Hi. Prosecutor in Texas here - also a gun enthusiast. I haven't once cared about caliber/color/ammunition used in a defensive shooting. I understand the argument that a wildly colored weapon could leave the jury with a strange impression of you, and I agree with your assertion that it's best just to have a regular firearm as opposed to one with some sort of nontraditional look to it. That being said, if an actor is justified in using deadly force, and in doing so the actor ends up shooting and killing someone whose threatening actions warrant deadly force, I'm not looking to wrap you up in some nonsense murder/manslaughter/criminally negligent homicide charge. Mot of us prosecute because we believe in the rule of law and we don't like criminals - not because we like messing with good people. My own analysis is this: (1) Did you intend to discharge the weapon? If yes: (2) Were your actions warranted under the circumstances? If yes to both, I tell law enforcement that we won't be prosecuting your case, and I applaud you for refusing to be a victim. But then again, this is Texas. It might be different in other states.

Not all prosecutors are A-political or as in your case pro-gun unfortunately. Especialy in some states there exists a serious bias. And unfortunatly some people will put their own opinions and even political ambitions before justice.

As someone who went though the legal battle nightmare that follows a self defense shooting I can say for sure they will use anything they can. In my case they tried to use the fact that the firearm I used was an M9, a "military style" handgun against me. They also tried to say my range bag was a "military style go bag" and I was "ready to run" they did not even look in my range bag, the officer just put that in his report based on the fact that the bag was cammo. I should have just put the dang thing up when I got home from the range but I did not think that only a few hours latter I would be involved in a self defense shooting. Thankfully it all turned out fin in the end but it was definitely a learning experience.

It is bad, I think of myself as a strong willed individual but the whole legal battle not only was I dealing with the fact that I shot someone but I had to deal with so many people telling me I was wrong, that I was a criminal when all I did was protect my family. It gets to you, people think it wont but it will. I am now making sure they have nothing to use against me if god forbid I ever have to deal with that again, Im not going to risk that kinda of stress just to have a cool looking gun... its not worth it. Yes in the end you may win but the added stress and extra time it takes to fight those allegations will make one miserable.

The stress that our legal system inflicts is massively understated and misunderstood! Especially when your friends and family will have to stand by and watch as the state paints you as something you are not.

I think you are referring to the Vegas PD guy who was playing Simon says with a guy and shot him. His gun said “you’re F’ed” written out on his AR.

I understand that there's the classic "well it's going to make the jury think you took killing someone lightly because of X" aspect to it... but if a pink gun gets a lady more interested in shooting and carrying, then I say go for it. It doesn't matter, because they're going to try EVERYTHING anyway. A prosecutor that is really trying to stick a conviction on someone is going to ham up a standard black M&P Shield 9mm as some black, sleek, super efficient launcher of extra-extra lethal 9mm hollow point man killers. They'll try and fry you on how your gun looks, how many rounds it carries, whether or not the military uses it, handloads/hollow points/proprietary bullet types, how much ammo you were carrying, etc etc etc. You make a valid point, but it doesn't matter if your gun is pink or not, if they're trying to throw the book at you when you were in the right, they're going to cook up some bullshit either way. Any good defense lawyer, talking to a jury that is a notch above mentally retarded, can shoot down a wishy washy argument like that.

You said the simple truth: the jury has to feel for you. All of the b*s* about the law goes in one ear and out the other. The prosecution is not worried about the law, they get their recognition from conviction percentage, not from how well they followed the law.

Disagree, Many circumstances can determine that outcome, The absolute most important thing is not even to make sure you operate within the law but to make sure you have a damn good attorney, People who crossed the line will walk with a good attorney when the guy who played by the book gets locked up for having a public defender, Prosecutors are there to lock you up and typically if they take your case they think they have it won, They keep their high conviction rates for a reason. They pick and choose the cases they think they can win, so make yourself an easy target and you will go down that way, make yourself a hard target and they might not even try.

yeah that sounds cool. its horse shit. you can very easily find yourself in a situation you did not plan for, and if you have to shoot you will probably end up at a trial, regardless of how you perceived things at the time. you have to defend yourself not from the prosecutor, but from a group of people who probably dont support gun ownership or self defense.

The police officer you are referring to had "You're Fucked" on his dust cover. He also gave the suspect multiple confusing and contradictory orders and shot him after his pants fell and he tried to pull them back up. Dude was on a power trip.

Yeah I saw that video it was fucked up. He told a drunk guy that was obviously not a threat to crawl on his hands and knees while keeping his hands up. Shot him dead when he pulled up his pants.

Had an incident where a guy called the cops saying I'd pointed a gun at him (brandishing in my area). When the police arrived and accused me of brandishing, I told them to ask the complainant to describe the gun and he said it's a black semi-auto. Turns out it's purple and he was arrested for making a false statement to police! Enough said for my side of that argument!

+Brett Peterson I suggest reading a few massad ayoob articles or reviewing az vs harold fish. fish, a retired teacher & ccw holder shot a guy in a lethal force event. fish used federal hydra shok factory ammunition. Fish was convicted but his case was later thrown out before a new trial.

Ballistics are a crap-shoot anyway, unless you have a rare or 1 of a kind weapon. So, no worries. I personally do not like frangible ammo. It's less spread than shot and less effective than a hollow-point. I prefer lead hollow points in front of a potent charge of powder. Great shock, moderate penetration and low cost for what it does in target. Even in my 1851 Navy, that sort of load performed quite well in 20% ballistics gel, splattering the 1st half of the block or more to the walls and ceiling upon impact from 12' away.

Actually it's possible. I had mine suspended for longer after I acquired too many points and the reasoning on paper was that because I had a "sports car" it was causing me to break the speed laws more often. I had a stock 2000 mustang GT.

The difference in your statement is this: A guns sole purpose is designed and manufactured to kill or cause deadly/severe life threatening injuries when used. This is what a gun is exclusively made for and IS a DEADLY WEAPON. A car/Vehicle on the other hand is made for transportation /transport. It is not made to kill people nor designed or engineered for that purpose. If you decide to run some one over with your car.. You have turned that vehicle into a dangerous instrument or used it in the capacity of of a deadly weapon but that is not what it was designed to do.. Big difference

The advice i always heard on ammo was to find out what the police load with in your area. That is a hell of a defensible position.

I'm a former LEO. As such, my SA Range Officer Compact wears Thin BLUE Line grips. My wife EFCs a PINK Kahr P380. My daughter EDCs a TIFFANY BLUE Glock G42. IF the shooting is JUSTIFIED, the firearm used, much less its color, is MOOT.

i'm sure it's just me but this sounds like a flaw in the legal system in terms of prosecutor ignorance and jury selection. Either you should have a jury that's familiar with guns so they aren't just gawking at it like it's a live grenade or you should have prosecutors who are familiar with guns to demystify the gun for the jury so color isn't throwing them off. I would've thought a gun with color or design (shy of blood spatter and skulls) would make it look less intimidating than the stock black weapon you see being held up like a demon head during police and politic propaganda photo ops. that's just my opinion tho

That's not how it works. You get a selection of voters chosen at random and widdled down. You don't need everyone to be experts in firearms. You tell the jury. That's the whole point of the trial. You think we should only have computer scientists in hacking cases? What about bomb experts in terrorism cases only on the jury?

Courthouses do not allow firearms or weapons. The one time I was in court they expressly told everyone to make sure they didn't even see a multi-tool even if it didn't have a blade inside it

Its sad we live in a society where the color of your gun could make/break a court case. This is so sad. What does color of the gun have to do with anything? Lets say a person breaks into my house with a gun in the middle of the night. I grab a shotgun thats been hydro dipped in digital camo pattern. They bring the gun to court and they see it has camo on it......That makes a difference? What should that matter? Who cares if its black, blue, yellow, pink, purple, orange...etc.... What should be looked at in court is if the criminal was doing something he shouldnt have, and if the shooter was in the right (what he did was legal) The color of the gun should be irrelevant. Its like saying "the shooter did the right thing, but see it was partially cloudy that day, and there was a slight chance of rain" "so based on the weather we find him guilty" WTF does that have to do with anything. Society has become ridiculous if gun color can be used in court!

Saying a gun owner with a pink gun is an irresponsible person or doesn't take guns or safety seriously is so much BS it should make a normal person cringe. I could as well say that every person who puts coilovers and rims on his car is a reckless driver.

Yeah. I was going to make a similar parallel. If you put a flame paint job on your car and mag wheels, etc. you can still drive the speed limit and use your turn signal...Guns can be a significant investment. In money, time, and emotion. Especially if it is your first gun, like your first car; you may very well give it extra attention to make sure it functions and looks top notch. Just pride of ownership.

Said this already, sry. A pink gun is HIGHLY visible, if you carry concealed, you NEVER want anyone to know you have it, its why you dont print your firearm or brandish it. Black, od green and tan blend with the body. Pink and silver are not great options, but they are options.

When you carry a gun in public, it's no time for games. What can seem fun and neat at the range is totally different from resorting to lethal force to save yourself from death or worse. For a purely practical reason, drawing a gun should have a deterrent effect, and if your gun doesn't look like a gun because it's pink or looks like a Nintendo zapper, that isn't helping the situation.

While you are right on the question, the core of your reason is wrong. You aren't drawing your weapon to show it, scare the bad guy or anything else. You pull that gun you better get straight to killing someone. Whether you kill someone with a nice & friendly pink handgun, or a deadly lethal assault weapon black handgun is irrelevant.

@@tightywhitey6466 I disagree since %95 of incidents where a firearm is drawn in self defense are ended without pulling the trigger. It absolutely is enough deterrent just to aim it at an assailant. Be willing to pull the trigger if need be of course; But if you can avoid having to shoot or kill someone and still successfully defended you and yours just by presenting it, that's a win-win in my book.

I have advised women whose husbands are prohibited persons to get pink/muddy girl camo guns. Doesn’t prevent the joint constructive possession argument but at least gives me a counter to it.

I'm no lawyer, but isn't joint constructive possession difficult to prove anyway? In the case of Wilcox v. State, 522 So. 2d 1062, 1063, 1988 Fla. App. LEXIS 1412 (Fla. Dist. Ct. App. 3d Dist. 1988) the court held that because the defendant did not have the gun on his person, the prosecution had to prove that he had constructive possession of the weapon. Unless there is evidence or witness testimony of said prohibited hubby having it on his person or having access to it, it should be pretty easy to throw out, right?

Yeah, and most of the time your jury is made up of people who were not able to get out of jury duty. Usually housewives with no kids, somebody who watched Oprah all the time, and those awful soap operas. Better to not be on trial.

IMO anything reasonably done to increase the accuracy of the gun shows the owner of the gun is concerned about the safety of everyone (other than the threat) around them. If I fire a gun for any reason and somebody I don't intend to hit gets hit, I am liable. The more accurate the gun, the less likely an innocent bystander gets hurt.

Tim Sanders Fair enough. I feel the same way. The problem is the jury members who hate and fear guns. The ones that believe hollow point ammo is too mean and everyone should only use FMJ. The ones that think the ‘AR’ in AR-15 means ‘assault riffle’. The ones that think pistol grips makes the weapon evil. You might be liable civilly but not criminally, in every jurisdiction I know of anyone that dies as a result of a felony crime the person committing the felony is criminally responsible. Example, you and a friend are being robbed at gunpoint, gunman is distracted you pull your gun and you accidentally kill your friend trying to shoot the robber, the robber will be charged with murder... Same goes for a bystander down the street getting killed by your bullet.

MaelVampire99 a laser isnt for aiming. But in a self defense situation, no I wouldnt use my sights. I would aim and shoot as fast as I could. The Trace is for quicker reference in a dark place. Hence the reason it is green, since our eyes see it better than red. But I guess our military and police turn their weapons sideways too. Since they use the Crimson Trace and other lazers as well. Hell, even the Apache rolls over on it's side before firing it's hellfire missles lol.

Anything that increases accuracy is easy to defend for carry. After all, the responsible thing to do is to make your firearm as accurate as possible, to reduce the risk of harm to any bystanders in the area. Only an amoral person would want you to carry a less accurate firearm in public.

I participated in a focus group. One issue of the case was statute of limitations. One guy thought no crime should ever be limited by anything. He thought if you stole a pack of gum 20 years ago when you were 19-years-old, you should still be able to be prosecuted for that. He didn't care what the law was or how reasonable the law was; he wouldn't give in one inch to his ideas. Case law meant nothing to this guy. Black's Law was a vague guidebook. He constantly interrupted, too. He was an ass. Hated that guy. If the case were a self defense case and he thought zombie slayer ammo showed criminal intent, I have absolutely no doubt he would have voted guilty and would have shunned everything and anything the other jurors said to the contrary.

It's doubtful he would ever be picked for a criminal jury trial with these opinions. Both attorneys get to make at least 1 or 2 charges off the selected jurors. People like this have attitude written all over them. A trial lawyer will spot that. They make a living being able to read people.

I've been carrying for 28 yrs, drew my gun twice but thankfully never had to shoot at anyone. What I've learned about court over the years, is that it's not really about the truth. It would be great if an honest person who acted accordingly and committed no crime truly had nothing to worry about. Court is basically about who can make the most convincing argument ; who can put that bug in the juries ear to convince them their side is right. Good people go to jail every day, as do criminals often get a slap on the wrist. Court is a stage, where an honest but out of the norm looking biker like myself would have to cut my hair, shave my face and go buy a nice suit. I guess I'm just expanding on your statement that the jury has to like you, and every little thing that might offend or put a question upon your character needs to be addressed. It's better to start off by not wearing a t-shirt that says "kill 'em all and let God sort them out" on the remote chance that's the day you must use lethal force. Carrying a firearm involves looking at how every single thing you do can and would be perceived in a courtroom, especially what you do and say in the immediate scope of the situation that brought you to defend your actions in court. The prosecuting attorney will no doubt go through all your social media posts as far back as they can to try and find something incriminating. I'd love to hear your take on my comment. Thanks!

The best course of action is NEVER draw your gun unless absolutely necessary ( because ALWAYS remember it will cost you money time police record , potential law suit ,loss of carry license etc.etc.) 2nd MOST important rule NEVER kill shoot or brandish a gun to protect a stranger let them get killed unless you are under threat dont be a hero YOU WILL REGRET IT. let the police protect or defend them the police dept have deeper pockets then you. Let me write these IF I were in a school zone carrying my gun and a saw a crazed man shooting kids. I would walk away and let HIM . ITS a gun free zone you will be charged and god forbid you shoot a kid because he ran in front of your line of sight, those parents aint gonna care that YOU save many more children and their kid was collateral damage. They WILL ruin your life. Why do i have such strong opinions im former l.e. and military ( combat) vet. AGAIN do not brandish your wheapon unless your willing to shoot and kill do not wound. My wife owns a pink fmk 9mm,and this is just my opinion but as a car gun I think it may be a wise choice. For one reason only. You hear stories of people. Who say that another diver claimed to the police that they pulled a gun on them.person gets stopped and they have a gun in the car legally.now this person has to defend their innocence. Now if you had a colored gun in your car you could ask the police to have them describe the weapon you supposedly brandished.and most likely they will describe a black pistol.then you take out a pink handgun that can't be mistaken for a black gun at all and at least you have a leg to stand on in your defense.just an opinion I have

I would think that any jury that could be influence negatively by the color or your gun is going to already be influenced negatively by the mere fact that you had a gun and used it to protect yourself/someone else. I hear a lot of what you would rather not deal with in court, but I have to believe that you are a competent enough attorney to deal with such attempts to influence the jury.

I agree 100% with you, but, as a former law enforcement officer, I can tell you from the moment they walk in their minds are made up. There is very little an attorney can say to sway them. Unfortunately they do not tend to go with what is right or makes sense but rather their personal beliefs.

@@mtbikestuff4264 I know this is 2 years later, but if it is an obvious justifiable shoot it most likely won't even go to court. Not all shootings end up in court. If someone with a gun breaks into your house and you shoot them, and the evidence from the investigation backs that up, chances are the prosecutor won't pursue charges. That is why most of the self defense cases you hear about don't involve someone breaking into a house but someone getting shot out in public. A lot more gray area there (i.e. could you have removed yourself from the situation without killing someone). What screws most people, even in legit self defense cases, is the civil court shit that happens when the family of the asshole you shot sues you for killing their 'sweet, innocent baby' who, even though had a rap sheet a mile long and no legit job, 'would have earned them millions of dollars over his lifetime' to which you now supposedly owe them.

I would think, depending upon the venue, that a prosecutor who took issue with a gun being "pink" might well be furthering his case at the expense of his career. After all, his opponent in the next election could call him a homophobe (www.pinkpistols.org/about-the-pink-pistols/).

Not to be a dick but part of the job of a defense attorney is to fight to select a jury that is impartial to or better yet favors your client. If you get a group of people in the box that think things like the color of the gun or the type of ammo used should decide whether or not the shooting was justified have you really done your job? In that same vein shouldn't your closing argument hammer home the facts of the case which justified your client to use a firearm to defend against what they thought was a threat to their life and personal safety regardless of the color of the gun or the ammo used? Yeah, some things may not do you any favors and may make the job a little harder, but is it really the only thing keeping you from preventing a client from going to jail? Did those factors really make the difference between a prosecutor seeking charges instead of declining charges?

I went in for jury duty selection about 8 years ago. I never got selected but I was on standby. After looking at the 200 or so people who made up a jury of my peers, I walked away with a different point of view. Some of the potential jurors actually had their pajamas on! I wore nice jeans with a polo shirt and I was in the upper 20% of nicest dressed. Half of them looked like they were on drugs too! I made up my mind then if I ever have to shoot someone in defense of my life and no one is there to witness it. We are going for a long car ride into the National Forrest! Where I will bury such individual as deep as I can! I don’t trust ANY jury of my peers now days!

Anarchist, if there's empty shell casings even without finger prints left behind there can be touch D.N.A. on them. Even if you could somehow know for certain no touch D.N.A. were on the shells, the extractor leaves marks that can be identified, also the rear face of the slide imprints on the shells from the recoil pushing back when it's fired.

Sure you would be.... But yeah barrels made closely before and after (especially the one right before and after) the suspected one on the production line can have microscopically identical rifling marks. But the odds of an innocent person having the means and motive being cought up in the Investigation and just happens to have a gun made at the same time as the actual gun used are pretty slim, and the jurrors would know it. Not to mention the barrels marks would also continue to change slightly as rounds are fired through it.

Just to start, I live in tn. I carry a Smith and Wesson 637 five shot revolver. I have bright green hogue grips on it, because my favorite color is green and it looks good on it. Do you think that would be a problem???

I don't trick out my carry firearms, one it's expensive and two, my guns are tools, not jewelry. Hopefully, whatever I carry is not the tool I will need to use, but one can't count on that. I'm retired military, a licensed armed security officer and maintain an NRA Basic Pistol Certification, as well as the expense of legal insurance. I love shooting, enjoy the firearms, but don't treat like toys. Pink guns are just weird.

I agree but at the same time its not illegal. The legal system in this country isnt always fair and right. If you are the safest person ever around a gun but its got a punisher logo on it the people that ultimately decide your fate are going to be judging you based on it and that is just not right. I say do what you want to your gun as long as its legal and if you end up in court one day then hope the jury has the sense to not judge you on the guns appearance

He's giving this advice BECAUSE the legal system isn't always right. He's saying that the prosecutors will use anything they can against you, even if the mod is purely cosmetic and has no effect on the actual gun.

Basically the main ideal here, is don't look like you modified the gun to make it more death like, or that you didn't take having a gun seriously. Juries believe a gun is deadly enough on its own you don't need to modify it to make it more so. Juries believe if you color your gun, you might not be taking owning a gun seriously, since you decided to paint yours like a toy, or your nails.

I think you would be able to argue a pink gun better in a self-defense shooting. Here's my reasoning. You show it to the jury. You ask them to consider, if they would personally want to buy and carry a pink gun. Let's assume the defendant is a dude with a strong physical presence. You argue that the defendant (or have them testify) that they have a pink gun BECAUSE it is embarrassing. Why? Because it isn't something they want anyone to know they own. If they pull it out, they're doing so because they're in a serious situation that requires it.

This makes sense. How the jury feels about the defendant is EVERYTHING. I was a defendant in a courtroom in the 90's (auto insurance case, NOT firearms related) and the jury decided in my favor. I think mostly because they liked me and disliked the plaintiff and his attorney.

trigger jobs can be necessary for the safety of you and others because the harder it is to pull the trigger the more likely you are to sway the gun off target from trying to apply so much pressure to the trigger so it can certainly be necessary to maintaining accuracy

I have seen your video on Castle Doctrine and talking to the police. Question: If I am involved in a situation where I had to pull or use my firearm in self defense.. and I make notes for my attorney at the scene (while the action is fresh in my memory): 1. Are the notes admissible as evidence? 2. Can the notes be taken from me by the police? 3. Is this advisable?

+1 Good question. www.protectedtext.com/ I don't know if paper notes for your attorney would be admissible. But you can use an app like ProtectedText to encrypt your notes. I use talk-to-text on my phone... and voice or a keyboard is going to be much faster than pen & paper. Anyways, if your notes are encrypted, then it doesn't matter if they get your notes... they'd have no idea what your notes say without having the encryption key.

Notes cannot be admissible by evidence (at least in my state) - however, just because it isn't "evidence" doesn't mean that they are not helpful in a court case. It allows you to "practice" the important details of a case. Too often people get tripped up trying to remember and details get changed. You don't want to change details or get tripped up by a big budget prosecutor. Notes cannot be taken by the police unless you are in custody at the time. However, I would suggest waiting to take notes until after the police have left. Source - law school student. So maybe not as good as an actual lawyer, but better than interweb warriors.

1. Are notes admissible in court? Depends. If they are seized by the police, and your attorney is unsuccessful in getting them excluded as a-c privileged, then they could show up as evidence. 2. Anything can be seized as evidence, including your notes. If it happens, then it is up to your attorney to get them back and get them excluded. The police have all the physical power at the crime scene, you cannot tell them "Nope, these are my secret notes, you can't have them." 3. Not advisable unless it's the only way you can remember what happened. The rule is say nothing, write nothing until you have your attorney present and in control of the situation. A huge number of people have suffered because they thought the cops were "helping them remember" when what they were doing is helping the prosecutor get a conviction, whether it was warranted or not.

.....one reason why as a gun owner, LEO, or something like that, you are NOT going to get a "fair trial". However, one of my more memorable moments when in court was when the defense discredited the states "expert" when she pointed out with "Your honor, the state's expert has repeatedly misstated that the weapon used by my client has a "15 round CLIP" when in fact it has a removable 15 round box magazine and I would like to state for the record that the ignorance and grandstanding of the so-called expert has proven he is anything but."

"You grabbed a HUNTING pistol for defense, as you were panicked and did not know what else to do". Or, "I wanted a gun that would scare people, so I would be less likely to use it". I'm not a lawyer, but there are reasons someone might carry a gun that big. And it is weird, but allot of people are more okay with guns if you hunt with them, as if going out into the woods and killing animals makes you an inherently safer human being.

Great advice. My local Sheriff says carry a stock gun. He said go ahead and put night sights on but leave everything else alone if possible. He tells all of his deputies the same thing. This is speaking about your EDC. I think this goes along with what you have advised here.

In reality the Sheriff has given some very good advise, look are all these things legal (decorating your gun, hand loaded ammo, list continues)you can do anything you want as long as it does not create an unsafe condition BUT when you are forced to defend yourself and shoot some one do you honestly want to waste time and money defending your self against unfounded accusations, I remember an article by Massad Ayoob from years ago, he was advising against hand loads, the example he gave a LEO was allowed to carry his personal 1911, unfortunately at that time only one company made a decent self defense round, so he would buy some factory and then by the bullets load his own to the exact same specs, one day he tried to stop a drunk driver, the drunk ran after a long chase the drunk wrecked. the officer approached the car with his gun drawn the drunk got out and attacked him in the struggle the drunk was shot in the face. The drunks attorney used the attack that the officer was not satisfied with factory ammo he had to make even deadlier ammo. The officer eventually cleared himself but it took years and a lot of money. So ask your self is decorating your carry gun to look like the Nintendo zapper or loading your own hollow points to safe a few bucks worth the possible aggravation it can cause, carry ammo best advise is use what the locals are using so when a shady attorney tries to make an issue of ammo you can point at the officer in the court room and say I use exactly what he does

It's 100% the cosmetics of the gun that people are afraid of. They want AR bans because it /looks/ scary and no other reason. I imagine putting anything else on there just intensifies that irrational fear.

true but honestly the point in this video isn't about weapon attachments, i wouldn't consider a grip a cosmetic (maybe a rail but unlikely as it still has functions). think about it this way how unprofessional would it be if you seen a female cop with a bright pink or zebra gun? or a male cop with bright green and zombie blood or comic book character symbols on it? that's the problem with decals and designs, they come off as unprofessional and make it look like you're treating the weapon like toy or plaything than a deadly weapon. by all means put any attachment on your weapon you like, i have grip and barrel shroud on my rifle. that's what rails are for.

Kind of falls in line with the thought that occurred to me recently as I look into getting my ccw. Heaven forbid that you should ever have to use my firearm for self defense, you will have to surrender it for evidence. So I am thinking that it would be unwise to buy something extremely expensive. Because, even when you are found innocent there is still no guarantee that you will get it back or get it back very quickly. I'm not saying go as cheap as possible because a super cheap gun usually isn't of good quality, mind you. But a basic, mid range handgun would probably be best. Maybe invest in some different sights or a more comfortable grip but otherwise keep it factory original. Plus it might leave room in the budget for a back-up firearm too. I don't see many people talking about this sort of thing, so I'm curious if this thought is off base or not ? Thanks !
