This seemingly would have been the correct response but it's not always that cut and dry when dealing with these levels of intoxication. Depending on laws where you live if you kick someone out of your residence and don't follow thru with making sure they make it to a safe location (Taxi, hospital, their own residence) you could be on the hook for criminal charges (usually a form of neglect) if they were to suffer injury or death. Sending her out the front door in this situation would have been a better option than locking her on the balcony. Calming her down and sobering up in the living room would have been ideal if at all possible or call the authorities to have her escorted to a safe location.

I just listened to the audio of Warriena, and my heart was beating out of my chest -- she was HORRIFIED by what he was doing to her. That kind of guttural scream 'No," is when something is being done to you -- and that was after he was choking her. If he's still acting the same, with the same scornful attitude toward women (his messages), I hope history does not repeat. Apparently, other women dobbed him in at nightclubs so often that he got banned. What kind of gross stuff was he doing for them to resort to that! Grabbing body parts, perhaps.

In fairness to him, if you are someone with a lot of one-time sexual partners, keeping a record of who you were with and when could be useful to have for your own sexual health or in the event contraception fails and there's a need to prove paternity. The facts that led to her death are the only thing he was on trial for. Not his warped view on women. From the recording you know she fell within seconds of him bringing her out there, there is no way she climbed over or attempted to escape he threw her off or made her Hang so she would drop a fee moments later. It's evident that she was terrified due to his threats, at one point in the recording saying "untie me"(??); he's a big guy, she was a petite woman. She clearly feared for her life, maybe even realising she had just met this guy and had no idea if he was leaving her on the balcony so he could do something to her later (rape, murder: the mind of a drunk person jumps to conclusions without much urging). He absolutely played a major role in her death.

Agreed this is the most damning part of the whole thing. I think he was justified in everything up until he made the decision of the balcony instead of front door. She was out of control and it was a bad situation, but he let his anger get the best of him. His dialogue shows he became enraged and vengeful rather than "just wanting it to stop" as he claims. He decided to restrain and punish her, rather than just shoving her out the front door and walking away. He could have just as easily got her to the front door, shoved her into the hall and tossed her purse and some cab fare out after her. He could have called a cab for her or the police to come pick her up. Then whatever happened to her from that point was on her, not him.

Ya, honestly if you choose a risky lifestyle sometimes it turns out poorly. I get that people don’t like his behavior afterwards, and I don’t either, but she also chose risk. Her behavior was violent, but people don’t like how he behaved after she went over the balcony. It’s kind of like, come on, her behavior was scary too and first. It’s an overall tragedy and hopefully urges people to make healthy choices.

It sounds like she became aggressive and attacked him first (the stones), he'd had enough and shoved her out of the nearest door - not his best idea using the balcony but he'd also been drinking home made alcohol, so was also impaired, then he panicked once he realised what happened. He might not have been a nice guy, but he didn't kill her, however. If things could have calmed down a bit, without her climbing over, it probably would have been very different.

Man or woman, there's nothing scarier than a bad drunk. The sound of stuff being thrown around made me flinch a little. On hindsight there were many things that could have been done to prevent this tragedy but I think many people forget that Gable had consumed a lot of alcohol himself and his own judgement could have been compromised. His actions after Warriena's fall showed his character quite clearly and morally if not legally he has a lot to answer for.

I mean, to be fair, it's very easy to accidentally overdrink when you don't know what you're drinking. I also don't think she was sound of mind enough to **choose** to not throw those rocks. Nah. It's Kidnapping and could be involuntary manslaughter. You can't hold people against their will. In this case, she was locked on the balcony and wasn't allowed to leave. In the United States that is straightforward kidnapping or false imprisonment. Either way it's a felony and has seriously prison time associated with it. How he wasn't charged in Australia with kidnapping is beyond my legal comprehension. I'm wondering if it's really legal to lock people up there against their will. This case suggests it is perfectly legal somehow. In most of the rest of the world it isn't.

He could have kicked her out, among many other things. Putting her on the balcony was the dumbest option. You’re infantilising her to create a victimhood status. Besides, homemade alcohol doesn’t automatically equal stronger. That’s an assumption you’ve drawn. At best I can see the guy being charged with Reckless Endangerment if that even exists in this area. Being a petty criminal, or a low life doesn't necessarily equate with being a murderer. If the guy had been charged for any of his past deeds, odds are he wouldn't have been free to get involved with Warriena in the first place; and how he ever avoided a jail sentence before is beyond me.

Exactly this, the rationale a lot of people seem to have for convicting this guy is "he had it coming anyway" or something along those lines, but that's not justice. I am sure if it was a female friend the same people stating he deserves manslaughter would brush it aside as an accident.

Arguably there's also an charge of forcible confinement too. I'd assume the reason they didn't go for that is because he could've made the argument that he was trying to defuse a situation so that could've been the safer option. That said, he definitely did forcibly confine her somewhere she didn't want to be which ultimately lead to her death. He probably should've gotten the conviction for that.

One of the things that bothers me the most is something that was barely touched on... Her phone. Listening to the recording here, I was immediately suspicious that during the time she is upset and looking for her phone (and tied up?) He offers to call her phone, and even though she tells him to, he doesn't seem to actually do it. He instead asks for her phone number even though he already has it, and he later suggests that it's battery must be dead. It seems like she does try to leave several times but can't find her stuff, eventually accusing him of stealing her phone. He later says he's going to escort her out WITHOUT any of her stuff and this seems to prompt the final scuffle that ends in her being locked on the balcony. Later after he has ducked the emergency responders he DOES call her phone and lo and behold it's... In. His. Pocket.

He rang his lawyer, walked out calmly, avoided the downstairs scene, walked around and ate a Pizza. He showed no concern about his injured and possibly-dead date! He supplied the drinks and whatever else they had. He locked his inebriated dated out on the balcony. How did he not contribute to her 'fall/death'? I hope Karma comes swiftly for him.

So, I’m likely biased as I’d met Rie a few times though mutual friends and found her sweet natured, quiet and kind. I’m glad you can look at both sides, but Gable did so much wrong. Rie we was only 5’2 and about 125lbs, he was much bigger and taller and imposing. He also took her phone, so when she refused to leave without it (as anyone would I’m a foreign country) he knew where it was and didn’t give it to her. He also knew he was being recorded and possibly could have skewed what he was saying when things escalated. I also think he was way less drunk than her, and saw how out of control she was and should have had the foresight to not put her on a balcony. But it is a tough one. But I feel so bad for her, imagine the worst night of your life defining your entire existence.

As someone who has unfortunately struggled through dealing with an alocholic family member, I can understand his frustration and why he locked her out. He is an asshole and a creep, but not guilty of anything other than that. She became violent, and was being verbally abrasive, so he locked her out. It's unfortunate that things ended as they did. Maybe he will stop drinking and become a better person because of it, but alcoholism is a hard thing to kick.

He put her out there to calm down for a while.. And to protect himself.. Time out for a while. He couldn’t have assumed she was going to climb over the railing. With the way he acted after release plus the recordings, I have no doubt he could have progressed to murdering dates, and that maybe he even had a voice in the back of his mind that maybe she will fall off (in the recordings he also says something like "you are lucky I haven't thrown you off" so she may have genuinely felt in fear of her life). But the point is he did not yet commit murder here. He was negligent but also he was being pelted with stones which is genuinely abusive from her side so that is a mitigating circumstance. So I understand you can't and shouldn't convict him for this. I do suspect he wanted to show her a bit that he *would* be capable of murdering her. Still his shock at actually contributing to her death shows that he wasn't determined to do so, it was perhaps a thought that played in his mind. But if later it turns out he murders another girl, I will not be surprised at all.

Apparently in the full recording she asked him to let her go home and he declined because she'd been "a bad girl". I read this in a recent comment. Everything would've turned out differently if he'd just let her go home. He's an awful person.

While this was a horrible accident, Gabel could have done a lot differently too. Locking someone out on a balcony is super irresponsible and she was much drunker than he was (he sounds/looks pretty lucid in the time after).. He also hid her phone so when she refused to leave without it, he knew where it was and didn’t give it to her. The other is that he knew he was being recorded. I wonder if, as it escalated he was skewing it to make him sound better.

Even still if I was in a position he was, I would have known that the police arrest people that drunk in public if he was concerned for her at all (be that on the streets or what he wanted to do to her for throwing rocks at him) calling the cops would have got her put in a drunk tank and I think that would be legit pay back for the rock thing. This toadstool wasn’t guilty of murder, and the victim didn’t behave any better than he did BUT he actually kept her there against her will. The appropriate response to her provocation would have been to put her outside the apartment with her belongings. By locking her on the patio, he placed her in harm’s way. He’s clearly lacking in empathy as well as moral character. Good luck to any women who cross his path in the future.

Im not sure if this is the part where things started being physical, but the girl had pretty poor judgment up until this point anyways, and it sounds like she may have had trouble with alcoholism (or gauging how many drinks she actually can handle) as well. There has to be some blame put on the victim for her own death, and I think the jury ultimately made the right decision. However, they should have went after him for kidnapping since he did lock her out on the balcony against her will. He's lucky the case was tried in New Zealand though. While I'd be shocked if he got a guilty verdict, I could absolutely see a jury convicting him of manslaughter over here in America.

If you asked my judgement, I'd have called it manslaughter, or reckless endangerment at least. I know drinking was planned but I wouldn't try my homemade killer moonshine on a stranger the night I was planning on smashing them. And though a wrecked Wright was obviously getting dangerous, the guy knew the balcony was by far the most dangerous place in his apartment, and he probably only trapped her there because he was hoping to get more time with her. No sentence at all seems very insufficient.

disagree. it'd only be reckless endangerment if he forced her to drink alcohol. there's no reason to expect her to suddenly jump off the balcony. he "trapped" her there so that she'd cool down. she'd been attacking him and throwing rocks around his apartment, you know. the door was much farther away, and she clearly wasn't willing to leave herself. he literally wanted her to leave and she wouldn't. it was just a stupid drunken decision to try and climb down the balcony. one of those people who can't handle alcohol. he's a massive douche and an asshole but not a killer.

Disagree. He's not guilty at all of her "lack of judgement" to put it nicely that led to her death. She was aggressive. She jumped off the balcony. She killed herself. End of story. The man bears no responsibility whatsoever over her death. On the other hand she was the aggressor, and he locked her out to cool down. You dont throw rocks at someone and expect everything to be fine. Besides, he was found not guilty. In this day and age judges and jury are trigger happy about putting a man in a jail over a woman's death - which means he was crystal clear on the trial, and he wasnt charged with anything else during or after the trial People will put blame on him cause "man bad" and "women never wrong"

Including taking her to the door but she continued kicking screaming and carrying on like a demon. In my opinion she's only got herself to blame. She was an adult no one forced alcohol down her throat. He's not her babysitter if you're old enough to meet up with people on dating sites you damn well better old enough to be responsible for your own safety.

He contributed to her state simply by providing her alcohol. He didn't encourage her to drink and most definitely didn't force her or spike her drink unbeknownst to her. He couldn't know that her response to getting drunk is getting violent. He told her to get out, she refused. He wanted her out so in his intoxicated mind this could have very well be 'I want her out, if she refuses the front door she can use some time in the balcony'. He couldn't have known that she will decide to 'leave' by jumping into the balcony below when just minutes ago she was told to leave (like a normal person, through the door, you know) but refused. It's unfortunate case but he's not a murdered and being an asshole is not a crime.

If she refused and he didn't want her banging like a madman at his door and waking whole neighborhood up, he might have very well thought 'okay balcony will do'. He was drunk. We can try looking for logical explanations all we want but we will never know what was on his mind, and 'it would have made more sense' argument doesn't work. He was drunk. If you need proof that drunk people don't reason properly, then the girl herself is a very good example. I can guarantee that 'jumping out the balcony' surely would have made no sense to her if she was sober.

He made a huge mistake locking her on that balcony. He’s not a murderer though. I wouldn’t take someone I just met to my house. Nor would I go to the house of someone I just met. She was throwing good size rocks at him AND his whole fancy apartment was full of glass. Anyone would get angry. He should have just called the police. Two young, attractive people with their whole lives ahead of them.

He's not the one that told her or forced her to climb over the balcony so therefore his responsibility to her death is pretty much minimum. (but yeah, if it was me, I wouldn't lock her in the balcony, I‘d either kick her out of my house and call her a cab back to her hotel or leave her in my house to calm down while I go out for a walk)

The young lady was getting violent with him . The recordings showed that even through intense anger he was trying to stop her. How was he to know she would try that? The guy seems like a knob but not a killer. Let me also state that it is tragic that young woman lost her life. I’d willing be willing to bet that lots of us have been way too intoxicated and lived to tell the story. My heart goes out to her family and friends.

Agree, most people have been this drunk and been in situations which could have killed them/got violent. Definitely a first-class zhitty person (made worse by drink) but I think he put her out there to shut her up/let her chill, in his drunk idiotic mind maybe he thought it the best thing to do considering her violent behaviour. The series of decisions she made which led to her death are her responsibility and hers alone. Condolences to her family but there is no crime here.

I find it so weird people want equality for women, but it seems they get treated like children at the same time. Nah he is definitely guilty of creating the situation that led to that. Involuntary manslaughter. You don't lock a person on a balcony - you throw them out the front door. And a really drunk person as well. You also don't record without consent. All in all a psychopath, that gets bailed by daddy....Well a psycho doesn't really feel love for daddy and one day he will get drunk and delete daddy to get his inheritance. After all - there have never been any consequences for his actions before, why not? To drive 4 times over the limit, run from the police and endanger people around you and NOT be in jail is laughable.

Years ago I had a girl come over to my place to 'have a good time', she got totally wasted and started acting crazy and violent and I kicked her ass outta my house in the middle of the night. She ended up having to hitchhike home. After watching this, I can only imagine if she had fell asleep in a ditch and froze to death or something if I would have been held responsible. And unlike this guy I wouldn't have had thousands of dollars to throw at lawyers and bail. I think the real moral to this story is simply: Alcohol in excess brings out the worst in people and makes every situation much more volatile. Drink responsibly or don't drink at all!

Exactly and yeah most of us would have hell to pay for much less. Something to remember with alcohol is that it is a choice. And the consequences must be dealt with even if nobody wants to (aka a girl throwing a tantrum) ive had many-a-time where I REALLY didn't want to be there or have them there but violence.. suicide and death threats can be a pain in the ass and more often than not it was my/our responsibility to watch out for them. Big reason why I stopped drinking, and why I don't try to choose what people do, I choose what people im around.

Mike on ThatChapter is just so great to watch and on this channel there are frequently details about the victims and killers that I had not heard elsewhere. He is so great at finding the best details but not assuming things or exaggerating. Still facts, but he just goes deeper than other channels into the backgrounds and personalities of everybody. I appreciate that so much. He also humanizes everybody and is an amazing narrator.

all things considered the things he was doing isnt actually that bad, as was reflected by the judges verdict. The recording is probably the wisest thing he ever did. The incident is a tragic accident caused by two extremely drunk people who both should have known better. Now is he a colossal douche? absolutely! but not one deserving life in prison.

In his defence, if someone turns hostil at your when there alochol involved recording the situration is probably the best thing to do, because it can be seen as evidence in court, if she had of acused him on Rape or Assault. Audio is often the best way, because you put a camera in a hostil persons face it tends to rile them up.

This was national back in Australia. It was sort of hard because Warriena was intoxicated, and was getting physical towards him. He recorded for his protection and when you hear the recording, he seems calm whilst distancing and protecting himself. How he handled the aftermath is very weird.

He tried to do the right thing and escort her out of the front door, and in her angry and drunken state, she kept pushing past him and assaulting him with his own property in his own home. The only reason he ended up cornering her on the balcony and locking her out was because it was his last ditch effort to stop the assault upon himself and allow them both to cool off. Who would assume anyone would take a swing at dropping off the balcony of a 14th floor of a building in an attempt to swing into the apartment below? Even black out drunk, that's a far stretch. Most blackouts may end up in a minor brawl or some accidental hook up, but no one expects someone to chance an accidental suicide jump. You have to remember he had been drinking too. Everyone's talking about how her rationality of the situation was misconstrued, but then fail to give that same credit to him. If he wanted to kill her, he could've just done so as she was repeatedly attacking him and claim self defense. He obviously just wanted to escape the situation and allow them both to calm down. She decided to jump. That was her decision.

Alcohol isn't really a " drug". It's a food. Fermented sugar ;) It is a carbohydrate , has calories, etc. Anyways, glad you're sober, I am too--20 years this Feb . And the same as you: I easily could have ended up just like her---blackouts were a very common occurrence in my drinking years. Tragic tale, but seems to me they are both just drunks. Be interesting to check back on Gable's status in the years to come, don't see things ending great for him either unless he gets sober. Just the way it is!

The vast majority of people are not alcoholic and enjoy it in the manner it ought to be enjoyed. Just because some of us have already had more than our share of drinking, lol, doesn't mean others cannot continue to enjoy it. I am sober because I had little choice in the matter: either I recovered, or would be facing eventual jail/hospitalization, and death. Also: caffeine , paracetomal, and horrible vegetable oils and corn sysrup/high fructose frankenfoods which cause massive disease and unwellness are sold there too ;)

If somebody conducts in repeated criminal offences it does suggest there is a behavioural problem. That girl should’ve been given her phone and exited the door. It’s very unsettling when I see someone that lacks any emotion or remorse. Huge red flag

I’m so glad you covered her tragic story because a year ago or so I saw an interview of this POS on 60 minutes Australia and he came off as sort of a victim from what remembered although it was bragged that he has slept allegedly with over 100 women and they never described Warriena like you did. To me, they made her seem like it was her fault, etc. I’ll tell you this, he was a great actor and seemed like he was “remorseful” when in reality he isn’t. I’ll be honest because I kind of felt bad for him too, that’s how great of an actor he was...They never discussed her background, her kindness, her love for animals, how close she was with family and friends as detailed as you did. Thank you so much for giving us her side, her short and beautiful life and sad story. RIP beautiful Angel 🙏🏼👼🏼🙏🏼❤️🙏🏼👼🏼🙏🏼

@Ms Bliss I honestly don’t know who’s fault it was. I don’t like to victim blame or shame. Only them two and God know what really happened that tragic night. I just like to know about each persons life involved; who they were, what they liked, etc., and since we only know his side of this tragic story, we’re just left with questions as to what really happened.

To be fair, he was a victim in a way. He may be pompous. He may sleep with many women. He may even be a sexist pig. Those aren't crimes though. He's not a murderer. Warriena was drunk out of her mind, so I don't really blame her for her actions, but she was acting crazy and assaulting him. I sincerely believe he locked her on the balcony to get her to calm down. There's no way he would have thought she'd jump off. He wanted to have sex with her. He didn't want her to die. Sadly both of their lives were tragically changed that night.

Look up Kim Meredith. She was one of my friends who was brutally murdered in Albury NSW here in Australia in 1996.🇦🇺 What Kim must have endured in those final hours was nothing short of TERROR and fear of the worst kind. The family are amazing. I still talk to them and her younger brother is one of my closest friends. They have just released a book in her memory and a song was written and produced also. I would love to see Kim's case covered, as she was an angel and needs to be remembered 🙏💗💫✝️

I think even though their existence is very creepy, the tapes really played to his advantage. It sounds like he held back a lot of frustration at first until she refused to stop hitting him with whatever she was throwing. Telling her that she was lucky someone hadn’t thrown her over the balcony seems very ominous in hindsight, but it sounds more like one of those empty statements people make when someone is being a total asshole. It’s like telling a drunk to go play in traffic when they piss you off. It doesn’t mean you’re serious. If that same drunk happened to stumble in front of a car 5 minutes later it would be a very unfortunate coincidence. I doubt he put her out there expecting she was drunk and foolish enough attempt that Jason Bourne shit 15 seconds later. He probably wasn’t comfortable just sending her out into the street in that condition, but also didn’t want her inside his condo destroying his place and was too drunk to realize the best solution was simply calling the cops. This was an interesting one.

I was thinking the same thing, that he put her out on the balcony because she was destroying the place. She was aggressive in speech and conduct. He was by no means a good guy, a creepy creep but not a murderer.

Does failure to report an accident (if that is how we define this case) and fleeing the scene is not punishable in AU? No legal obligation are posed on the alleged witness of such event?

So I'm not the only who immediately thought what about the fact this dude just dipped after it happened from his own apartment with a girl he was with, No call to the police or ambulance (only to his lawyer?), Called his father to pick him up.. And then later turned up to a police station with his lawyer... Is there no punishment in AU for this? I get it, He never made her fall to her death, But that behaviour surely carries a charge in any law of land worth it's salt right? Or not...

From the sound of it, she was the aggressive drunk and then she agitated him who was also drunk and then this all happened, tbh both of them sound like horrible people when drunk. The way she acted with him, I'd also be annoyed, just that I wouldnt lock her in balcony, but would defo kick her out of house and get her a cab home.

a cab home? Was she in a state to get home from the cab though? I don't know how Australian laws work in these situations, but here in Russia I would have wrestled her down to the bed and held her down until she fell asleep. Judging by the amount of alcohol she had it wouldn't be too long.

From what I remember reading this trial transcript, I believe she was still not dressed while she was being aggressive. She was not in a state to be shoved out the front of apartment with no clothing on. He ALSO was absolutely wrong in his shoving her out on his balcony. I'm not sure, but in some warped way he may have been trying to avoid unwanted attention by not pushing her out of the front of his apartment. His thoughts and behaviors were just as scattered as hers, however, and he completely made the wrong decision. We who are listening to this with clear heads know the chaos about to ensue, and it's an awful feeling knowing we can't do a thing about it.

If Australia does have a crime of involuntary manslaughter, that would seem the most appropriate conviction, to me. He is partly responsible for getting her too drunk, but she's partly responsible for getting too drunk, as well. And throwing rocks at his head doesn't make any sense at all. So this is his rock collection and she picks it up and starts lobbing them at his head or at him or in his general direction? She definitely, by her actions, contributed to her ending up out on the balcony. So, unfortunately she did play a part in her own death. Although, it would be a legitimate position that a drunk person should never be put on a balcony 14 floors up from the ground. What a sad case. What a valuable case for highlighting the stupidity and dangers of over consumption of alcohol.

As much of an a hole he seems to be, I'd still say she is and always will be responsible for her actions. She wasn't a minor, she wasn't naive, and she went there by her own choice, drank the horrendous moonshine and started acting violently towards the guy. He was dumb enough to put her in the balcony yes. But he didn't kill her at all and i have to say, she is only victim of her own poor poor decisions beforehand.
