What about when someone buys an exclusive license on a beat thats been up for a year and already been leased to multiple people? Also what does the limit on streams/plays really mean? Like after its been streamed 5000 times on Spotify (mp3 license) it gets taken down?

That is sort of a grey area tbh. There's a really good DjPain1 interview with Taylor King where they talk about that exact issue. Generally, all previous leases will still be valid until their expiration date. The limit is based mostly on good faith. How does a company prevent people from illegally downloading their software? They don't it's all about the honesty of the people involved. IMO, while illegally downloading a movie is a WRONG thing to do, screwing over a producer is even worse. The artists know we are not big corporations, we're single people trying to make a living so, from my experience, they tend to respect the terms of the contract for the most part. I myself keep track of all the people that release songs with beats they got from me, and every now and then I try to check and see if everything is more or less within the boundaries. I do understand that this is not really possible for producers that sell a lot more than I do.

It does not! If someone buys the exclusive, the producer needs to stop selling the beat from that point on. At the same time tho, the leases that were previously sold remain untouched and fully valid.

I just need to know how many royalties do I owe to a producer, if the contract states that the writers share is split 50/50 between me and the produer. but the producer owns and controls 100% of the publishers share. Ok so I know a producer who makes beats on KZbin for free for profit and with no tags. Rappers are permitted to use the beats to monetize as well. There are contracts available but in the contracts, there is no time limit and no maximum limit of streams. Trust me this guy is legit too I know it’s not a scam. I DMed him on instagram and he said that the only scenario where he would take action is if the rapper is going to get signed by a record label, because he wants the record label to know his talent. Would you say that there really is no point in even leasing the beat?

The only question i still have is this: the producer still owns the beat even if someone buys an *exclusive* lease, but what does owning the beat mean? it doesn't mean that the producer can use the beat her/himself for a song of her/his own, right? so, what IS the significance of still *owning* the beat?

You would be correct! Exclusive leasing means that the artist has exclusive rights to use, re-mix, re-release and modify the beat to their heart's content (depending on the details/limitations of lease agreement itself). The producer maintains the copyright of the instrumental/beat, meaning that they are entitled to a share of the profits made from anything using that piece (the song, streaming, commercials, re-mixes, etc (all can be changed depending on your specific lease agreement, which is why you never sign before reading/consulting a lawyer or someone informed on law in your/the offering's country (because the contract can be specifically based on laws only in the signer/signee's territory))). If you lease exclusive rights to your beat, or buy exclusive rights to a beat, you can be confident (as long as your contract is properly put together) in knowing that specific beat will ONLY be legally allowed to be used by the artist/signee on the contract. The producer CANNOT re-sell or re-lease that beat (rights to using the beat themselves for alternate versions/re-mixes/ are something that should be outlined in the contract. However when it comes to them making their own 'legally recognized/protected' song, they would not be able to legally produce and distribute a tracking using the same beat (of course again, this is subject to the specific terms of your contract itself). If it is not mentioned, it would have to be legally contested in court and probably be up to the opinion of a judge. Not sure who's side they would default to honestly) until the terms/conditions of the contract have been met (eg. 5 years OR 50,000 streams/download equivalents).

As a small producer myself, I feel everyone in the industry should at least know the basics, and I always advocate for looking more into it if you have more time. Too many people getting screwed over by feeling pressured and feeling like they don't have/can't get the information, but it is all available out there online and it just takes a little bit of time to protect yourself for years to come. Doesn't that seem that it's no longer exclusive? Also, I noticed some platforms offer "Buy Outs" Is this entirely different from licenses? Love this explanation, but I wished you would have mentioned KZbin Content ID as that is also a major confusion when leasing beats and knowing their limitations. From what I understand, no lease sold “should” be monetized with KZbin Content ID but most people (both artists and beatmakers) dont know how it works. Then you will get multiple people trying to claim money to their version of your beat, but YT does not know how to tell the difference and only allows one version to be monitized. Love the rest of the points tho.

@@definebeats718 So far: All I know is that when leasing your music (unless you change the contract otherwise), you are only giving written consent to the buyer that they can use their recorded version of your instrumental to monetize it (with whatever limitations you set), but NOT upload it to anything that tags it with content ID (like YT). Now.. people don't really know that unless you make it clear on your website, so I'd say is the sellers responsibility to make it clear. But, you really don't have any control of what anyone does, you just have a piece of paper that can help you in court if needed, IF you want to go that far to claim something. Its better to have services like EXMGE Network that claim the Audio ID for you in return of a %. They are not perfect by any stretch, some tracks do fall under the cracks, but they are better targeted I would say. Also, is fair to mention, this types of services have only worked directly with YT Content ID, I have yet to see them work with things like Spotify, Apple Music, Google Play and other stores.

The people that purchased the non exclusives, keep their rights. When selling an exclusive, in the contract you must state the names of the non exclusives, and that they still own the rights that there was agreed to. AFTER you sell an exclusive you aren’t able to sell a non exclusive of the beat anymore, but the non exclusives that bought the beat BEFORE are completely fine.

Don't Quote me on this but any Artist that is Actually serious about their craft will be Registering that song with a Performance Rights Organization (P.R.O.) and with that being said, and these steps are taken Correctly than ya'll should both be tied to it, unless they bought an Exclusive, these P.R.O. companies keep up with all that to make sure the Artist and Producer get All the Royalties how they should by keeping up with all of that Information. So I would Assume that they Would Allow The Producer to have some kind of access to Those Numbers... I could be wrong, but from my research so far, that is more or less how it Should Work, but that is if the Artist is Actually taking it Serious and taking all the right steps to ensure Neither The Artist Or The Producer run into any Complications like that.

Depends on your DAW! I use Ableton and I like to do them manually one by one. I solo the instrument I need and bounce the song like that, then repeat the process for all the instruments.

I’m no genius but I believe before uploading to Spotify u have to agree to terms and conditions and agree that ur using the music appropriately and within ur rights and that u have the right to upload it and earn from it.

Hey if we uploaded the beat to all the platforms (spotify, apple music etc.) If buyer buys a exclusive rights Then it is necessary to remove it from all the stores or not? And how can we remove it?

so i understand all of this, but when an artist purchases a lease, i send them the beat and what else. like what is the license supposed to look like? is it just the terms of what they're buying? like if they buy an exclusive license, do i just write out the terms of use of that specific license and send it to the artist?
