and policies. Which at this time they haven't. As it sits now these agencies can't make up thier own laws and policies, because they haven't been granted that authority. We had government beurocRATs running these agencies for decades and creating policies without authority. EPA, ATF and so on. However congress will eventually grant them this authority to avoid having to vote and add thier name to an unpopular policies or laws. Because they don't want to lose thier seat in power and they are cowards.

I don't think congress has the authority to delegate that kind of authority, they get all there authority by WE the people via voting them in. if they delegate to people we don't elect that circumvents the entire reason we have this form of government

@@Do-UR-Research2749 true, however congress has passed bills that became law before that were unconstitutional, and if/when they ever got challenged in court they were deemed no go. What will be needed is to get them challenged, and I get that isn't going to be easy or even likely the wv vs epa was states getting in on it and they would be very unlikely to challenge the rule on emissions for cars/trucks

@@farmboydiesel4569 It's not just about the US saving the world from the climate. I mean regulations like the Clean Air Act worked incredibly well. Look at pictures of LA and New York from the 50-60s and see the difference. Ambient air quality standards have shot up significantly since those times. Life expectancy from airborne related illnesses have plummeted year over year. We can breath easy.

The problem is that the US Congress can't regulate things that aren't involved in interstate commerce.
