I haven't bought an expensive car in years. My last car was a £160 Passat Estate 130bhp TDi with a blown head gasket. Fixed it for £300 and still have it 10 years later. Last year I bought a 2005 Passat 130 TDi Highline with full leather trim and black paint for £225. Just needed a full set of brakes and a few minor bits and pieces. I fixed it and stuck 2 wings on it too, as it only had 120k miles on it. Final cost was £675 and after a few days cleaning it's like a new car

I’ve been a car dealer for 13 dealers. Back then everyone sold the cheaper cars as part exchanges to clear, they were cheap and the majority of buyers were ok. They knew if the engine blew or of clutch went they’d get a refund. There’s no way we could do that now. Expectations are too high, you’d just be setting yourself up for trouble. The reality for most reputable dealers is there’s no love lost. A customer buying a 20k car is much easier to deal with than someone buying a 2k car.

I went to Court once regarding a poorly rebuilt engine, I had independent engineer reports and the Judge was so ignorant and downright rude that I couldn't believe it. He held up the reports and asked me in a really indignant tone, if I expected him to read them. Moral of the story, avoid courts like the plague . Judges are answerable to no one and can be really unreasonable people. I decided to cut my losses but never again
@Rapscallion2009 Жыл бұрын
To be fair, The Judge does have very limited time due to case volumes. So you provide a summary and if the opponent challenges it you then refer to the engineers report to back up your position. I'm not a Lawyer, but I understand that's how it's done. But. There's ways of explaining this to people, and the judge perhaps could have been more diplomatic.

Back in the early 2000's I was regularly buying circa 12 year old family cars such as Sierra's, Cavaliers etc for as little as £50 in the trade, they were usually with long MOT's fairly presentable and useable. This was back when we had to pay to have scrap cars removed because they were worthless. Then in about 2005 ish a scrap car was suddenly worth about £400. The very cheap end of the used market changed at this point and then again in 2009 when scrappage was introduced. Cars in general also started getting more expensive in the last recession and never really went back down. This coincided with many smaller family owned franchised dealers opting to sell up to the big corporates at this point. Most of the big corporates have an auction policy when getting rid of the older px's, or they run there own online auctions like Sytner. The fees that the likes of BCA then charge are insane and inflationary and has led to cheap cars being no longer cheap. The small used car dealer doesn't benefit from any of this and neither does the public.

I’ve never really got my head around VAT being included again on a used car? If I can explain. When new, the car would have been placed on the road and the VAT paid on the car to the government, from the first selling dealership. Then it’s traded in; the dealer then sells the car on to a new owner, as a used car, but the government has already been given the VAT when new, why do we need to be stung again for VAT on it’s used value ? All the duty for that car is been agreed and paid when it was new? You don’t go an sell a used television and charge VAT on a used item, again that would have been collected from new, by the selling retailer? Madness ! 😊😊😊😊anyway, best wishes, a nice to see a honest used car dealer,very refreshing 😊😊😊

Not for a vehicle but I do have a similar tale. As a family lawyer divorce was a big part of my work. My client was being divorced by his soon-to-be ex for reasons not concerning the audience here. Anyway, she wanted to keep the family home which had recently had a full roof of solar panels added. Her claim (through her solicitor) was that the panels were simply part of the value of the building. My claim was that there is also an ongoing income element which needs to be shared because my client would not get the enjoyment or benefit of that income stream. The judge having listened to arguments then stated that she had recently installed solar for the exact reasons I was asserting and deemed them an income stream for the occupant. A nice victory. 🙂

I listened to your argument/point on cambelts, but the simple fact is as a dealer you should change the cambelt, if it is unknown when it was last changed. Not just because it saves you getting sued in court.. But because it could leave someone in a dangerous situation at the side of the road. The Consumer Rights Act states that the goods must be of satisfactory quality in that they are of a standard that a REASONABLE PERSON would consider as satisfactory taking into account the description, the price paid and other relevant circumstances. (Section 9(2)) So it would not be reasonable to expect a 23 year old £2000 car to be free from faults.
@Gingerharry2011 Жыл бұрын
The unfortunate thing is (no dig at chops here he does seem the exception) dealers have taken the Mickey for years, shifting scrap on to unsuspecting customers for inflated prices. It had to happen. If you want a cheaper car you gotta buy either private or auction. And they have no come back, which is appropriate for low value cars.
@carukchannel Жыл бұрын
This is spot on, and the basis of how companies like lawgisitics defend dealers
@Rapscallion2009 Жыл бұрын
The question is "what faults are reasonable?". Some people expect a new car for £500, but equally you shouldn't pay dealer premium prices and be told "wear and tear" for absolutely everything.
@simmybear31 Жыл бұрын
The problem is the difference between a business that is set up as an 'expert' in its field in this case a car dealer, and a consumer whom the law believes has to have no expert knowledge. The law therefore generally supports it is unreasonable for a consumer to have the same knowledge as a dealer. There are many really conscientious and honest small dealers but there are sadly lots of dishonest ones.

It's totally not practical to outsource work on a cheapie, you've just got to do the whole thing yourself, cam belt, welding, service, then you've got a nice wage in it, tbh that's what everybody does who does cheaper cars, else everyones had your money and your just left with the liability.

as a customer id rather pay the £600 extra knowing the work had been done properly, trouble is how do we know that the whatever dealer we are using has really done the work and not just bumping up the price ? As a trades man I made a conscious decision to ONLY do repairs to other peoples items and warrantee the repairs ONLY for 2 full years, there is simply no way I would give a warrantee on something so old and TBH I can't get my head around the expectation that such an old car should have 6 months warrantee. If I could find a trustworthy dealer near me I would much rather they just walk me through what the risks of each item is and between us agree what should be changed before the sale and what to maybe just put off for later.

AHH I remember times when you could pick up a reasonable car that would at least get you through you first year or two of driving for about 500.... so wish I had actually gone outa my way to do my test back then.. but no I got too busy and did it last year instead, couldn't find anything worth my time or to suit my needs (being an adult with jobs and responsibilities ect) for under 2 or 3 k which was all I really wanted to spend for first year. wound up digging around and getting a 2013 golf for 7.5k which hurt.. insurance more than anything but hey at least I got a nice car that will last more than a year and be comfortable. only downside is lack of service history so I can neither confirm or deny its had a belt... dealer was a little cavalier about it saying they dont need one till 100k miles, and am sat here like...true but 10 years is plenty of time for rubber to degrade, especially when you involve heat and oil and am already racking miles faster than both previous owners combined haha. and now I find my self looking at a topdon 600s OBD, partly for the curiosity partly save some time with repairs, though my local garage dont partake in rip-offs, id feel better knowing what's going on with the car before taking it anywhere, or do some things myself like breaks which on this car need a computer to go to service mode. I duno its really tempting haha

Imagine how much tax in VAT one car can generate in it's lifetime for the government. It's insane that VAT is charged on a car sale every time it gets sold by a dealer, no matter how old it is or how many times it's been sold before. Add to that all the fuel duty, VAT on parts, car tax, insurance tax and parking charges. The government is just rinsing the motor industry and car owners.

notes :- 1) regarding advise free mots, it's not mandatory for mot testers to issue advise notes, so people selling vehicles (general public and car sales) tend to go to the mot stations/testers that do not issue advise notes. taking into account the mot is about reaching a "very minimum standard" only "at time of test", is limited to testable items only, and no covers or wheels are removed for the test, and has nothing to do with road safety or vehicles being in a acceptable standard/condition, the mot is not worth the paper it's written on!? 2) i love the way people selling vehicles say "oh yes the vehicle has had a service" when in fact all that has been done is a engine oil and filter change. what about the air filters, pollen filters, fuel filters, spark plugs, and a oil and filter change does not involve removing covers or wheels, mechanics cannot see things like the brakes properly (and the brake efficiency test during a mot does not show worn out brakes!)
@ChopsGarage Жыл бұрын
So what would you rather, no MOT and no Oil and Filter? Can you imagine the price that cars would need to sell for with the expectations you have here. There simply would be nothing other than private sales under 5k. I think if a dealer has got an advisory free mot (how the hell do you begin to find a garage that guarantees no advisories, how do you even start that conversation?) and done and oil and filter for the mark up thats a good level of prep.
