@@kenneth6707 The plaintiff's property's backyard touches a lot of other properties. These neighbors are one of those in the back, they aren't nextdoor neighbors you have to see all the time.

@@サディスティック人Not really “frame,” it’s just a tragic case. Both the defendant and plaintiff seem fired up and speaking out of their emotions. Both the son and husband come off more genuine. This case sucks because a great injustice happened to the plaintiff….. and the legal responsibility lies with the plaintiff.

@@quietus.87 no, i was assuming the "uncomfortable ride home" was either the plaintiff mad dissapointment would radiating 😬 on the flight home. OR the previous person i replied to, by how they worded it seems like they insinuated that the son's honesty was the cause of plaintiff's dismissed case

Had a wooden fence, next door neighbors who had multiple dogs. The stench from the urine was overwhelming. Had to replace with concrete blocks!!

I think she wanted to keep the peace since they have to remain neighbors. She felt sympathy for the plaintiff and his dog, but knew legally the defendant were not negligent, hence why she kept saying let him be mad at me.

Initially thought this case would be a slam dunk for the plaintiff, because I always had a suspicion that JJ didn’t really like big dogs. But glad to see she was able to be objective here

She's always objective. Big dogs carry responsibility. Can't have a big ass dog without a lease and get surprised when it bites someone.

That is exactly what I stated. Big dogs carry responsibility, so I kind of assumed JJ would instantly side with plaintiff..

You won't win unless you're in control of your animal, irrespective of the breed. This is not the only case where this has happened. At least the dog survived. Terrible situation.

As a dog owner, I agree with the verdict. I wouldn't be comfortable having a fence that wide open separating me from my neighbor's dogs, whether they had Rottweilers or Yorkies. I'd want to make sure that my dog and their dog(s) were safe at all times, so I'd insist on a different fence and offer to pay half the cost of removing the old one and installing the new one. It's sad that the plaintiff's dog was so seriously injured, but as JJ said, sometimes it isn't anyone's fault.

Plaintiff took his case from bad to worse when he explained he knew before how vicious and dangerous those neighbor dogs were. You can feel his angst, but it's his fault his dog and son were injured.

How? The dogs were aggressive and attacked his dog for doing what ALL dogs do, and satisfying their curiosity. They could have smelled the dog's piss on the fence. They could have smelled something else of interest on the fence. The point is that the plaintiff's dog was injured without justification. Had his border collie done the aggressive attacks, then it would be a different story, but if his dog was attacked like he said it was without provocation, that makes the defendant guilty and the defendant's dogs dangerous.

​@@elffanatic2000No, the plaintiffs were to ensure that their dogs could not get on to the defendants' property fully or partially. And if the plaintiff thought that there was any danger on the defendants' property, whether vicious dog or bug zapper or chocolate or anything else, that is even more of a reason for the plaintiffs to ensure that their dogs could not get to that other property. If they know that their dogs do what dogs do, it is their responsibility to prevent harm from happening to their dog. The defendants' guard dogs did what guard dogs do - on the defendants' property, and rightfully so.

he let his pride and anger with the neighbour and dogs interfere with his responsibility - my heart goes out to the dog as the owner is clueless even at the end of the case he still does not get it and will probably do nothing to fix the fence!

I would have put up a wooden Privacy fence long before this. Dogs are animals and we can't always anticipate their behavior

Crystal: ... and THAT is why it annoys me so much when I see videos of babies (human) with dogs - and the parents always say "oh they won't hurt anyone". You never know what can set a dog off - keep them away from babies and children, parents, PLEASE (or you only have yourself to blame) 😏😏

@@trinity72gpPrecisely. I had a German shepherd and I had him behind a six foot wooden privacy fence. He didn’t get out and terrorize the neighborhood or go after the neighbors children or pets. I had no one suing me and worrying about my dog. Common sense isn’t so common anymore.

@@jenn1916 It may not be the most classy looking fence, but even if he were to put chicken wire over the metal bars of the existing fence it would have prevented his dog from sticking his head over. And chicken wire is cheap, and you can do it yourself.

"sometimes things happen that just aren't anybody's fault" This is JJ sharing wisdom. The law might assign blame to the dog who stuck it's snout through the fence, but thats just for the sake of the law. Dogs don't understand property lines, and if two dogs are able to reach each other and get into a fight, that is just the nature of animals sometimes. BOTH dog owners should have done a better job (wire mesh or something like JJ suggested earlier) and the dogs could have been kept from doing what dogs will do sometimes. The only ones I feel sorry for in this case are the dogs.

We had a similar situation- our dogs are contained with an electric fence..a neighbor’s dog got loose and came on our property and my dogs got him pretty good before we were able to stop it. They called the police and wanted us to be held liable..sorry, not sorry. Our dogs were on our property doing what they are trained to do- protect and defend.

I agree with her decision. If the plaintiff felt that the dogs are vicious then he should take every precaution necessary to secure his fence so that his dog wouldn't stick their snout into it so the other dogs could go after it. Rottweilers can indeed be on the rough side and they can attack if provoked, which I think happened when the plaintiff's dog stuck its snout in the fence, but in this case, I think they were defending their home.

I love the way JJ approaches animal cases in a similar way she approaches family court cases. Yes, she acknowledges that dogs have their own instinctual behavior based on breed, but she also treats the owners with the same parental responsibility over the pet as if the dogs were children. It’s a good balance.

I think it may have been a bit of a large assumption that the rottweilers couldn't fit their snout through the fence - they looked to have longer snouts than usual in some of the photos. Having said that, if the plaintiff KNEW that this was an issue, KNEW that these dogs were aggressive and violent, and did nothing to cover those very large spaces in the fence, that is on him.

The defendant pointed out that the picture was old, when they were puppies, their size at the time of the attack wouldn't allow their heads through the fence.

Plaintiff’s son admitted that his dog’s snout was through the fence rails and he had to reach to the neighbor’s side to free his dog, in doing so, also got bitten.

They should be thankful that their dog is still alive sans an ear. Very unfortunate. I am sure no one would have predicted what would have happened with that fence and those dogs. At least I wouldn't have.

I wouldn't have waited for "signs" before dealing with the fence issue. 😮Come on they are Rots! The money they ended up shelling out on vet bills could have dealt with the fence issue 🤦🏾‍♀️

@@G0dismabestfren Like I said, I personally wouldn't have seen the scenario where the smaller dog would stick its head/snout through the fence to the point where the other dogs would be able to grab onto it. I would have assumed it was smart enough to pull back before that happened. But it wasn't a scenario I would have thought of in the beginning. If I had, I would have put down some mesh like JJ suggested.

We had a huge, untrained Rottweiler living next to us when i was a teen and even though we had a 6 foot fence, i made it a point to be outside and watch our little dog whenever he had to go out. One day that d@mn dog knocked down part of the fence and came barreling at my mom and dog. Thankfully the yard was big enough and we were right next to the back patio door to move them inside. Super scary! Those dogs can cover some serious ground in a just a few seconds.

If this was your case, you'd have won. He didn't "care" for his dog until it was too late, then tried to rely on the fact that it was a Rot attack to win the case 🤦🏾‍♀️

People who live next to others with dogs need to install a second fence 18" from the first fence so there can be no contact whether paws or snouts are poking through the first fence.

Sounds like the plaintiff didn't want to lose the aesthetic of the fence by putting up mesh to cover the gaps. He could have gotten faux ivy that would have given privacy and prevented the dogs noses from going through the fence. Simple fixes really.

I have a small-medium sized dog. If my neighbor next to me had a big aggressive dog, I’d securely fence my property immediately to prevent any incidents. Dogs are like children, you can’t always predict their nature. And as the owner, you have to anticipate almost every possibility. Unfortunate incident, but one that could’ve been prevented. Simple verdict by JJ

Overall, I agree with Judy's judgement here. As a former dog owner, I feel that the right thing to do would be to pay half of the vet bills if I were the defendant. Then after that I would work with the plaintiff to create a solution to not allow this to happen again. I think that this is just a very unfortunate event that took place for both parties.

Sad to say but if you know collies that dog probably charged the fence probably ran along the fence all the time teasing them. Rottweiler said stick your nose through. And gave him what he had coming. Sad but JJ is correct you are the protector of your dogs anywhere you are with them.

I don’t know why anyone with dogs of any size would have fence like that. Also the defendants clearly have a small dog as well as the Rotts so it was definitely a protection issue but the son pulling in the opposite direction helped and didn’t help at the same time.

I learned in 9th grade business law, about attractive nuisances and JJ's example of a child putting its head through to see the dogs was just plain dumb. The dogs are vicious and the owners responsible.

The Defendants paid to have the side of their fence secured to keep their dogs out of their neighbors property, the plantiff didn't do the same. It's sad.

Defendant's dogs tends to be a vicious kind of breed, so they have the responsability to make sure their dogs aren't a danger to their neighbours.

JJ made the right call, and most humanely. But I do understand the plaintiff's feelings. One of his family members (as that's what pets are to all of us) got mauled by the neighbors, and he wants to be made whole. It's a hard situation, but he had no recourse against the Scotts. Going forward, I wonder if they were able to make reparations to the relationship - or not?

I hope they fixed this too. The fact that they had been to some degree friendly and cooperative with each other makes the tragedy many times worse.

This was just one of those times in life where something really bad happened but it wasn't anyone's fault. I feel bad because all 4 of them seem like decent people. It is what it is though

This happened to one of my dogs too. But it’s his fault. He stuck his snout through the gate and the three dogs on the outside got him. I paid the vet bill and didn’t blame someone else. He leaned his lesson and remembered not to do it again.

Yeah, the defendant couldn't help but open her mouth when she was winning the case. If I ever had a case before her and it was obvious I was winning, I'd just kick back and enjoy the win. If she asked me if I had anything to add, I'd just say "Well, your honor, I think you understand everything. I'd be happy to help if there is a confusing point you need clarified, otherwise, I'm happy to hear your verdict."

Well...probably because he's suing them and publically blaming them for his own negligence. He's fairly calm in court but I would imagine, considering the horror of the circumstance, he's been pretty heated with them. They all ought to bury the hatchet and work together to install an appropriate fence to avoid this sort of issue, and go back to veing good neighbors.

Proper verdict. I’m sure it was horrible to see his dog injured and bleeding like that. If there had never been an issue with these “puppies” and the dogs father was friendly with the plaintiffs dog, I wonder why they had an agreement not to have all the dogs out at the same time especially if they are trained.

The plaintiff lost because he kept referring to what is clearly a gate as a fence. Fence can be attached to a gate but the main difference between a gate and fence is a gate has more privacy or some sort of lattice , wooden board or chain link. 🤣

She was so perfect on this case 💯💯 I remember Not wanting to watch her because I thought she was Rude but one episode I watched really change how I was Judging her 😔 Now when Ever I Eat lunch, Dinner I came Right In KZbin and Watched all her Show hmm some time I get a little unjust because some cases she not being fare with The plaintiff or defendant but she can be so funny I love when they Say ummh she says that not an answer 😂😂

Typically fences are built a few inches within the yard if there is a single fence owner. A survey might have been useful here for the lawsuit outcome, although it wouldn't have saved the pup from injury.

Here in England 🇬🇧 we call them railings, which are found around public parks and such like, for homes we have wooden fencing sat on gravel boards and concrete posts in between each panel, or brick walls, which prevents situations like this, the plaintiff was at fault for the injuries his dog sustained, and stop blaming the neighbours just because they have rotties, it's truly sad what happened to the dog😢, and hope he was ok afterwards,

I don't even understand why that lady's getting all up in arms when judge Judy is literally on her side. It's like she wants to fight about it. Just let judge Judy explain the situation and then be done with it. You got a free trip to LA and an appearance fee

The husband would be wise to keep his wife away from the plaintiff. The husband seems to be able to keep his emotions in check and the wife seems like she likes confrontation

Yes, their dogs are in fact, vicious, and they’re probably not very good dogs- so fix your fence and keep your dog out of their property. You gotta protect your dog from those beefed up things.

The plaintiffs are in the wrong. They knew the dogs next door were dangerous to their dog. It is too bad that the plaintiffs do not want to take responsibility for the safety of their dogs or do anything to protect their own dog. And Judge Judy it was a fence NOT a gate However your ruling was spot on.
