The thing is that those are the prices they were meant to have as collector's pieces from the beginning of the game. Reprints of Reserved List cards would still fetch a high price, but the Reserved List as a concept artificially inflated the prices of cards that were already going to be expensive to begin with, so if that price bubble were to burst, prices WOULD tank. Obviously not to hyperbolic levels like 10 dollars, but it wouldn't be insane to see a 300 dollar card drop to 100 dollars. That's still 66% of its price shaved off.

When I got a look at the pricing in 2017 I about crapped my pants at how expensive it was. For example: Staff of Domination was a $0.50 rare when it came out and for a loooong time after. Now it's $56???? There's no shortage of this card. Fifth Dawn was produced in MASSIVE numbers! Also, why hasn't this card been reprinted in 16 years?? This game will certainly die if we can't get in more new players... and that starts with getting costs under control!!
@victort.25834 жыл бұрын
@@georgedriff5156 How so? Yugioh is usually pretty generous with their reprints, and there are fairly regular reprint sets. You can expect a reprint reasonably soon (their annual tins and supplemental products have reprinted some big cards; e.g., Borreload Savage, Phantazmay, etc.). Their preconstructed decks are usually pretty good, to the point that you can pick up 3 of them (~$10 each; $30 total) and a handful of budget cards to make a surprisingly decent deck (Dinosmasher's Fury, Soulburner, even Shaddoll Showdown come to mind). Professor, as an attorney, I can state confidently that this was one of the best layman explanations of Promissory Estoppel I've heard. The Reserved List protected value 25 years ago and even 15 years ago, but now the value is in the collectibility and the purpose of the purported contract has now been frustrated. WOTC could modify and or eliminate the reserved list and it would not damage values one bit, in fact I think the vintage cards would increase in value. People like to foil out their decks. If Legacy came back full force, players would want to buy ABU power rather than newer printings anyway, and my reserve list cards would be in even more demand.

This is not true for reserve list cards recently (within the last 2-5 years) purchased, especially the Revised dual lands. Prof omits Revised from his discussion and examples, let's evaluate Birds of Paradise (Approximate MTG Goldfish / large retailer / ebay Pricing): Alpha $3000 (high variance) Beta: $1400 Unlimited: $170 ... Revised $15 Modern Printings $7-8 BaB Promo $50 So for birds, it's a 10x jump from Unlimited (3rd) to Revised (4th). It's 200x jump from Revised (3rd) to Alpha for Birds. Same exercise with Underground Sea: Alpha: $7500 (high variance) Beta: $2800 Unlimited: $1000 Revised: $650 It's a 2x jump from Unlimited (3rd) to Revised (4th). It's only 10-15x jump from Revised (3rd) to Alpha. Convenient omission? A 200 fold price increase vs a 15 fold price premium? The mass reprinting of original Dual Lands would crush Revised Dual prices. There will be casualties of "just print", and they're mostly invested players who already own their Revised duals.

One thing that the pro-Reserved List crowd has done a great job of (bolstered by WotC employees themselves) is getting almost everyone to talk about the Reserved List in terms of it being a "promise." @doctordistracto83904 жыл бұрын
Separate from his legal analysis prof touched on what would be the biggest issue with suing, the pretty well established fact that either the original cards won't come down in value, or they'll come down but only as part of a broader rotation of investor money out of reserved list cards and into sealed or another collectible or whatever, not at all due to the broken "promise." You can't claim you relied on their "promise" to your detriment if there's no detriment, so your case is DOA. Then even if you could somehow win you'd have no damages. No one is spending $120K ballpark to sue over the fact that duals got reprinted and then doubled in value so they're owed $0. Frankly a stronger case would be investor vs investor against the investors who manipulated the market to suppress prices and corner all the product by nagging wizards into making and retaining the reserved list.

As someone who played back then, the majority of the complainers were *NOT* players, but rather collectible speculators. I've been saying it for 20+ years that the reserved list is damaging to the longevity of the game, as it has basically made the eternal formats, Vintage and Legacy specifically, impossible to enter for newer players. As such they are barely staying alive these days. Another "fun" thing that makes the reserved list bullshit is that there are cards from Revised (a.k.a. 3rd edition) are on it, you know, the first all reprint set. And finally, WotC can get rid of the Reserved List tomorrow if they really wanted. Why? Because it is policy, specifically it's official name is "Official Reprint Policy", as it is policy, they can remove it whenever they want just by making a simple news release announcing its abolition. If they do this, they can start designing sets containing cards from it tomorrow. Any lawsuit would then have to prove that they designed the sets *prior* to the lists removal., and as the design lead time for non-standard legal sets is now down to less than a year, that could mean we could get them as early as fall next year.

Underground sea gets reprinted you not gonna get it for less than $250 unless wizards drastically changes reprint policy A better strategy is to ban broken cards, because you know, they are busted and push for effective, fair functional reprints. Interestingly there are two different aspects at play here. 1) The whole "legal argument" about promissory estoppel fails as a result entirely because the speculator community has failed to uphold the community side of the promise. 2) Evidence shows that the value of the original versions will RISE if the cards are reprinted, due to access. Remember that prior to MM1 Tarmogoyf was 80...ish, and after the drop, it spiked up to close to 200 (Obviously it's gone down due to being reprinted another 4 times and due to the metas of modern and legacy) - we've seen this happen with a number of different cards that see play in the largest formats (Modern/EDH/Legacy.)

@@somedude3236 See here's the issue with the argument of an "$800+ card" losing value. The investment into that card in the first place was like $3.50 at most. It's a $3.50 card that has it's value inflated because it's never been reprinted. Though as has been used as an example, Shivan Dragon alpha has a value still well above $5000 even though there are modern reprints of the card. The proxy Collector's Edition has a value of around $130 even though there has been modern reprints of the card. Reprints don't crush the value of older cards, first edition prints will ALWAYS hold value. Even if you look into other card games, as someone else here has already mentioned, a Blue-Eyes White Dragon (DDS) holds a value of $850 for a DAMAGED copy. Close to $2000 for a NM copy, and it's one of the most reprinted cards in Yu-Gi-Oh. If a card is going to hold value, it will hold that value wither it's reprinted a lot or not, because people will always want to own a first edition or shiny copy of the card and there are only so many copies of the first edition printing. The issue with MTG is there are to many cry baby investors that don't give two shits about the game who will cry the moment you dare threaten their "investment" for the sake of making the game better. You dare add some risk to their investment and it's like you've kicked their dog. The game is far better off ignoring those investors and doing what is best for the player base. The reserve list was a stupid idea by WotC to make a small vocal group of people happy, and in the end all it's done is hurt their game in the long run.

@@wesleywyndam-pryce5305 I think it's specifically to make it obvious which ones are the new cards. As someone who has waged many rhetorical battles on this subject, it's so good to hear the avalanche of dispositive arguments coming from the lips of one of the community's most esteemed thinkers. It is worth noting that some affirmative legal arguments in favor of Reserved List abolition are also quite strong. The dilution of brand that comes from widespread counterfeiting cuts against the argument that whatever the plaintiffs would be asking for in a promissory estoppel claim is "in the interests of justice". There is also the fact that Hasbro has financial duties to its shareholders, and the egregious sums of money WotC is leaving on the table by *not* reprinting ABUR duals and company would be amount to an abdication of their responsibility to those shareholders. Furthermore, notice of an upcoming change to the policy set out more than a few years would dry up the claim that investors were acting in reliance on an immutable promise in the first place. And let us not forget the reality of the theoretical lawsuit: it would all but certainly be a class-action suit. Counsel would be assigned, a fair settlement crafted to appeal to the court's punitive instincts would be reached (several orders of magnitude below the several billion USD that r/mtgfinance tells itself it would be owed), and every Magic player who responded to their letter in the mail would get all of a few cents by check. “Artificial scarcity” (i.e. intentionally restricting supply of a product) has several damaging second-order effects including creation of “deadweight loss” (a measure of lost economic efficiency) and a restriction of future growth. A company that intentionally limits access to their product, limits or eliminates a portion of their customer base that would be using/advertising/selling their products. It encourages excess competition as new companies enter the market in pursuit of excess prices. And it encourages the development of a black market to produce the product at the normal price point. All of these second-order effects are unfolding now due to a sluggish reprint policy & adherence to an antiquated reserved list policy.
@victorienisidore9994 жыл бұрын
Only if the market is accessible. The only way to compete against WOTC would be to create a new game and make payers quit Mtg for the game. I mean, look at the price of Iphones, you can't compete on their market because their apps and store is not legally accessible from other smartphones. No company other than Wotc can produce Magic cards, your economic principle doesn't work here. Plus there are counter example that the prices won't tank it
@thirdwavefinance81544 жыл бұрын
@@victorienisidore999 All three of the effects mentioned are already taking place & are growing. Limitation & elimination of a portion of the customer base that would be using/advertising/selling their products is occurring as individuals are priced out of the game - especially in older formats. Competition is beginning to emerge in the form of other hobbies & trading card games. Player-designed cards are becoming increasingly popular as the most popular format is now a casual format that is not beholden to a requirement for official cards. And a large black market for counterfeits continues to develop as prices rise. The barriers to entry for competition in this industry are extremely low because cost to produce a card is extremely low. There is a much smaller gap between cost and sell price for other goods (such as an iphone) - i.e. margin is much much lower for those goods creating a much higher barrier to entry. A card that costs a few cents to produce but sells for hundreds of dollars plus is massive. High price, low cost to produce, & popularity of casual formats are all creating a very low barrier to entry for competitors (i.e. competition such as new cost-effective games, proxies, player-designed cards, and a counterfeit market).

It is so absurd the level to which expense has become a factor in enjoying this game. No game should have barriers this massive to entry. it would probably become my main format

@@NurdLMB I don't know why you'd even want to target it since it's just all of best cards all in one place anyway. They've done a pretty good job of powercreeping Legacy just by ignoring it. Every time they make OP stuff in Standard, Modern, or Commander it becomes Legacy's problem to figure out. I know what you're saying though. Just because something is not a great idea, doesn't mean Wizards won't try it.

Honestly, I would simply love for WotC to print another "Collector's Edition" with all the relevant reserve list cards. While these cards wouldn't be "tournament legal" (And thus not breaking the Reserve List), you could surely bet it would sell like gangbusters (If secondary prices of gold boardered cards are any indication). I couldn't care less if my card boarders are black, silver, gold (Or dare I say white), I just want a way to play the game with friends, and not forgo having a roof over my head in order to do so.
