Sony failed to innovate in software and services and its traditional business model came back to bite them. They are now trying to use the legal system to keep the gaming space the same to help their backbone. If this deal goes through, Sony will need to radically shift their strategy.

@Gaming Playroom The point isn’t whether the memory cards were bad or not. Of course it was a terrible setup. But that was 20 years ago. Point is it’s 2022 and a brand new console is still sticking you with proprietary storage devices. SSD prices go down regularly. So at some point an additional PS5 SSD will be much cheaper than a proprietary storage drive. Both corporations make terrible decisions. And they are usually designed with one goal in mind. Money. So don’t trust any of them. They just go about it using different strategies.

Essentially; anything which threatens Sony's preeminence in the console space is "unfair", while anything Sony can (and does) do to maintain that position, is just the maintenance of the "natural order" of things. What grabs me is that Sony are basically trying to turn their fears that the Activision acquisition means they'll essentially never be able to compete with GamePass in the subscription/services space into an argument against innovation and democratisation of games provision. Sony wants the Brazilian regulator to maintain the status quo in as much as it can, a status quo which sees Sony as the dominant gaming platform largely en foot of its pursuit of an extremely aggressive first and third party exclusivity strategy. What may be an unintended outcome of the argumentation Sony has pursued here might be the whole issue of paying to ring-fence third party content from a competitor, particularly where the intent is expressly to prevent growth of a competing platform, coming under scrutiny... Microsoft's lawyers calling such attention to the hypocrisy in that regard was extremely clever, and it'll be interesting to see if the judgement of the Brazilian authority references this. All in all, huge own goal for Sony. Its readily apparent this is all about protecting their own dominant market position by actually trying to prevent a competitor from innovating and finding novel solutions to challenging that dominance.

@@Mr.Badoogle It's more like a producer and assistance role. Sounds like their creative types are going to be directing the next project. They definitely have a lot on their plate as is, but doable. Look at a dev like Obsidian. They are about a 30% smaller than Respawn and are currently either developing or working on at least four separate projects, and assisting inXile on whatever their new RPG is. It's all about proper management.

Sony is most alarmed by the thought they could lose users to the xbox ecosystem. COD is a lock-in title that keeps players in the Playstation ecosystem and Sony reaps the additional microtransaction fees gamers spend on the Fortnite, etc free-to-play games which makes up a larger percentage of their revenue

Sony’s arguments with regard to this acquisition are clearly bogus, but their fear of losing market share seems quite reasonable given that the relative behemoth financial/infrastructure resources of MS are becoming ever more deeply invested in and committed to, the interactive entertainment industry. Though Sony is a hardware company, perhaps they’d ultimately be better off focusing on producing and publishing marquee, must-have software titles for all platforms, instead of a traditional console hardware/exclusivity business model which is already on its’ way to becoming outmoded.

Microsoft is working very hard to try and get this purchase through without a consent decree. Such a decree might slow down their future acquisition plans or take away their ability to respond in-kind to something Sony might do in the future (or more accurately, someone else like Google or Apple). They are willing to go ahead and not pull a Bethesda (by comparison, purchased for 1/10th the price) and talk about how they made this deal to bring value to Game Pass to get out of this acquisition with no governmental strings attached. Such strings are devastating, and Microsoft knows it. During the consent decree years, they had to stand by and watch several times as the world changed around them and be unable (or unwilling) to act in fear of the decree they were living under. I still think Microsoft at heart is a platform creator, and their DNA is about building a platform and having people publish on it. Xbox is, and has always been, contrary to this... because of the nature of game publishing. Things are changing right now... through subscription services and through the consolidation we're about to go through. Microsoft sees value in getting their chips in now (consider their failures to make the right bets on phones and are completely shut out). If they can pull this off, just wait till the dust settles and they make one more massive acquisition. Maybe it's EA. Maybe it's Ubisoft. They'll probably know that's the last one they can reasonably do before regulators get antsy, and that one will finally include a dreaded consent decree. I would say that maybe Microsoft could hold after this, but Sony is not their only competition. Apple is one major acquisition away from jumping in here. I think Netflix was thinking about it, but they have their own problems now just staying afloat or looking for a buyer. Microsoft making a major purchase like this and promising to play nice with others will make Apple look like fools if they decided to, for example, try to buy Ubisoft and take them Apple exclusive. Apple might be able to get the deal done but consumers would punish them and regulators might even chastise them or force them to release on existing platforms. That precedent would open the door to regulators saying, "now about that closed off App Store." There are a lot of balls Microsoft are juggling here, and to be honest, this play has reach far beyond Sony. This is a stake in the ground that other software stores should be open and compatible, which at least lets them play in areas they otherwise lost. It restarts the game, if you will.

Great points Feel like only 1 more big big publisher is possible for Microsoft (EA, Take-Two, Ubisoft sized). Personally if 1 Big big slot is left I want them to get WB Discovery (For WB Games, DC, etc etc etc) Then Medium & Smaller Sized Publishers: Bandai Namco, Koei Tecmo, Konami (It's basically dead), Sega, Thunderful, Pearl Abyss, Team17, Avalanche Studios Group, Keywords Studios, Paradox Interactive, & various Individual Studios in between After that Microsoft are set for various game genre bases EA, Ubisoft, Embracer Group, & Take-Two I'd prefer to stay Multi-Plat for various reasons Embracer Group: Too many game studios that are all still growing Ubisoft: Too many studios/ devs so for that amount of both they can get way better stuff (Would be interesting if Sony ever changes their ways for the better and gets the money so they get Ubisoft or even if Embracer Group get any of these) EA: Too many deals to have to pay for, plus they'll have Activision which COD & Battlefield are both always pitted against each other for some reason Take-Two: Xbox has Gun & True Crime which can both be competitors to Red Dead Redemption & GTA

I do think Microsoft's overarching goal is grow game pass subs. It's part of Phil's bonus and I think it's part of Satya's. To be fair the acquisition of all these studios hasn't paid dividends yet. The games have to be good and they have to make you want game pass. In terms of this legal bickering I think it is legal posturing. Sometimes in court you shoot for the moon and if you get a nibble here or there from the court you are happy. If Sony can get any speed bump placed in Microsoft's way, that's a win for them.

I love car shows. Lots of different people, lots of different rides. Some people build awesome tuners or muscle cars practically from the frame up, pouring years of blood, sweat and tears into what becomes a beautiful machine. Then there are the rich crowd who couldn’t begin to describe how an engine works, let alone build a car themselves, so they buy their way in. Sony has been kicking goals (into its own net) for the last 12 months. The arrogance is wafting through the gaming community like an egg fart in a fresh breeze. With this behavior, the fact their "exclusives" aren't even that engaging anymore and most if not all of them transferring over to PC eventually and gamepass, i may end up selling my ps5 in the future.

MS wouldn't make COD console exclusive wouldn't make any financial sense. This is purely a ploy by PS to try to keep the market lead they have brought into the generation. It'll be interesting to see how things play out.

If Microsoft is smart they'll have a work around for making cod exclusive, for example Sony makes publisher pay to have cross play, cod has cross play current with pc and Xbox and I'm assuming Activision paid for it. That being said Microsoft will say we want to make cod for playstation but we're not paying for cross play and that'll be their loophole

Great point, one that I haven't heard people bring up. Sony has many of these clause in their contract, which I'm sure MS will come and say "you want COD? We ain't paying for all that"... Which will make other developers/publishers say "why are they getting special treatment? ", which can ultimately affect their bottom line.

@@CSM.HBJ-Dogg with what you said, then Phil has the power to enact a change. Other publishers have the power too, but they don't want to be in Sony's bad side. Epic vs Apple brought to light many "hidden fees" of Sony. Not saying MS doesn't do fees (it's business), but I don't think is as extreme as Sony. The point is, if Sony relaxes the fees for MS just so MS can put COD, then other publishers might want the same, and thus hurting Sony's bottom line. Being the juggernaut that COD is (and Sony has already expressed that), I won't be surprised something like this can happen.

I'd laugh if by keeping Cod on PS5 Xbox meant they'd keep Warzone on it and not the cod games like MW, Black Ops etc. I'm sure that won't do that but by doing so they technically aren't lying and did in fact keep Cod on PlayStation but just Warzone.

8:40 i wish you interpreted the entire statement and didn't stop at "not profitable", considering they followed up by saying that they could do that strategy if they think they could pull sufficient numbers of people from rival platforms to compensate for losses. and basing on Sony's reaction, CoD could possibly do it. not saying Cod is gonna go exclusive or not. but MS is clearly weighting both options.

@@DestinL all im saying is MS left allot of wiggle room in the way they make their statements about exclusivity of future titles. statements like "will stay multiplatform" isn't as cut and dry as we think it is. there are multiple strategies to circumvent it and still make CoD essentially exclusive. MS could make the annual CoD 1 year timed exclusive. so PS gets the last CoD when Xbox launches the new one. MS could even make the new games exclusive and just support the old games or just keep servers up for the old ones, and that would still fulfill the "will stay multiplatform" statement. like i said, i dont know if future titles will be exclusive or not. all im saying is there are enough loop holes in that statement for them to do so, and a pathway of deciding to do so with the whole "pull sufficient numbers of people from rival platforms" thing

@@-iZLA- I am not a lawyer but I too saw potential wiggle room in their verbiage to suggest that they have outs in the events situations do not play out in their favor. I guess it depends on what happens in the future. Especially if Sony tries to block the ABK deal we may see the gloves completely come off and instead of the verbiage saying we desire to keep COD on all platforms it is currently on to we plan to put COD on lots of platforms and Sony is just not one of them lol.

I like how MS keeps saying "sure, we'll keep cod on play station".. with zero comment on in what capacity. I hope they give ps a basic stripped down version, and heavily incentivise players to play on Xbox/PC.. Through exclusive game modes and dlc, plus charging their vaunted $70 only for playstation. I'd also make it painful for Sony, taking a big wet bite out of their asses in the form of a "cross play tax" like Sony does, but direct that only at Sony. Or they could do the old, if you want cod, it's only available through gamepass.. don't want to do that? Oh well, we tried.

Game pass is the focus, keep the games multiplat. It gives the casual game a bigger incentive to get game pass once they see that 70 dollar price tag. Microsoft know this and are set up for success.

Most of what you’re saying won’t be able to be done during their marketing agreement unfortunately but once that expires I wouldn’t even doubt if MS shelves the cod franchise and releases basically the same game under a new name. Don’t know if it’s legally possible but if it is it would release them from any requirements to put it out multiplat. Just a thought

Sony is primarily pissed because with this string of Microsoft buyouts, they are now in a major predicament. But if I were in charge of Sony Interactive Entertainment, I would not let any of these buyouts take away from PlayStation’s ability to create quality competing franchises instead of moaning and complaining. Sony should use their adversity as a way to grow and create strong competing exclusives. Their problem is that they have narrowed down their focus in game production. If they want to learn and grow, they need to expand with what they have.

I know this is going to be long series of videos, but I think the underlying thing that rubs people the wrong way is Sony is more invested - literally and figuratively - In keeping a dying model afloat (tying exclusive content to specific hardware) by any means necessary rather than innovate in ways that truly benefit gamers/gaming industry as a whole. Instead of investing in ways to keep games off Game Pass, why they don't they invest in their own subscription service and make it better? They're the same as Epic when they entered the PC gaming space with their "exclusives". Forcing people to use the atrocious Epic Games Store instead of creating a platform as good as or even better than Steam. It's companies using the courts to stop competition instead of rising to the challenge and creating better products is what bugs the shit out of people regardless, of platform.

I only play Sony exclusive on Playstation but every other game I play on Xbox because I support Microsoft and their business practice. They seen to be the only company that wants a fair and equal field for all platforms. If a new game company came out with a system, they probably wouldn't attack and give help if asked directly to benefit both of them. Sony and Nintendo especially are just scum of companies when it comes to competition.

also notice that when MS was going further with 2nd/3rd party deals during the 360 generation, and it was still no on the level of Sony with PS2 or 4, that they got a log crap and discussion around it. Yet people just act like its fine and dandy if Sony does it. The usual excuse is "well they are the market leader/mind share leader" to which I say? Ok, MS was at that position for most of the 360 gen - so why was it such a point of contention then BUT NOT for PS2 or 4? Thats right - the bias is there. Generally everyone seems ok with Sony doing something that MS (and even Nintendo sometimes) will catch massive shit for doing.

@@xBINARYGODx Honestly the PS3 and the 360 ear was probably the most fair fight in console history. The PS3 sold more in the end, because they cared about the consumer. Also the Xbox 360 would of sold less if it didn't have the red rings of death. They kept the CPU/GPU back plate X design the same and never changed it a square. It would slowly warp after long use. Microsoft knew this and sold more consoles than it should of cause of this. The PS3 won sales wise because PSN was free on the PS3 with a wifi chip built in it, and a blu-ray reader for movies. Blu-ray readers where sold for 500 to 800 in 2006. So the PS3 was a stupidly great deal for what you paid for.

As a business, I dont fault Sony for going this route. But from just looking at this it makes Sony look like they are a child whinning that the 'Big Meany' Microsoft isnt playing fair. Microsoft has stated in court documents these games will remain console multiplatform. Now it would be cool if Microsoft took some of their owned IPs, like Conker, to some Activision developers(like remake Toy Chest(?)) and say they can make Crash multiplatform but we need a Conker now and then too. Sony just knows this will all make Microsoft too much money and the only options they have are sabotoge this, which they are trying to do poorly, or deny future Call of Duty games on their consoles, which they know Sony fans will just buy an Xbox or play Gamepass on other devices. It all comes down to money and Sony looking after themelves only, not the gamer market. Like if they brought Spiderman or the upcoming Wolverine to xbox even with a year(or when they just brought it to Steam) exclusive, Sony would make a ton of money. But that helps Microsoft too, which they dont want. Like Crossplay and other stuff. Its sad really.

Basically, Sony doesn't like the Trojan horse sales. They know that MS is set to hit huge profit margins by keeping certain games multi-platform. This puts Sony in a precarious situation because they'll lose a sizeable share of the user numbers if they bar MS from releasing the games on their consoles.

That is why I reiterate that should the F.T.C., block this deal based on arguments made by Sony, (they will not) they’d clearly be playing favouritism, in a space where it’s not suppose to exist.
