ASEAN needs to get its act together first as its member nations have overlapping claims among themselves. They are just shelving that and trying to agree a 'unified' stance on something which is not unified. It's like trying to build on sand and it prevents others who have a strong interest in the area - but no claims themselves - like fellow ASEAN member Thailand, Australia and India from being able to back anyone fully.

The South China sea was originally named the Champ Sea, which was named after the ancient kingdom in current central Vietnam. Vietnamese already continuously administrated both of 2 these islands since 17th century and no single country except VN claimed those at that time. Both of Paracel and Spratly were belong to Indochina/Annam colony of France, so after getting independence, Vietnam had full right to take these 2 islands back obviously. And South Vietnam did that and exercised legal control over these 2 islands until China came illegally in 1974 and 1988. And I want to make it clear that Vietnam does not claim entire SCS, we only claim our 200 nautical mile EEZ + our these 2 islands which lay outside of our EEZ( but as I said EEZ can't apply for islands). Even a lot of messy problems arising until now after Chinese came and some other countries claimed based on EEZ, hope Vietnam and other countries involving can avoid conflict as much as possible More detail about San Francisco Conference : The conference was joined by 51 countries around the world. This is the piece treaty of UN attempt to return all colonies to its initial country after WW2, and as a result, this treaty formed hundred of nowadays countries in the world. In the treaty Japan had to return all colonies back to original countries, which include Paracel and Spratly islands controlled by French. Both of China and Vietnam asserted their claim on Hoàng Sa( Paracel Islands ) and Trường Sa ( Spratly Islands ) but China's claim was rejected by 45 out of 51 countries whereas Tran Van Huu, Prime Minister of Bao Dai’s government of Vietnam stated that “in order to annul the seeds of possible disputes, we claim our sovereignty over Hoang Sa and Truong Sa archipelagos”. No objections were raised nor any reservations made against his statement at the conference. France, in the victory side, also asserted the sovereignty of both of Paracel and Spratly Islands are belong to Annam of Vietnamese because Japan took over them from France. Hoàng Sa and Trường Sa was belong to South Vietnam from 1956 to 1974 and the entire UN, except China nor Russia, recognized and didn't oppose to them. In 1974 China illegally fought and invaded Hoàng Sa ( Paracel Islands) and fought Trường Sa (Spratly Islands) in 1988, but it could only occupy small part of Spratly Islands.

The 9 dash line originated from the ROC when they still controlled the Chinese mainland before the CCP took over after 1949. The USA has military bases all around China. Should and China just let USA surround them and do nothing? :) The 9 dash line is not a no enter zone. 12NM from the island is no enter zone territory and 200 nm out from each island is the exclusive economic zone.

It is on the demonize level to discuss that if China will become the dominant power in Asia because it is a Pseudo-proposition. China has made a continued policy to treat other countries in a civilized manner. Most Chinese are disinterested in the debate about a new shifting of world power or power competition in the traditional sense which applied to the context of game theory. The ignorance makes people ignored the international law and blind to see the historical evidence of China's sovereignty over the South China Sea according to the 1943 Potsdam Proclamation and Cairo Declaration. China has indisputable sovereignty over Nansha Island and adjacent waters, backed by historical and legal evidence. The construction of China's own territory is not against international law. Philippines' arbitration request is not meant to resolve disputes, but to negate China's right. The most important thing for international law is who defines the international law. and about the South China Sea, you cannot find the sovereignty from the map related to the Philippines and its history or other countries. According to its proponents, China’s claim stood relatively undisputed until the 1930s. From this time onwards, Western colonial forces and an increasingly assertive Imperial Japan recognized and sought to utilize the strategic value of the Nansha Islands (Spratlys) in particular. In 1939, Japan occupied parts of the archipelago in an attempt to control Southeast Asia and prepare for an invasion of Australia. Upon Japan’s defeat in 1945, it was stripped of the area it had occupied in the South China Sea. Although post-war ownership of the islands remains disputed, both Mainland China and Taiwan have adopted the position that rather than creating a “void,” the areas have been restored to Chinese ownership. these declarations emphasize that areas once held by Japan in the South China Sea would no longer be part of that country’s post-war sovereign territory, and that territories Japan has stolen from the Chinese, such as Manchuria, Formosa, and the Pescadores, shall be restored to the Republic of China.” Ownership is deemed to have been implicitly accepted by Western powers (notably the United States) in their failure to object to repeated assertions by (initially) Taiwan over South China Sea sovereignty. As part of the Chinese claim, Taiwan has maintained a presence on Taiping Island (the largest island of the Nansha Islands Archipelago) since 1946. To Beijing’s understanding the status of the islands was seemingly acknowledged as Chinese territory through U.S. requests to the Taiwanese authorities for permission to perform aerial surveys in the region between 1957 and 1961., constitutes a territory that cannot be divided on an island-to-island basis. By recasting the case as one fundamentally challenging Chinese sovereignty over the Nansha Islands, China believes the case constitutes an infringement of Chinese territorial integrity. More than just an infringement of territory, “The UNCLOS did not provide rules for the issue of territorial sea baselines for continental countries’ archipelagos; nor did it provide rules for historic rights, although it affirmed their status in international law.” China believes the court has no jurisdiction to decide on the matter. As such, it rejects the case and will not accept or participate in the arbitration. As discussed in the Chinese government’s Position Paper, two reasons for rejection stand out. First, on August 25, 2006, China deposited, as permitted under Article 298 of UNCLOS, a statement that China will not accept compulsory dispute settlement procedures (including compulsory arbitration) concerning maritime delineation. Second, China rejects the court’s authority; Upon ratification of the UNCLOS on 7 June 1996, Declaration made after ratification (25 August 2006) and Declaration under article 298:The Government of the People's Republic of China does not accept any of the procedures provided for in Section 2 of Part XV of the Convention with respect to all the categories of disputes referred to in paragraph 1 (a) (b) and (c) of Article 298 of the Convention. The United States is not the signatory on The UNCLOS so that they should not make any comment on the issues unless they put the signature on the UNCLOS.

Ancient Chinese maps I have seen posted on line call the South China Sea the "Sea of Cham", which is a kingdom that was located in the middle of current day Vietnam country. Those people had port settlements in the Philippines, Java, many Islands in this very area and even the Island of today's PRC Sanya even in the time period of the military rule of the original Vietnam (today's northern 1/3 of Vietnam) from 200BC to 1000AD. The Cham people were expert mariners and back then you need to ship your freight with a ship captain who knew the dangerous waters to avoid ship and cargo loss. China claims to be a big brother, but everything they do is only for their gain and explotation. From this I see Vietnam to have easily claim to the Islands they assert to. The best compromise is for China to stop the militarization of these artificial man made islands.

The Champa people have been intermixed mostly now with the Vietnamese people. Large scale persecution against the Champa people in last 100 years or so was extreme so this has reduced the pure Champa people population to very few. The original point of this discussion is that today's Sea of China is really not theirs as they claim, but the islands were owned at various times by the generally closest countries to those Islands.

@@hcmcspitz6486 if you want to talk about history, both Vietnam and China has reasonable records, but China's case seems to be slightly stronger. If we speak about continental shelf and EEZ, they are closer to Malaysia and Philippines. To be fair, Vietnam and other claimants also building on the islands or doing land reclamation, although they are unable to do it at the pace of China. E.g. Vietnam has started military installation in 1980s. The rest of the claimants also doing the same thing at a point in the time.
