The guy's not a lawyer, he's a state assemblyman. I always hated this scene because it's inconsistent with Tony's character. Politicians are very valuable to have in your pocket and Tony would know better than to burn his bridge with Zellman by doing this. Also in Season 6 Tony tells AJ that he'd be in jail if it weren't for Zellman's help after he tried to kill Junior. (This guy also played Boon in Animal House.)

I'm not sure it goes against Tony's character; he has a history of letting his temper get away from him, often to his own detriment. I think seeing Irina happy with Zellman, when she was so miserable with Tony, was probably the last straw for him.
